Consider/act on Ord. 26-O1122 to amend the Planned Development Overlay District PD-3-24 (Pabst Farms Town Centre) for Marcus Corporation, located at the NE corner of I-94 & Summit Ave, tax key OCOC0633.999.030 (Item was postponed 3/4/26) - 2nd Reading City Planner Gallo presented the changes made from the first reading. Schellpeper indicated his appreciation the feedback consideration and clarification of connectivity of roads and signs, but he still had concerns about the traffic flow. Aultman Kloth expressed the same concerns and asked if they could reevaluate it again if it was problematic. Gallo said as a general development plan they do not know the impact of other users until they come in, adding that the theater would stagger movie times so the cars leave at different times and should disperse. Jungwirth asked to hear from the applicant and Eric Olson, Director of Real Estate Marcus Corporation, indicated traffic was reviewed by them and the overall road driveways were already in the PUD and the staggering would spread any congestion. WLFD Chief Bowen spoke, adding that consideration of the width of the main going into the narrow areas was their primary concern, but they were comfortable with the change to 3-way. Motion to give the ordinance its second reading made by Ellis and seconded by Schellpeper. Motion carried 7-0-0. 5 2 Common Council - May 05, 2026 New Business a. Consider/act on the Temporary Use Permit for two firework displays at Dockhounds Stadium during 2026, located at 1011 Blue Ribbon Circle North. City Planner Gallo provided an overview that included history on the Conditional Use Permit and previous Temporary Use Permits approving two shows for fireworks. Applicant requested August 20th and September 4th with rain dates for this year. Gallo indicated there have been no complaints and the Fire Chief did not object to issuing the permit. It was discussed and determined that if they were to not have to revisit this every year, the original CUP would need to come back and be amended. Jungwirth asked for clarification on hours and duration. Matt Sokol, applicant and owner of the display company, said they start 5-7 minutes after the game and have never gone past 9:30 pm. Gallo added that they could have a rain delay. Ellis had safety concerns with the brush area and cars on the highway. Sokol said they error on the side of caution with any potential fire hazards, and the fall-out zone is double what is needed with wind being taken into consideration. Fire Chief Bowen said they have observed shows from the interstate and had no concern, and the Fire Department could still cancel a permit due to high winds or other concerns. Motion to approve the Temporary Use Permit for two firework displays at Dockhounds Stadium during 2026, located at 1011 Blue Ribbon Circle North made by Schellpeper and seconded by Spiegelberg. Motion carried 7-0-0. b. Consider/act on Process to Fill District Two Alderman Vacancy City Clerk Kozlik explained the options available to Council to fill the vacancy would be by temporary appointment for the remainder of the term through April 19, 2027, or to hold a Special Election with timing for that being either before the Partisan Primary in July or with the General Election in fall. The Mayor included some of the history on previous appointments and said he thought it would be important to have full representation in the coming months. Schellpeper advocated for the Special Election in July for accountability and transparency. Aultman Kloth commented they are seeing voter fatigue and added that voters would have the opportunity in Spring to make a change. Spiegelberg supported a Special Election in July. Schellpeper said he felt the incumbency would give power or an advantage. Mayor Rosek added that Ald. Ellis beat an incumbent. Ellis supported temporary appointment. Motion to approve holding a Special Election in July to fill the vacancy made by Schellpeper and seconded by Spiegelberg. Motion failed, 3-0-4. Voted No: Jungwirth, Frankowski, Aultman Kloth, Welch. This is part of the Olde Highlander Development. 40 Certified Survey Map – Plan Commission 5-6-26 – Page 2 Olde Highlander, LLC CSM Review: The proposed certified survey map (CSM) contains one lot that is being reduced in size by dedicating lands (35,928 SF or .82 acres) and creating one unbuildable outlot (3780 SF or .087 acres. Previously the Plan Commission and Common Council approved a land division in this area. That CSM had two lots. See below. This new CSM is a redivision of Lot 1 below. Why? The purpose of this CSM is to dedicate lands to the City in two different locations. The first dedication is along Olde Highlander Drive (30,947 SF). This dedication was never completed. This will allow a public street (Olde Highlander Dr) to be constructed and connect to the proposed Snyder Way extension that is currently under construction. The second dedication is to widen Snyder Way (4981 SF). This is to accommodate a reconfiguration of the turning movements of the newly reconstructed area of the access drive for the Vacation Owner’s property on the east side of Snyder Way. Finally, an outlot is being created that consists of 3780 SF. This is a triangular shaped parcel that is not needed for right-of-way. The Olde Highlander Drive ROW is now intersecting Snyder Way at a 90-degree angle, verses instead of a sweeping curve. Previously approved Certified Survey Map for Olympia Fields – Ski Hill Area 41 Certified Survey Map – Plan Commission 5-6-26 – Page 3 Olde Highlander, LLC Timeframes: The CSM was received on April 14, 2025. The City has 90 days to act. The City must take action by July 14, 2026. The Plan Commission shall act on either May 6 or June 3. The Council should act no later than their meeting on July 7, 2026. If the City fails to approve the document within the 90-day timeframe, the CSM document is automatically approved. Further Detail: There were concerns raised by the adjacent property owners that they do not want traffic to use their private parking lot as a cut-through from the Synder Way extension to get to Summit Avenue. Since that time the applicant has been working with the adjacent Vacation Owners. The owners signed an agreement that an access drive can be attached from their property to the proposed Snyder Way extension. The access was to be disguised to not be a clear cut-through, but yet allow for delivery trucks and other access. That agreement is attached. While reviewing the access drive, the Fire District wanted the turning movements to accommodate their fire apparatus equipment. Plans showing the area have been included in the packet. The area around the street needed to be widened, hence the need for additional right-of-way. This is a house-keeping item to assist in the redevelopment of the ski hill area. The applicants have been working diligently to address the outstanding issues for the construction of the Snyder Way extension. The other proposed right-of-way was never dedicated and there are no other plats for this specific area, therefore, it makes sense to dedicate the .8 acres on this document. Staff Recommendation: Plan Commission recommend approval of the Olde Highlander Certified Survey Map to reconfigure lands abutting Pabst Road to the Common Council. Enhance the effectiveness of our city government BACKGROUND In the 2026-2030 Capital Plan, fleet included $315,000 in 2027 for the replacement of plow truck #47, a 2002, single-axle, Freightliner FL70. ADDITIONAL ANALYSIS In today’s economy, lead times for vehicles are unpredictable and very long if production slots are not secured with major manufacturers ahead of time. Therefore, our vendors have been asking the fleet department to commit next year’s orders now to ensure we can get the equipment we have budgeted for 2027. If we commit now, the chassis for the new plow will be secured and built by the end of the year. However, it will not be delivered or invoiced for until early 2027. FINANCIAL IMPACT Securing a chassis now (before the Capital Plan approval for 2027) will save the City approximately $15k to $20k. The savings are tied to the ability to secure a chassis production slot that will not be subject to EPA27 emissions. The current budget of $315k would remain as is versus having to increase the budget for the new emission requirements coming next year.
