AGREEMENT FOR THE INSTALLATION AND MAINTENANCE OF SIDEWALK
THIS AGREEMENT is made and entered by and Joseph J and Kathryn M Brisk (“Brisk”), 307 N.
Lake Road, Oconomowoc, Wisconsin and the City of Oconomowoc (City”), 174 E. Wisconsin
Avenue, Oconomowoc, Wisconsin.
WHEREAS, the City planned to install sidewalk within a portion of the right-of-way of
Lisbon Road in the City; and

Alternative C shall be the same estimated cost of Alternative A ($31,395.60).
7. Brisk’s contribution for the Sidewalk Extension shall be the lesser of the actual
construction costs, or $31,395.60 for Alternatives A or C or $41,484.00 for Alternative B
(the “Brisk Cap”).
8. Upon substantial completion of the Sidewalk Extension, the City will generate an invoice
to Brisk issued for actual installation costs or the Brisk Cap. Brisk shall pay the invoice in

Based bid and the following Alternate Bid item:

work and will only borrow actual funds that are completed.

Management
RELATES TO THE STRATEGIC PLAN
Strategic Goal II: Improve and Maintain Our Infrastructure/Facilities; B Maintain our Existing
Infrastructure
BACKGROUND
A Request for Proposals (RFP) was completed with the hours assigned to the Construction Management
(CM) tasks. The RFP was specified to be a Not-to-Exceed proposal for the following tasks.
Task 1 Construction Management Services
Use 400 hours for construction management services.
Task 2 Construction Inspection Services
Use 1250 hours for the primary person and 550 hours for the second.
Task 3 Construction Survey Services
Use 50 hours for survey data preparation and for construction staking.
Task 4 Record Drawing Information
There are no assigned hours for this as it is incidental to the inspection services.
Task 5 Miscellaneous Items and Administrative
Provide a listing of administrative costs and any items not specified in tasks 1 through 3 that your
firm normally provides for construction management projects.
Proposals were requested by and sent to 9 engineering firms. We received three proposals on Monday
February 26, 2026.
We utilize the hybrid QBS (Qualifications Based Selection) process to evaluate proposals. This hybrid
evaluation process includes a technical evaluation consisting of 80% of points and cost evaluation
consisting of 20% of points. The consultant with the highest combined total of points will be recommended
to Council for approval with the not to exceed cost plus authorization for staff to execute a 10% contingency.
Consultants may not perform construction management services for projects their firm designed.

Othmer, Utility Engineer Technician and Jason Herzog, Director of Public Works. All three firms obtained
more than the 80% point requirement for further consideration. The scoring summary and the not-to-
exceed cost information is shown below.
Sigma Group has completed the 2024 and 2025 street construction management while staying under the
contract value. City staff recommend awarding the construction management contract to The Sigma Group,
Inc. for the amount of $262,567.90.
