Call to Order/Approval of Meeting Agenda – Geller called the meeting to order at 6:30 pm. Motion to approve the agenda by Mathies, second by Slack. Motion carried by voice vote. 2. Public Comment – none 3. Discussion and Possible Action: Land Use Application 2026-01 submitted by Michael Jensen for a CSM and rezone for parcel number 062/0608-263-8821-0 located at 2000 Range Trail Motion by Mathies to recommend approval of Land Use Application 2026-01 with the following condition, second by Lukas: • The approval of the Joint City/Town Planning Committee if required Motion carried by voice vote 4. Discussion and Possible Action: Land Use Application 2026-02 submitted by Leticia Hernandez for a CSM for parcel number 062/0608-063-8370-4 located at 3068 Timber Lane Motion by Slack to recommend approval of Land Use Application 2026-02 with the following conditions, second by Mathies: • Addition of the driveway access zones as consistent with the recommendation of the Public Works Director to the CSM • Determination of the septic field on Lot 1 • Addition of a note on the CSM restricting lot clearance to a maximum of 30,000 square feet Motion carried by voice vote 5. Discussion and Possible Action: Land Use Application 2026-03 submitted by R & J Acres for a CSM and rezone for parcel numbers 062/0608-302-9001-0 located at 2109 Schmid Lane Application tabled until the April Plan Commission meeting in order that the rezone and CSM could be considered at the same time. 6. Discussion and Possible Action: 2025 Comprehensive Plan Amendment Updates a) Land Use Application 2025-04 from Kurt Wedig requesting a change from RR4-8 to RR 2-4 for lands located on Riverside Road between Flint Lane and Sugar River Road (76.36 acres) - Parcel numbers: 062/0608-322-8000-7 and 062/0608-322-8550-0 i. Public Comment • Andrea Rodrigues-Pavao, 1839 Flint Lane; against the rezone; additional traffic on Flint Lane cannot be accommodated due to safety issues; doesn’t want farmland developed • Robert Blasdel, 7607 Riverside Road; wants input on the eventual development of the property in question; prefers agricultural uses over development; farmers unable to purchase land; farming operations are being downsized • Shari Blasdel, 7607 Riverside Road; opposes the application; development will have a big impact on their peace and retirement; no neighborhood meeting has been held regarding the development ii. Applicant Comment – • Kurt Wedig; grew up on a Dairy Farm and understands rural life; benefit of 2-4 acres Land Use designation allows for more families to move to the Town of Verona; positive impact to the tax base; smaller lots are easier from a maintenance standpoint; would town consider 3-6 acre designation iii. Commission Discussion • Mathies – changes to the Comprehensive Plan are discretionary and the Board and Plan Commission use their best judgement; the proposed change would be better considered at the 10 year review of the Comprehensive Plan; maintaining the 4-8 acre designation preserves rural character • Slack – 3-6 acres is not an official zoning category and is therefore not an option; conservation subdivisions are required which helps with the preservation of rural character; it’s a struggle to balance development, rural character and landowner rights • Geller – prefers the 4-8 acre designation as this portion of the town is intentionally at a lower development density Motion to recommend denial of Land Use Application 2025-04 by Geller, second by Lukens. Motion carried by voice vote. b) Land Use Application 2025-05 from Robert and Sandra Rego requesting a change from RR 4-8 to RR 2-4 for 1828 CTH PB (49 acres) i. Public comment - none ii. Commission Discussion • Slack – supports the application because it is consistent with the Future Land Use category of the adjacent acreage and would allow for better neighborhood planning Motion by Mathies, second by Slack to recommend approval of Land Use Application 2025-05. Motion carried by voice vote. c) Land Use Application 2025-06 from JMM LLC requesting recognition and identification of the subject property as a potential non-metallic mineral extraction site for 7230 Pine Row (160 acres) i. Public Comment – none ii. Applicant Comment – • Will Springer, 110 St Main Street, Janesville; the property is a registered mineral deposit site under NR135 and the registration as such has been recorded iii. Commission Discussion • Mathies – opposed to the application because identifying the land as having mineral resources may have impact on future adjacent land uses Motion to recommend approval of the application with the language as follows by Slack, second by Lukens o Geological features indicative of the potential for non-metallic mineral extraction have generally been identified on parcel numbers 062/0608-282-8000-6, 062/0608-282-8500-1, 062/0608-282-9000-4 and 062/0608-282-9500-9. Land Use Application 2025-07 from Gary Ishmael requesting a change from RR – 8+ to RR 2-4 for 1694 Range Trail (9.15 acres) Motion by Lukens to recommend approval of Land Use Application 2025-07, second by Lukens. The two parcels would then be 24.83 acres (AT-35) and 18.63 acres (RR-16) respectively. Current and Proposed Zoning: The current zoning of the parcel is AT-35. Zoning will remain unchanged. Currently, the parcel is less than 35 acres in size but is considered contiguous with the two larger parcels to the south in terms of zoning and will remain AT-35. The residential parcel that the acreage is being added to will remain RR-16. Extra-territorial Review/Boundary Agreement Authority: This parcel is in Area C (Section 8.05) of the Boundary Agreement with the City of Verona and therefore the CSM does not require review or approval from the Joint City/Town Planning Committee. Before conducting the site inspection, the County G.I.S., aerial photography, and the Wisconsin Surface Water Data Viewer w ere used to determine the type and approximate location of the waterway. The map shows that there is an intermittent stream flowing north and northwest through the property. An intermittent stream is one that has a periodic or recurrent flow. A site inspection was conducted on August 2, 2023. It was observed that no define bed or banks exist throughout the entire property. After further review of the waterway , it has been determined is NOT navigable at any point up- steam of its intersection with County Highway G . Downstream evaluation from this point of intersection was out of scope with this determination and is therefore considered navigable. The enclosed map shows the portion determined to be non-navigable. The hardship associated with this request is caused by the unique physical characteristics of the property and the placement of the existing residence in relation to current ordinance requirements. Dane County ordinance requires a 66-foot-wide shared access easement to preserve the possibility of a future public right-of-way. The ordinance also requires a 30-foot setback from the edge of such an easement. On this property, the existing single-family residence was constructed prior to this proposed land division and without consideration of a future 66-foot access corridor. If a 66-foot-wide access easement were applied, the existing residence would be located approximately 16 feet from the easement boundary, placing it well within the required 30-foot setback and creating a violation. As a result, strict compliance with the ordinance would make it impossible to create a conforming lot without removing or significantly altering the existing home, which is not reasonable. This hardship is not self-created. It results from the interaction between the existing home’s location and the current ordinance requirements. Our intent with this request is to create a long-term multigenerational living arrangement that allows our family to remain closely connected. Living adjacent to my parents would provide a unique opportunity for daily interaction and meaningful involvement in each other’s lives. For our children, growing up next to their grandparents would foster strong relationships through regular shared experiences, contributing to their emotional development, stability, and overall well-being. This arrangement would also create a practical and supportive environment for our entire family. It would allow my parents to remain actively engaged in our daily lives while providing mutual support through childcare, shared responsibilities, and simply being present for one another. While this is not the basis for the variance request, it represents a meaningful and lasting benefit that would result from approval. Currently the parcel is an approximately 4.09-acre RR-2 lot. The CSM would create two lots of 2.10 and 2.0 acres. Comprehensive Plan Guidance: The Future Land Use Map category for this parcel is Rural Residential 2-4 acres. The parcel is currently zoned RR-2 so a rezone is not required. Current and Proposed Zoning: The current zoning of the parcel is RR-2. The proposed zoning would be RR-2 for both lots. Extra-territorial Review/Boundary Agreement Authority: This parcel is in Area D (Town neighborhoods) (Section 8.05) of the Boundary Agreement with the City of Verona and therefore the CSM may require review or approval from the Joint City/Town Planning Committee. Surrounding Land Use and Zoning: The parcel is in the southeast part of the Town in an existing Town neighborhood. Lands to the north are residential parcels mostly 2 acres in size. Site Features: The existing parcel has been currently farmed along with surrounding parcels but due to a change in ownership of the adjacent farmed parcels, future farming/planting of the land is unlikely. Driveway Access: The current driveway that serves the existing residence will remain unchanged for access to Lot 2 as a shared driveway access agreement has been created to provide access to Lot 2. The CSM will also need a variance from the County for a 33’ wide shared driveway easement vs a 66’ easement, to accommodate the required setbacks. Date: March 19, 2026 Re: Conditional Use Permit (CUP) Working Group proposal MEMORANDUM This memo is a follow-up to the 2025 DCTA CUP Survey (link to survey results ). In response to the survey, a CUP Working Group was formed to review the results and consider potential amendments to the Dane County Zoning Code. Focus of Initial Recommendation The CUP Working Group chose to focus its initial recommendations on conditional uses in agricultural zoning districts that are not directly related to agriculture -- the districts and uses are noted in the table below. Applicants seeking these uses would instead be required to: 1. Apply for a rezoning to a different commercial or industrial zoning district, like Rural Industrial (RI) or Manufacturing & Industrial (MI) district (note: a rezone to RI or MI can include a deed restriction to a subset of specified uses); and 2. Apply for a corresponding Conditional Use Permit (CUP), if needed. Request for Feedback The Working Group would like feedback on the proposal to ask Dane County to amend the Zoning Ordinance to: • remove the identified conditional use categories from the zoning districts noted above; and • direct applicants for those uses to apply for a rezone and corresponding CUP in the appropriate commercial or industrial zoning category (e.g., GC/HC, RI or MI zoning district). Questions & Answers What would happen to existing CUPs if the CUP categories are removed from the zoning districts they are currently in? Existing permits would remain valid. Landowners/operators with CUPs in these zoning districts would not be immediately impacted by the proposed change. However, applications for new CUPs, or renewal of existing CUPs, would need to comply with the new code. This would require a rezone and a new CUP . Does this mean we will have to amend our town’s Comprehensive Plan? If a plan currently outlines policies for the affected land uses, or policies that could reasonably be applied to them, there is likely no need to amend the plan. How would this work with the RI 16- acre minimum lot size? Applicants can request smaller acreage as part of the rezone/CUP process. What are the benefits of removing these conditional uses from existing zoning districts? Under Wisconsin law, towns have more control over zoning decisions than CUPs. CUPs are governed by 2017 Act 67, forcing approval by the county if applicants meet listed “substantial evidence” standards. In contrast, zoning changes are legislative decisions of the town board. They allow broader discretion to consider comprehensive plan consistency, long-term land use goals, and the broader public interest. Moving these conditional uses to a new zoning category, will give towns decision making authority over these significant land use proposals. If the zoning change is denied, the CUP will not be considered by the County. What are the potential drawbacks? Applicants would need to submit two applications, a zoning change and a CUP, and will have an additional application fee. Note, both applications can be submitted at the same time so the overall timeline for action should not increase. While CUPs can be “sunset” to end at a date certain or upon transfer of ownership, once land is zoned into a non-agricultural category like RI, it will remain in that category.
