b) Discussion and Possible Action on the Possible Rezoning of Parcel
Numbers 090500506002 and 090500505000.
Agent: Hannah Cholip
Address: 415 Fredonia Ave
Administrator Jenkins told the Commission that the attorney sent a letter
with clear action steps and a firm deadline for response. Ms. Cholip gave
a response before the deadline indicating that she had created an LLC to
start a medical business. Administrator Jenkins reminded the Commission
that the primary use of the building had to be commercial. The next step
would be to schedule an inspection of the property with the Village
Marshal to determine if the primary use of the property is related to Ms.
Cholip’s business and the secondary use is as a residence. He asked the
Commission to consider what happens when the inspection reveals that
primary use of the building is still residential – further legal action. He
asked if the commissioners still had an appetite to rezone the property,
and if so, be firmer with Ms. Cholip regarding her obligations in the
process. He referred to a current zoning map: there are two small
residential parcels near Ms. Cholip’s property, however most of the
surrounding land is commercial. The Village’s Comprehensive Plan
envisioned the entire area downtown as commercial zoning.
Commissioner Franck asked if it is appropriate to rezone just the parcel
with the house on it. Administrator Jenkins said there would have to be a
change to the language in the RS-3 district, unless Ms. Cholip changed
her lot lines to become compliant with the RS-3 lot size requirements. He
reminded the Commission that they had brainstormed moving the lot lines
during their initial meeting with the resident. Administrator Jenkins said he
explained to Ms. Cholip that a CSM isn’t required, she could move the
lines through a quit-claim deed, but there has been no meaningful action
on her part. Commissioner Barta is in favor of rezoning because the
structure on the property is clearly a house. Commissioner Winker
considered the history of the commercial use of the property. He
sympathized with Ms. Cholip but was concerned about losing limited
commercial property. Commissioner Weiland said a developer could
come in and open a coffee shop with an apartment on top. Chairman Lenz
stated the Village and seller were explicit about the expectation of
commercial use, both in the real estate listing and the special assessment
letter provided to the title company before Ms. Cholip purchased the
property. Administrator Jenkins said the realtor and mortgage company let
her down as well, and the Village doesn’t want to discourage any first-time
home buyers. He explained that if the next inspection revealed the primary
use of the property as residential, the Village attorney would issue an
injunction, and fines and penalties could be issued. He reminded the
Commission that they did not have the authority to bring legal action; the
matter would be referred to the Village Board. Commissioner Franck
stated Ms. Cholip has been given plenty of time to respond meaningfully,
and she doesn’t want to lose commercial property. Commissioner
Redmond said being ignorant of the law doesn’t mean immunity from
penalties and the Commission has gone above and beyond to help
resolve the issue. Commissioners Winker, Weiland, Buvid, Franck and
Redmond were against rezoning. Administrator Jenkins said staff would
conduct a second inspection. If it reveals that Ms. Cholip is truly running a
business as the primary use of the property then the issue has been
resolved. If it reveals the property has primarily her residence, the matter
will continue to be investigated.

415 Fredonia Avenue Recommendation
1-5-2026
Commissioners,
As you are aware, the Village conducted a second inspection of the commercially zoned
property located at 415 Fredonia Avenue, where Ms. Hannah Cholip has been residing in
violation of zoning regulations since her purchase of the property in late 2024. This inspection
was conducted following Ms. Cholip’s statement that she had converted the property so that its
primary use was a business, with residential use being secondary.
The inspection revealed that only one room of the home – approximately 10% of the total
square footage – had been converted into a home office space (see attached report).
Below is a snippet from our Zoning Ordinance pertaining to this matter:
§ 575-27 B-1 Central Business District.
A. Purpose. The B-1 Business District is intended to provide for the orderly continuation
of the traditional central business district in the Village of Fredonia. The business
activities are of a general nature and are characterized by on-street parking.
…
Permitted accessory uses.
(1) Accessory garages for storage of vehicles used in conjunction with the operation of
the business or for occupants of the premises. (See building code for specific limitations.)
(2) Off-street parking and loading areas accessory to the principal use.
(3) Residential quarters for the owners, proprietor, commercial tenant, employee, or
caretaker located in the same building as the business.
(4) Essential services.
(5) Solar collectors, hidden from ground view.
(6) Dish antennas, ground- and building-mounted, limited to 24 inches in diameter and
not visible from the street.
USE, ACCESSORY: A subordinate building or use which is located on the same lot on
which the principal building or use is situated and which is reasonably necessary and
incidental to the conduct of the primary use of such building or main use, when permitted
by district regulations.
At this time, staff is requesting that the Plan Commission:
A) Deny Ms. Cholip’s Requested Zoning Change of Parcels 090500506002 &
090500505000
B) Provide a recommendation to Staff and the Village Board on whether to pursue legal
action against Ms. Cholip for improper use of the property, should the Commission
determine that the findings of the second inspection warrant such action.
Attached is the full documentation related to this matter. Should you have any questions
in advance of the meeting, please feel free to reach out.
Thank you,
Christophe E. Jenkins

NARRATIVE
I was asked by the Fredonia City Administrator to accompany him on a
compliance check at 415 Fredonia Avenue. This is related to the question of
whether the building was being used for its zoned purpose.
Upon arrival, we met with the owner, Hannah Cholip, who allowed us entrance.
By outward appearance, the building appeared to be a small, single-family two-
story residence. My understanding in speaking with the village administrator
is that the property is zoned as commercial use.
Inside the building appeared to be small, with two small rooms and an attached
small kitchen. I had attended a similar inspection of this location several
months ago, and many of the personal effects that were present then had been
removed. The lower level was fairly impersonal, and the Western room of the
lower level was taken up by what Cholip described as her home office.
A full-sized file cabinet was against one of the walls. There was a table set
up as a desk, containing a computer which Cholip advised she used in her home
health nurse business. Her work at the location being a combination of
scheduling her home nurse visits, communications with her clients and other
vendors related to that, and processing the "paperwork" the business involved.
There did not appear to be any personal items or possessions in that room
indicated other than her claimed usage. The room appeared to be the one in
which her home business was focused. I estimated the room to be approximately
12 by 12 feet.
The easter of the two rooms contained furniture and items consistent with what
I would describe as a living room, however, again a number of the personal
possessions that were in that room at the last visit were no longer there.

To Whom It May Concern,
My name is Hannah Cholip and I am applying to get my property, 415 Fredonia Ave,
Fredonia, Wisconsin 53021, rezoned. I am a nurse at a hospital in the area. I bought this
property in August and it was my first home buying experience. I closed on the property and a
short time later attempted to apply to have chickens on my property. I was informed by the
village clerk that my property was zoned as commercial therefore I could not have chickens. It
was not clear to me that I was purchasing a commercial property. I have never owned a
business and never intended to start a business. There is a house and a garage on the property
and I am currently using it as a residence. It not only benefits me personally to have it rezoned
but the community as well. A property benefits a community more as residential because it
provides a stable housing base for residents, which can lead to increased community
engagement, improved local services, a stronger sense of belonging, and a more vibrant local
economy by supporting nearby businesses and contributing to the tax base. I want to contribute
to the community and make this my home. This property does not resemble a business, it
resembles a home, therefore it would be better used as a residential property than a commercial
property.
Thank your for your consideration,
Hannah Cholip
