Marquette County Board of Adjustment April 30, 2026 – Marquette County Courthouse, Public Safety Room Members present: Mary Walters-Chair, Lance Achterberg, Mike Johnson. Others present: Jean Potter, Adam Stapleton, Donna Stapleton The Chair called the meeting to order at 1:00pm. Member introduction s made by Chair. Chair asked for a motion to approve the minutes of February 26, 2026, Board of Ad justment hearing. Motion by Achterberg, second by Johnson. Motion carried: 3-0. The Chair explained instr uctions for hearing procedures. Potter explained appealing a Board of Adjustment decision. David & Donna Stapleton, 6942 County Line Rd., Hartford, WI 53027 requested a variance under Section 7.2 of the Marquette Code of Ordinances Chapter 63-Shoreland Protection for the construction of a deck at a reduced setback of 56 feet to the Ordinary High-Water Mark (OHWM) of Tuttle Lake, on unrecorded Lot 10 Tuttle Lake Plat, part of Govt Lot 5, described in Doc# 325489, Sec. 22 T17N R10E, Town of Crystal Lake, Marquette County, WI. Property address is W2720 S Tuttle Lake Rd. Chair summarized the application materials. Discussion held with applicants. Video was shown. Chair opened the public hearing. Chair stated for the record there was no one present in person or remote to speak and closed the public hearing. Achterberg proposed a condition to the application requir ing the applicants implement shoreline erosion control and revegetation of disturbed areas during construction under the guidance of the Marquette County Land & Water Conservation Department as necessary. Motion by Achterb erg, second by Johnson; motion carried 3-0. Application with conditions approved 3-0. Rea sons for approval included limited size of the lot and locations of septic and well; location of deck includes one of two egress points for dwelling; no impact to shoreland area or neighboring properties which match proposed reduced setback to OHWM similar to the requested structure. Other Business: Potter stated the next meeting will be held i n the Public Safety Room of the Courthouse, May 29, 2026, at 1:00pm. Meeting adjourned at 1:20pm
