Stat. §66.10014. Mr. Maas noted the 2017 the State of Wisconsin passed Act 243, which required cities with a population of 10,000 or more to create a New Housing Fee Report. The key take-away from Act 243, is the creation of Wis. Stat. § 66.10014(4): (4) If a fee or the amount of a fee under sub. (2) (a) is not properly posted as required under sub. (3) (a), the municipality may not charge the fee. No action required, this is purely information for Plan Commission members. Pursuant to Wis. Stat. § 66.10014(3)(b), the municipality shall provide a copy of the New Housing Fee Report to each member of the governing body of the municipality. This will go before the Common Council for their review on February 10, 2026. Henke sought verification that fees do not go before a vote, but the vote is through the budget process. Mr. Maas noted this was correct and fees are adjusted through amendments to Chapter 42. Andereck motioned to adjourn; Piquett second. Main Street Hartford, WI 53027 *Meeting was called to order at 6:30 p.m. by Mayor Dennis Regan. *Members present: Mayor Dennis, Joint Planning Committee Member s: Jeff Turchi, Gerald Ziegler, and Ralph Horst. Absent and Excused: Joint Planning Committee Members: Jacob Kohler, Ryan Lippert, Ralph Horst. Also Present: City of Hartford Planner Jacob Maas *Minutes: Minutes of November 10 , 202 5, were reviewed. Ziegler motioned to accept the minutes; Horst seconded; motioned carried in unanimous voice vote. *Appearances: No appearances. * Discussion Regarding Petition for Direct Annexation by Unanimous Consent Submitted by Winter Park Builders, LLC (registered agent Scott Simon) for approximately 58.0670 acres, parcels T6_037800Z and T6_016100A, located at 1500 W. State St. and north of 1500 W. State St., in the Town of Hartford (discussion only). Winter Park Builders is looking to annex 2 parcels (Tax Keys: T6 -037800Z and T6 -016100A) into the City of Hartford. These 2 parcels will be part of a potential residential development that will incorporate the City owned HADC parcel. T6-037800Z and T6-016100A are comprised of 58.0670 acres of land. ANALYSIS: Configuration: The petitioned area, as legally described, is contiguous to the City of Hartford on the East and South side. Petition Accuracy: The petition and legal description do not appear to have any discrepancies. Status of Public Improvements: Sewer, water, and electric services will be available to the petitioned area. Valuation Impact: Information provided will need to be reviewed prior to next common council meeting. Need: The proposed annexation would allow the property owners to extend development from the City owned HADC parcel. The annexation of the property will also allow for the inclusion of the land into a possible new TID. School Service Impact: The annexation could allow for a residential development that could potentially bring up to 250 students to the district. Other Service Costs: The annexation would have minimal impact on Protective Services (police, fire, EMS), as it is already covered by the City’s protective services. Joint Planning Committee Meeting, February 9, 2026 Consistency of Land Use and Zoning: In 2026, the City of Hartford will undergo a complete rewrite of its Comprehensive Plan that will incorporate the proposed development into the future land use plan. Relation to Sanitary Sewer Service Boundary: The subject property lies within the City of Hartford’s adopted 20-year sanitary sewer service boundary. STAFF RECOMMENDATION: Staff recommends APPROVAL of the petition for Direct Annexation by Unanimous Consent submitted by Winter Park Builders for approximately 58.0670 acres located at Tax Keys: T6-037800Z and T6-016100A in the Town of Hartford. Joint Planning Committee Discussion: Ziegler inquired if there would be over 100 units; Mr. Maas noted he has provided a conservative number regarding the number of students. A member inquired about proximity of water the hookup; Mr. Maas noted the developer has an offer to purchase the nearby 40 acres. Water and sanitary will be connected through Innovation Way. A member inquired how far out the development project is; Mr. Maas projected an approximate 5-year period for development. *Adjournment: Motion by Horst second by Turchi to adjourn meeting. Motion carried. Meeting adjourned at 6:36 p.m. Respectfully Submitted, Jacob Maas, Planner, City of Hartford Compiled by Jenny Conley, Planning Aide January 21, 2026 PETITION FILE NO. 14828 SHANNA KREILKAMP, CLERK CITY OF HARTFORD 109 N MAIN ST HARTFORD, WI 53027-1521 PAMELA BEINE, CLERK TOWN OF HARTFORD 3360 COUNTY ROAD K HARTFORD, WI 53027-9370 Subject: RETTLER REVOCABLE TRUST ANNEXATION Section 66.0217 (6), Wis. Stats., provides that the annexation of lands to cities and villages within a county having a population of 50,000 or more shall be reviewed by the Department of Administration in order to determine if the proposed annexation is in the public interest or against the public interest. The proposed annexation from the TOWN OF HARTFORD to the CITY OF HARTFORD (see attached description) must be reviewed pursuant to the statute. To assist us in making this determination, we urge that you promptly supply the data requested on the enclosed questionnaire (where possible) and return the questionnaire to the department. The purpose of this questionnaire is to assist the department in determining "Whether the governmental services, including zoning, to be supplied to the territory could clearly be better supplied by the town...." The statute further stipulates that the department shall study the "shape of the proposed annexation and the homogeneity of the territory with the annexing municipality." In addition, we would appreciate receiving from you any comments or information bearing on governmental services or shape and homogeneity that would indicate whether the annexation is in or against the public interest. Please return the questionnaire as soon as possible so that the information can be reviewed prior to the department's statutory deadline of February 10, 2026. Direct any questions and comments to Bradley Vowels-Katter at (608) 261-6097. Thank you for your cooperation. In determining whether an annexation is in the public interest, s. 66.0217 (6), Wis. Stats. requires the Department to examine "[t]he shape of the proposed annexation and the homogeneity of the territory with the annexing village or city…." so as, to ensure the resulting boundaries are rational and compact. The statute also requires the Department to consider whether the annexing city or village can provide needed municipal services to the territory. The subject petition is for territory that is reasonably shaped and contiguous to the City of Hartford, which is able to provide needed municipal services. Note: It appears that the legal description call ‘…along the aforesaid west line of the Northeast ¼’ is inappropriate, as the line was not previously referenced. The Department reminds clerks of annexing municipalities of the requirements of s. 66.0217 (9)(a), Wis. Stats., which states: "The clerk of a city or village which has annexed shall file immediately with the secretary of administration a certified copy of the ordinance, certificate and plat, and shall send one copy to each company that provides any utility service in the area that is annexed. The clerk shall record the ordinance with the register of deeds and file a signed copy of the ordinance with the clerk of any affected school district..." State and federal aids based on population and equalized value may be significantly affected through failure to file with the Department of Administration. Please file a copy of your annexing ordinance, including a statement certifying the population of the annexed territory. Please include your MBR number 14828 with your ordinance. Walls B/C/D are determined clockwise from wall A. - The State of Wisconsin defines lead-based paint as that which is equal to or greater than 1.0 mg/cm2 by XRF. Paint chip analysis would be recommended for determination of lead in paint below this level or to rule out lead in any quantifiable amount (for OSHA related information). - Readings with a negative value (i.e. -0.1) are equiv to 0.0. - The calibration of the XRF analyzer was verified before and after testing by taking three readings from a source known to contain 1.02 mg/cm 2 lead (NIST Standard Reference Material). The three positive calibration readings were followed by a sample on bare wood containing no lead-based paint. Executive Summary Review: The owner of Pearl of Canton II has submitted an application for wall signage for the Pearl of Canton II Restaurant – 46 E Jackson Street. Section § 13.0607 (a)Wall signs, to include permanent banners, placed on or against to the exterior wall(s) of business buildings shall not extend more than one (1) foot outside of a building's wall surface, and shall not exceed in sign area the equivalent of three (3) square feet for each linear one (1) foot of building (store) frontage facing an access street for any one (1) premises. Wall signs (and structures) shall not extend above the ceiling level of the first floor of the building upon which they are located and shall not cover windows, doorways or architectural detail. Permanent banners may be used as wall signs provided that they bear no commercial message of any kind. The Pearl of Canton II sign is requested to be placed on the front of the red awning that currently exists to cover the previous tenant’s business name. The sign will be on a 3/16 inches thick board made of plastic and aluminum, weighing 12 pounds and is 24 square feet in area. The letters will be black vinyl with a white background and the sign will be mounted to the existing canopy frame. Additional lighting has not been requested. The proposed sign is within the code requirements for size, placement and color. Planning Staff recommended Conditional Approval of the proposed wall sign in the Business Improvement District – Pearl of Canton II – 46 E Jackson Street. Conditions: 1 – Sign will be installed to meet the IBC code requirements. 2 – The applicant will provide the Building Inspector with documentation that the sign meets the IBC code requirements prior to installing the sign. Plan Commission Discussion of a Sign Permit for the Pearl of Canton at 46 E. Jackson Street: Mr. Maas reviewed the Executive Summary . Member Andereck asked if the lettering is final. Chairperson Michalak called the contractor to the podium, who explained that currently the awning is vinyl with letters sewn into the awning. The proposed sign is aluminum with aluminum backing rails to support it with angles going back to the main frame to hold it securely. The letters cannot be changed on the awning without removing the whole awning and the owner of the building will not allow the business owner to mount a sign anywhere else on the build ing. Motion by Kohler, second by Andereck to approve the sign permit with conditions. Motion carried. Plan Commission, City of Hartford, May 13, 2024 Page 3 of 8 Discussion and Consideration of a Site Plan for a New Maintenance Building at 755 N. Rural Street Executive Summary Review: The School District of Hartford, Joint 1 is looking to develop a 1,500 square foot addition to an existing 3,028 square foot maintenance building located at 755 South Rural Street. The addition will also consist of the development of a 3,125 square foot asphalt surface adjacent to the addition. 755 South Rural Street is 14.59 acres (651,222 square feet). 755 South Rural Street is the location of Lincoln Elementary School. The last development to occur at 755 South Rural Street occurred in 2019 after a successful referendum in the fall of 2018. Section 13.1100 of the Municipal Code grants the Plan Commission the power to review and approve site plans. Section 13.1104 requires I -1 Institutional Districts to have the following additional Site Plan Requirements: • Landscape plans shall include foundation and yard plantings. • A landscaped area at least ten (10) feet in depth shall be located between the street right- of-way and driveway or parking areas, and shall be planted with materials suitable for screening ornamenting. • If the development includes a parking area which has five (5) vehicles or more, the requirements for parking lot landscaping must also be included on the landscape plan. • If the development abuts any residential district, a landscape planting screen of at least six (6) feet in height at the time of planting or berm which meets code requirements must be installed. Adjacent Uses, General Layout, Building Plans • The property is surrounded by Single-Family properties to the North, West, and East, an Institutional property to the North, and park land to the South. • The proposed 1,500 square foot addition would be located on the southwest side of the existing maintenance building. • The proposed addition would allow for the creation of an additional maintenance area, and additional indoor parking for School District vehicles. • The proposed addition meets all setback requirements of Section 13.0324(f). • The exterior will match the exterior metal siding of the existing maintenance building. • An additional 3,125 square feet of parking and loading space will be added with the development. • The lot coverage of impervious surface will increase from 7.1% of the property (46,236 square feet) to 7.8% of the property (50,862 square feet). That is well below the 70% maximum impervious lot coverage allowed by Code. Environmental • 755 South Rural Street does have a wetland pocket to the south of the proposed development. o Future development to the south of the proposed development would likely require a wetland delineation to be performed. Grading, Drainage, and Utilities The proposed development will be built at the same elevation as the existing maintenance building. The proposed addition and associated asphalt surface will result in a 0.7% increase in impervious surface area. The developer shall reach out to the City of Hartford Engineering Plan Commission, City of Hartford, May 13, 2024 Page 4 of 8 Department to verify stormwater requirements. Utilities will be extended from the existing building. Landscaping and Lighting • The developer shall submit a landscape plan for foundation plantings. • The developer shall submit a parking lot landscape plan if the proposed asphalt area has a parking area of five (5) vehicles or more. • Two LED wall mounted sconces will be mounted above the exit doors. Given the small addition of lighting and the distance (more than 350 feet) to any residence, Staff will not require a photometric plan. Planning Staff recommended approval of the Site Plan in the City of Hartford’s I -1 Institutional District at 755 South Rural Street for a Maintenance Building addition and asphalt parking and loading area, with the following conditions: 1. The developer shall submit a landscape plan for foundation plantings. 2. The developer shall submit a parking lot landscape plan if the proposed asphalt area has a parking area of five (5) vehicles or more. 3. Verify with City Engineering staff the post-construction stormwater requirements for the proposed development. Plan Commission Discussion of the Site Plan for a New Maintenance Building at 755 N. Rural Street: Mr. Maas reviewed the executive summary, noting a correction to I-1 Institutional zoning. Once the final plan is submitted to Building Inspection all three conditions must be addressed. Motion by Piquett, second by Boehlein to approve the site plan for a new maintenance building at 755 N. Rural Street. Motion carried. Discussion and Consideration of an Extraterritorial Certified Survey Map at 7542 Waterford Road in the Town of Hartford Executive Summary Review: The property, tax key number T6-0791-00Z, is located in the Southwest Quarter of the Southeast Quarter of Section 31 in the Town of Hartford on the north side of Waterford Road. The owner is the Debra J. Zellmer Revocable Trust. The proposed Certified Survey Map would result in the creation of two (2) nonagricultural lots. Lot 1 being 1.478 acres, and Lot 2 being 1.426 acres. The existing property is 19.27 acres. The creation of the two (2) lots and 0.370 acre R-O-W dedication would leave the parent par cel at 15.996 acres. The proposed CSM indicates a shared access location. Staff Comments: The Town of Hartford, via the Intergovernmental Agreement between the City of Hartford and the Town of Hartford, gives the City of Hartford Extraterritorial Zoning Authority. This Authority is enforced under Section 13.1700 of the City of Hartford’s Zoning Code. Section 13.1702(b) states: Plan Commission, City of Hartford, May 13, 2024 Page 5 of 8 b) Criteria for Nonagricultural Subdivision or Land Division. In the case of nonagricultural lands, the City may grant approval of a subdivision provided that the City shall determine that the proposed subdivision or land division complies with each of the following four criteria: 1) The proposed subdivision or land division shall be compatible with adjacent land uses and shall maintain the general land use pattern of the area in question. 2) The proposed subdivision or land division shall result in a development pattern which is compatible with surrounding developments and land uses. Measures of compatibility shall consider lot sizes, traffic generation, access, noise and visual features. 3) The proposed subdivision or land division and the resulting development shall not adversely affect the City’s ability to provide public service, install public improvements nor accomplish future annexations. The City may consider annexation agreements with the property owner in order to comply with this requirement. The City may also consider whether the City and Town(s) have reached an agreement on necessary public improvements and public services facilities required to serve the development. 4) The proposed subdivision or land division shall provide permanent open space lands for use by the general public in conformance with the City of Hartford adopted Parks and Open Space Plan or the City’s other adopted Master Plan elements. The permanent open space lands shall be accessible and open for use by the general public. The open space lands shall be exclusive from, and in addition to, lands required for dedication to comply with applicable public parks and open space dedication requirements and shall be provided at a ratio of two acres of permanent open space lands for every one-acre of developed lands, including street rights of way. For the purpose of this provision, wetlands, flood plain lands, steep slopes, or other lands which are not developable because of sensitive environmental features shall not be counted as permanent open space lands in calculating the ratio of permanent open space lands provided versus developed lands. Steep slopes shall include lands that have grades of twenty percent (20%) or more. Planning & Inspection Comments: • The proposed lots are identified in the City of Hartford’s Comprehensive Plan’s Future Land Use Map as Medium Density Residential (1.1 to 2.9 dwelling units per acre). o The proposed density is less than 1 dwelling unit per acre. • The proposed lots are located within SEWRPC’s 20-year sanitary sewer service boundary. • Staff is recommending that the two (2) parcels do not share access, and that the driveways and accesses have setback of five (5) feet from the property lines. • The 66 feet (33 feet from centerline) dedication of Waterford Road right -of-way is adequate for residential collector street. Plan Commission, City of Hartford, May 13, 2024 Page 6 of 8 Plan Commission Discussion of an Extraterritorial Certified Survey Map at 7542 Waterford Road in the Town of Hartford: Mr. Maas reviewed the executive summary, noting that additional splits would also need to be reviewed and the CSM should be changed to remove the shared driveway (individual driveways). Chairperson Michalak asked if single family homes are planned for the lots. Mr. Maas affirmed. Motion by Kohler, second by Kuepper to recommend approval of the extraterritorial Certified Survey Map at 7542 Waterford Road in the Town of Hartford. Motion carried. Discussion and Consideration of a Concept Plan for the Neuville Property – Neumann Development Subdivision on North Main Street Neumann Developments, Inc. (Matthew K. Neumann, registered agent) is proposing to develop 111 single-family lots on a proposed 85.43 acre subdivision. The lands that make up the proposed subdivision were annexed into the City of Hartford in July of 2018. Upon annexation, the parcels were zoned to Rs-4. Rs-4 Zoning Districts permit Single-Family dwelling units at a density not to exceed 4.36 dwelling units per acre. The proposed Neumann Developments, Inc.’s development can be broken down as follows: • 110 single-family lots • Lot Sizes o Max: 19,944 square feet (0.46 acres) o Min: 8,400 square feet (0.19 acres) o Median: 9,437 (0.22 acres) o Average: 10,322 (0.24 acres) • Single-family lots total area: o 1,145,736 square feet o 26.30 acres Lot Single-Family Lots (square feet) Lot Duplex Lots (square feet) 31 10,080 1 5,004 32 10,080 2 5,459 33 10,080 3 5,430 34 10,487 4 5,430 35 17,550 5 5,430 36 10,080 6 5,430 37 10,080 7 5,331 38 10,010 8 5,401 39 10,010 9 5,118 40 10,010 10 5,118 41 10,082 11 5,118 42 10,880 12 5,118 43 11,440 13 5,118 44 11,440 14 5,118 45 10,656 15 5,400 46 11,431 16 5,400 Plan Commission, City of Hartford, May 13, 2024 Page 7 of 8 47 10,080 17 5,400 48 10,080 18 5,400 49 10,080 19 5,400 50 10,080 20 5,400 51 10,080 21 6,898 52 10,081 22 5,018 53 10,081 23 5,040 54 10,081 24 5,085 55 10,678 25 5,400 Total 265,717 26 5,400 Average 10,629 27 5,400 Median 10,080 28 5,400 SF Acres 6.1 29 5,400 % of Total Acres 34% 30 5,400 Total 160,464 Average 5,349 Median 5,400 Duplex Acres 3.7 % of Total Acres 20% In the context of the 26.30 acres being developed as single-family lots, the density is 4.22 dwelling units per acre. The density is reduced to 1.30 dwelling units per acre when looking at the totality of the site (85.43 acres). Staff Comments: • Water and sanitary sewer will have to be extended on North Main Street to the proposed subdivision. Since this is a conceptual plat review, no action is required. Plan Commission Discussion of the Concept Plan for the Neuville Property – Neumann Development Subdivision on North Main Street: City Administrator Steve Volkert noted that the concept plan was close to what had been proposed previously. 4 cul -de-sacs, 111 total lots, primarily single -family. Stormwater needs are addressed with 3 ponds on the north, south and east sides. Chairperson Michalak asked for comments. Member Piquett noted that for previous iterations of this development, he (in his capacity as Wastewater Director), Steve and the previous City Planner and a previous City Engineer had discussed needing a pump station, possibly oversized to address future development with the City picking up the cost of the extra sizing. Mr. Volkert noted that the City would also look into future sizing for other utilities. Member Kuepper asked how much land to the north would have to be accommodated for future sizing. Mr. Maas stated that most undevelopable land in the current parcel is to the east, and the City has not reviewed needs for non-annexed property. At this time the developer was called to the podium. Steve DeCleen stated that the developer Plan Commission, City of Hartford, May 13, 2024 Page 8 of 8 expectation did not include a lift station and he would need to vet that. Member Piquett explained that the lift station was part of the previous development discussion. Mr. DeCleen noted that Neumann Development will look into the possibility of a lift station but the expectation is that gravity flow will be sufficient. Alderperson Liaison Kohler noted that previous iterations of this development had been voted down due to lack of single -family housing and expressed his opinion that this is a much more favorable proposal. Member Kuepper asked about plantings in the cul -de-sacs – who would be responsible for maintenance. Mr. Maas noted responsibility would be assigned to the homeowners association (HOA). Member Piquett noted that the previous engineeri ng firm was SEH if the developer wanted to contact them to discuss the lift station. Member Andereck asked what the speed limit along that stretch of Main Street was. Mr. Maas noted that the City is currently working on a jurisdictional transfer with the Town, and at the time that the City is given jurisdiction speed limits can be addressed. Planner’s Report: Mr. Maas reviewed Article 5 in the proposed zoning code, noting that a requirement for an architectural review board means that the Plan Commission will review site plans as two separate agenda items. Mr. Maas also noted the updated wording for telecommunication facilities. Adjournment: Meeting adjourned by Call of Chair at 5:59 p.m. Respectfully submitted, Jacob Maas, City Planner Compiled by Char Smelter, Planning Aide RESOLUTION NO. ____ A RESOLUTION APPROVING THE FINAL PLAT OF COPPER TRAILS SUBDIVISION – PHASE 2 WHEREAS, Neuman Developments, Inc.
