Subject Matter: Resubmitted Marchstone Development Declaration of Covenants,

Meeting Date: Village Board – August 24, 2026
Referral History: Village Board – November 24, 2025, January 26, 2026
E

P
roject Background:
Co

F
iscal Impact:
Recommendation:
The Village Board approved the Marchstone Development Declaration of Covenants, Restrictions, and
Easements on January 26, 2026. The developer has submitted proposed revisions to the previously approved
Declaration based primarily on builder feedback and a desire to provide additional flexibility in residential design.
The attached redline compares the previously approved document with the proposed revisions.
Staff recommends the Village Board review the proposed revisions to the Marchstone Declaration of Covenants,
Restrictions, and Easements and consider approval.
N/A
The Declaration was previously reviewed by the Village Board in November 2025 and January 2026. Prior to the
January approval, the document was reviewed by Village staff, including the Village Attorney, Village Engineer,
and Village Planner.
T
he developer has now proposed a number of revisions, primarily to the architectural and design standards.
Changes include revisions to requirements related to building elevations, exterior materials and colors, building
trim, foundation exposure, windows, exterior doors, lighting, and other residential design standards. The
proposed revisions generally provide greater flexibility to the Architectural Control Committee when reviewing
individual home designs.
The proposed Declaration also includes various cleanup and organizational changes. A redline showing all
proposed changes is included in the packet.
As with the previously approved Declaration, property owners remain responsible for compliance with applicable
Village and Dane County requirements. The Declaration specifically provides that approval by the Architectural
Control Committee does not replace required Village or County approvals.

the Association are incorporated by reference. Among other matters, the articles and bylaws
restrict the voting rights of certain members, and obligate all members except for Declarant to
pay regular and special assessments to the Association for its operations. The members shall
have the rights and duties set forth in this Declaration, the articles of incorporation and bylaws of
the Association, all as amended from time to time, and as provided by applicable law. Any
authority of the Association and its members shall be subject to the authority given to the
Declarant and the ACC in this Declaration.
8.3 Management of the Association. The affairs of the Association shall be managed
by the Board. The Board shall be selected in the manner, and shall have the duties, powers and

Village Ordinances or the obligation of any Owner, the Declarant, or the Association to pay such
assessments pursuant to the requirements of those provisions.
8.6 Collection of Assessments. The Association shall levy and collect assessments as

GENERAL PROVISIONS
9.1 Term. This Declaration shall run with the land and shall be binding upon and
inure to the benefit of all persons having an interest in any of the Lots for a period of 30 years
after this Declaration is recorded, after which time this Declaration shall automatically stand
renewed for successive five year periods unless terminated as provided in Section 9.2.
9.2 Amendment.
While the Declarant owns any Lot, the Declarant by its sole act shall have
the right to terminate or amend this Declaration by an instrument signed by the Declarant
and recorded with the Dane County Register of Deeds.
After the Declarant ceases to own any Lot, the Owners, by the vote or
consent of Owners owning two- thirds or more of the Lots, shall have the right to amend
or terminate this Declaration by an instrument recorded with the Dane County Register of
Deeds. The instrument shall either be signed by the described number of Owners, or
shall contain a certification that the required number of the Owners approved the
amendment or termination at a meeting of the Association duly called and held.
9.3 Invalidation. Invalidation of any one of these covenants or any severable part of
any covenant by judgment or court order shall not affect any of the other covenants, which shall
remain in full force and effect.
9.4 Exculpation. The ACC shall not be liable for damages to any person submitting a
request for approval, or to any Owner, tenant, or mortgagee of any of the Lots or anyone else by
reason of any action, failure to act, approval, disapproval, or failure to approve or disapprove
with regard to such requests. The ACC’s review of plans does not include review for structural
53
s
oundness or compliance with any applicable building codes and practices. The ACC is not
representing that any home or site plan meets any state, federal, county, or local setback
requirements, statutes, building codes, or ordinances. The Owner of the Residential Lot and the
Owner’s builder shall have the sole responsibility to ensure compliance with all such
requirements. Neither the Declarant nor the ACC shall be liable for any such matters.
9.5 Enforcement Actions.
The Declarant, the Association, the ACC, and any Owner shall have the

P
roject Background:
Replacement of existing sewer main, water main, asphalt, curb and gutter. Park St.
still has the orignial underground utlities put in around 1959.
Recommendation:
Staff recommends moving forward with Park St reconstruction. The road pavement
and underground utility conditions makes Park St. a good condidate for a full
reconstruction project. Reducing the amount of I/I will help reduce cost at the sewer
plant.
The current clay sewer pipe is allowing water infiltration into the sewer causing I/I
numbers to rise at the sewer plant during wet periods. Replacing the sewer pipe will
help bring the I/I numbers down. The water main along this stretch has 20 recorded
breaks and two valves that are no longer operating correctly. The cost of each break
to repair varies, but on average cost around $5,000 for repair. Water
infiltration increase the flow at the sewer plant by 200,000-300,000 gallons per rain
day. This water mixes with the sewer water and still needs to be ran through the plant
at an estimated $2-5 per 1,000 gallons.

Electric bikes and electric scooters differ from traditional bicycles in speed, operation, and usage patterns.
Without clear guidelines, conflicts may occur between riders, pedestrians, and motorists, particularly on
shared-use paths, sidewalks, and roadways.
T
he Committee, assisted by the Parks and Recreation Department and Village Attorney, defined e-bikes
and e-scooters, including classifications based on speed and motor assistance. They clarified where each
device may operate and established consistent safety requirements, including helmet use, yielding to
pedestrians, maintaining safe speeds, and following applicable traffic rules. The regulations also align with
state law and regional best practices where possible to promote safe and predictable use for all.
Issues with traffic flow and safety.
Chapter 51.14 – Bicycles
Cost of signs
The Public Safety Committee recommends updating the Village’s existing bicycle ordinance to address the
growing use of electric bicycles (e-bikes) and electric scooters (e-scooters). These devices are increasingly
common in the community and are not clearly defined or regulated under the current ordinance, which
creates gaps in enforcement, safety expectations, and public understanding.

Carly,
We have a change order related to the future generator and docking station configuration that I need to make you aware
of.
The generator distribution solution for this project is somewhat atypical. As you know, the plan is that there will not be a
generator on Day 1; however, a future generator is anticipated as well as there are provisions for a docking station that
will allow for a portable generator to hooked up (both in the absence of the future generator and/or during required
maintenance of the future generator once it is installed). Obviously, it is important that set-up for the future permanent
generator be compatible with the Day 1 docking station.
The design addressed all of these elements, including physical space being allocated for future generator (at the
building's exterior) and a future automatic transfer switch (ATS) in main electrical room. During the shop
drawing/submittals process, a complication was discovered regarding the Day 1 docking station. Normally, the automatic
transfer switch (which in our case is planned for the future) provides the means to isolate the portable generator source
from the utility. This is required so that both sources cannot feed the service panels at the same time. Since the ATS is a
future item, we need a different means to isolate the sources.
The required change order modifies the docking station and service breaker with the necessary equipment to what is
explained above. The solution was identified prior to any equipment being ordered, so the presented cost is entirely for
the additional necessary components to make the system work.
When initial submitted by Brikl Bros., this cost was $47,997. Through our team's efforts, we were able to reduce that cost
to $29,145.
Please feel free to give me a call on Monday, or to email me over the weekend, if you have any questions. Unfortunately,
the timing of this is sensitive relative to the lead time of the equipment. We will need to give Brickl Bros. some type of
authorization at the earliest possible opportunity.
Sincerely,
Wold Architects and Engineers

The Technology Package for the new Village Hall and Police Department includes the audio-visual and
security systems necessary to support public meetings, staff operations, building security, and police
operations. The most recent project budget allocates $200,000 for technology-related improvements.
I
nitial bids were received in June and rejected by the Village Board. The project was subsequently rebid with
separate Audio-Visual and Security Packages. On July 27, 2026, the Village Board awarded the Audio-
Visual Package to Communications Engineering Company (CEC) for $134,264.91 and rejected the Security
Package bids, directing the project team to rebid that portion of the project.
T
he Security Package was rebid and three bids were publicly opened on August 20, 2026. Omni
Technologies, LLC submitted the low base bid of $157,223.00. Following review of the bids, Wold Architects
& Engineers recommends awarding the Security Package to Omni Technologies and does not recommend
awarding either alternate.
The Technology Package includes:
• Audio and presentation systems for the Community Room and Community Conference Room.
• Video conferencing capabilities in meeting and conference spaces.
• Public meeting microphones, speakers, and control systems.
• Audio systems supporting Police Department operations and training spaces.
• Electronic access control and security system components throughout the facility.
• A/V equipment racks, cabling, programming, and system integration throughout the building.
The procurement of the Technology Package was conducted in accordance with the Village's Purchasing
Policy. Bids were publicly advertised and received through a competitive sealed bidding process. Award of
the contract is subject to Village Board approval.
The most recent project budget allocates $200,000 for technology-related improvements. The Village Board
