Take from the Table Discussion and Consideration of an Ordinance amending Section § 52.1111(B)(2), Refuse Storage under Chapter 52, City of Hartford Zoning Code. Mr. Maas reviewed the executive summary and noted the following: Background: Currently, Section § 52.1111(B)(2) of the City of Hartford Zoning Code states: (2) The access gate must face away from street view or adjacent residential areas City staff has run into problems with the “away from street view” portion of this section due to many commercial properties being either corner lots or three (3) street -yards. Which creates compliance difficulty during the Site Plan Review process for development, or existing facilities. The May 26, 2026 Common Council tabled the Section § 52.1111(B)(2) amendment to allow staff to include language that the access gate shall remained closed with the exception of loading and unloading. The proposed language is as follows: Page 2 of 5 (2) The access gate must face way from adjacent residential areas and shall remain closed with the exception of refuse container loading and unloading. Staff Comments: The change would eliminate many legal, non-conforming dumpster enclosures. Furthermore, it would reduce developer constraints during the Site Plan Review and development process. Staff made changes to address comments at the May 26, 2026 Common Council meeting. Recommendation: The City Staff recommends the APPROVAL the Ordinance amending Section § 52.1111(B)(2) of the City of Hartford Zoning Code. Pechacek motioned to recommend for approval of an Ordinance amending Section § 52.1111(B)(2), Refuse Storage under Chapter 52, City of Hartford Zoning Code with the revised proposed language; Piquett seconded; Henke inquired if this changed the corner lot rule; Mr. Maas noted this was amended because of issues with corner lots to allow them to face toward the street side, but it would still need to remain closed. Henke discussed adding further clarification to the proposed code regarding address side street yard and non-address street yard; Mr. Maas indicated he was comfortable with the code as proposed because of some properties with three street sides. Regan inquired if enforcement was typically complaint driven; Mr. Maass noted it was; motion carried. Discussion and Consideration of the Rezoning of a Parcel from M-2 General Industrial District to M-1, Light Industrial District at 2115 Innovation Way (Tax Key: 230-1017-1312-013). Mr. Maas reviewed the executive summary and noted the following: Background: ByRandy, LLC (property owner) and Kent Ehrenberger (applicant) are looking to rezone 2115 Innovation Way from M-2, General Industrial to M-1 Light Industrial. 2115 Innovation Way is currently a vacant lot located within the Dodge County -Westside Industrial Park. The parcels that abut 2115 Innovation Way and parcels located across the right -of-way are zoned M -2, General Industrial. The City of Hartford Comprehensive Plan identifies the future land use of 2115 Innovation Way as Industrial. Kent Ehrenberger is looking to develop 2115 Innovation Way into Industrial Shops. Staff Comment: Planning Staff have no issue with the proposed rezone. The rezone conforms with the future land use map in the City’s Comprehensive Plan. Attached is Appendix A – Land Use Table. Recommendation: The Planning Staff recommends APPROVAL of the Rezoning of 2115 Innovation Way (Parcel #: 230-1017-1312-013) from M-2, General Industrial to M-1, Light Industrial. Pechacek inquired if there were utility impacts; Mr. Maas indicated there were not. Page 3 of 5 Henke inquired about the wellhead; Mr. Maas indicated it is in the wellhead protection zone, and there are limitations on the land use. Henke motioned to recommend for approval for the Rezoning of a Parcel from M-2 General Industrial District to M-1, Light Industrial District at 2115 Innovation Way (Tax Key: 230-1017- 1312-013); Andereck seconded; motion carried. Discussion and Consideration of an Extraterritorial Certified Survey Map for a parcel on Waterford Road just North of Clearwater Beach Road (Tax Key: T6-0791-00Y) in the Town of Hartford. Mr. Maas reviewed the executive summary and noted the following staff comments and recommendations: Staff Comments: The Town of Hartford, via the Intergovernmental Agreement between the City of Hartford and the Town of Hartford, gives the City of Hartford Extraterritorial Zoning Authority. This Authority is enforced under Section 47.02(b) of the City of Hartford’s Zon ing Code. Section 47.02(b) states: b) Criteria for Nonagricultural Subdivision or Land Division. In the case of nonagricultural lands, the City may grant approval of a subdivision provided that the City shall determine that the proposed subdivision or land division complies with each of the following four criteria: 1) The proposed subdivision or land division shall be compatible with adjacent land uses and shall maintain the general land use pattern of the area in question. 2) The proposed subdivision or land division shall result in a development pattern which is compatible with surrounding developments and land uses. Measures of compatibility shall consider lot sizes, traffic generation, access, noise and visual features. 3) The proposed subdivision or land division and the resulting development shall not adversely affect the City’s ability to provide public service, install public improvements nor accomplish future annexations. The City may consider annexation agreements with the property owner in order to comply with this requirement. The City may also consider whether the City and Town(s) have reached an agreement on necessary public improvements and public services facilities required to serve the development. 4) The proposed subdivision or land division shall provide permanent open space lands for use by the general public in conformance with the City of Hartford adopted Parks and Open Space Plan or the City’s other adopted Master Plan elements. The permanent open space lands shall be accessible and open for use by the general public. The open space lands shall be exclusive from, and in addition to, lands Page 4 of 5 required for dedication to comply with applicable public parks and open space dedication requirements and shall be provided at a ratio of two acres of permanent open space lands for every one -acre of developed lands, including street rights of way. For the purpose of this provision, wetlands, flood plain lands, steep slopes, or other lands which are not developable because of sensitive environmental features shall not be counted as permanent open space lands in calculating the ratio of permanent open space lands provided versus developed lands. Steep slopes shall include lands that have grades of twenty percent (20%) or more. Planning & Inspection Comments: • The proposed lots are identified in the City of Hartford’s Comprehensive Plan’s Future Land Use Map as Medium Density Residential (1.1 to 2.9 dwelling units per acre). o The proposed density is less than 1 dwelling unit per acre. • The proposed lots are located within SEWRPC’s 20-year sanitary sewer service boundary. • The 66 feet (33 feet from centerline) dedication of Waterford Road right -of-way is adequate for residential collector street. • Lot 2, Lot 3, and Lot 4 each have 66 feet or more of right-of-way frontage along Waterford Road. Recommendation: The Planning Staff recommends APPROVAL of the Certified Survey Map for Tax Key: T6-0791-00Y, Waterford Road, Town of Hartford, with the following condition: 1) Maintain the 66 feet (33 feet from centerline) right -of-way dedication of Waterford Road. Pechacek inquired if this impacts EMS or access for EMS; Mr. Maas noted it should not. It’s a right-of-way and now fully dedicated. Andereck motioned to recommend for approval for the Extraterritorial Certified Survey Map for a parcel on Waterford Road just North of Clearwater Beach Road (Tax Key: T6-0791-00Y) in the Town of Hartford with the noted conditions; Pechacek seconded; motion carried. The development of the Innovation Way extension will allow for the development of the City’s (HADC) land. The proposed development of the Innovation Way extension is part of the TID No. 14 project plan. Staff Comments: Under § Wis. Stat. 62.23(5): Page 5 of 5 (5) Matters referred to city plan commission.
