City of Middleton
CAPITAL ASSET POLICY
I. Introduction
The purpose of this policy is to set forth the guidelines for the physical and reporting control of
the City of Middleton’s capital assets including a uniform method of accountability, inventory
control, meeting financial reporting needs, and accounting for depreciation and the
interdepartmental use of assets.
II. Definitions
Capital Assets
Capital Assets are tangible and intangible assets which are intended to be held or used for the
long‐term. Classifications of capital assets include land, buildings, improvements, infrastructure,
construction‐in‐progress, and machinery and equipment. For the City of Middleton, capital
assets are those with a minimum cost of $5,000 for general capital assets and $25,000 for
general infrastructure assets and a useful life of more than one year unless specifically excluded
by policy.
Depreciation
Depreciation is a systematic allocation of the exhaustible cost of capital assets according to their
estimated useful lives. The City of Middleton uses a straight‐line method of depreciating capital
assets.
Infrastructure
Infrastructure refers to public property or public domain capital assets that are normally
stationary in nature. Examples include roads, bridges, streets, sidewalks, water and sewer
systems, and drainage systems.
Intangible Assets
Intangible Assets are nonfinancial capital assets that have no physical substance, but whose
value comes from long‐term rights and advantages that it offers to its owner. Intangible Assets
should only be recognized if the asset is separable from the City (capable of being sold,
transferred, or licensed, etc.) or the asset arises from contractual or other legal rights.
Proprietary Funds
Proprietary Funds are used to account for activities that receive significant support from fees
and charges. There are two types of Proprietary Funds: Enterprise Funds and Internal Service
Funds.
Tangible Assets
Tangible Assets are capital assets that have a physical form including general capital assets and
infrastructure assets.
Revised 12/1/2020
2
Useful Life
Useful Life is the estimated average life over which a depreciable asset is expected to provide
service.
III. Capitalization and Depreciation Policy
Capitalization Policy
General capital assets such as buildings, machinery, and equipment will be capitalized if they
have a cost of $5,000 or greater and an expected useful life of one year or more. The acquisition
cost of the asset will include the actual purchase price plus any other additional charges
incurred to put the asset into service. Donated assets will be valued at the estimated fair market
value of the asset. Infrastructure assets for governmental funds will be capitalized if they have a
cost of $25,000 or greater. Proprietary fund infrastructure assets will be capitalized if they have a
cost of $5,000 or greater. Land assets will be capitalized regardless of the cost.
Capital asset improvements that exceed the capitalization threshold should be capitalized if:
• The estimated life of the asset is extended by more than 25% or
• The cost results in an increase in the capacity of the asset or significantly changes the
character of the asset.
Assets costing below the capitalization thresholds and not meeting the definition for a capital
asset improvement will be expensed in the respective fiscal year of purchase. The City may
choose to capitalize group assets where individual items are below the capitalization threshold,
but the total value of the group represents a material value of the City’s assets. An example is
the City’s collection of library materials.
Depreciation Policy
Depreciation is the allocation of the total acquisition cost of a capital asset over its estimated
useful life. The City of Middleton calculates depreciation on a straight‐line basis by subtracting
the salvage value from the acquisition cost and dividing the result by the estimated useful life of
the asset. Depreciation is calculated and reported annually for financial reporting purposes.
Land, certain land improvements, construction‐in‐progress, and similar assets are not
depreciated. Land is considered to have an unlimited useful life and its salvage value is unlikely
to be less than its acquisition cost.
The estimated useful lives of depreciable assets will be assigned by the Finance Department
based on the period over which services are expected to be provided by the asset. Estimated
useful lives will generally follow these guidelines unless more specific information is provided by
the custodial department of the asset or as required by the Public Service Commission.

IV. Inventory and Asset Control
Inventory of City Property
Each department shall maintain a list of capital assets for which they have custody. These lists
shall contain sufficient information to allow for easy identification of assets and shall be used to
ensure that all City property is in the possession of the City and properly accounted for.
Annually, Custodial departments are responsible for notifying the Finance Department of the
acquisition or disposal of capital assets as well as damage to capital assets that impairs their
ability to be used by the City. The Finance Department shall annually coordinate with custodial
departments to ensure that capital assets are appropriately listed on the City’s insurance
records and annual financial statements.
V. Interdepartmental Use and Transfer of Assets
Interdepartmental Uses of Assets
Assets may be temporarily shared between departments or funds by mutual agreement of the
departments. The sharing of capital assets between governmental funds does not require an
accounting entry and may be done without recording a financial transaction. Shared use of
capital assets between a governmental fund and a proprietary fund may require a financial
transaction if the Finance Department determines that the value of the use of the equipment is
material to the funds.
Interdepartmental Transfers
Transfers of non‐land assets between departments or funds are allowed by mutual agreement
of the departments. If the asset meets the definition of a capital asset, the department
transferring the asset must notify the Finance Department. This notification shall include a
description of the transfer of responsibility for the maintenance and accountability for the
asset being transferred to the department receiving the asset.
Asset transfers between two governmental funds do not require an accounting entry and may
be done without recording a financial transaction. Asset transfers between governmental and
proprietary funds require the approval of the City Administrator and will be recorded as a
financial transaction based on the current value of the asset as determined by the Finance
Director.
Revised 12/1/2020
4
Transfers of land assets between funds require the approval of the City Council. At the time of
the transfer there shall be a consideration of the value of the land asset being transferred and
the appropriate compensation that shall be provided to the fund transferring the asset from
the receiving fund.
VI. Disposal of Assets
Reference to City Ordinance
City Ordinance 2.24 establishes the procedure for the disposal of surplus and abandoned
property. The provisions of this policy are intended to provide additional clarification on those
procedures.
Lost or Stolen Assets
A lost or stolen capital asset must be reported to the Police Department, City Administrator,
and the Finance Director as soon as it is discovered to be missing. A police report shall be
filed. If the asset is not recovered, the Finance Department shall remove the asset from the
City’s capital asset records and make the appropriate accounting entry.
Surplus Assets Determination
Before a capital asset is declared surplus, the custodial department must first determine if the
asset was originally purchased with grant funds. If it is determined that grant funds were used,
the department must refer to the grant agreement and follow the prescribed procedures for
disposal.
When a department decides to surplus a capital asset, the Department Head or designee shall
notify the City Administrator or designee and the Finance Director. The City Administrator or
designee will evaluate the surplus property for potential use in another area or determine that
there is no other City use for the property.
Disposal of Surplus Assets
For capital assets that have been declared surplus the following disposal methods shall be
considered in priority order:
1. Interdepartmental Transfer
2. Public Auction
3. Trade‐In
4. If none of the above methods are possible, follow the process for disposal of
functionally obsolete items
For items that are being sold, a public auction should be used with sale to the highest bidder.
A Class 3 public notice of the auction is required except when the probable sale value of the
assets do not justify the cost of the notice in which case notice may be provided through the
City’s website. Priority may be given to trading‐in capital assets rather than using a public
auction process in situations where continuous asset use is required.
Revised 12/1/2020
5
City employees shall not be given preferential access to the sale of surplus City property
compared to the general public. Sale proceeds shall be returned to the specific fund from
which the surplus property was disposed. The sale of land assets shall require the approval of
the Common Council.
Surplus property may be sold, donated, or transferred to another governmental entity
without going through the public auction process with the prior approval of the Finance
Committee.
Destroyed, Damaged, or Functionally Obsolete Assets
Capital assets which have been destroyed, damaged beyond repair, or become functionally
obsolete, must be reported to the City Administrator and the Finance Director. The custodial
department shall proceed to handle the disposal of the assets through the following methods
which are listed in priority order subject to the approval of the City Administrator:
1. Donate to a local non‐profit or charitable organization
2. Sale for scrap value
3. Recycle
4. Landfill

2.24 - PROCEDURE TO DISPOSE OF SURPLUS AND ABANDONED PROPERTY
(1) Unless specifically excepted from the procedure set forth herein, all personal property
belonging to the City that is no longer needed for City use and all personal property which
appears to be lost or abandoned, discovered by Police Officers or transferred to the Police
Department by citizens, shall be disposed of as follows:
(a)
(b)
The City Administrator shall, at least annually, require the Department heads to report
regarding any surplus or abandoned personal property in their possession. Upon receiving
such report, the Administrator shall cause the property to be sold at public sale to the
highest bidder. Notice of the time and place of the sale of such property shall be published
as a Class 3 notice in the official newspaper, and shall also be given in such manner by the
Administrator as will attract probable purchasers in the most favorable market. The
Administrator need not offer any property for sale if it appears the probable costs
surrounding the sale exceed the value of the property. The Administrator is also
authorized to have items appraised by qualified persons when deemed necessary.
The City Administrator shall make and preserve an accurate record of any such sale,
including an inventory of all property sold thereunder, the date and consideration for said
sale, and the name and address of the purchaser of the property. Each such record shall
be kept as a public record for at least two (2) years from the date of sale. The proceeds of
such sale shall be paid to the City Treasury after deducting the necessary expenses of
keeping the property and conducting the sale.
(2) The following classes of property shall not be subject to Subsection (1) of this Section:
(a)
(b)
(c)
(d)
All unclaimed and abandoned property subject to a specific method of disposal pursuant
to Wis. Stat. §§ 66.0139(3) or (5) or 968.20 shall be disposed of as set forth in said statutes.
All unclaimed and abandoned property not otherwise referred to herein which is usable
for City operations shall, having remained unclaimed in City possession for thirty (30) days,
be transferred to the City department able to use the property unless the property must
be processed pursuant to Wis. Stat. §§ 170.07-170.11.
All unclaimed money and other chattels shall be disposed of pursuant to Wis. Stat. §§
170.07-170.11.
All unclaimed and abandoned property which is subject to a currently pending
investigation by the Police Department for a criminal charge resulting therefrom shall be

exempt from the disposal procedures of this ordinance until the Police Department closes
its case file or the statute of limitations applicable to the charge expires, whichever first
occurs, unless a court of record issues an order pursuant to Wis. Stat. § 968.20 requiring
earlier release of the property.
(e) Property to be sold or otherwise transferred to another governmental entity, provided that
any such transfer receives the prior approval of the Finance Committee before the transfer
takes place.

Disposal. Disposal of surplus assets shall be prohibited, except as authorized in this division.
Notification and listing of surplus assets. Should a department replace an asset which may still
be of use to another city department, or which is anticipated to be sold; such asset should be
reported in writing to the finance director as surplus. Notification shall include a description of
the asset, including asset number, approximate value, location where the surplus item is to be
stored and date the asset is no longer in service. The finance director shall prepare a notice of
the surplus asset, and distribute to all departments.
Request for transfer of surplus item to active use. Should a surplus asset be of value to a city
department, department head should notify the finance director in writing. Notification shall
include a description of the asset, including asset number, location where the surplus item is
to be used and date the asset is put into service.
Trade-in exception. Should an asset be utilized as a trade-in to reduce the cost of a newly
purchased replacement item, department head should notify the finance director in writing.
Notification shall include a description of the asset, including asset number, trade-in
allowance, and date the asset is no longer in service.
Obsolescence or items for disposal. Should an asset that has been previously included on
either a departmental fixed asset inventory or the capitalized fixed asset inventory be deemed
of no value due to obsolescence, damage or disrepair, the department head should notify the
finance director in writing of the desire to dispose of such item. Notification shall be through
completion of a disposal of fixed asset form available from the finance director. Fixed assets
may not be disposed of until approved by the city administrator in writing.
Sale of assets. Should an asset be deemed of value, but not of use to the city, the city
administrator shall direct that a notice be posted to offer the item to the highest bidder via a
sealed bid process. The city retains the right to reject any or all bids.
Contents of notice. The notice shall contain a description of the asset, minimum bid if any, and
the date, time and location of the bid opening. Copies of the notification of asset sale shall be
provided to the mayor and common council.
Establishing minimum bid. If the value of the asset is estimated to be less than $5,000.00, the
city administrator shall set the minimum bid. If the value of the asset is estimated to be
greater than $5,000.00, the finance committee shall set the minimum bid. If the minimum bid

is greater than $10,000.00, notice shall also be placed in newspapers, magazines or other
media as deemed appropriate to obtain sufficient bid responses. The finance committee must
approve the sale of assets with a minimum bid value greater than $10,000.00.
(i) Surplus auction exception. If the asset is placed for sale through a bona fide surplus auction,
requirements in subsections 10-367(f) (sealed bid), (g) (bid notice) and (h) (minimum bid), may
be waived.

Waushara County Property Disposal Policy
The Waushara County Board has designated the Buildings and Grounds Committee
along with the Waushara County Administrator as overseers of all County property (See
County Board Bylaws). This policy is meant to provide guidance on the disposal of
property once a Department has determined that it no longer has use for such property.
This policy applies to all county owned property of Waushara County. Real Property
decisions will be made by the County Board as the need arises.
Vehicles
Vehicles no longer needed by a Department, that cannot be used by another County
Department shall be sold. The Department may sell through the auction site for
Wisconsin Surplus http://www.wisconsinsurplus.com/frame.htm or through such other
advertisement as authorized by the Buildings and Grounds Committee and/or
Administrator.
IT Equipment
As IT equipment is replaced on the normal schedule or due to special needs and
unexpected changes, the IT Coordinator shall inventory such used equipment and
determine if it can be used in another County Department. If the IT Coordinator
determines that such equipment cannot be used in another County Department, such
equipment shall be sold at the direction of the Buildings and Grounds Committee and/or
Administrator. All such funds received from IT sales shall be returned to the IT
depreciation account for future upgrades and IT needs.
All Other County Owned Property
Once a Department determines that is no longer in need of property, the Department
Head or designee will send an email to all other Departments in the County to determine
if another Department has use for such property for County business. If no
Department expresses a need for such property, the property shall be turned over to the
Buildings and Grounds Superintendent. The Department must complete an Inventory
Submittal Form at the time of turning over the property. The Buildings and Grounds
Department shall inventory all property turned over to it for possible disposal. On a
semi-annual, or as needed basis, the Buildings and Grounds Superintendent will
present the inventory of said property to the Buildings and Grounds Committee. The
Committee will review the list with the County Administrator and may direct the
Buildings and Grounds Superintendent or another person/department to do one of the
following with said property:
1. Sale: All equipment other than that redistributed as above shall be sold. Such
sales can be done through an auction site such as Wisconsin Surplus, public
posting such as the County website or other approved plan presented by a
department or the Buildings and Grounds Superintendent.
2. Donate: If property is unable to be sold or if a Department or the Buildings and
Grounds Superintendent is aware of another Waushara County municipality or
school district or other non-profit community based organization that may be able
to use the property to further benefit the citizens of Waushara County, the
Committee may authorize donation to such entity.
3. Disposal: Equipment unable to be redistributed, sold or donated may be
disposed of through any proper disposal or recycling facility. If there is a fee
associated with the discarded or recycled product, this cost will be paid through
the Buildings and Grounds Budget.
6. Wisconsin Sales Tax on Municipal Disposal Sales / Auctions
Source: Wisconsin Department of Revenue, Publication 209 — Sales and Use Tax for Wisconsin Counties and
Municipalities
Bottom line: The Village generally must collect and remit Wisconsin sales tax on items sold at a disposal
auction, unless a specific exemption applies. The Village does not itself pay the tax as seller — it collects
the tax from the buyer and remits it to the state.
Auction receipts are taxable by default
Publication 209 explicitly lists “Auction receipts” as a taxable sale by a governmental unit (subject to
the 5% state sales tax).
Using a licensed auctioneer shifts the compliance burden
If the municipality hires an auctioneer to clerk the auction, the auctioneer is responsible for collecting,
reporting, and remitting sales tax on taxable sales; the municipality's receipts from the auctioneer are
not themselves taxable. This is why many municipalities use services like Wisconsin Surplus Auctions.
Occasional Sale Exemption may apply for smaller/less frequent sales
A governmental unit's sales are exempt from sales tax if: (1) it is not “engaged in a trade or business”
— taxable sales/events do not occur on more than 75 days per calendar year AND total taxable sales
do not exceed $50,000 per calendar year; and (2) it does not hold, and is not required to hold, a
Wisconsin seller's permit.
Trade-ins reduce the taxable amount
If property is traded in as part of a purchase, only the difference between the purchase price and the
trade-in allowance is subject to tax.
County/city sales tax stacks on top of the state rate
Most Wisconsin counties, including Dane County, now impose a county sales tax (commonly 0.5%).
Village of Cross Plains sales would likely carry the state 5% plus the applicable Dane County rate, for
roughly 5.5% total on taxable disposal sales, unless exempt.
Real property (land) is a separate framework
Sales tax applies to tangible personal property, not real estate. Land/building disposals are governed
by separate state statutes (e.g., competitive bid or public sale requirements), not sales tax law.
Practical recommendation for the policy draft
Include a dedicated clause specifying who is responsible for sales tax collection at disposal sales (the
Village directly, or a contracted auctioneer), and reference the occasional-sale threshold so the Village
does not inadvertently trigger seller's-permit obligations for a periodic cleanup auction.
Source: https://www.revenue.wi.gov/DOR Publications/pb209.pdf (see Part 3.A.(1)(g) for auction receipts, Part 5 for the
occasional sale exemption)
Caveat: This is not legal or tax advice. Application of the occasional-sale exemption depends on the Village's specific sales
volume and permit status — confirm with Cross Plains' municipal attorney or the Wisconsin DOR before finalizing policy
language.
