c) Acceptance of Donation of AED for PWSB Splash Zone from the Fredonia

for being a huge part of the village.
6. Items
for Action and/or Discussion
a) Motion to Approve Resolution 2025-021: Pertaining to the
Appointment
of Election Inspectors for the 2026-2027 Election Cycle
made by Trustee Eippert.
Seconded by Trustee Syring.
T
rustee Van Roo asked how the nominees were vetted. Clerk Johnson
explained the qualifications for being an election inspector included
residence
in the county, the ability to read and write English, and being
over 18 years of age. President Pro-Tem Abegglen recognized the names
on the list as having served many terms and had no concerns about the
nominees.
Passed by 4-0-2 voice vote, President Lenz and Trustee Franck
abstaining.
Pr
esident Pro-Tem Abegglen passed control of the meeting back to President Lenz.
b) Introduction to Ordinance 2025-05: Pertaining to Intoxicating Beverages.
Clerk Johnson shared there had been a significant overhaul to alcohol
permitting legislation in 2023 and the final provisions of Act 73 begin to be
implemented in January 2026. The requested ordinance update is largely
housekeeping, eliminating specific language in the local ordinance and
instead adopting state statute directly. The updated ordinance
contemplates no-sale event venue permits and above-quota licenses.
c) Introduction to Ordinance 2025-06: Pertaining to Carrying Weapons.
Marshal Leet said Trustee Van Roo brought concerns about the Village’s
existing weapons ordinance. Trustee Van Roo said the current ordinance
is more restrictive than state statute. Marshal Leet explained that the
proposed change is also a housekeeping update and removes specific
language, instead adopting state statute directly. Marshal Leet gave
examples of how the local code is more restrictive than state statute,
which allows local privately-owned businesses to decide if they will allow
weapons on their property or not. He recommended the village have a
weapons ordinance on the books so that local law enforcement has the
flexibility to write a ticket for a minor weapons violation rather than
escalate immediately to state violations. Trustee Syring requested an
example of a “minor” weapons violation. Marshal Leet said an example of
a minor violation could be if a person with a conceal-carry license went to
a bar after work that restricted weapons and he unknowingly carried his
weapon into the bar.
If the Marshal’s Office is called and the responding
of
ficer felt like the circumstances were appropriate, the deputy could
confiscate the weapon and advise the person to pick up the weapon and
local
citation at the Marshal’s Office the next day, instead of pursuing
more serious state violations. He also stated that if nothing was done by
l
aw enforcement in that circumstance and something should happen later
in the night, that could open the village up to liability. Marshal Leet
explained that the local definition of dangerous weapons was outdated
an
d he would like to rely on the state to define dangerous weapons.
d) Di
scussion and Possible Action on Addendum to TID #3 Developer’s
Agreement: Mirror Image.
Motion to Approve Addendum to TID #3 Developer’s Agreement:
Mirror Image made by Trustee Franck.
Seconded by Trustee Abegglen.
Administrator Jenkins reminded the board that each property in TID #3
had a developer’s agreement that binds the developer to minimum
development values. Administrator Jenkins shared that both Mirror Image
and Greatland Electric have been delayed in breaking ground in time to
meet their contractual obligations. They must therefore make a payment in
lieu of taxes so that the village can continue to be on target to generate
the tax increment necessary to make the TID whole. Greatland has site
plans already approved by the Planning Commission and just had trouble
lining up a contractor before winter, and Mirror Image is waiting on a large
sale to go through to spur their development. He is confident both
developers will break ground in spring of 2026. The village doesn’t lose
anything because the developers still pay the tax increment needed.
Passed by 6-0 voice vote.
e) Discussion and Possible Action on Addendum to TID #3 Developer’s
Agreement: Greatland Electric.
Motion to Approve Addendum to TID #3 Developer’s Agreement:
Greatland Electric made by Trustee Syring.
Seconded by Trustee Franck.
Passed by 6-0 voice vote.
7. Correspondence: None
8. Items for Future Consideration: President Lenz said, in consideration of the
upcoming holidays, the next board meetings would be on January 8 and January
22. Planning Commission will be scheduled on January 5. Administrator Jenkins
invited the Board to the annual Christmas Party and distributed a donation form
for 2026 events.
9. Motion to Adjourn made by Trustee Abegglen.
Seconded by Trustee Franck.
Passed by 6-0 voice vote.

Wisconsin Statute or Local Ordinance: Chapter 125 and Section 339
Background Analysis:
There was a significant overhaul to the alcohol beverage statute passed by the legislature in 2023.
The Village has been issuing licenses under Act 73 since the 2024 licensing cycle. The last
provisions of the law come into effect January 1, 2026.
Staff Comments: This is largely housekeeping, most of the changes remove specific language
from our existing ordinance and point directly to the statute that governs the process. As
adjustments are made to statute, our ordinances will now not need to be updated in conjunction
with the state.
We inc
lude language regarding full-service retail outlets like breweries and refineries that now have
an opportunity to open premises in the Village through a permitting process approved at the state
level. This will ensure the board continues to have an opportunity to exercise some oversite
regarding the premises and operators.
We’ve also added language regarding operators permits, no-sale event venue permits, and above-
quota licenses; all new provisions under Act 73. There are no changes for our existing license
holders or our approval processes.
Administrator’s Recommendation: Approve
Action Requested: Motion to Approve Ordinance 2025-05 Pertaining to Intoxicating Beverages.

Wisconsin Statute or Local Ordinance: Ordinance § 282-2
Background Analysis: Earlier in the year, Trustee Van Roo approached the village with concerns
about the village ordinance regarding carrying of weapons.
Staff Comments: I looked at our ordinances with consideration of the trustee’s concerns, and I
found an ordinance that appeared to be a patchwork that did not appear to have been updated to
reflect changes in state law, resulting in an ordinance that was both not consistent with state law
and in some cases with other village ordinances. Upon review of the ordinances with the village
attorney, I concur with his opinion that the most consistent way to ensure that they match is to tie
them to the state ordinances with an “adopted by” ordinance.
Administrator’s Recommendation: Approve
Action Requested: That Section 282-2 of the Village of Fredonia Code of Ordinances is hereby
repealed and recreated as outlined in Attorney Woodward’s opinion.

chipper would replace the current Vermeer BC 1500 that is 19 years old, which we would be trading

Staff Comments: The new Morbark gas chipper will replace the Vermeer diesel chipper that is 19
years old. The new chipper would have updated safety features, smaller frame size, no DEF, and
clutch less technology. Staff feel by going to gas, this unit would be easier to maintain and if
anything needs maintenance, we have local mechanic shops that can repair the machine down the
road.

Item Description: “Fredonia First” New Construction Incentive Program
Report Prepared By: Admin Jenkins
Report Date: 12-29-25 Meeting Date: 1-8-26
Strategic Priority?
o Smart Residential, Industrial, or Commercial Growth
o Responsible Fiscal Priority
o Supports Public Safety and Infrastructure
o Encourages Open Communication and Collaboration
o Strong Sense of Community
Fiscal Summary: Loss of Inspection Fees/Gain of Net New Construction & Taxes
Budget Line Item: 100-00-44300-000-000
Wisconsin Statute or Local Ordinance: N/A
Background Analysis: Throughout 2025, per my Administrator goals, our team reviewed and
researched a variety of housing incentive programs that counties and municipalities have
implemented to encourage residential growth within their communities. We focused specifically on
programs that incentivize new construction. As development costs continue to rise, any advantage
we can offer to promote Fredonia as a place to settle and invest is beneficial. Examples of these
incentives include down payment assistance grants or loans, the waiving of permit fees, and the
easing of zoning restrictions. After evaluating programs of varying scope and scale, we concluded
that reducing the burden of municipal permitting costs - while lowering the overall cost to build or
purchase a home - was an effective and administratively manageable approach. From this effort,
the “Fredonia First” program was created.
Staff Comments: The “Fredonia First” New Construction Incentive Program provides an incentive
of up to $5,000 through the waiver of residential building permit fees. To qualify for this waiver, the
Village must receive confirmation that either (a) the lot sale price or (b) the new construction costs
are reduced by the full $5,000, ensuring that the financial benefit is passed directly to the
homeowner. Upon verification, the Village would deduct the approved amount from the total
residential building permit fees issued by the Building Inspector, effectively absorbing the cost.
By example, an average 1,500 sq ft residential permit fee would total ~$6,500 = $5,000 in Village
Impact Fees (Sewer/Water Hookup, Park Fee, etc) and $1,500 in Inspection Fees (through JP
Inspections).
In return, the Village benefits from increased net new residential construction and the addition of
long-term taxpayers in perpetuity. This concept has been discussed with local home builders, as
well as the current developer, Hillcrest, both of whom view the program as a positive and
competitive step for the community. Similar incentive programs have been successfully

implemented in other municipalities, including the Village of Jackson, the Village of Richfield, and
Sheboygan County.
If agreeable, I recommend implementing this effective January 1, 2026. This timing aligns with the
current momentum of residential development on the north end of the Village and allows sufficient
time to finalize program details and administrative procedures.
Some questions to consider:
• Is $5k the suitable amount?
• Do we limit ourselves to just single-family? What about condos/duplex?
• Could an incentive multiply for the right builder within a developer’s agreement?
• Do we expand to commercial lots to encourage new construction?
Administrator’s Recommendation: Approve
