Mr. Maas reviewed the executive summary noting the following conditions for approval: 1. Cleanouts should be installed on the sanitary lateral at the 90 degree bends. 2. This appears to be possible at the SE corner of the proposed storm water facility. 4 7. Please confirm what the slope is for both proposed driveway aprons. Maximum slope is 10%. 8. For the new concrete curb and driveway aprons to be installed, forms must be inspected and approved by City Engineering prior to any concrete poured. Please contact 262-673-8261 for inspection. 9. The contractor is responsible for traffic control for the proposed curb and driveway apron work as well. Traffic control must adhere to the DOT Manual on Uniform Traffic Control (MUTCD). 10. The existing water lateral will need to be properly abandoned at the water main. 11. The proposed ¾” water lateral shown on the west side of the building appears to be the sanitary sewer line and should be labeled accordingly. 12. Confirm the water meter size that will be used for the building. 13. Ensure adequate space is provided in the utility room for meter installation and future maintenance. Water meter specs and requirements are attached for reference. 14. The proposed transformer location is not shown on the plans. The developer should contact Mike Thimm at mthimm@hartfordutilities.org to review service size, cable route options and to obtain a cost estimate for the project. 15. Demolition of existing residential and accessory structure requires a demolition permit (Building Permit) through the City of Hartford. This City will also need proof that the Wisconsin Department of Natural Resources was notified. 16. Replace within Trees, category C, with a male cultivar of Ginko Biloba (Princeton Sentry). 17. 1 space for each employee on the largest work shift. Mr. Maas noted the site developer is choosing to go with the 20-foot buffer yard option; there are lots of planting along the residential property to the north. Mr. Mass noted Alderperson Pechacek brought to his attention that one accessory structure on the property is within the 20-foot buffer yard and it would need to be moved forward. Regan sought clarification that the motion should include the addition of condition 18. Mr. Maas verified and noted condition shall be: No structures are within the 20-foot buffer yard. Andereck motioned to approve Site Plan & Architectural Review in the B-3, General Business District for Tommy Express Car Wash at 1310 E. Mr. Maas reviewed the executive summary providing the following analysis and recommendation: BACKGROUND: The City of Hartford is looking to annex a 1.47 acre parcel (Tax Key #: T6 -0380-00A) for development of Innovation Way’s right-of-way. The City of Hartford, in 2023, created this parcel as part of a land swap with the property owner of 1331 West State Street. This land swap was done to allow for the extension of Innovation Way to Western Drive. ANALYSIS: Configuration: The petitioned area, as legally described, is contiguous to the City of Hartford on the East and South side. Petition Accuracy: The petition and legal description do not appear to have any discrepancies. Status of Public Improvements: Sewer, water, and electric services will be available to the petitioned area. Valuation Impact: T6-0380-00A has an assessed value of $0.00 in 2025. Discussion and Consideration of the Rezoning of Parcels from C-1, Conservation District to I-1, Institutional District at 278 North Pike Lake Drive, 264 North Pike Lake Drive, and 234 North Pike Lake Drive (Tax Key: 36-2201-008-998, 36-2201-008-997 and 36-2201-008-061). Mr. Maas reviewed the executive summary providing the following analysis and recommendation: Background: RMC Homes VIII, LLC (Rob Crotty, Registered Agent) is the current property owner of 278 North Pike Lake Drive, 264 North Pike Lake Drive, and 234 North Pike Lake Drive. RMC Homes VIII, LLC is proposing to rezone the property from C-1, Conservancy to I-1, Institutional. They are looking to develop the properties for assisted senior living facilities. In December of 2016, the City of Hartford rezoned these parcels to Institutional (letter attached). When the City rezoned the City in January of 2025, these parcels were erroneously rezoned to C-1, Conservancy due to wetlands on the property. Staff Comment: Planning Staff have no issue with the proposed rezone, as the rezone complies with the December 2016 rezone. Page 9 of 9 The rezone will allow the following principal land uses to be developed at 278 North Pike Lake Drive, 264 North Pike Lake Drive, and 234 North Pike Lake Drive: Assisted Living Center (RU) Nursing Home (CU) Group Day Care Center (RU) Park, Community (RU) Park, Neighborhood (PU) Recreational Trail (CU) Admin. Buye r is advised as follows: The MFL is a landowner incentive 196 program that encourages sustainable forestry on private woodlands by reducing and deferri ng property taxes. Orders 197 designating lands as managed forest lands remain in effect for 25 or 50 years. When ownership of land enrolled in the 198 MFL program changes, the new owner must sign and file a report of the change of ownership on a form provided by the 199 Department of Natural Resources and pay a fee. By fili ng this form, the new owner agrees to the associated MFL 200 management plan and the MFL program rules. The DNR Divi sion of Forestry monitors forest management plan 201 compliance. Changes a landowner makes to property that is subject to an order designating it as managed forest land, 202 or to its use, may jeopardize benefits under the program or may cause the pro perty to be withdrawn from the program 203 and may result in the assessment of penalties. For more information call the local DNR forester or visit 204 https://dnr.wisconsin.gov/topic/forestry. 205 USE VALUE ASSESSMENTS: The use value assessment system values agricultural land based on the income that 206 would be generated from its rental for agricultural use rather than its fair market value. When a person converts agricultural 207 land to a non-agricultural use (e.g., residential or commerci al development), that person may owe a conversion charge. 208 To obtain more information about the use value law or conversion charge, contact the Wisconsin Department of Revenue's 209 Equalization Bureau or visit http://www.revenue.wi.gov/. 210 FARMLAND PRESERVATION: The early termination of a farmland preservation agreement or removal of land from such 211 an agreement can trigger payment of a conversion fee equal to 3 times the per acre value of the land. Contact the 212 Wisconsin Department of Agriculture, Trade and Consumer Protection Division of Agricultural Resource Management or 213 visit http://www.datcp.state.wi.us/ for more information. 214 CONSERVATION RESE RVE PROGRAM (CRP): The CRP encourages farmers, through contracts with the U.S. 215 Department of Agriculture, to stop growing crops on highly erodible or environmentally sensitive land and instead to plant 216 a protective cover of grass or trees. CRP contracts run for 10 to 15 years, and owners receive an annual rent as well as 217 certain incentive payments and cost shar e assistance for establishing long-ter m, resource-conserving ground cover. 218 Removing lands from the CRP in breach of a contract can be quite costly. For more information call the state Farm Service 219 Agency office or visit http://www.fsa.usda.gov/. 220 SHORELAND ZONING ORDINANCES: All counties must adopt uniform shoreland zoning ordinances in compliance with 221 Wis. Admin. Code Chapter NR 115. County shoreland zoning ordinances apply to all unincorporated land within 1,000 222 feet of a navigable lake, pond or flowage or within 300 feet of a navigable river or stream and establish minimum standards 223 for building setbacks and height limits, cutting trees and shrubs, lot sizes, water runoff, impervious surface standards (that 224 may be exceeded if a mitigation plan is adopted and recorded) and repairs to nonconforming structures. Buyers must 225 conform to any existing mitigation plans. For more information call the county zoning office or visit https://dnr.wi.gov/. 226 Buyer is advised to check with the applicable city, town or village for additional shoreland zoning or shoreland-wetland 227 zoning restrictions, if any. 228 FENCES: Wis.
