Public Comment – None. 3. Plan Commission Reports and Recommendations 3.1 PUBLIC HEARING, Discussion and Possible Action Regarding a Conditional Use Permit for Mental Health America of Wisconsin to Operate a Peer-Run Respite Home for Veterans Located at N2 W27318 Lyles Drive (PWC 0984-029) Mayor Bierce stated the applicant withdrew their request for the Conditional Use Permit; therefore, no Public Hearing would be held this evening. 4. Licensing 4.1 Discussion and Possible Action to Discuss the Bartender Application of Dakota Vitrano Ms. Tarczewski stated she received a request for a bartender license. She said the background check revealed several violations, and she said she was not comfortable issuing the license so the applicant was asked to attend this meeting to discuss it with the Council. Ms. Vitrano addressed the Council and was very open about her violations and the steps she has taken since those incidents to make sure she makes better life choices. Craig Werner, owner of Mug Shotz, was also present offering his support to Ms. Vitrano. Ms. Brown stated that Mr. Werner is visible at his bar and believes he will keep an eye on her. She said she believed in second chances. A motion was made and seconded (P. Vetterkind, B. Dziwukski) to approve the Bartender License for Dakota Vitrano. Motion Passed: 5-For, 0-Against. 5. Engineering Page 3 of 37 Common Council Meeting Minutes ~ August 3, 2026 Page 2 of 4 5.1 Discussion and Possible Action Regarding Cedar Gables LLC Letter of Credit Reduction from $394,828.46 to $232,975.16 (a Reduction of $161,853.30). Ms. Wagner stated Cedar Gables has installed the water and sewer infrastructure and has requested a reduction of $196,593.30 to their letter of credit, but she could only justify a reduction of $161,853.30 based on some change orders. She said she was also releasing the final paving on Watertown Road and North Avenue based on the work they completed last winter. Ms. Wagner stated based on the Letter of Credit and Bonds in place, there is a remaining balance of $799,506.46 which she finds sufficient. A motion was made and seconded (C. Brown, J. Wamser) to reduce the Letter of Credit down to $232,975.16. Motion Passed: 5-For, 0-Against. 5.2 Discussion and Possible Action Regarding The Glen at Springdale A. Approve the Developer's Agreement. B. Establish the Financial Guarantee in the Amount of $5,756,194.08. Ms. Wagner stated this development is on the Esser Farm and is in the middle of Springdale Estates. It will consist of mixed single-family and two- and four-unit condominium buildings. The developer will be installing sanitary sewer, watermain, storm sewer, ponds, and roads. She said everything would be dedicated to the City except for the ponds which we will be given maintenance rights over them. She said it will be platted in two phases, but the infrastructure will be built in one phase. She stated the Developer’s Agreement has been tweaked to address the different phases and adds timeframes. Ms. Wagner stated the Developer will come back to Council to adopt another Letter of Credit when they are ready to begin Phase 2. Ms. Wagner stated there is a discrepancy in the City’s municipal code. Under the Land Division Section, it states the developer is required to have a 120 percent financial guarantee for the development and within another section they are only required to have 110 percent. She stated the City Attorney states it should be 110 percent, which equates to $5,276,511.24. Ms. Wagner stated the Developer is asking for a review of some of the items. He doesn’t feel some items should require financial guarantee since they are considered private. He asked for the final financial guarantee to be contingent upon review by the City Attorney and staff to see if items can be removed. Mayor Bierce voiced his concern over the open items and suggested tabling this discussion until September to give the parties time to work through the outstanding concerns. Ms. Wagner stated the sale of the property is contingent on the approval of the Developer’s Agreement. Dan Scardino from Point Real Estate was present for this item. He stated he would be administering the project and delaying the Developer’s Agreement would be catastrophic to the development. He said the approval of the Letter of Credit was less important. Page 4 of 37 Common Council Meeting Minutes ~ August 3, 2026 Page 3 of 4 Ms. Wagner asked if approving the Developer’s Agreement contingent upon final review would be sufficient. She said then they could revisit the Letter of Credit. Mr. Scardino stated that was fine. Ms. Brown stated both the Plan Commission and the Common Council agreed to the development. She said the Development Agreement is not an issue. She said the City needs to know what is in the Letter of Credit to be sure we are adequately covered in case there are any complications. She requested that be taken up at a future Council meeting to be “on the record”. Mr. Klein asked Legal Counsel if the Developer’s Agreement and Letter of Credit could be approved tonight as proposed and revise the Letter of Credit later if that becomes necessary. Attorney Riffle stated what he heard was approve the Developer’s Agreement contingent upon final approval of the DPW Director and City Attorney and set the Letter of Credit not to exceed the recommended amount. He said Mr. Scardino was asking if the City could require the leveling of the site as part of the Letter of Credit. Attorney Riffle stated they would look at it. Mr. Scardino stated they will make sure the City of Pewaukee gets the financial guarantee they require. Attorney Riffle stated the developer would not be able to start construction until the City receives the Letter of Credit. Ms. Brown stated she had concerns if the Letter of Credit was reduced. Mayor Bierce stated the Council could approve it “as is” and if the developer wants to reduced it, it would have to come back to Council. A motion was made and seconded (B. Dziwukski, P. Vetterkind) to approve the Developer’s Agreement and establish the financial guarantee in the amount of $5,276,511.24 contingent upon the final review by the City Attorney and the Director of Public Works and allow the Developer to come back to Council if they want the Letter of Credit reduced. Motion Passed: 5-For, 0-Against. 5.3 Discussion and Possible Action Regarding Resolution 26-08-22 Partial Release of Developer Agreement Between Pewaukee and Ridgeview Corporate Park Phase II Ms. Wagner stated one of the property owners along Busse Road asked for release of the old Developer’s Agreement. She said this resolution releases all but four sections of the Developer’s Agreement; which are VI General Indemnity, VII Agreement for the Benefit of Purchaser, XIII Further Drainage Provision, and XV Assignments. She stated these items should stay intact in case something comes up in the future. A motion was made and seconded (P. Vetterkind, R. Reinbold) to approve Resolution 26-08-22. Motion Passed: 5-For, 0-Against. 6. New Business 6.1 Discussion and Possible Action to Appoint Members to the Residency Board Page 5 of 37 Common Council Meeting Minutes ~ August 3, 2026 Page 4 of 4 Mayor Bierce presented the names of Patrick Mitchell (3-year term), Daniel Coats (1- year term), Aaron Busche (5-year term) and Kyle Haferman (Alternate) to serve on the Residency Board. Council members asked what this Committee does. Mayor Bierce stated if someone goes on the sex offender list and wanted to come back to live in the City of Pewaukee to live and were denied, this gives the ability to appeal to our decision. Ms. Brown asked if the Committee recommendations were all people who lived in the City. Mayor Bierce stated they were. He added the Council could thank Lieutenant Moonen for finding these people who understand the system and the process. A motion was made and seconded (B. Dziwulski, P. Vetterkind) to approve the appointments to the Residency Board, according to the recommendations of the Mayor. Motion Passed: 5-For, 0-Against. 6.2 Discussion and Possible Action Regarding the Accounts Payable Listing Submitted August 3, 2026 A motion was made and seconded (J. Wamser, P. Vetterkind) to approve the accounts payable listing. Motion Passed: 5-For, 0-Against. 7. Public Comment – None. 8. Adjournment A motion was made and seconded (P. Vetterkind, B. Bierce, Aldermen C. Brown, B. Dziwulski, R. Reinbold, S. Tabbert, P. Vetterkind, and J. Wamser. Also In Attendance: Attorney S. Riffle, Administrator S. Klein, DPW Director M. Wagner, City Planner & Community Development Director N. Fuchs and L&A Consultant D. Hickey. 1. Call to Order and Pledge of Allegiance Mayor Bierce called the meeting to order at 6:30 p.m. and asked everyone to stand for the Pledge of Allegiance. 2. Public Comment - None. 3. New Business 3.1 Discussion Regarding the Financial Report dated January 1, 2026 to June 30, 2026 Ms. Brown stated the Council used to get budget reports in the past and thought it would be appropriate to bring it back. She asked the consultants from Lauterbach & Amen (L&A) to prepare something for discussion. She said it was very detailed and the Council would need to determine what they would like to see in the future. The Council stated they would prefer a quick summary. Ms. Brown noted that the interest earned is considerably lower than what was budgeted for. Mr. Hickey stated the interest rate is lower. Mr. Klein added that the Ehlers interest on investments is reflected as unrealized gains. Mr. Hickey stated the interest earned was aggressively budgeted, and the expenditures were very conservative. Ms. Brown voiced her concern that there was such a discrepancy. Ms. Brown noted there we were significant overages in Police Services, Parks and Recreation, Attorney fees, and Building Services overtime. Mr. Hickey stated he would research and get back to Ms. Brown. Mr. Tabbert asked if the Department Heads forecast expenditures on a quarterly basis. Mr. Klein stated the department heads watch their budgets. Mr. Tabbert stated it would be helpful to him to see explanations on the items that have large variances. Ms. Brown asked why the equipment budgets for Parks and the Fire Department are massively over budget. Mr. Hickey stated the Fire Department paid for two fire trucks that were in last year’s budget. Mr. Reinbold stated the Council needs to put a percentage or a dollar amount on what they consider “out-of-whack”. He suggested the Finance Committee should discuss it. Page 7 of 37 Common Council Meeting Minutes ~ September 17, 2026 Page 2 of 3 It was determined that the Finance Committee would look at the report and decide what it would ultimately look like moving forward and create a synopsis page. 3.2 Discussion and Update Regarding the Proposed Amtrak Hiawatha Station in the City of Pewaukee Mr. Fuchs stated unfortunately there were drainage and flooding concerns at the Marjean Lane site and Amtrack didn’t think it was a feasible site any longer. No action was taken on this item. 3.3 Discussion and Possible Action to Appoint Patrick O'Hern to the Public Works Committee Mayor Bierce presented Mr. O’Hern’s resume and recommended his appointment to serve on the Public Works Committee. A motion was made and seconded (C. Brown, B. Dziwulski) to appoint Patrick O’Hern to the Public Works Committee. Motion Passed: 6-For, 0-Against. 3.4 Discussion and Possible Action to Approve the Accounts Payable Listing Dated August 17, 2026 A motion was made and seconded (P. Vetterkind, C. Brown) to approve the accounts payable listing. Motion Passed: 6-For, 0-Against. 3.5 Discussion and Possible Action Regarding Resolution 26-08-23 Authorizing Amendments to the 2022 Borrowing to Reallocate Excess Borrowed Funds. Ms. Wagner stated this resolution was to take road projects that were underspent and allocate them to projects that were overspent. She said a few projects were added to ensure the City spends down all the borrowing proceeds. A motion was made and seconded (C. Brown, J. Wamser) to approve Resolution 26-08-23 authorizing amendments to the 2022 borrowing and reallocating excess borrowed funds. Motion Passed: 6-For, 0-Against. 4. Storm Water Utility 4.1 Discussion and Possible Action Regarding a Budget Amendment of $127,000 for the Storm Water Utility Capital Expenditure Account. Ms. Wagner stated that Mr. Hickey brought this to her attention. She said the 2026 Storm Water Utility capital budget was established at $200,000 but it should have been $380,000 based on the anticipated expenditures submitted to Council during the budget process. She said that error was overlooked. She said there is a short fall of $180,000. She said the rubber tire excavator came in under budget in the amount of $327,000 leaving a shortfall of $127,000. Ms. Wagner stated there was a trade-in value of $50,000 which will go back into the equipment fund. She stated the actual shortfall is $77,000 but since the money has to be spent, she is requesting the $127,000 budget amendment. Page 8 of 37 Common Council Meeting Minutes ~ September 17, 2026 Page 3 of 3 Ms. Brown asked if we didn’t put away enough money for it. Mr. Hickey stated it was budgeted for appropriately but the expenditures for 2026 did not indicate we would be spending that amount this year. A motion was made and seconded (C. Brown, R. Reinbold) to amend the Storm Water Utility Capital Expenditure Account in the amount of $127,000. Motion Passed: 6-For, 0-Against. 5. Public Comment – None. 6. [Wagner] Sub Item Agenda Language: Background Provided By: Magdelene Wagner Background: As part of the 2026 budget, Green Road Rehabilitation project was approved. The Green Road Rehabilitation project includes installing a microsurfacing on the existing pavement. Microsurfacing is a fast-curing, polymer-modified cold-mix asphalt treatment used to preserve existing pavements and extend road life. This treatment consists of a thin surface course of polymer-modified cold mix asphalt, crushed aggregate, mineral filler, water and chemical additives. This treatment cures rapidly, allowing roads to reopen to vehicles in less than one hour, depending on weather conditions. The project will extend the life of the pavement along Green Road. Preparation ahead of this treatment has occurred by City Staff including mastic sealing of the joints/cracks in the existing pavement. In addition, some inlet repairs by City Staff will be made prior to this work being completed. This strategy of pavement preservation will continue to be proposed on our newer roadways to extend their life before major repairs are needed. As this is classified as a maintenance treatment, it does not qualify for our road assessment policy and therefore this cost will not be assessed to the adjacent property owners. We received 1 bid for this work from Fahrner Asphalt Sealers LLC in the amount of $140,107.50. We have completed work with Fahrner Asphalt Sealers and recommend approval of this project. Fiscal Impact: The 2026 budget for this project was $250,000. Their adequate funds to complete this project. Recommended Motion: Council award the 2026 Green Road Rehabilitation to the Lowest Qualified Bidder, Fahrner Asphalt Sealers, LLC, in the Amount of $140,107.50. The City allowed the creation of the 2nd lot without removal of the existing parking lot to meet the ordinances with a posting of the letter of credit to cover the cost of the removals if they were not completed within 1 year of the date of the agreement. RM was given an extension due to construction that occurred on the adjacent parcel which was using this portion of the parking lot. RM has recently sold their building and the lot to one owner.
