TOWN OF EAGLE TOWN BOARD MEETING April 15, 2026 Approved Minutes Chairperson Mommaerts called the meeting to order at 6:30pm and led with the Pledge of Allegiance. Roll Call: R. Kugel, D. Domagalski, R. Hajewski, D. Knauer and C. Mommaerts were present. Proof of posting and notice was verified as being met. Approval of Meeting Minutes: Motion by Kugel to approve the minutes of the Town Board Meeting on March 18, 2026, as presented. Hajewski seconded the motion. Motion carried, 4-0 (Knauer abstained). Mommaerts opened the floor to public comment: Marilyn Rogers did not speak but was in attendance to answer questions as needed on agenda item 14 - sign request near Eagles Preserve. Maria Hinners spoke against opening Westwind Drive to through traffic stating there would be no difference in response time, and it would be detrimental for kids at play. Randolph Mielke thanked Diane Knauer for her time on the board and congratulated Faith Lang on being elected. Mielke had sent a letter to the board in advance of the meeting urging members not to connect Westwind Drive and cited reasons not to. Robert Heizman spoke in opposition to opening Westwind Drive, stating it would not mean quicker response; many ATVs would cut through as well. David Gunkel said that he is adamantly against opening Westwind citing the dangers of it being used as a shortcut and the costs involved. Brian Williams states many younger families with children move to Westwind Drive because it is quiet; children ride their bikes there. Valerie Williams says opening up Westwind would mean dozens and dozens of extra cars and does not understand why it is up for discussion. John Concotelli concurs with the other speakers regarding Westwind Drive and asked if there have been studies and drawings on the matter. Treasurer’s report: Mommaerts noted income is at 53.77% and expenses are at 21.34%. Motion by Kugel to approve the March 2026 financial report as presented. Knauer seconded the motion. Motion carried, 5-0. Town payment of claims and Recreation Department payment of claims: Motion by Knauer to approve the payment of Town claims and the payment of Recreation Department claims as presented. Domagalski seconded the motion. Motion carried, 5-0. Reports (Discussion and Action): Waukesha County Sheriff's Report: A deputy was present. The call log was reviewed. Alice Baker Library Report: Knauer reported library income is 22.42% and expenses are at 19.86%. The annual report to DPI needed to be revised and refiled. Interviews for the position of library director were conducted in closed session. Act 150 needed to be revoted on because the standards failed, but if enough other municipalities pass it, it will go into effect. Knauer noted the board may want to consider not being exempt from the library tax and allow Waukesha County to charge our residents Waukesha County tax; research needs to be done. Planning and Zoning: No report. Joint Municipal Buildings Committee did not meet. Kettle Moraine Fire District Report: The report and call log provided by Chief Nottling was reviewed. Supervisor Domagalski reported on the fire fee committee meeting: James Small did a presentation to talk about what other communities are doing. The committee is on hold due to discussion on the Intermunicipal Agreement. Domagalski would like to see a fire fee committee just for the Town of Eagle with more public involvement. Kugel feels the motion that was made last month regarding the Intermunicipal Agreement was taken out of context and reacted to inappropriately. Motion by Kugel to amend the motion adopted on March 18 regarding termination of the current intermunicipal agreement and instead state the current intermunicipal agreement be modified to include the following items: changes to the staffing policy to include a full-time working fire chief that responds to and works at all fire and EMS calls during times of his or her work shift, the fire chief shall also respond to calls as needed outside of scheduled work shift to support fire and EMS operations, establish fire station Number 33 in the Village of Eagle as the sole 24-7 response station for the district. Second by Domagalski. In further discussion Domagalski suggested a full-time EMS deputy would be a possibility. Knauer feels we are being too specific and thinks all three municipalities should be involved in discussing items in the agreement that are not working. Domagalski replied we just want to get the ball rolling. Percentages were brought up but it was determined that could be reviewed at the end of the current agreement. Response times from the two locations were discussed. Kugel stated the intent of the consolidation was to make things more efficient for the three communities rather than build up and staff two stations. Motion carried, 5-0. Joint Municipal Court did not meet. Discussion/action on GFL Contract: Hajewski started by saying discussion to terminate our relationship with GFL took place at a recent meeting due to performance issues and concerns about when the Town was notified about the acquisition. Justin Montani, Henry Pinkos, and Doug Wrecke of GFL were in attendance. Justin stated that they are aware of the changes the Town has had to deal with and want to make sure those concerns are being addressed. The original contract in 2020 was with Badgerland Disposal/LRS. In 2023 there was an addendum to extend through 2029. The 120-day notice to terminate would need to be received approximately this time in 2029. There is language in the original contract that if there is a breach, written notice could be given to fix the problem within 30 days. Domagalski asked if drivers are done for the day if they finish their route early as they seem to be racing down the road to grab the next bin. Doug replied that typically they would help out on other routes. Early on in the acquisition drivers and trucks were coming from three different service locations and customer service calls to Janesville were not relayed to Hartland in a timely manner. Effective November 2025, Eagle has been serviced out of the Hartland location. It appears there has been an occasional miss since then, but nothing like last April. If the drivers are speeding, they would like to hear about it so it can be addressed. Kugel asked if the dump cycle on the trucks is automatic or manual due to concerns that the bins were not being fully emptied and trash was blowing away. Doug replied that it is an automatic factory preset. Drivers are told to make an attempt to pick up trash if they see it blowing around. Hajewski asked about the Consent to Assignment Form. Montani will check on it. Mommaerts asked if it would be possible to get out of the contract before 2029. Montani replied that it would need to be a mutual decision to terminate; GFL values the relationship and would like to continue servicing the Town for at least the life of the contract and hopefully longer than that. If there is a breach, the Town would need to point to something specific in the agreement, give written notice of the breach, and then GFL would have 30 days to correct it. Lake Management District: Hajewski noted the monthly meeting is next week. Discussion took place on transferring the ownership of the Town’s boat to ESLMD and they would take over insuring it. Motion by Hajewski to transfer the Eagle Town boat to the Eagle Spring Lake Management District for $1.Second by Knauer. Motion carried, 5-0. Discussion took place on a wake enhancement ordinance. Mommaerts would like to stay clear of litigation. The Town’s attorney is still awaiting case law. No action was taken. Discussion/Action on TEAMS Committee: Mommaerts will address this item during committee appointments under Chairperson Report. Discussion/action on next steps to hire DPW employee: Kugel reported quite a few applications were received and are being reviewed. Discussion/possible action Industrial Park Stormwater: Mommaerts contacted Lynch Engineering to take an overview to see where the water is going; they also have a drone that can be utilized. Discussion/action on connecting Westwind Dr: Domagalski clarified that the reason he asked for this agenda item was at the request of a village board member but has since received a lot of opposition. When the Fox Chase Subdivision went in in 2018, a study was done; it was supposed to connect and be paid for by the developer. The Town Board in 2018 had agreed to the connection but clearly it did not happen. Motion by Domagalski to not connect Westwind Drive to the Village. Second by Kugel. In further discussion, Hajewski noted that the Town should not pay anything towards this if the Village pursues the issue. Motion carried, 5-0. Discussion/action on Ordinance 26-01 to Regulate Recycling and Solid Waste: The DNR changed several regulations which required Responsible Units to update current ordinances. Motion by Hajewski to approve Ordinance 26-01 to repeal and recreate Ordinance 21-09, an Ordinance to Regulate Recycling and Solid Waste. Second by Kugel. Motion carried, 5-0. Discussion/action on sign request near Eagles Preserve subdivision: Kugel received a request from a resident for a school bus warning sign. Motion by Kugel to approve the sign request. Second by Hajewski. Motion carried, 5-0. Kugel will work with DPW to order the signs. Beverage Operators Licenses: Motion by Knauer to approve beverage operator licenses for John Helkowski, Mark Scholl, Eddie Verrett, & Karen Schmidt. Second by Kugel. Motion carried, 5-0. Committee Reports: Park/Recreation Department: Hajewski reported the Summer Activity Guide is out and gave highlights of the programs and sponsors. Discounted sales for attractions begin May 1. County Board Supervisor: Mommaerts did not run for reelection. The new District 14 Supervisor is from Dousman. Garbage Pickup & Recycling: Discussion on the contract took place earlier on the agenda. Hajewski has nothing further to report. Roads Report: Kugel reported salt has been ordered for next season. The new tractor has been delivered. Chairperson Report: Mommaerts thanked Knauer for her time serving on the board. Knauer stated it has been a privilege and encouraged residents to stay engaged, be supportive of the board, and be involved with positive changes. Domagalski acknowledged the Town Chair for getting items on the agenda and the Town Clerk for getting the agenda out well in advance of the meetings so that the board can be prepared and citizens have time to give feedback.
