BOARD ROOM, MUNICIPAL BUILDING, 210 COTTONWOOD AVE.
Village President Pfannerstill called the meeting to order at 6:34 PM.
Present: Trustee deBoer, Trustee Truttschel, Trustee Wallschlager, Trustee Conner (via
Zoom), Trustee Hallquist, Village President Pfannerstill
Excused: Trustee Pfeiffer
Others present: Police Chief Misko, DPW Director Jenson, Recreation Director Blonien, Fire
Chief Jambretz, Clerk Policello, Village Manager Bailey
Chief Jambretz Proclamation
Village President Pfannerstill introduced Fire Chief David Jambretz and offered remarks
honoring his decades of distinguished service to the Village of Hartland. President
Pfannerstill read a formal proclamation into the record recognizing Chief Jambretz's career.
The Board and public were reminded that an open house and final call for Chief Jambretz
will be held at the Fire Station on Thursday from 11:00 AM to 1:00 PM.
Administer Oath to Officer Peter Otte
Village President Pfannerstill administered the Oath of Office to new Police Officer Peter
Otte. Chief Misko noted that Officer Otte would begin the Police Recruit Academy at WCTC
on Wednesday, July 29, 2026, where he will complete 720 hours of law enforcement
training. Upon completion, Officer Otte will return to the department for several weeks of field
training, with an anticipated solo patrol start date of approximately March 2027. He
highlighted the strong turnout from the police department, noting officers present included
Officer Wandaogo, Officer Bell, Officer Nelson, Officer Gurgul, Officer Martins, Lieutenant
Souther, Deputy Chief DeBarge, Detective Shea, and PFC Commissioner Trevor deBoer. A
brief reception was announced to follow in the library.
Public Comments
A resident, Sophia Bierman, addressed the Board regarding ongoing concerns with
neighboring rental properties in her area of Hartland. She described a pattern of escalating
incidents she attributed to a tenant at a property she stated is owned by Trompler/Neosho
Hydraulics. Village President Pfannerstill acknowledged her concerns and clarified that state
law prohibits the Village from regulating to whom landlords may rent their property. He
directed Ms. Bierman to work directly with Chief Misko regarding the Village's nuisance
property provisions, and indicated he would also follow up with the Chief regarding the
possibility of additional tools on the books. Chief Misko invited Ms. Bierman to call the Police
Department at her convenience to discuss the matter further.
A second public comment was received from Thomas Sarwinka and Sandra Sarwinka.
Thomas is a Scout working on a civics-related badge project concerning the Village's e-bike
and e-scooter ordinance. The Board welcomed them and encouraged the Scout to reach out
to the Village President or Police Chief for a follow-up interview.

1. Approval of Minutes – July 13, 2026
Motion to approve the minutes of July 13, 2026, was made by Trustee Hallquist and
Trustee Truttschel seconded. The motion carried unanimously.
2. Items Related to Vouchers
2a. Consideration of Contractor's Application for Payment No. 4 in the Amount of $22,673.36
to Close Out the Progress Drive Sanitary Relay Project
DPW Director Jenson presented the final payment application for the Progress Drive
Sanitary Relay Project, to be paid to Globe Contractors, Inc. He explained the project
involved upsizing a sanitary pipe from 8 to 12 inches along Progress Drive to accommodate
the quarry development, and that all work had been inspected, televised, and signed off on
by Ruekert & Mielke and Village staff. Village Manager Bailey confirmed the project is
funded through and reimbursed by the Tax Increment Finance (TIF) district.
Motion to approve Payment Application No. 4 in the amount of $22,673.36 to Globe
Contractors, Inc. for the Progress Drive Sanitary Relay Project was made by Trustee
Truttschel and seconded by Trustee Hallquist. The motion carried unanimously.
2b. Consideration of Vouchers for Payment in the Amount of $166,188.48
Trustee Wallschlager inquired about a $308 charge under economic development listed as a
"Garland sample." Village Manager Bailey clarified this represented the garland to be used
for the downtown nights event and that the cost is drawn from Business Improvement District
(BID) funds, not village funds. Trustee Hallquist inquired about the categorization of
unlabeled accounts on the first page of the voucher list and was informed those represent
fund balance or revenue accounts, such as deposit refunds or grant offsets. Trustee
Hallquist also raised a question regarding nearly $15,000 in legal services from von Briesen.
Village Manager Bailey summarized the various matters for which legal counsel was
engaged, including easement work, the lead pipe ordinance, the hotel project, collective
bargaining agreements, the Eagle Pass subdivision, and the sale of the municipal building,
among others. Village Manager Bailey offered to have the detailed billing forwarded to the
Board on a monthly basis going forward.
Motion to approve vouchers for payment in the amount of $166,188.48 was made by
Trustee Wallschlager and seconded by Trustee Truttschel. The motion carried
unanimously.
3. Review and Consideration of Items Related to Licenses and Permits
a. Consideration of Operator/Bartender Licenses
i. Jessica M. Cabaniss
ii. William T. James
Chief Misko presented both license applications for Board review. Regarding Jessica M.
Cabaniss, Chief Misko noted that her application did not disclose prior OWI offenses — a
first offense in 2003 and a subsequent first offense in 2016 — which were discovered
through a background check. The Clerk had the applicant come in to correct her application
to include those items. Chief Misko stated both offenses would typically be approved under
the department's standard protocol.
Regarding William T. James, Chief Misko noted there were no new violations since the last
license was issued two years ago. The background file contains older entries from between
1982 and 1986 involving domestic-related charges, a 2001 disorderly conduct with use of a
3
dangerous weapon, and an OWI from the 1990s — all of which had previously been
reviewed and approved by the Board.
Chief Misko clarified that both applications would ordinarily be approved under standard
protocol, but because offenses exist in their backgrounds, the matter must come before the
Board.
Motion to approve Operator/Bartender Licenses for Jessica M. Cabaniss and William T.
James was made by Trustee Truttschel and seconded by Trustee Hallquist. The motion
carried unanimously.
4. Discussion and Consideration of revising the Village Board's Policy regarding
operator/bartender applicants that have a drug or alcohol offense on their background check
Village Manager Bailey opened a discussion on whether the Board's existing policy — which
uses conviction date as the starting point for the 12-month waiting period before an applicant
with a drug or alcohol offense may be approved — should be changed to use arrest date
instead. He noted the issue had been raised by trustees who felt the current approach
produced inequitable results, as two individuals arrested on the same date for the same
offense could reach their 12-month eligibility at different times depending on how quickly
their respective court proceedings concluded.
Trustee Wallschlager argued in favor of retaining the conviction date, as a person is innocent
until proven guilty and an arrest alone should not be grounds for denial. Trustee deBoer and
Village President Pfannerstill countered that using the arrest date, applied only after a
conviction is confirmed, would create a fairer standard, particularly in cases where prolonged
court timelines extend a person's ineligibility well beyond 12 months from the underlying
incident.
Chief Misko offered context, noting that the conviction-date approach was likely established
because an offense is not technically confirmed until conviction. He acknowledged that the
COVID-19 pandemic significantly slowed court proceedings and exacerbated the inequity.
Chief Misko noted that because this is a policy — not a statute — the Board may still
exercise discretion even where policy would suggest denial, and suggested the Board could
alternatively remove the prescriptive language on the applications entirely and simply bring
all cases with relevant history before the Board for individual review.
After substantive discussion, the Board agreed that the notice language on the operator
license application — which stated that the Board's policy has been to deny applications until
at least 12 months have elapsed since the conviction date — should be removed. The
Board's direction was that all new applicants with drug or alcohol offenses on their record
would be brought before the Board for case-by-case consideration, and that the Clerk may
revise or remove the policy language accordingly, with the option to bring updated language
back to the Board at a future meeting.
Motion to remove the policy statement from the operator/bartender license application
was made by Village President Pfannerstill and seconded by Trustee Truttschel. The
motion carried unanimously.
5. Discussion and consideration of amending sec. 6-37(c) of the Municipal Code to allow the
clerk to issue operator/bartender licenses for renewal applications that have no offenses
after the last license was approved by the Village board
Village Clerk Policello explained that since a 2024 ordinance provision was enacted allowing
the clerk to issue renewal operator licenses where there are no new arrests or convictions
for alcohol or drug related offenses, she has nonetheless continued to bring many renewal
applications before the Board because the applicants had older offenses that predate their
last approved license. She requested the Board's consideration of expanding the clerk's
4
authority to issue renewals in those cases as well, so long as there are no new offenses
since the Board last approved the license.
Board members expressed support for the concept, with Village President Pfannerstill noting
that background checks would still be conducted on all renewals, and that the clerk should
include language to that effect in any revision. Chief Misko confirmed that background check
requirements and related restrictions are already addressed in the municipal code and state
statute. The Board voted to direct the clerk to draft updated ordinance language for a first
reading at the next Board meeting.
Motion to direct the Clerk to amend sec. 6-37(c) of the Municipal Code to allow the
Clerk to issue operator/bartender renewal licenses where no new offenses have
occurred since the Board's last approval, with updated language to be brought forward
at the next meeting, was made by Trustee Truttschel and seconded by Trustee
Wallschlager. The motion carried unanimously.
6. Consideration of Third Reading of Bill for an Ordinance No. 06/22/2026 "An Ordinance
Creating sec. 86-77 of the Village of Hartland Code of Ordinances Regulating Lead Water
Service Line Replacement"
DPW Director Jenson presented the ordinance on third reading, explaining that it provides
the Village with local regulatory authority to carry out lead service line replacement work as
required by state and federal mandates. The ordinance was drafted by the Village's legal
counsel and reviewed by village staff.
Motion to approve Ordinance No. 06/22/2026, creating sec. 86-77 of the Village of
Hartland Code of Ordinances Regulating Lead Water Service Line Replacement, was
made by Trustee Truttschel and seconded by Trustee Hallquist. The motion carried
unanimously.
7. Consideration of Third Reading of Bill for an Ordinance No. 06/22/2026-A "Ordinance
Related to the Regulation of Electric Bicycles and Electric Scooters"
Chief Misko, Village Manager Bailey, and the Village Clerk noted that a final review of the
ordinance was completed prior to the meeting and that the ordinance was in good standing
for adoption. Chief Misko provided a section-by-section overview of the ordinance for the
record.
The definitions in sec. 82-74 mirror Wisconsin state statute classifications, including Class 1
(pedal assist, up to 20 mph), Class 2 (throttle, up to 20 mph), and Class 3 (pedal assist, up
to 28 mph) electric bicycles, as well as electric scooters. Chief Misko noted that because the
Village may only be more restrictive — not broader — than state statute, certain definitions,
including motor wattage limits, cannot be altered locally.
The applicability section (sec. 82-76) was discussed, noting that existing bicycle operating
regulations under Village Code sections 80-268 and 80-269 — covering lighting
requirements, riding conduct, traffic signal compliance, and roadway behavior — are
incorporated by reference and apply equally to e-bike operation.
Under operation regulations (sec. 82-77), Chief Misko highlighted a key added provision
requiring every person operating an electric bicycle or electric scooter to exercise due care
so as not to unreasonably impede traffic or pose an unreasonable risk of harm to
pedestrians or other traffic. This language was specifically designed to address scenarios
such as riders operating at high speeds through crowded public events. Attorney DeLamor
recommended a minor language correction on line 73, changing the reference from "CHAP.
346" to lowercase "ch. 346 (2025-2026)," which was incorporated into the motion.
Class-specific restrictions were addressed, with the Board confirming that Class 1, 2, and 3
electric bicycles would have no restrictions as to where they may operate within the village
5
— consistent with how standard bicycles are treated. Electric scooters would be restricted
from roadways with speed limits of 35 mph or more, which affects only a limited number of
Village roads such as portions of STH 83 and Hartbrook Drive. Village President Pfannerstill
raised a question about a provision prohibiting short-term commercial rental of electric
scooters; Chief Misko explained the restriction is aimed at large-scale commercial operators
such as Bird or Lime, which can result in scooters being scattered throughout a community
without adequate oversight. The provision was retained as written.
Sec. 82-77 designates a prohibited areas mechanism by which the Board may, by resolution
at a single meeting, erect signage to restrict e-bike or e-scooter operation in a specific
location should safety concerns arise, without requiring a three-reading ordinance process. A
citizen email questioning whether a single-meeting resolution provided adequate opportunity
for public input was acknowledged; Chief Misko noted the resolution process still constitutes
an official Board action and provides a reasonable balance between efficiency and
community involvement.
Regarding penalties, Chief Misko recommended aligning the citation deposit amount with the
existing bicycle ordinance fine structure. The corresponding fine of $102.50 — consistent
with the $25 deposit and updated court costs — was incorporated into the motion for
placement in Appendix B of the Village's fee schedule.
Village President Pfannerstill noted that the Village has received inquiries from neighboring
municipalities regarding the ordinance and expressed his intent to share the final version
with them and to notify the local press of its adoption.
Motion to adopt Ordinance No. 06/22/2026-A, An Ordinance Related to the Regulation
of Electric Bicycles and Electric Scooters, including the language correction to sec. 82-
77(a) at line 73 of the ordinance, and directing that a fine of $102.50 be placed in
Appendix B of the Village fee schedule corresponding to violations of this ordinance,
was made by Village President Pfannerstill and seconded by Trustee Truttschel. The
motion carried unanimously.
8. Discussion and Consideration to Award the 2026 Crack Sealing Program Contract to
Thunder Road, LLC for the sum of $47,577.00
DPW Director Jenson presented the annual crack sealing contract, noting that the work
would be coordinated alongside the previously approved GSB-88 sealcoating program. The
targeted areas include Park Court, Overlook Trail, and select other locations identified
through the Village's pavement condition (PASER) rating system. Director Jenson noted that
crack sealing is most effective on roads between approximately five and seven years old,
and represents a cost-effective preventative maintenance measure. The contract was
publicly bid with only one responsive bidder received. Village Manager Bailey noted that staff
is exploring the possibility of moving to two-year contracts for smaller programs such as this
one in order to attract more competitive bidding.
Motion to award the 2026 Crack Sealing Program Contract to Thunder Road, LLC for
the sum of $47,577.00 was made by Trustee DeBoer and seconded by Trustee
Hallquist. The motion carried unanimously.
9. Discussion and Consideration to Award the Sewer Joint Grouting Contract to Visu Sewer
not to Exceed $50,000.00
DPW Director Jenson explained that televising completed on the Village's sanitary
interceptor over the previous two years identified several joints requiring grouting due to
infiltration issues. The interceptor is the main sanitary artery running through the Village,
conveying flows toward the Delafield connection. Because Visu-Sewer conducted the
original televising and holds all the relevant data and records, Director Jenson explained that
engaging a different contractor would require re-televising the entire interceptor, negating the
work already completed. Accordingly, staff recommends awarding the contract directly to
6
Visu-Sewer. Director Jenson described the grouting process as involving a pressurized plug
device inserted into the main, which seals off a joint section and injects grout in all directions
to stop infiltration. The contract is structured on a time-and-materials basis not to exceed the
$50,000 budgeted amount, given the difficulty of access in certain areas.
Motion to approve the Sewer Joint Grouting Contract to Visu-Sewer not to exceed
$50,000.00 was made by Trustee Truttschel and seconded by Trustee Wallschlager.
The motion carried unanimously.
10. Discussion and Consideration to Adjust Non-Resident Ambulance Charges
Fire Chief Jambretz presented a correction to the ambulance fee schedule adopted in May,
noting that the non-resident rates had inadvertently been omitted from that action. He
explained that under the current rates, non-residents are being charged less than residents,
which is contrary to the Village's intent. The recommended adjusted non-resident rates,
developed in coordination with the Village's ambulance billing company and based on
guidance from the state, are as follows: ALS-1 from $1,700.00 to $1,973.41, and ALS-2 from
$2,000.00 to $2,811.52. Chief Jambretz noted these rates are expected to be approved at
the state level and that the billing company recommends getting ahead of that process. ALS-
1 generally covers calls such as asthma or diabetic emergencies, while ALS-2 covers more
intensive interventions including CPR, advanced medications, and major trauma.
Motion to approve the adjustment of non-resident ambulance charges to $1,973.41 for
ALS-1 and $2,811.52 for ALS-2 was made by Trustee Hallquist and seconded Trustee
deBoer. The motion carried unanimously.
11. Announcements
Fire Chief Jambretz reported that while he had been away for two weeks attending EAA
AirVenture, the department continued operations without issue. He noted that engines and
ladders are fully operational and that the department is awaiting manufacturer pricing to
complete repairs to the damaged ambulance. He asked that those present keep the
communities of Neenah, Menasha, and Appleton in their thoughts following a tornado that
struck the area and destroyed a fire station in the Neenah-Menasha area earlier that day. He
reiterated that his final day and public open house would be Thursday, July 30, 2026, at the
Fire Station from 11:00 AM to 1:00 PM, with the final radio call at 1:00 PM.
Police Chief Misko reported that architect interviews for the new fire station were held earlier
that day, attended by Village Manager Bailey, President Pfannerstill, Trustee Wallschlager,
Trustee Truttschel, and the Clerk. He noted that several strong candidates were interviewed
and that the selection process would continue with the Village's consultant. He announced
that Judge Sonderhouse will be appointed Interim Judge at Lake Country Municipal Court at
9:00 AM the following morning, with a special election to follow to fill the role permanently.
Chief Misko also announced that National Night Out will be held on August 6, 2026, from
6:00 PM to 8:00 PM at Nixon Park. He congratulated Officer Otte and welcomed him to the
department, and offered congratulations to Chief Jambretz on behalf of the police
department.
DPW Director Jenson reported that the surface course was completed at Four Winds the
prior week, and that a final punch list review is anticipated to close out that project. Utility
installation at Eagle Pass subdivision is progressing. He noted DPW staff attended the
Recreation Summer Camp Touch-a-Truck event at Hartland South Elementary the prior
week. Kids' Day is scheduled for Wednesday at Nixon Park from 9:00 AM to 1:00 PM.
Director Jenson also announced a planned road closure on North Avenue between
Hartbrook Drive and Greenbrier on Wednesday from 7:00 AM to 3:00 PM for the
replacement of two butterfly valves on the 12-inch water main, in preparation for upcoming
county paving of that section.
Recreation Director Blonien noted that the final week of summer camp is underway, and that
T-Ball will conclude the following Friday with an awards banquet at Nixon Park.
7
Village President Pfannerstill noted that in-person absentee voting for the August 11, 2026
election begins the following day, with hours of 7:30 AM to 4:30 PM Tuesday through Friday
of the current week, and Monday through Friday of the following week, with extended hours
to 5:00 PM on the final Friday. He echoed the call for prayers for those affected by the
Neenah/Menasha tornadoes and noted he has personal connections to the Neenah area.
President Pfannerstill also addressed, for the record and in the interest of transparency, that
he has received calls from representatives of neighboring municipalities over the past year
and a half suggesting that Hartland consider merging with Lake Country Fire and Rescue.
He stated unequivocally that he has no intention of merging the Hartland Fire Department
with any other department. He noted that he agreed to meet with Lake Country Fire and
Rescue out of respect for a neighboring organization, and would extend the same courtesy
to Western Lakes Fire District, but emphasized that his intention is to continue on the path
toward a full-time Hartland Fire Department. He said that any consideration of a merger
would be brought directly before the Board and the community before any action were taken.
President Pfannerstill also recognized DPW staff for their ongoing care of the Village's
hanging flower baskets throughout the summer heat.
12. May Convene into a Closed Session pursuant to Wis. Stat. §19.85(1)(g), for the purpose
of conferring with legal counsel for the governmental body who is rendering oral or written
advice concerning strategy to be adopted by the body with respect to litigation in which it is
or is likely to become involved with respect to two parcels located at 550 Hartbrook Drive in
conjunction with current negotiations regarding procurement terms pursuant to an eminent
domain proceeding previously authorized by the Village Board of Trustees.
Motion to convene into closed session pursuant to Wis. Stat. §19.85(1)(g) for the
purpose of conferring with legal counsel rendering advice concerning strategy with
respect to litigation in which the Village is or is likely to become involved regarding two
parcels located at 550 Hartbrook Drive, in conjunction with current negotiations
regarding procurement terms pursuant to an eminent domain proceeding previously
authorized by the Village Board of Trustees, was made by Village President Pfannerstill
and seconded by Trustee Conner. A roll call vote was taken: All trustees were in favor,
motion carried 6-0, and the Board convened into closed session.
13. Reconvene in Open Session to Discuss, Consider and Take Possible Action, if
Necessary, with Respect to any Matter Taken Up in the Closed Session
President Pfannerstill made a motion to reconvene in open session; motion seconded by
Trustee Hallquist, all were in favor, motion carried. The Board reconvened in open session.
No action was taken on any matter arising from the closed session.
14. Adjournment
Motion to adjourn was made by Trustee Truttschel and seconded by Trustee deBoer.
The motion carried unanimously. The meeting was adjourned.
Respectfully submitted,
Sandee Policello
