TOWN OF VERONA
TO: Town Board of Supervisors DATE: July 1, 2026
FROM: W. Christopher Barnes, Public Works Director
SUBJECT: 2026 Road Maintenance Project
ACTION RECOMMENDED: The Town Board:
Award a contract change order to Payne and Dolan, Inc. for paving and chip sealing of the
northern section of White Crossing Road in the amount of $51,557.95
As part of the 2026 Capital Improvement Plan, eight roads were selected for improvements:
Spring Rose (south), Spring Rose (north of Highway G), Bobcat Lane, Stony Ridge Circle,
Boulder Hill Court, Rock Ridge Court, and Wesner Road. An additional road section, the
southern half of White Crossing Road, was added and bid as an alternative. The improvements
generally consist of asphalt wedging and leveling of poor or distressed areas, aggregate chip
seal, sign replacement, and restoration of disturbed shoulder areas.
Project bids were received on February 12, 2026, with the low bid of $241,986.39 submitted by
Payne and Dolan, Inc. The project was awarded by the Board on March 3, 2026.
In anticipation of the pending Fitchrona Road (Nesbitt Road to Tonto Trail) reconstruction,
approximately half of the projected town share cost of the Fitchrona Road project were reserved
in the 2026 budget with the reminder to be budgeted for 2027. The Town has been informed
that the Fitchrona Road project will not be bid until late 2026 and construction will begin in 2027.
The total town cost share of the Fitchrona project has not yet been determined.
The delay in the Fitchrona Road project gives the town the opportunity to complete the
improvements on White Crossing Road in 2026. The contractor has agreed to honor the original
unit prices with exception of a price increase of $15.00 per ton of asphalt paving material due to
recent oil price increases and market instability. This increase represents a $5,775 increase in
asphalt paving for the northern half of White Crossing. The bid prices of asphalt in 2027 are
completely unknown at this time.
If approved, the added northern half will be completed at the same time as the southern half and
will provide a complete and uniform road section on White Crossing Road.

Current Conditions
We have a Dark Sky Ordinance enacted in 2014.
We have abundant new residential construction, all of which should be built in accordance
with the DSO.
We have several of our own street lights (around Town Hall) and several utility-owned street
lights that the Town pays for.
We have neighboring communities which either have DSO or are working on Dark Sky
Preservation.
Fitchburg adopted Ordinance in 2025 with new standards for outdoor lighting using dark sky principles
Middleton upgrading its 2024 outdoor lighting ordinance using latest template from Dark Sky International
Town of Perry adopted DSO 2009 and amended 2024.
Town of Rutland adopted DSO 2025.
City of Verona to upgrade three municipal areas.
Could We Improve the Conditions?
Our Ordinance
•Technology has changed. We could add
updated definitions and resources.
•Compliance penalties and timings could be
improved.
•General topic of enforcement could be reviewed
and potentially revised. (Note that the better the
ordinance and inspection, the fewer problems
we’re likely to have.)
Our Lights and Utility Bills
•Energy savings = taxpayer savings. Utility bills
should go down with lower K lights.
(City of Verona has just submitted a grant
application to PSC for upgrading lighting at
City Hall, Festival Park and Public Library,
expected to produce 75% energy savings and
light pollution reductions.)
•Residents and neighbors appreciate dark skies.
•Town could set a good example.
•Town might seek Dark Sky Community status
from Dark Sky International.
WHERE WOULD WE START
(and who would do it)
•Review the current ordinance; we have examples from Town
of Perry, Town of Rutland, Dark Sky International. (NRAC)
•Discuss inspection and compliance procedures with Town
staff and other towns. (NRAC)
•Review the utility bills and lighting types being used around
Town Hall and on Town streets; estimate benefits if different
lights and fixtures are used. (NRAC or PW Director)
•All parties report back to Town Board for discussion and
ultimately for any changes to Town property and/or
ordinance.
Take the First Steps
1. Authorize / request
that NRAC begin review
of the existing ordinance
and make appropriate
recommendations to the
Board for revisions.
2. Authorize / request
NRAC (or Town staff) to
review existing lighting
and develop
cost/benefit information
for changes.
TOWN OF VERONA
TO: Mark Geller, Town Chair DATE: July 2, 2026
FROM: W. Christopher Barnes, Public Works Director
SUBJECT: Town owned building lighting fixtures
As requested, I have made a summary of the town-owned external lighting fixtures and
their relevance to the current Town dark sky ordinance. It is important to note that the
current building was completed in February 2017, and the current dark sky ordinance
was adopted in September of 2017 making the totality of the town facility exempt from
the ordinance provisions.
As shown on the attached sheet, there are several styles of lighting fixtures at the Town
office/garage facility, all of which are controlled in a master lighting panel. The largest
fixtures are parking area lights which are scheduled to turn off at 11:00 pm. These
fixtures feature a sharp cutoff shade complying with the current dark ordinance. Other
doorway or area lighting are generally downcast or include a light cut off shade or
shield. Three lights do not cast their light downward – two wall accent lights (26 watts)
and one flag illumination light (10 watts). These fixtures have LED bulbs and are timed
to activate from dusk to dawn. These lights could be changed to operate during specific
times; however, they function as security lighting, especially during community rental
events. If desired, the wall accent lighting could be placed on a timer circuit. Flag
illumination is required as part of the national flag code.
Overall, the town lighting complies with the intent of the Town dark sky ordinance and
provides a good balance of energy conservation, security and dark sky provisions. One
challenging aspect of the current ordinance is the lack of objective illumination
standards and a reliance on best practices. Many communities assess night-time
illumination by specfing a lighting trespass standard. A typical lighting trespass
ordinance requirement is no more than 0.5 foot candles be detected 10 feet beyond the
property line. This lighting level is determined by a light meter to monitor illumination
(measured in foot candles). Typical light meters cost $150- $250.

FROM: W. Christopher Barnes, Public Works Director
SUBJECT: June 2026 Report
The monthly Public Works Department Activity report is submitted for the information and review
of the Board and the Committee. June was a very active month with several high windstorm
events requiring numerous callouts for downed trees. Seasonal mowing and brush cutting alos
was ongoing. Numerous citizen and resident concerns and action requests were received and
addressed on a daily basis. If you should have any questions, please let me know.
Road Maintenance Activities
• Began second round of roadside.
• Performed numerous tree and limb removals from downed trees on Range Trail, Sunset Drive,
Horse Bend, Fritz Road Flint Lane, Shady Oak Lane and Spring Rose Road.
• Restocked asphalt patch for pothole repairs on various roads.
• Replaced 2 old/damaged road signs.
• Began 2026 Road Improvement project on Stony Ridge Circle
June 25th, Range Trail tree removal
2
Equipment and Facility Activities
• Set up for various community room events.
• Assisted All Energy Solar with finalizing the solar panel project.
• Coordinated HVAC annual checkup.
• Assisted Master Builders with HVAC Control repair.
Sanitary Sewer Utility Activities
• Continued working with MMSD on the interceptor sewer replacement from Goose Lake
to the Fitchrona Road Pump Station #12. Bidding is currently scheduled for late
August/September with construction to tentatively begin this year.
• Participated on June 17th in a training seminar for preparation/updating of Capacity,
Management, Operation, and Maintenance (CMOM) programs sponsored by MMSD and
Wisconsin DNR.
Engineering Activities
• Received final closeout documentation for Bridge B-13-0683 on Old PB over Badger Mill
Creek. The actual construction was completed in 2018.
• Continued working with Fitchburg city staff and utility companies on the Fitchrona Road
Reconstruction project. Two property owners are contesting the city’s right to acquire
right of way near the proposed Lacy Road roundabout. Without the right of way
acquisition, utility relocations cannot be completed until the suit is resolved. Additionally,
City of Fitchburg is working to gain approval from the DNR for a non-motorized trail
under the Military Ridge State Trail bridge. Subsequently, the project bid opening has
been postponed until late fall and construction to begin in early 2027.
• Continued construction inspections on the Sugar River Vista subdivision. Paving is
currently underway.
• Completed new voting district and street maps
• Continued liaison work with the US 18/151 task force and scheduled public information
meeting seeking community input from businesses, residents, and commuters
throughout the corridor.

TOWN OF VERONA

FROM: W. Christopher Barnes, Public Works Director
SUBJECT: 2026 Town Stormwater Basin Maintenance
The 2026 town budget includes a project for removal of organic plants and accumuiated
soil sediment from the town office and garage stormwater basin. The budget for basin
cleaning was estimated to be $30,000. The basin is approximately 10 years old and in
2023, MSA engineers performed an inspection of the basin and recommended cleaning
of the basin. The cleaning work generally consists of the removal of the organic plant
material on site for drying and mulching and removal of accumulated sediment in the
basin bottom. The underlying sediment has been measured to be between 6" and 22"
in depth.
The clean out work can be defined as "maintenance" rather than "new construction"
hence former bidding is not required, but staff chose to advertise and bid out the project
regardless. Four companies received bidding documents and one bid was received.
The bid is as follows:
Speedway and Gravel, Middleton, Wl .................... $84,189.44
The bid was reviewed by the Public Works Committee at the June 2026 meeting and
recommended no award and to attempt a re-bid in the winter of 2027.
Subsequently, Ederton Construction offered to supply a quote for the work requted.
Edgerton submitted a proposal in the amount of $45,000. Their proposal is attached.
The primary difference is Edgerton is already mobilized near the site, and they have
permission to place the dredged pond material on EPIC property in lieu of hauling
offsite. Upon review of the proposal staff finds the proposal to be reasonable value for
the work required and Edgerton has performed similar storm water excavations on the
EPIC campus. If awarded, work would be ongoing with the current Edgerton work
program.

The following items are requests for modifications to the boundary agreement. I want to
explain our rationale so that even if you disagree, you’re aware of why we’re asking for a
particular change.
1. CUPs apply to the Boundary Agreement / Joint Planning Committee
We believe that this item is already included in the current boundary agreement;
however, it would be best to get general agreement on this item and clearly state
that CUPs apply.
2. Anyone who wants to annex into the City can annex (this includes areas C
and D)
I don’t think the City is going to budge on extending water utility services to
Town residents. If a future situation arises in which a Town property owner wants
City services, we would want them to annex into the City. I suppose it’s also
possible that a Town property owner might want to annex into the City for other
reasons, which we would want the boundary agreement to allow.
3. Expanded Area A and Area B
The City continues to grow and there is a significant demand for housing. I think
the City is growing faster than either party expected, and the Boundary
Agreement should account for the high demand for housing.
4. Continued ability to create town islands
I actually think this is a beneficial item to both parties. If the City is unable to
create town islands during annexation, that would put forced annexations on the
table, which I don’t think are beneficial to either the City or the Town.
5. Clarification of language such as inclusion of highways in annexations
I think one of the things we discovered during the boundary agreement is that
both parties would be better served by clarifying these items in the agreement.
6. Additional language cleanup and clarifications
Similar to the EMS Agreement, we have a number of less substantive clarifications
but we want to see if we can work through the issues above first.
Sincerely,
Luke Diaz

The Town Administrator sent an email on March 5th, 2025 to the City Administrator,
requesting a meeting to discuss a potential successor agreement. A response was

Re: Request for Modifications to the City/Town Intergovernmental Boundary Agreement
Dear Mayor Diaz,
This letter is in response to the memo received by the Town of Verona sent April 14, 2025, requesting
modifications to the current Boundary Agreement between the City and the Town. The Town strongly
supports opportunities for municipal cooperation and regional planning and welcomes thoughts on
improving the current agreement. Further, the Town recognizes the pressures all communities located
in Dane County face from the ever-increasing demand for housing, as the Town is subject to those
same pressures.
As for the amendments you have requested, we do not see any benefit to the Town in discounting the
existing agreement entirely when creating an updated agreement. Expansion of Areas A and B and
allowing annexations without restriction in any area of the Town (which would seem to violate state
statutes) would undermine the entire purpose of a boundary agreement. In fact, revisions to the
agreement as you propose would leave the Town more vulnerable to tax base losses through
annexation than it would be without any agreement at all. The inability to protect some areas of the
Town for growth would be detrimental to the ability to remain viable as an independent municipality.
The Town is hopeful that a new boundary agreement can be reached that provides benefits to both
municipalities. Unfortunately, the modifications as proposed do not protect the Town in any manner.
Again, we remain open to modifications that are mutually beneficial and welcome any discussions in
that regard.

To: City of Verona Common Council
Subject: 2026 Successor City/Town Boundary Agreement
As stated in our response to Mayor Diaz’s request for modifications to the City/Town
Intergovernmental Boundary Agreement dated April 30
th, 2025, the proposed modifications
would not provide any benefit to the Town. After careful consideration of land use planning and
projected growth forecasts for Dane County, the Town of Verona Board would like to see the
following incorporated into any successor boundary agreement with the City. This is not meant
to be an all-inclusive list.
1. The town proposes three areas for consideration: City Interest, Town Interest and Town
neighborhoods. While the intent of the current “City-Town Interest Area (Area B)” was
to allow for both Town and City development opportunities, it has not operated as such.
2. The current “City-Town Interest Area (Area B)” of the Boundary Agreement be allocated
into either Town interest or City interest areas, as referenced above.
3. As Town islands can only be created via a boundary agreement per state statute, the
Town Board would be amenable to continuing to allow for the creation of town islands.
4. Any annexations would continue to include the entirety of the adjacent roadway.
5. An improved mechanism for Communication between the Town and City regarding
regional land use.
The Town Board supports a successor boundary agreement that will benefit both municipalities,
which demonstrates a commitment to thoughtful regional planning. We look forward to your
feedback.

MEMORANDUM
To: Sarah Gaskell, Town Administrator
From: Jamie J. Aulik, City Administrator
Date: May 7, 2026
Re: Boundary Agreement
Administrator Gaskell:
A sincere thank you for the continued dialogue. We hope there is a real opportunity to
reach an agreement that provides long-term clarity and stability for both the City and the
Town.
At a high level, our shared objective is straightforward: to preserve the Town’s rural character
while allowing for orderly and predictable growth for the City. With that in mind, we are
requesting the Town’s final and best offer for a boundary agreement that reflects the
following framework:
• Remove Area B: This would clarify Town and City development areas, and a
Joint Planning Committee would no longer be needed.
• Post-Annexation Revenue Sharing: The City is prepared to extend
reimbursement to the Town for annexed areas from five (5) years to ten (10) years
of tax revenue to offset the potential loss of tax dollars from the Town not
expanding.
• Defined No-Development Areas: Establish mutually agreed-upon areas that will
remain rural and not be developed for the duration of the agreement, including
consideration of no development along the Fitchrona Rd. corridor.
• Growth Area Clarity: Identify areas where Town growth is anticipated,
including discussion on the Two Half-Empty Milk Cans property, and
commercial-only development in areas located by the CTH G interchange
adjacent to Epic.
We believe that reaching an agreement now avoids a scenario where development pressure
drives decisions in a less coordinated way. Without a framework in place, both the City and
the Town may face increasing pressure from developers seeking to leverage jurisdictional
differences, rather than advancing shared long-term planning goals.
Our intent is to create a balanced, durable agreement that reduces uncertainty, protects key
rural areas, and provides a clear path forward for growth.
We appreciate your partnership and look forward to reviewing your final proposal.
Very respectfully,
Jamie J. Aulik

To: Jamie Aulik, City Administrator
Subject: 2026 Successor City/Town Boundary Agreement
Dear Administrator Aulik,
Thank you for providing the City’s proposal for a successor Boundary Agreement.
Unfortunately, the City’s “final and best offer for a boundary agreement” does not address
any of the requests made by the Town in October of 2025. Most significantly, the Town’s
request to divide the current City/Town growth area into City or Town growth areas has been
ignored, with the City instead proposing that the entirety of the current joint interest area be
reallocated only to the City.
The framework provided by the City does not allow any avenue for the Town to grow in an
orderly and predictable manner, as guided by the Town’s Comprehensive Land Use Plan.
Rather, it asks the Town to set aside mutually agreed-upon areas as “No Development”
while simultaneously asking for the identification of specific areas where Town growth is
anticipated in the short-term.
The Town continues to support opportunities for municipal cooperation and regional
planning. The Town recognizes the pressures all Dane County communities face regarding
the demand for housing, as the Town is subject to those same pressures. Unfortunately,
the City’s proposed framework does not provide the Town with any mechanism to address
the issue.
The Town Board continues to support a successor boundary agreement that benefits both
municipalities and which demonstrates a commitment to thoughtful regional planning.
Respectfully,
Town of Verona Board of Supervisors
