City of Delafield Citizen Comments
Mary Daniel, 309 Wisconsin Ave – spoke regarding the DOT County Highway C update. Daniels asked who the
bridge belonged to – the City of the County. There were no engineering drawings regarding the path from Poplar
path to Indian Springs Dr and who provided the cost for the path. How close to the highway will the path be? Who is
responsible for the maintenance costs for maintaining the sidewalk? What are the overall costs for the pedestrian
path maintenance? Will this be a path or sidewalk? Have the safety issues regarding crossing the on ramp been
addressed? Is this path in the 5 -year path plan? This may not be worth the grant money in the long run.

Applicant requests approval to rezone the subject property from the A-1E Exclusive Agricultural
District to the A -1 Agricultural & Residential Holding District.
Aicher noted this is a rezone. It is currently nonconforming based on the zoning it currently has.
Motion by Valde, seconded by Price, to approve the request for the rezone from the A-1E
Exclusive Agricultural District to the A-1 Agricultural & Residential Holding District for the
property located at DELC0796994, 112 S. Cushing Park Road, and adopt Ordinance 847 that
amends the zoning district on the subject property from the A-1E Exclusive Agricultural District
to the A-1 Agricultural & Residential Holding District.
All in favor. Motion carried.
DELC0804982, 2900, 2910, 2912, 2916, 2920, 2926, 2930, 2940, 2948, 2950 & 2952 Golf
Road. Owner: BJV Nagawaukee LLC. Applicant: Darin Frerichs. Applicant requests approval of
an Amendment to an existing Planned Development Approval to accommodate a land division.
Aicher explained this breaks apart the big box store section from the smaller strip mall section of that
parcel. Michels asked about the parking easement and parking allotment and whether additional
development could occur on the property. Hafner clarified that additional development would require
another amendment to the Planned Unit Development.
Motion by Henry, seconded by Laughland, to approve the Amendment to the Planned
Development in accordance with the enclosed draft ordinance and subject to the enclosed
Declaration of Reciprocal Easement Agreement being recorded immediately following the
recording of the Certified Survey Map. The recorded Certified Survey Map shall be attached as
Exhibit A, and all Exhibits shall be legible for recording.

Motion by Henry, seconded by Laughland, to approve the Certified Survey Map to divide a
parcel into two parcels for the property located at
DELC0804982, 2900, 2910, 2912, 2916, 2920, 2926, 2930, 2940, 2948, 2950 & 2952 Golf Road.
All in favor. Motion carried.
DELC0735998, 4024 Nagawicka Road. Owner: University Lake School. Applicant: Chris Buday.
Applicant requests approval of a Conditional Use – Site Plan and Appearance Amendment and
Business Plan of Operation to install soccer field lighting and to construct a shed.
Aicher explained that was discussed by the Plan Commission and the lighting was vetted and the
Plan Commission is comfortable with the proposed lighting.
Henry noted some concerns regarding the proposal, specifically the impact to the neighbors.
Valde asked how many games would be played.
Melissa Benson, Delafield, WI was present to speak on the proposal.
Benson noted the games would be dependent upon the field schedule, but in a given year would be
about 10 – 15 games. Aicher added that the use is being granted for specific times of year 2 -3 times
per week and specific times of day. Benson added that the proposal is erring on the side of heavier
usage.
Laughland added that the proposal worked through potential issues, but there is also a condition that
notes the Conditional Use could be cancelled, which allows for the reconsideration if there are issues.
Tim Prost spoke on behalf of the applicants. Prost explained the lighting plan and the engineering
behind the lighting selected.
Michels asked about the pole height. Prost noted that high poles allow for more tilt on the visors and
more light control. Benson added that the lights are dark sky certified.
Henry added that the condition in number 6 should read no more than three.
Motion by Valde, seconded by Price, to approve the Conditional Use – Site Plan and Appearance
Amendment and Business Plan of Operation to install soccer field lighting and to construct a
shed. With removing “2 or” from item number 6 and adding “amendment” after “permit” to
number 7.
Motion carried with Henry voting nay.
DELC0808985002, 501 Maple Avenue. Owner: Cedar Square III LLC. Applicant: John Barker,
501 Maple, LLC. Applicant requests approval to create a Planned Development Overlay District,
including General Development Plan and Specific Implementation Plan approval and Site Plan
and Appearance Approval to allow a 16-unit residential condominium development.
Aicher summarized the proposed project and current status. There were items that still needed to be
sorted out, but this could be handled by staff. Hafner noted the items should be approved
contingent staff and attorney review and in accordance with the recommendations suggested by City
Planner, Amy Barrows, that were provided that evening.
Michels asked if there was any reason that this item was rushed. Hafner clarified that the developer
would like to move forward with the project. Michels noted that it is not a preference to have the project
presented where there seem to be a lot of items being reviewed at the last minute.
Laughland asked about the items on the checklist, and which were of the most significance for the
Council to address. Hafner explained there are two main items of concern that have not been fully
resolved. One item is emergency access. Another item is the retaining walls and consideration for
guardrails.
Laughland asked what the consequence would be if this were delayed.
John Barker, Delafield, WI, was present to discuss. Barker noted that there is limited time to complete
these projects, and any delay further limits that time. He would like to advertise but cannot do so until
approval.
Barker added that his understanding is that the retaining walls do not require a railing. Barker has
hired an engineer who specializes in retaining walls. He explained the retaining walls and the
emergency access plans. He further explained the design for the retaining walls.
Laughland asked if the wall would be dangerous if there was snow obscuring the visual design in
winter. Barker does not think that snow would cause issue.
Valde noted this was a complicated plan and the Plan Commission has worked through the item and
recommended it. Aicher clarified that the project has advanced from Plan Commission to Public
Works Committee, which generated the list of conditions, which would normally then be reviewed
again by Plan Commission. This is fast tracked, so the Council is reviewing at this point instead.
Ultimately, staff vets everything out in accordance with the law and state codes. Hafner added that
guardrails would be required if this were a public roadway, but the question remains as to whether
they can be required, or should be required, on a private drive.
Laughland added that he would not like to leave too many things on the table which cause issues with
the project and the requirements for the developer. Barker noted he is willing to complete the items
required to accommodate emergency access.
Michels asked whether the attorney had reviewed these documents. Hafner confirmed, but there are
still a few items that need to be buttoned up, and the attorney may still need to review again and there
was one minor item that would need to be addressed.
Discussion regarding the emergency access items and the possible addition of railings continued.
Motion by Henry, seconded by Price, to approve the Planned Development Overlay District,
including General Development Plan and Specific Implementation Plan approval and Site Plan and
Appearance Approval to allow a 16-unit residential condominium development, subject to staff
and attorney review and addressing of comments from the Public Works Committee.
All in favor. Motion carried.
DELC0808985002, 501 Maple Avenue. Owner: Cedar Square III LLC. Applicant: John Barker,
501 Maple, LLC. Applicant requests approval of a Certified Survey Map to create an Outlot.
Motion by Henry, seconded by Price, to approve the Certified Survey Map to create an Outlot for
the DELC0808985002, 501 Maple Avenue.
All in favor. Motion carried.
DELC0808985002, 501 Maple Avenue. Owner: Cedar Square III LLC. Applicant: John Barker,
501 Maple, LLC. Applicant requests approval of a Developer’s Agreement to accommodate a
16-unit residential condominium development.
Motion by Henry, seconded by Laughland, to approve the Developer’s Agreement to
accommodate a 16-unit residential condominium development subject to final staff review and
attorney review and approval.
All in favor. Motion carried.
DELC0808985002, 501 Maple Avenue. Owner: Cedar Square III LLC. Applicant: John Barker,
501 Maple, LLC. Applicant requests approval of a Watermain Easement to accommodate a 16-
unit residential condominium development.
Hafner explained the engineering comments that had been provided to the Council. Michels asked
what the engineering staff had reviewed. Hafner explained that the engineering staff had reviewed for
substance, and the surveyor had then reviewed and there were issues determined that review.
Michels asked if delaying this item would cause delay in the construction, as it seems like the Storm
Water Maintenance Agreement should be approved in conjunction with the document. Hafner noted
that construction could begin if this item was delayed, but the Storm Water Maintenance Agreement
and the watermain easement are not linked. The items noted are technicalities that will take minimal
effort to correct.
Michels noted concern that there are so many unresolved items. Hafner noted that if Council shares
the concern about how the item is being presented in its current state, Council should state such and
this will be taken into account for future projects. Vlade added this is unusual, and items are generally
in a finalized format.
Aicher noted that this is being presented in this manner in an effort to try to determine if the timeline
for projects could be shortened. That being said, there were many items left on the table, and there
would be a review to determine how the process can be fixed, one way or the other.
There was a general consensus that Council would prefer a buttoned -up project to be presented to
the Council for future items.
Motion by Michels, seconded by Laughland, to approve the Watermain Easement to
accommodate a 16-unit residential condominium development, subject to final exhibits being
reviewed and approved by engineering staff.
Discussion: Henry added that if there are issues or concerns, then staff should send this back to the
Council.
All in favor. Motion carried.

New Business
Discussion and possible action regarding Resolution 2026-08, a resolution amending the 2026 operating
budget related to unanticipated increased revenue of $9,244 from a Wisconsin Department of Justice
Law Enforcement Drug Trafficking Response grant, and increased expenses covered by the grant of
$9,244 for development of a new Response to Hazardous Controlled Substances program (training,
respirators, filters, protective suits, gloves, boots, and fit -testing equipment).
Chief Nyren noted that the department received a grant. This amendment is budget neutral.
Motion by Laughland, seconded by Henry, to approve Resolution 2026-08, a resolution amending the 2026
operating budget related to unanticipated increased revenue of $9,244 from a Wisconsin Department of
Justice Law Enforcement Drug Trafficking Response grant, and increased expenses covered by the grant
of $9,244 for development of a new Response to Hazardous Controlled Substances program (training,
respirators, filters, protective suits, gloves, boots, and fit-testing equipment).
All in favor. Motion carried.
Presentation by Police Chief Landon Nyren regarding the staffing of the City of Delafield Police
Department and the need for an additional sworn officer. This item is for discussion only at this time and
no action will be taken on this item at this meeting.
Chief Nyren presented regarding the need for an additional sworn officer. The day shift hours are still often only
at one officer on patrol. This increase could be achieved with an increase of only $63,000 years. An admin
position could be eliminated after the retirement of the current staff member. The true need is two officers, but
the reality is that there are budget constraints, and the ask for now is one. Nyren reviewed the comparable
presented. The last staff increase was in 2017.
Laughland asked why the ask isn ’t until 2027. Nyren noted the reality of hiring prior to 2027 at this point is not
practical.
Laughland asked what officers do when there is no additional officer support available. Nyren explained that
mutual aid has worked for now, and can continue for now, but this should not be something that is relied upon
long term.
Price asked about the timing of the reduced staffing. Nyren noted it happens all week, but most frequently on
the weekends.
Michels asked how often the City is at one officer per shift. Nyren did not have this exact statistic but leave time
usage most affected the two-officer minimum.
Valde noted that with the staffing and 16 officers and 24/7 staffing requirements make it difficult to meet the
minimum.
Aicher added that it would be helpful to present the council with data about how frequently the shifts occur
where there are staff shortages.
Hafner added that this presentation is coming forth early to allow the City to think about how to fund it. There
are two options, one is to use the excess fund balance, the other is a referendum.
Aicher asked when a decision on a referendum would need to occur. Hafner suggested an August timeframe
on the referendum question for a November ballot. Michels added it might still be something that could get on
the August ballot but it would be a very short timeline for that election. Aicher added that the City has
historically proposed these types of questions on ballots with larger turnouts for transparency.
Aicher asked to present information on the why at the next meeting. Hafner asked if a “Safer Grant” would be
an option. Nyren clarified it was a “Cops Hiring ” grant and none had been announced for the fiscal year. If one
were to be announced, Nyren would certainly apply.
Schneider added that the deadline for a November referendum question would be the 25 th of August.
Henry would like projections on the ongoing costs for the referendum.
Price asked about the budgetary implications without going to referendum. Hafner clarified that the City is
already operating in a structural budget deficit that includes the use of excess fund balance and adding this to
the budget would expedite the depletion of those funds.
Hafner explained that the referendum is not allowed to include an annual inflation increase, so the Council
should consider asking for an amount that averages out to an amount that could support that position for 10
years or so.
Aicher noted that the immediate consideration is to focus on the why to fully understand the justification for the
need.
Discussion and direction to staff regarding various elements of the WisDOT Genesee Street/CTH “C”
Bridge Replacement Project currently scheduled for construction in 2029.
1. Community Sensitive Design (CSD) decorative elements to be incorporated into the bridge design
(Federal funds would cover 80% of costs up to a maximum federal contribution of $147,525. City
would be responsible for the 20% local cost share and 100% of costs above the maximum federal
contribution).
2. Extension of sidewalk to the bridge and inclusion of sidewalk on the bridge deck.
3. Maintenance agreement for sidewalk, including sidewalk on the bridge deck, and CSD elements.
4. Cost sharing agreement for sidewalk and CSD elements.
Hafner explained that there had been a meeting a year ago presenting the project. The sidewalk on both sides
was presented at this time but was brought up as something that would need to be considered further. A recent
meeting had occurred where the DOT determined they would not pay for the sidewalk on the west side and the
City would need to pay for it. Hafner had explained in that meeting that he did not think the City wanted a
sidewalk on that side. He received an email earlier that day where the DOT had confirmed a sidewalk on both
sides would be included.
Michels asked about safety requirements for the offramps with a sidewalk.
Hafner explained that this would be part of the DOT designs, but the City would be required to sign a
maintenance agreement for the sidewalk across the bridge. He added that the west side sidewalk is part of the
plan and asked the Council to provide feedback with regard to whether they would like this included in the
plan, even if the DOT is paying for it.
Valde added that there are no sidewalks on the west side, so the proposed sidewalk goes nowhere.
Hafner added there will be dedicated bike paths.
Discussion occurred about the sidewalk and the extensions that will be required to be added by the City.
Hafner asked if the Council wanted to commit to putting the sidewalk in with the bridge project.
Valde is supportive of a sidewalk on the east side.
It was suggested that if the west sidewalk is cut out, the state would pay for the extensions.
Aicher asked if there would be any safety benefit to sidewalk on both sides. Hafner added that currently that is
the status of the bridge on the east side.
Motion by Valde, seconded by Henry, to install the sidewalk on the east side from Poplar Path to Indian
springs.
All in favor. Motion carried.
Hafner asked if there was a desire to pursue the elimination of the sidewalk on the west side of the bridge
deck. Discussion occurred about the west side path options, it was discussed that the wider bridge with a west
side sidewalk would be beneficial, but the overall consensus was that extending any additional sidewalks to
that point would not be beneficial at this time.
Hafner explained the funding share for this and noted that if the City exceeds the allotted amount, they would
be responsible for 100% of the cost above that amount.
Hafner reviewed some of the decorative options.
Michels would like Public Works Committee to review.
There was a consensus to investigate the rock look, the sailboat logos, and the wrought iron fence. Laughland
added that the HWY G stone aesthetic was also nice.
There was also a consensus to refer to Plan Commission and Public Works Committee.
Hafner added that the cost sharing agreement and the maintenance agreement were incoming.
Approval of Vouchers Payable Report for the reporting dates of 5/6/2026 - 5/19/2026 in the amount of
$131.635.60 for accounts payable and $128,600.77 for payroll.
Motion by Henry, seconded by Valde, to approve the Vouchers Payable for the reporting dates of 5/6/2026
- 5/19/2026 in the amount of $131.635.60 for accounts payable and $128,600.77 for payroll.
All in favor. Motion carried.

Discussion: Henry added that if there are issues or concerns, then staff should send this back to the
Council.

501 Maple, LLC. Applicant requests approval of a Watermain Easement to accommodate a 16-

Discussion: Henry added that if there are issues or concerns, then staff should send this back to the
Council.

Road. Owner: BJV Nagawaukee LLC. Applicant: Darin Frerichs. Applicant requests approval of
a Certified Survey map to divide a parcel into two parcels.

Motion by Henry, seconded by Laughland, to approve the Developer’s Agreement to
accommodate a 16-unit residential condominium development subject to final staff review and
attorney review and approval.
All in favor. Motion carried.

Hafner noted

and the watermain easement are not linked. The items noted are technicalities that will take minimal

Road. Owner: BJV Nagawaukee LLC. Applicant: Darin Frerichs. Applicant requests approval of
a Certified Survey map to divide a parcel into two parcels.

Plan Commission
Discussion and Possible Action Regarding the Following Items:
DELC0796994, 112 S. Cushing Park Road. Owner & Applicant: Robert & Claire Widule.
All in favor. Motion carried.
DELC0804982, 2900, 2910, 2912, 2916, 2920, 2926, 2930, 2940, 2948, 2950 & 2952 Golf
Road. Owner: BJV Nagawaukee LLC. Applicant: Darin Frerichs. Applicant requests approval of
a Certified Survey map to divide a parcel into two parcels.

Discussion and Possible Action Regarding the Following Items:
DELC0796994, 112 S. Cushing Park Road. Owner & Applicant: Robert & Claire Widule.

This may not be worth the grant money in the long run.

and Appearance Approval to allow a 16-unit residential condominium development.

Discussion: Henry added that if there are issues or concerns, then staff should send this back to the
Council.

Road. Owner: BJV Nagawaukee LLC. Applicant: Darin Frerichs. Applicant requests approval of
a Certified Survey map to divide a parcel into two parcels.

Hafner explained the engineering comments that had been provided to the Council. Michels asked
what the engineering staff had reviewed. Hafner explained that the engineering staff had reviewed for

Presentation by Police Chief Landon Nyren regarding the staffing of the City of Delafield Police
