Absent: Trustee Quinn (excused). Pledge of Allegiance The Pledge of Allegiance was recited by all those present. Public Comments James Toshner, N58 W25740 Fox Hollow Drive, James Toshner from Fox Hollow Drive addressed the Board to advocate for expanded golf cart use. Living near the new October Fields development, he noted a surge in traffic, especially golf carts, in evenings. He and his wife started looking into buying a golf cart and learned from Administrator Green and a Board member that while ATVs are legal on roads, golf carts aren't. He observed three golf carts on Village roads just that evening. Toshner emphasized the popu larity of golf carts, noting the rapid resale of used ones. Believing nearby Delafield allows them, he suggested the Board officially authorize their use, backed by 23 resident signatures supporting the proposal. President Gehrke thanked Mr. Toshner for his comments and noted that some Board members had already been in contact with him on the matter. He encouraged Mr. Toshner to remain in contact and assured him the Board would communicate how it intended to move f orward. Consent Agenda A. August 12, 2026 Village Board minutes B. Administrator Report Administrator Green gave a brief update on current Village projects and departments. New Business A. Discussion & necessary action re: selection process for new building inspector Administrator Green sought direction on proceeding with interviews of the two candidates or exploring alternative selection processes. Trustee Beal suggested looking beyond the current candidates, noting the existing inspector may be willing to extend his tenure upon request . Administrator Green proposed options including a formal Request for Proposals (RFP) with wide distribution, direct outreach to known inspection firms, or a multi -jurisdictional inspection arrangement, noting some firms hadn't submitted past proposals. Tr ustee Moonen expressed dissatisfaction with the proposals, noting limitations like one candidate's limited availability and supported a multi -jurisdictional approach for more equitable cost -sharing. He recommended a broader RFP process to attract more cand idates. Trustee Baum suggested considering an in - house inspector based at the Village’s facilities. Administrator Green acknowledged this as possible but complicated, citing the need for certifications, coverage for absences, insurance, and a vehicle. Trustee Beal expressed hesitance with this option, while President Gehrke noted its prior discussions and the benefits of a multi -jurisdictional model. Trustee Moonen requested that staff obtain current insurance cost estimates so that the in -house option could be properly evaluated and not prematurely excluded. The Board reached a general consensus — without formal action — to direct Administrator Green to pursue a broader, more formal outreach and RFP process, while also continuing to explore the multi-jurisdictional consolidated inspection model as a longer-term solution. B. Discussion & necessary action re: ORD 2026-09 Authorizing withdrawls from Village Treasury Administrator Green explained the origin and purpose of the ordinance. He stated that following the departure of the previous Treasurer, it became apparent that the Village lacked a clear, codified policy outlining the chain of authority for accessing Vill age funds in the absence of the Treasurer or Village Administrator. The Village Attorney reviewed the matter and drafted Ordinance Village Board Minutes September 9, 2026 Page 3 of 3 Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov 2026-09 as an amendment to Chapter 2 of the Village code to formalize those authorities and ensure continuity of operations — specifically enabling the Deputy Treasurer to make payments and keep essential obligations current. Motion by Moonen, second by Baum, to approve Ordinance 2026-09 authorizing withdrawals from the Village Treasury, with the amendment to add the word "Treasurer" to Section 1(b) to specify the Deputy Treasurer. Motion carried unanimously. C. Discussion & necessary action re: Parkitecture contract for Park Improvements Project President Gehrke introduced the item, noting that action was needed due to an increase in the Parkitecture contract, now $239, 660, driven by an expanded project scope from $2,000,000 to $4,000,000. Administrator Green confirmed the increase was less than anticipated. Trustee Moonen agreed, mentioning initial expectations of a 10% increase were overshot. Concerns were raised over t he lack of specific completion dates and performance assurances. Green acknowledged some project elements might extend into 2028 due to material or scheduling issues but aimed for a 2027 completion. Bidding timing was debated; Gehrke and Moonen recalled discussions about early spring or winter bid cycles. Beal desired an earlier bid cycle, aligning with intentions to schedule work before spring. Gehrke clarified the contract focused on architectural services, with construction timelines detailed later. The project budget exceeded $200,000 by $39,000-$60,000, but Green noted initial figures lacked precise scope understanding. Moonen inquired if plan review fees were included in the ceiling; Green confirmed they were. The Board agreed to the contract, emphasizing a 2027 completion, early bidding, and contract sureties, with Beal departing at 7:03p.m. due to prior obligations. After additional discussion regarding details, motion by Baum, second by Moonen, to approve the contract with Parkitecture for an amount not to exceed $239,660.00 . Motion carried 3:0. Adjournment There being no further business, motion by Baum, second by Moonen, to adjourn the meeting at 7:15p.m. Respectfully submitted, Elisa M. To: Elected Officials and Officers From: MUNICIPAL LAW & LITIGATION GROUP, SC Re: Lake Country Municipal Court Joint Order for a Special Election for Municipal Court Judge Dated: September 14, 2026 Dear Ladies and Gentlemen: You have received a request from the Lake Country Municipal Court to adopt a revised Joint Order for a Special Election for Municipal Court Judge for the Lake Country Municipal Court. An issue was raised regarding the form of the prior order. It is very important that the effective date of the order is the same for all municipalities. To that end, the order specifically states: Upon execution of this Joint Order by all member communities of the Lake Country Municipal Court, this Joint Order shall be dated and effective as of November 30, 2026 All the municipalities are being asked to adopt this order prior to November 13, 2026. Please do not change the date of the order or the effective date. It is ok though, to date the signature the date that the governing body acted on the order. Realizing that this is unique situation, clearly not addressed adequately by the statutes, the Court’s staff and committees are working to legally call the special election. MUNICIPAL LAW & LITIGATION GROUP, S.C. Elected Officials and Officers September 14, 2026 Page 2 Please feel free to call me with any questions. Recommendation & Requested Action • Committee Recommendation: The Public Works Committee recommends approval of the Memorandum of Understanding. • Staff Recommendation: Move to approve the Intergovernmental Agreement (IMA) document between the Village of Lisbon and the Village of Sussex for water provisions to Southeast Lisbon. Memorandum of Understanding between the Village of Sussex and Village of Lisbon for water provision to the Southeast corner of the Village of Lisbon. The Village of Sussex, a Wisconsin Village located in Waukesha County, Wisconsin (“Sussex”), and The Village of Lisbon, a Wisconsin Village located in Waukesha County, Wisconsin (“Lisbon”) entered into an Intergovernmental Cooperative Plan under Wis. Stats. 66.0307, in September of 2020. Sussex and Lisbon both acknowledge that Municipal Law & Litigation Group, SC and its attorneys (“Law Firm”) represent both Sussex and Lisbon as to the specific legal issues that Sussex and Libson refer to the Law Firm. The Law Firm has not been asked to offer any a d v i c e , a n d w i l l o ff e r n o a d v i c e , a s t o t h e m a n y p o l i c y i s s u e s i n v o l v e d i n t h e t h i s Memorandum of Understanding , but has been asked to analyze only the legal issues involved in this Memorandum of Understanding. The Law Firm has advised both Sussex and Lisbon that the Law Firm reasonably believes that representing both Sussex and Lisbon as related to the legal issues involved in this Memorandum of Understanding will not be adverse to the Law Firm's relationship with either client . Given their understanding of these issues and the scope and nature of the Law Firm’s relationship and representation of both parties, Sussex and Lisbon, through the execution of this Memorandum of Understanding, consent to Municipal Law & Litigation Group, SC and its attorneys individually and collectively, representing both Sussex and Lisbon regarding the scope of representation described herein and waive any potential conflict of interest that might arise therefrom. The Intergovernmental Cooperative Plan contemplated Sussex providing Lisbon water service for the southeast corner of Lisbon at some point in the future if requested by Lisbon, if it was technically feasible, if there was sufficient water available, and if Lisbon paid all costs to provide a water system to the area (the “System”). In February 2026, Lisbon requested water service be extended to the southeast portion of Lisbon from Sussex. Sussex has acknowledged said request and believes based upon the data provided that water provision can occur. The Intergovernmental Cooperative Plan outlines many details about said water provision, but there are several important details to make the implementation of the water extension and System work based upon the specific request from Lisbon. Sussex and Lisbon want to detail these practical matters to make it feasible to complete the water provision and to agree to those matters in this Memorandum of Understanding. 1. Lisbon has requested water provision by the System for the “Service Area Lands” as shown on the map depicted in the attached Exhibit A, which is incorporated herein, for a water volume up to 45,000 gallons of average daily demand and a maximum day demand of 80,000 gallons , per day. This water provision is for use by residentially, commercially, and institutionally zoned properties located in Lisbon only based upon existing and planned uses for the S ervice Area Lands. Zoning amendments to properties served by water in Service Area Lands shall be reviewed by the Village of Sussex only to ensure water demand can be appropriately met within the daily usage values presented herein. Emergency flows, such as fire hydrant flow, may exceed the daily usage values. 2. Lisbon shall have the right to take ownership , should it so desire, the water system infrastructure described herein in the event that Lisbon creates its own water utility. This process shall conform to the procedures and requirements of the PSC. 3. Sussex will provide water via the System to Lisbon for use by the residential ly, commercially, and institutional ly zoned properties in the Service Area Lands as retail customers of Sussex as shown on Exhibit A for up to 45,000 gallons of average daily demand and a maximum day demand of 80,000 gallons with the following conditions: A. DESIGN AND APPROVAL 1. Lisbon shall enter into a contract with Strand Associates, Inc. (“Strand”) to design said System for the Service Area Lands shown on Exhibit A and shall pay all costs for design of the System. Strand shall design the System to meet all of Sussex’s required design specifications and construction details for the System and Lisbon shall submit plans to Sussex for approval by the Sussex Village Board prior to engaging in the bidding , as applicable, for the System . All costs incurred by Sussex for review and approval of the System’s design shall be paid by Lisbon pursuant to Sussex Village Code Section 3.11 regarding Professional Fee Chargeback. Specific critical design elements include but are not limited to: • Where the System’s water main will be placed in right of ways and easements so as to be accessible and protected from potential impacts. • Install pressure relief valves on individual customer service laterals where the service pressure will exceed 80 psi as required by building code. • The emergency interconnect to the City of Pewaukee’s water supply , which prevents the Service A rea Lands from being a long dead end in case of a water main break. Both parties may agree to waive this requirement only if the Wisconsin Department of Natural Resources, the Public Service Commission of Wisconsin, and/or the City of Pewaukee will not approve an emergency interconnection. • All properties are required to connect to the System within 6 months of the water main construction reaching substantial completion to ensure the water quality is maintained and the water revenue is sufficient to take on this infrastructure. • 2. Sussex will submit the plans, if approved by Sussex, for consideration by the necessary State agencies for the extension of the S ystem including the work necessary to receive approval from the necessary State agencies, including but not limited to the Public Service Commission of Wisconsin (“PSC”). Lisbon shall pay for all costs related to gaining the necessary approvals to extend the System. These costs include but are not limited to Strand ’s costs in preparing the documents and interacting with the PSC, filing fees, other consultant fees as necessary, and internal Sussex staff costs. Sussex agrees to submit to PSC as the applicant. 3. Lisbon shall negotiate and pay for the necessary right of way and/ or easements necessary to the installation of the System. Said right of way/easement acquisition shall be completed prior to bidding for construction of the System and shall be in a manner and form acceptable to Sussex. Any costs incurred by Sussex with respect to right of way/easement acquisition shall be paid by Lisbon. Sussex shall submit delinquent water charges to Lisbon Treasurer each year by no later than October 15 th, for collection. B. Construction and Implementation 1. Lisbon intends to bid this project for construction of the System in early 2027 pending the receipt of necessary DNR, PSC, and Sussex approvals. Water main construction shall be substantially completed within 12 months of receiving necessary approvals from DNR, PSC, and receiving concurrence from Sussex to proceed to bidding. Lisbon shall , within 30 days of execution of the construction contract to construct the System, make the necessary RCA payment to Sussex for the amount due in that year for each of the 114 residential and 1 institutional connecting structures. T he amount due shall be associated with the applicable RCA fee at the time and shall be commensurate with the Sussex standard fee schedule applicable at the time. Connections for new development structures shall be subject to the RCA fees applicable at the time of connection in accordance with the Sussex typical fee schedule. 2. Lisbon shall hire an i nspection firm that is acceptable to Sussex to inspect the construction of the System , including, but not limited to, depth, fill placement , sizing, and other similar items. Lisbon shall pay for all costs related to inspection including, but not limited to, any review or consultation with Sussex staff to ensure the System is completed in accordance with the project plans and specifications as approved by Sussex . Said inspection work shall also include record drawings and documents and necessary work to i ncorporate the System plans into Sussex’s G.I.S. system. 3. All necessary sampling and valve operations shall be performed by Sussex staff only. 4. Lisbon shall pay Sussex for the cost to purchase install all necessary water meters for the System and to conduct cross -connection control inspections . It is understood by both parties that due to the large volume of meter installations at one time, a third party approved by Sussex may be utilized to complete this work. 5. Upon completion of the System, Lisbon shall dedicate said System and any related public infrastructure, including granting any easements or use of right of way agreements, necessary for Sussex to own, maintain, and operate the System to Sussex. Sussex shall receive the dedication. 6. Lisbon shall secure the necessary agreements and have all 114 existing residential dwelling units and 1 institutional building connected to the System by December 1, 2027, or within 6 months of the water main installation being substantially completed, or a later date if agreed to by both parties due to permitting or construction delays. Requests for an extension must be submitted in writing to the Village of Sussex. Lisbon shall ensure for Sussex that there are no cross connections to the water system through internal plumbing and shall have this work properly inspected. Lisbon shall work with the property owners on abandonment of private wells to keep record of the situation and if a property is to maintain a private well after connection to the Sussex Water Utility that all DNR rules are enforced by Lisbon to ensure no cross connections and to ensure a regular volume of water sales occurs to keep water quality safe and to provide for sufficient revenue to maintain the System. 7. Lisbon will provide to Sussex, in a manner/form approved by Sussex, acceptance of special charges/assessments on behalf of their residents/property owners to ensure payment of utility bills so as to keep the Sussex Water Utility whole since Sussex can’t impose any applicable special charges/assessments to Lisbon taxpayers’ property taxes like it does for properties located within Sussex.
