Unbound Spirits, as a qualified producer, is requesting to sell their intoxicating liquor at the German Christmas Market. The sales will be conducted from a hut in the vendor area on Village Green 11/27 – 11/29/26. Approval from the community’s governing body is required by the State for the type of alcohol they will be offering for sale. The license itself will be granted and issued by the Wisconsin Division of Alcohol Beverages. ADDITIONAL ANALYSIS During the review of the applications last year, Protection & Welfare stated that future applications would be placed under the Consent Agenda. The legislation provides that the governing body, with good reason, can impose any requirements or restrictions in connection with these approvals. FINANCIAL IMPACT N/A RECOMMENDATION There were no issues with the sales from previous years. Staff recommends approval under the Consent Agenda. SUGGESTED COMMON COUNCIL MOTION Consent Agenda Item. Eight additional water features remain to be installed to complete the park. The Rotary Club has fundraised a majority of the project and has concluded their fundraising efforts. As part of the 2027 budget development process, $75,000 was initially included in the Capital Plan for purchasing the remaining water features. However, current funding is available in the 2026 budget under play equipment, originally allocated for playground equipment for the Hawthorne Ridge and Lake Ridge Park areas. Redirecting these funds would provide the necessary funding to purchase the remaining splashpad components. This purchase allows for expanded recreational use by residents in the surrounding neighborhoods and would complete the water feature portion of the project. ADDITIONAL ANALYSIS N/A FINANCIAL IMPACT Currently there is $88,057 left in the playground equipment project fund. Then cost for the remaining features with additional freight charges is 73,918.60. RECOMMENDATION City Staff recommend approval to use $73,918.60 for purchase of Splashpad Equipment SUGGESTED MOTION Motion to approve Resolution 26-R3402. 80 RESOLUTION NO. 26-R3402 RESOLUTION FOR PURCHASE OF REMAINING ROOSEVELT PARK SPLASH PAD STRUCTURES WHEREAS, the City of Oconomowoc Parks and Recreation Department has budgeted $90,000 for Playground Replacement; and WHEREAS, Commercial Recreation Specialists have provided the quote for purchase of the remainder of splashpad equipment to complete project; and WHEREAS, Parks and Recreation Department staff recommend the proposal of Commercial Recreation Specialists for purchase of remaining splashpad features. Oconomowoc, based on population, is a third-class city.  Special Election: A Special Election can be ordered to fill a seat, often coinciding with other scheduled elections, appointing a temporary successor until the Special Election.  Application Process: Interested candidates would submit a resume or letter of interest to the City Clerk.  Eligibility: Candidates must be qualified electors, residents of the specific district that has the vacancy, at least 18 years old and not convicted of a felony (unless pardoned).  Alternative: The Council may, at its discretion, choose to leave a position vacant until a regularly scheduled election. The Council does have the option of adding this vacant aldermanic seat onto the already scheduled Special Election to fill the Waukesha County Executive vacancy set for December 15, 2026. The Special Election would need to be ordered by Council at the October 6th Council meeting and interested candidates would have until October 20th to circulate nomination papers. Alternatively, Council could choose a stand-alone Special Election to occur before the Spring Election or add the vacant seat to the regularly scheduled Spring Election. A Special Election cannot be added to the November General Election. Should Council choose to appoint a temporary successor until a Special Election is held, applications could be accepted through September 30, 2026 for interviews and selection at the next Council meeting. SUGGESTED MOTION Motion to approve the selected process for filling Aldermanic District 1 vacancy. 82 Y:\Insurance\Claims Filed\Liability\2026 6.5 Gertz Fall - Oz Plaza\Background Memo for Denial of Claim by Gertz.docx 1 MEMORANDUM FINANCE DEPARTMENT Date: September 15, 2026 To: Mayor and Common Council From: Steve Hatton, Finance Director Re: Consider/act on Resolution 26-R3392 for Denial of Claim by V Gertz RELATES TO THE STRATEGIC PLAN Strategic Goal-NA BACKGROUND On June 5, 2026, we received a “Notice of Claim” submitted by Vickie L Gertz of 1281 Lily Road regarding an alleged fall that occurred on or about June 5, 2026 in Oz Plaza near the Glinda statue. DATED: September 15, 2026 CITY OF OCONOMOWOC By: Gina Kozlic, City Clerk C: Attorney Stan Riffle 85 1 MEMORANDUM FINANCE Date: September 15, 2026 To: Mayor and City Council From: Steve Hatton, Director of Finance / Administrative Services Re: Consider/act on Resolution 26-R3403 Authorizing Exception to Levy Limits for Western Lakes Fire District Charges for 2027 Services RELATES TO THE STRATEGIC PLAN Strategic Goal- V. Enhance the Effectiveness of City Government (E) Maintain/Improve the City’s Financial Sustainability BACKGROUND The City of Oconomowoc joined Western Lakes Fire District (WLFD) in 2017 to provide Fire and EMS services. Along with the City, WLFD serves six other municipalities. State Levy Limit provisions allow municipalities served by a joint fire department to increase their property tax levy to accommodate increased costs charged by the joint fire department. For this levy adjustment to be utilized, two conditions must be met: 1. The increase in total costs assessed by the joint fire department must be less than CPI + 2.0% (as of August 31st) and 2. All municipalities served by the joint fire department must adopt a resolution to exceed the levy limit. At its meeting on September 9th, Western Lakes Fire Department adopted its 2027 budget. The budget increased funding assessed to communities served by 4.49%, which is expected to qualify for the CPI+2% requirement. ADDITIONAL ANALYSIS A summary of total WLFD assessments of its municipalities, and the City of Oconomowoc’s portion are summarized below: Western Lakes Municipal Contributions Operating Capital Total Operating Capital Total $ Chg % Chg Levy - Owners 10,790,692 1,903,512 12,694,204 11,287,063 1,977,518 13,264,581 570,377 4.49% Contracted 265,416 - 265,416 292,854 - 292,854 27,438 10.34% 11,056,108 1,903,512 12,959,620 11,579,917 1,977,518 13,557,435 597,815 4.61% 2026 2027 86 2 Each owner/member’s share of the WLFD Operating costs are determined by four factors: a. Percent of total district calls for service (50% Weighting) b. Percent of total district population (15% Weighting) c. Percent of total district Improvement Value (20% Weighting) d. Percent of total district Land Value (15% Weighting) The City’s share of total district costs increased for 2027 vs. 2026 due to increases in Call Volume, Population and Improvement Value. FINANCIAL IMPACT The Levy Limit adjustment allows the City to absorb the $333,307 in increased costs for Fire/EMS services without cannibalizing permissible levy funding for all other City services. This $333,307 increase represents 1.49% of the preliminary 2027 General Fund Budget total of $22,390,045. This resolution authorizes the City to adjust its 2026 levy by up to $333,307. The full proposed 2027 budget and anticipated levy will be presented at the September 15th Common Council meeting and subsequent budget workshop on October 1st. RECOMMENDATION Staff recommend approval of resolution 26-R3403 authorizing an exemption to our levy limits for Western Lakes Fire District Charges for 2027 services. Stats., which statute provides that levy limits otherwise applicable do not apply to the amount that a city may levy in that year to pay for charges assessed by a joint fire department to the extent that the amount levied to pay for such charges would cause the city to exceed the limits imposed under Section 66.0602, Wis. Stats.; and WHEREAS, the exception to the levy limit applies only if the total charges assessed by the joint fire department for the current year increase, relative to the total charges assessed for the previous year, by a percentage that is less than or equal to the percentage change in the US Consumer Price Index for all urban customers, US city average, as determined by the US Department of Labor for the 12 months ending on August 31 of the year of the levy, plus 2%; and WHEREAS, the exception to levy limits under Act 484 further only applies if the governing body of each city, village and town served by the Western Lakes Fire District adopts a resolution in favor of exceeding such levy limit as may be applicable; NOW THEREFORE, BE IT RESOLVED that the City of Oconomowoc hereby authorizes a levy for charges assessed by the joint fire department which exceeds the limit as described and imposed by Section 66.0602, Wis. Stats., but only to the extent as authorized by Section 66.0602(3)(h)2a, Wis. Stats., and BE IT FURTHER RESOLVED that this resolution shall not be construed as authorizing Western Lakes Fire District to adopt any particular budget, but rather that the Act 484 budget formula shall be deemed a maximum limit on any budget increase which is duly adopted under all applicable procedures and requirements of the Western Lakes Intermunicipal Agreement. PASSED AND ADOPTED by the City Council of the City of Oconomowoc, this _15th_ day of September___ 2026. ____________________________ Mayor Matt Rosek ______________________________ Gina Kozlik, City Clerk 88 MEMORANDUM CITY ADMINISTRATOR Date: September 15, 2026 To: Mayor and Common Council From: Mark Frye, City Administrator Re: Consider/act on Resolution 26-R3404 to Cancel the City’s Contract with Flock Safety BACKGROUND The City initially contracted for the use of four Flock cameras for the two-year term of 2024-2025. The agreement was extended for a second two-year term of 2026-2027 along with the addition of two cameras, a total of six. As per our agreement, “Flock deletes all footage on a rolling 30-day basis for data obtained from the cameras”. When the purchase of Flock cameras was approved, it was contingent upon the City having a strong policy in place for the use of the data. Our Police Department has adhered to the policy and there are no incidents of improper use. Recently there have been comments and statements from other law enforcement agencies regarding Flock’s data retention exceeding the number of days stated in the agreement. ADDITIONAL ANALYSIS As with all forms of technology, the public can be skeptical of what the data is used for. As a community, we must ensure the public’s confidence in our ability to protect any information stays strong. As such, we must consider the public benefits provided by Flock versus the public’s confidence in the safety and use of the information they gather. Our agreement can be cancelled if either party gives the other party notice of non-renewal at least 30 days prior to the end of the then current term. FINANCIAL IMPACT If the contract is cancelled, we may be responsible for a payment of $18,000 in 2027, the final year of our agreement. These funds are currently included in our draft operations budget if needed. RECOMMENDATION Resolution 26-R3404 is titled to cancel the City’s contract with Flock Safety. The Common Council must weigh the pros and cons associated with the Flock camera technology with the concerns from the residents. SUGGESTED MOTION Motion to approve Resolution 26-R3404 should the Common Council decide to terminate the contract.
