CTH T (Lakefield Road) Speed Limit Mr. Edgren explained that, upon a resident's request to reduce the speed limit of CTH T (Lakefield Road) from 45 MPH to 35 MPH, a speed study was conducted from Struck Lane to Green Bay Road. Currently, the speed limit is 55 MPH east of Green Bay Road, 45 MPH west of Green Bay Road and drops to 25 MPH at Struck Lane in the City of Cedarburg. The speed study, presented to the Traffic Safety Commission (TSC) in July 2025, showed good compliance with the 45 MPH speed limit as 85% of the vehicles were going 49 MPH or less; and, therefore, the TSC did not make any changes. At the October 2025 and January 2026 TSC meetings, reconsideration of the speed limit reduction was requested by several City of Cedarburg officials and residents. After discussion Page 5 of 91 and no motion to approve a speed limit change, the item was approved to be forwarded to the Public Works Committee with no recommendation. Mr. Reynolds, who resides on Lakefield Road, expressed concern as this stretch of road is rarely patrolled and traffic consistently exceeds the existing speed limit. Supervisor Arnett presented a letter from the City of Cedarburg mayor who supports the request for the speed limit change. The City of Cedarburg is looking for an accommodation to change the section that is currently at 45 MPH down to 35 MPH. Discussion on the possibility of performing another speed limit study and proceed with the recommendation of the State of Wisconsin. Sheriff Knowles has been in contact with Chief McNerney regarding this request and agrees that this is a safety issue. Sheriff Knowles' concern is traffic enforcement from the county side as this is an area that would be difficult to monitor on a regular basis. Discussion on the current speed limit, speed study data, no reported accidents in this stretch, driver behavior, the 85th percentile rule and a common sense approach to the request for a 10 MPH reduction due to the support of the City of Cedarburg mayor, police chief and residents. Chairperson Wolf requested a roll call vote on the motion (see motion in box below). Bichler - No, Grabow - No, Strom - No, Vogel - Aye, Wolf - Aye Motion: Motion to reduce the speed limit from 45 MPH to 35 MPH. CTH W Engineering & Right-of-Way Acquisition Amendments Mr. Struck stated, that as part of a required Archeological Investigation, findings have required the shifting of the proposed oxbow drainage feature significantly east out of the proposed extended right-of-way and permanent easement. Questions on cost of the entire project. Motion: Motion to approve raSmith, Inc.'s Amendment to Agreement and CORRE's Right of Way Acquisition Amendment for the CTH W Reconstruction project for $8,000. We Energies Easement at Justice Center Mr. Edgren explained that Hollander Chocolate Company has requested a large electrical service upgrade from We Energies for an Electric Vehicle (EV) Charging system and that We Energies is reviewing potential options to bring 24.9Kv voltage to Hollander Chocolate. We Energies is considering a few alternatives, but the route presented seems best for electrical distribution planning, future usage, extensions, etc. according to a We Energies representative. We Energies is seeking feedback from Ozaukee County regarding the possibility of granting an easement, outside the road right-of-way, on Ozaukee County property. Questions about the potential for future development on the property and whether We Energies will provide any compensation. Committee members agree that compensation should be requested for granting the easement. c. Management/Financial/Informational Reports 1. Highway Financials - Feb 2026 There were no questions regarding financials. Questions on Construction Report - Completed Projects. 9. NEXT MEETING DATE March 19, 2026 10. Henning, Chief Deputy County Clerk Page 8 of 91 Item: 5.a.1. Agenda Item Information Sheet To: PUBLIC WORKS COMMITTEE From: Jon Edgren, Public Works Director Meeting Date: March 19, 2026 Department/Office: Facilities Item Name: Resolution: Permanent Easement Granted to We Energies on Parcel Number 16-032-10-004.00 Summary: BACKGROUND INFORMATION: Hollander Chocolate Company, located at 1180 South Spring Street which is across from the Justice Center Soccer Fields, has requested a large electrical service upgrade from We Energies for an Electric Vehicle (EV) Charging system. The EV Charging system would require a significant electrical upgrade, so We Energies put together a plan to bring 24.9Kv voltage to Hollander Chocolate, which currently only has access to the 8Kv electrical distribution system. However, their route requires an easement on the Justice Center Soccer Field Park in the northeast corner. (See attached sketch.) ANALYSIS: I believe that the project is good for the community, and it has a minor impact on the Justice Center parcel as it’s a strip of land 15-ft wide in the northeast corner of the parcel so I’d recommend approval. Also, attached is the easement document with the exhibit for eventual approval by the County Administrator. Finally, the PWC asked for potential compensation for the easement, and We Energies responded that they’d suggest $1,000 in compensation. However, that money would come from Hollander Chocolate as a pass through for the project. Recommended Action: Approve the Resolution granting the We Energies easement as presented, and forward to the Ozaukee County Board for approval. Attachments: 1. Agenda Item Information Sheet To: PUBLIC WORKS COMMITTEE From: Jon Edgren, Public Works Director Meeting Date: March 19, 2026 Department/Office: Highway Department Item Name: City of Mequon's CTH W Streetscape Project Bid Award Summary: BACKGROUND INFORMATION: For many years, the City of Mequon has explored ways to beautify Country Trunk Highway (CTH) W (N. Port Washington Rd) as their primary commercial district and entrance to the City of Mequon. In the last year, they’ve completed plans for a Streetscaping project along CTH W from Zedler Lane to Mequon Road (STH 167/57) that would add trees & shrubs, colored concrete, improved medians and other items to improve the aesthetics of the highway. However, Corporation Counsel Rhonda Gorden expressed concerns over Ozaukee County’s ability to have the City of Mequon indemnify the County on a County Highway. Following discussions at the Public Works Committee (PWC) meetings in January, April & June of 2025, Corporation Counsel Gorden worked with City of Mequon Attorney Brian Sajdak to develop a Memorandum of Understanding (MOU) to allow the project to move forward, funded by the City of Mequon, but clearly maintaining liability of the County as our highway. The MOU was approved by the PWC in August of 2025. On Tuesday, March 10th, the City of Mequon awarded the Streetscaping Bid to Wil-Surge Electric in an amount not to exceed $2,650,800. ANALYSIS: Given the approved MOU (attached) and the City of Mequon’s Common Council approval (City of Mequon’s Support Document attached), I have no concerns with moving forward with the project award to Wil-Surge Electric in an amount not to exceed $2,650,800. Recommended Action: Award the CTH W Streetscape Project Award to Wil-Surge Electric in an amount not to exceed $2,650,800. Attachments: 1. The City shall correct any deficiency within a reasonable period of time after receiving notice. C. The County may make temporary repairs to, and conduct maintenance on, the Streetscape Elements if the County, in its own judgment, determines the repairs or maintenance are necessary for the public's safety. Except in the event of an emergency, the County shall provide written notice to the City of any required repairs or maintenance, and provide the City a reasonable opportunity to complete the repairs or maintenance in the same manner as called for within this Agreement. The City shall reimburse the County for any cost incurred by the County for such repairs and maintenance. In the event that repair or replacement is required as a result of a larger project to replace or reconstruct the highway, the City and County will address the costs of such work as part of a separate agreement at the time such project is contemplated. 5. INDEMNIFICATION. The City shall indemnify and hold the County harmless against any and all liabilities and damages related to the provisions in this Agreement and against all claims, suits and actions arising therefrom and against all costs of defending the same, including actual attorney's fees, which liabilities shall arise from the acts or omissions of its officers, employees, servants and agents. To the fullest extent permitted by law, the City's total liability to the County and anyone claiming by, through, or under the County for any injuries, losses, damages and expenses caused in part by the negligence of the City and in part by the negligence of the County or any other negligent entity or individual, shall not exceed the percentage share that the City's negligence bears to the total negligence of both Parties and all other negligent entities and individuals. Further, nothing contained within this Agreement is intended to be a waiver or estoppel of the Parties, or their insurer, to rely upon the limitations, defenses, and immunities contained within Wisconsin law, including those contained within Wisconsin Statutes§§ 893.80, 895.52, and 345.05. To the extent that indemnification is available and enforceable, the City or its insurer shall not be liable in indemnity or contribution for an amount greater than the limits of liability for municipal claims established by Wisconsin Law. 6. The project includes new street and pedestrian light fixtures, median modifications, street trees and landscaping enhancements within the medians, and intersection improvements. The project also includes a westbound Donges Bay Road right-turn lane as it approaches North Port Washington Road. A Resolution Authorizing a Contract Amendment for the Development of Streetscape Construction Plans with Harwood Engineering Consultants, Ltd., was approved on August 14, 2024. Port Washington Road is under the jurisdiction of the County even though the road is located within the City. Therefore, there is a memorandum of understanding (MOU) in place with Ozaukee County regarding these improvements, which was approved as Resolution 4231 in September 2025. This MOU requires the County to approve the award of the project, in addition to the City. The County is technically the project owner, but the City will effectively oversee the project's construction and finances. The project was previously bid in May 2025, in which the City received only two bids for the project's construction. At that time, the low base bid was $2,560,000. These bids were previously rejected by Common Council at the June 2025 meeting, citing the project cost, which may have been inflated due to the time of the year the project was bid, the compressed schedule to complete the project, and uncertainty with tariffs and inflation. As a cost-saving measure, the current iteration was bid earlier in the year and with a longer construction schedule. Furthermore, the project was bid with alternate bids and additive bids to give the City flexibility in award with regard to cost. Page 30 of 91 Analysis The City received five bids for the project construction contract with a low base bid of $2,388,968.48 submitted by Wil-Surge Electric, Inc. of Butler, Wisconsin. A summary of the base bid, alternate bid, and additive bids submitted are attached to this memo for reference. When comparing the current bids to the earlier bids, the lowest bid is approximately $170,000 less. However, when including the stamped asphalt alternate bid, which was included in the previous base bid, the two lowest bids are almost identical. Based on feedback from the contractors who bid on the project, whatever savings that were gained by changes to the bid package were offset by inflation and higher construction costs. While the overall cost of the project is higher than anticipated, staff is recommending moving forward with the award of the base bid. As a reminder to the Council, this project has been in the planning stages for approximately four years. Delays included I-43 construction and jurisdictional issues with the County. However, there was a commitment made to the general public and business owners along the corridor that improvements would be made. In comparison, the City has spent over $6,000,0000 in TID #3 for public improvements over the life of the district. It appears that, based on the financial analysis below, there will be sufficient cash available to fund the project with TID proceeds. Staff suggests implementation of the base bid, and excluding the alternatives or additives for the project due to the concern of the cost associated with each item. Wil-Surge Electric, Inc.'s bid total is $2,388,968.48, which is $128,080 lower than the next lowest bidder's base bid total. Wil-Surge Electric, Inc. has performed similar work of this type for other communities and has successfully completed projects of similar scale. No engineering estimate was prepared for this bid. Additionally, due to current staffing vacancies and multiple construction projects scheduled this season, staff is recommending a construction administration contract with the design engineer, Harwood Engineering Consultants, on an hourly basis not-to-exceed $24,000 for assistance with construction oversight when City staff is unavailable or occupied with other construction projects occurring this summer. This would supersede a previously authorized $6,000 contract for construction administration associated with this project. Fiscal Impact The overall cost of the streetscaping project is proposed to be split between TIDs No. 4 and No. 5. Currently, the TIDs have approximately $3,000,000 in combined cash reserves as of December 31, 2025. Cash flow estimates in the TID annual reports (see attached) show that the districts will have cash available after the project to cover maintenance costs in future years. Staff typically recommends that large public construction project awards include a contingency. This contingency allows for additional services that may arise from unforeseen field conditions, eliminating the need for minor extras to be reapproved by the Common Council, provided the project remains within budget. Some elements may require significant repairs that only become Page 31 of 91 apparent once work commences, which are compensated at a unit cost. Consequently, staff recommends that the resolution authorize an amount not to exceed $2,500,000 for the construction contract, which incorporates a contingency of approximately 4.6% for additional authorized efforts. The projected cost of the full project effort, including the construction contract and construction administration contract, is $2,524,000. Recommendation A recommendation is forthcoming from the Public Works Committee on March 10, 2026. Recently, as part of a required Archeological Investigation, findings have required the shifting of the proposed oxbow drainage feature significantly east out of the proposed extended ROW and permanent easement. Therefore, we requested proposals for re-doing the Plat, Relocation Order and Appraisal to obtain a much larger portion of the Solomon Parcel (Parcel #12). In February, the Public Works Committee (PWC) approved a change order to update the Plat and Relocation Order. ANALYSIS: The Public Works Committee approved the Plat & Relocation Order in November of 2023 and June of 2024, but need to re-approve given the latest changes (attached). Recommended Action: Approve the CTH W Plat and Relocation Order as presented. Attachments: 1. Agenda Item Information Sheet To: PUBLIC WORKS COMMITTEE From: Jon Edgren, Public Works Director Meeting Date: March 19, 2026 Department/Office: Highway Department Item Name: CTH W & CTH C Plat & Relocation Order Summary: BACKGROUND INFORMATION: In June of 2024, the Ozaukee County Public Works Committee (PWC) authorized approval of the State Municipal Agreement (SMA) for the redesign of the Traffic Signals at the County Trunk Highway (CTH) W (N. Port Washington Rd) & CTH C (Pioneer Rd) intersection through the Wisconsin Department of Transportation’s (WisDOT) Highway Safety Improvement Program (HSIP). WisDOT will fund 90% of the eligible design and construction costs, and the County will pay 10% of the eligible costs and any non-participating costs. In September of 2024, the PWC approved Ayres Associates as the Design Engineer, and the project has been moving forward since it’s approval. The project is reaching it’s final design, and we’re planning to shift some curb & gutter outward, so we’ll need to acquire some corners of right-of-way (ROW). As we’re utilizing WisDOT funds to pay for 90% of the project, we need to follow State policies for obtaining the ROW. Therefore, the first step is approval of the Plat & Relocation Order, so our ROW Acquisition Specialist can begin negotiations with the landowners. ANALYSIS: Given the safety aspects of this project and significant grant funding, we support approval of the changes to the intersection. Attached is the CTH W & CTH C Plat & Relocation Order for approval. Recommended Action: Approve the CTH W & CTH C Plat and Relocation Order as presented. Attachments: 1. Agenda Item Information Sheet To: PUBLIC WORKS COMMITTEE From: Jon Edgren, Public Works Director Meeting Date: March 19, 2026 Department/Office: Highway Department Item Name: CTH W & CTH C Real Estate Acquisition Firm Award Summary: BACKGROUND INFORMATION: In June of 2024, the Ozaukee County Public Works Committee (PWC) authorized approval of the State Municipal Agreement (SMA) for the redesign of the Traffic Signals at the County Trunk Highway (CTH) W (N. In order to begin acquiring right-of-way (ROW) and ensure we’re following all applicable State & Federal acquisition regulations, we need to hire a ROW Acquisition Specialist. We reached out to seven (7) different consultants, but due to the small nature of the project and a relatively short turnaround, we’ve only received a proposal from one (1) firm. ANALYSIS: We’ve received a proposal from Single Source, but are anticipating at least one more proposal. We will plan to bring forward analysis of the proposals with a recommendation to the PWC meeting. Recommended Action: Approve the CTH W & CTH C Real Estate Acquisition firm as recommended. Agenda Item Information Sheet To: PUBLIC WORKS COMMITTEE From: Jon Edgren, Public Works Director Meeting Date: March 19, 2026 Department/Office: Highway Department Item Name: 2026/2027 Bridge Inspection Agreement Summary: BACKGROUND INFORMATION: The Wisconsin Department of Transportation (WisDOT) requires that all bridges are inspected every 12 to 48 months. In Ozaukee County, there are 56 County and locally owned bridges, and at least 40 of their inspections are scheduled for Fall of 2026. Historically, Ozaukee County has covered the costs to perform the inspection on all of them, and our consultant distributes the bridge reports to each individual municipality. In 2024, Ozaukee County performed a Request for Proposals (RFP) for Bridge Inspection, and selected CORRE Associates based upon their low cost and qualifications. Based upon a positive experience over the last two years, we requested a proposal for the next two years of inspections. ANALYSIS: Given that CORRE has agreed to a minimal price increase for the typical inspection ($310/bridge to $320/bridge), they’ve performed well as Ozaukee County’s Bridge Inspectors and it’s a benefit to maintain a consistent approach to bridge inspections, we recommend approving CORRE’s 2026/2027 Bridge Inspection Agreement. (See attached.) Recommended Action: Authorize the Public Works Director to approve CORRE’S 2026/2027 Bridge Inspection Agreement. Attachments: 1. Agenda Item Information Sheet To: PUBLIC WORKS COMMITTEE From: Jon Edgren, Public Works Director Meeting Date: March 19, 2026 Department/Office: Highway Department Item Name: Safe Streets for All Agreement Summary: BACKGROUND INFORMATION: As part of the Bipartisan Infrastructure Law (BIL), the United States Department of Transportation (USDOT) is distributing funds through the Safe Streets and Roads for All (SS4A) Grant Program. The SS4A program funds local initiatives to prevent roadway deaths and serious injuries. In 2019, the Public Works Committee (PWC) authorized Traffic Analysis & Design Inc. (TADI) to perform a Safety Screening Report throughout Ozaukee County to seek highway and/or intersection improvements that were potentially eligible for safety related funding through the Wisconsin Department of Transportation’s (WisDOT) Highway Safety Improvement Program (HSIP). Through that effort, Traffic Signals at CTH NN & CTH Y (Granville Rd) were constructed and Traffic Signals at CTH W (Port Washington Rd) & CTH C (Pioneer Rd) are going to be updated utilizing HSIP funds, which pay for 90% of design and construction costs. The PWC authorized TADI to assist in submitting a SS4A application with the intent of performing a comprehensive safety assessment of Ozaukee County’s entire highway network, and we’ve been approved by the USDOT. The intent is to obtain a Comprehensive Safety Action Plan (CSAP), which is estimated to cost $250,0000 with 80% Federal funding for the Ozaukee County highway network, which leaves $50,000 for the Highway Department. The CSAP would perform a safety analysis of our highways, and create a prioritized list of improvements including state or federal-aid options. ANALYSIS: Obtaining the CSAP would create future opportunities to seek Federal or State grant funding for continued safety improvements throughout Ozaukee County, and would clarify priority locations for safety concerns. Recommended Action: Authorize the Public Works Director to approve USDOT’s SS4A Agreement. Attachments: Page 63 of 91 1.
