5. PUBLIC HEARINGS:
a. CSM LOT LINE ADJUSTMENT & REZONE FROM LEGACY TO TOWN RESIDENTIAL ZONING: 7222 & 7252 HWY. 19
The applicants would like to adjust their lot lines by just under an acre. The land being exchanged contains an accessory
building, which will become a non-conforming structure as it will be in the front lot of the new land configuration and be
over the number of accessory buildings allowed on a residential parcel. The property owner between the two parcels
requested the removal of the ingress/egress easement over their land, to the objection of the applicant seller who noted it
was also a septic easement, and that the applicant buyer’s road access and driveway is only 50’ wide not the 66’ Town
ordinances specify. More information is needed on the easement before determining whether to keep or vacate.
b. REZONE FROM LEGACY TO TOWN EXCLUSIVE AG ZONING & CONDITIONAL USE PERMIT TO UPDATE CELL
TOWER: 6207 BARMAN RD.
No representative for the applicant was present. The applicant is seeking to expand the fenced area at the tower site and
install additional antennae. The review by professionals will include whether the installation of the second antennae was
authorized &/or permitted. The number, type, and recipients of easements noted in the application may be incorrect.
Motion by Commissioner Barman, seconded by Commissioner Ballweg to close the public hearing and return to the
regular meeting. Roll call vote: Ballweg AYE, Barman AYE, Endres AYE, Swann AYE, Weiland AYE, Wright AYE. Motion
carried.
6. CSM LOT LINE ADJUSTMENT & REZONE FROM LEGACY TO TOWN RESIDENTIAL ZONING: 7222 & 7252 HWY. 19
Motion by Commissioner Swann, seconded by Commissioner Barman to table the application until the Commission
receives easement clarification. Motion carried, 6-0.

Mildred Court. Motion carried, 6-0.
Motion by Sup. Zinck III, seconded by Sup. Meinholz to approve the lot line adjustment as approved by the Plan
Commission. Motion carried, 5-0.
9. OLD BUSINESS
a. RESIDENTIAL REZONE & CONDITIONAL USE PERMIT FOR AN ACCESSORY BUILDING WITH PLUMBING & A
FOOTPRINT LARGER THAN THE PARCEL’S HOME. FRYE, 7401 MILDRED CT.; 0808-081-8450-0
The applicant has made some design changes that may impact the need for a CUP; the Rural Based Business zoning
overlay may be a better fit. This will be discussed more at the next meeting.
b. LEGACY ACRES 22-LOT PRELIMINARY PLAT AND REZONES TO SFR AND EA, 6506 STATE HIGHWAY 19
More data has refined the site layout, preserving more of the tree line than initially shown, but will still warrant
additional landscaping for coverage. The straight wall of the hill resulting from the engineering of the road will be a
maximum height of 10’ and will be on private property, outside of the road right of way, and protected with fencing.
Nearby subdivisions with homes built along the hilltop and ridgeline have set a precedent to not place height restrictions
on homes built in Legacy Acres. The fire district would like a wider road, which would change stormwater calculations
and pond sizing. Town engineers noted wider roads and cul de sacs cost more for the Town to maintain; widening and
strengthening intersection corner and shoulders may be a better option. The subdivision covenants will require the HOA
to maintain the stormwater ponds and/or allow the Town to perform maintenance and add to the subdivisions’ tax bills.
The development plans will need to provide graded access off Irvin’s Way cul de sac to provide adequate egress to the
stormwater facility, which engineers sized to the 200-year storm. All stormwater swales and facilities are to all be on the
Developer’s property, not on Town property. The plans will need to sure water does not become channelized to or on
the adjoining parcels. Blasting &/or sawing will be needed for the project and will be performed in compliance with
applicable statutes. Advance notification of any blasting should be given to nearby property owners along with
information about documenting conditions before a blast. The one proposed shared driveway will require a shared
driveway agreement that should include a utility easement, with the driveway owned by Lot 3 with an easement to Lot 2.
Disturbance to slopes 20% or greater will be minimized, and the 20% slopes will be demarcated and attached as an
exhibit to the Developer’s Agreement or in the HOA. The developer will look at lots 4 and 5 to see if they can be shifted
for driveway buildability.

Living Trust and adopt the Rezoning Approval and Conditions as modified by the Town Board, and the additional
