MEETING MINUTES
PUBLIC HEARING & PLAN COMMISSION
RICHARD JUNG FIRE STATION – JUNE 24, 2026, at 6:30 PM
Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov
Call to Order
President Gehrke called the Public Hearing and Plan Commission meeting to order at 6:31PM.
Roll Call
Present: Village President Gehrke; Trustees Quinn, Moonen, Beal, and Baum; Commissioners Oelhafen,
Eberle, Howard, and Lesser; Planner Sumwalt; Engineer Leisses; Attorney Larson; Administrator Green;
and Clerk Cappozzo.
Absent/Excused: Commissioner McCormack.
Public Hearing to consider a request by applicant Connie Neibauer/ Par Tee Time Golf & Sports Bar
LLC, for an amendment to the existing Conditional Use Permit for a Restaurant and Tavern to allow an
outdoor patio area to be constructed in the B-2 Local Business Zoning District, on the property located
at N95W25901 County Line Road/ LSBT 0158.994.011.
Clerk Cappozzo read the published Notice of Public Hearing into the record and President Gehrke
opened the Hearing.
Planner Sumwalt presented an overview of the proposal using Waukesha County's GIS mapping. He
explained that the request involved a public hearing for a Conditional Use Permit amendment to allow
Par Tee Time Golf & Sports Bar to construct an outdoor patio area for food and beverage service,
including the outdoor consumption of alcohol. The proposed patio would occupy approximately 2,900
square feet in the northwest portion of the existing building footprint, utilizing what was formerly a bank
drive-through area. Planner Sumwalt emphasized that the proposed footprint would not increase the
overall impervious surface on the lot, as the drive-through lanes were already paved.
Planner Sumwalt reviewed the zoning context, noting that the B -2 district allows restaurants, supper
clubs, taverns, dance halls, and similar uses as conditional uses. He also recalled that when the
business was originally approved, the Commission had adop ted a text amendment creating a
permitted use for "theaters, arcades, video game parlors, and other indoor amusement places" in the
B-2 district—limited to uses under 10,000 square feet in total. He noted that the existing indoor golf
simulator use occupie d approximately 5,200 square feet, and that adding the proposed 2,900 -
square-foot patio would still remain under the 10,000 -square-foot threshold. He posed the question
to the Plan Commission as to whether the proposed outdoor patio area would be considered screened
to their satisfaction.

Planner Sumwalt summarized key details from the proposal: the site plan showed approximately 16
outdoor tables, a 6 -foot fence proposed along the south side of the patio, and new landscape beds
proposed along the north and west sides to connect existing la ndscape islands. He noted that
approximately 128 shared parking stalls existed on the shopping center lot. He highlighted two key
conditions of approval: that the patio would be subject to Village Board approval of a Class B alcoholic
beverage license amendment to include the outdoor premise area, and that the premise description
and the Conditional Use Permit must be consistent with respect to where the outdoor alcohol service
area is approved.
Clerk Cappozzo read a written comment into the record that was submitted by Jill Miles, N95W25938
Rivers Hollow Court (see attached).
Mr. Subedi responded, noting that additional landscaping had already been installed as part of the
original conditional use approval, and that the landscaping and the fence on the south side of the
patio would provide a layered buffer. He stated the busine ss had operated since opening without
neighbor complaints regarding noise or disturbance.
Theresa Nelson, N95W25850 Riverview Drive, read her written comments into the record (see
attached).
Darren Becker, N95W25357 Norwauk Road, addressed the Commission in support of the application.
Dee Freeman, 805 West Monroe Ave . Hartford, addressed the Commission in support of the
application.
Ashley Hallberger, 384 River Grove Drive, Unit 8, Milwaukee, a bartender at Par Tee Time, addressed the
Commission in support of the application
There being no further comments, President Gehrke closed the Public Hearing at 7:20PM.

A. Par Tee Time Golf for addition of outdoor patio area at N95W25901 Countyline Rd/ LSBT 0158.994.011:
i. Amendment to existing Conditional Use Permit for Restaurant/ Tavern
Having reviewed all applicable conditional use standards, Attorney Larson advised the
Commission that, based on the manner in which the standards had been evaluated, the
Commission was in a position to approve the amended Conditional Use Permit subject to
reasonable conditions. He proposed the following additional conditions beyond those
recommended by staff:
• The site plan shall be revised to comply with all applicable village ordinances, including
those governing fencing of outdoor licensed premise extensions.
• Landscaping along the south side of the patio shall be extended westward to the greatest
extent feasible, recognizing limitations posed by setback requirements and subsurface
infrastructure.
• Any amplified music shall be directed away from the south and maintained at a level
consistent with the Village's nuisance ordinance; live music is expressly prohibited.
Motion by Baum, second by Lesser, to approve the proposed amendment to the existing
Conditional Use Permit for a Rest aurant/ Tavern for Par Tee Time Golf & Sports Bar at
N95W25901 County Line Roa d, subject to Planner and Engineer comments , and the three
additional conditions proposed by Attorney Larson. The motion carried 5:1, with Commissioner
Howard dissenting.
ii. Amendment to existing Site Plan/ Plan of Operation (SPPOO)
President Gerke turned the Commission's attention to the Site Plan and Plan of Operation
amendment. The Commission confirmed that the conditions discussed under the Conditional
Use Permit—including the fencing requirement consistent with the municipal alco hol licensing
ordinance, landscaping, and music restrictions —would be incorporated into the Site Plan and
Plan of Operation as well.
A discussion arose regarding the proposed patio operating hours. Planner Sumwalt clarified
the distinction between business hours (the hours the establishment is open to the public),
patio hours (the hours the patio area is accessible to customers), and op erating hours (the
hours during which anyone, including staff, may be on -site). Ms. Neibauer clarified that the
hours she had listed—8:00 AM to 10:00 PM, Tuesday through Saturday—were intended to reflect
the full range of hours anyone might be present on the property, not that the patio would be
open to customers at 8:00 AM. She indicated that realistically, patio service to customers would
begin no earlier than approximately 11:00 AM.
The Commission discussed setting patio customer hours specifically. After deliberation,
consensus was reached to amend the patio hours to reflect that on Tuesdays, Wednesdays,
and Thursdays, the outdoor patio would close at 9:00 PM rather than 10:00 PM, wi th 10:00 PM

remaining as the closing time on Fridays and Saturdays. The opening time would remain as
submitted, providing operational flexibility for staff preparation. The establishment would
remain closed Sundays and Mondays.
Motion by Eberle, second by Oelhafen, to approve the proposed amendment to the existing Site
Plan/ Plan of Operation for Par Tee Time Golf & Sports Bar at N95W25901 County Line Roa d,
subject to Planner comments, amended patio hours, the conditions from the Conditional Use
Permit being incorporated into the Plan of Operation, and requiring a landscape plan for the
southern plantings to be reviewed and approved by the Village Planner. Motion carried
unanimously.
B. Condon Properties 2-Lot CSM to adjust common lot line of LSBT 0257.070 & LSBT 0257.071
Motion by Eberle, second by Howard, to approve the proposed Certified Survey map for LSBT
0257.070 and LSBT 0257.071, subject to Planner and Engineer comments , and recommendation to
Village Board of the same. Motion carried unanimously.
C. Amend existing SPPOO for Blaze Landscape at W220N5859 Townline Rd/ LSBT 0244.999.001
Planner Sumwalt explained that this item was a follow-up from the Commission's April meeting, at
which consideration of the biannual compliance review for Blaze Landscape's Conditional Use
Permit had been tabled pending the submission of an updated site pl an and plan of operation
amendment application. The petitioner had since submitted those materials.
Planner Sumwalt summarized the proposed amendments to the site plan, which included an
expanded boulder storage area, expanded wood chip storage area, a new used oil containment
tank on a concrete slab, a second dumpster, a relocated temporary topsoil stockpile, and a revised
general storage area replacing the former log stockpile. He noted changes to employee numbers
and details regarding the wood burning operation, which he had codified in a new section of the
Plan of Operation. He noted that wood burning had been a source of neighbor complaints,
primarily from the residential subdivision to the east in the Village of Menomonee Falls.
Planner Sumwalt identified two key questions for the Commission: first, whether the Commission
was comfortable with the petitioner's proposed changes to the wood burning provisions —
specifically a reduction to 14 burning days per calendar year, confined to January 1 through March
31, with burning limited to periods when winds were 8 miles per hour or less and between 7:00 AM
and 7:00 PM; and second, whether the large wood chipper that had recently been added to the
petitioner's equipment list was intended to be used on -site, and if so, whether the Commission
wished to establish operating hours for that equipment.
Petitioner Blaze Selestow clarified that the equipment list had been drawn from the business's
insurance records and reflected all equipment owned by the company across both its Lisbon and
Menomonee Falls properties, not solely what was stored in Lisbon at any given time. He explained
PLAN COMMISSION

Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov
that the large chipper —capable of processing trees up to 24 inches in diameter —was primarily
used on job sites, but had been used on -site on one occasion when a burning day was available
and was instead used to chip material, at which point the Village received a complaint, erroneously
believing it to be concrete crushing. He indicated that the chipper's noise level was comparable to
or less than that of the grinding equipment already permitted on-site.
The discussion on wood burning was substantive and reflected strong differences of opinion
among commissioners. Commissioners stated they did not believe burning should be allowed at
this location, characterizing it as incompatible with the surrounding residential area and noting
that the smoke—particularly on calm days with low winds —simply hangs in the air and migrates
to neighboring scho ols and residences , raised concerns about health impacts, comparing the
smoke to the Canadian wildfire smoke events of recent summers, with one member noting that
Menomonee Falls had declined to permit burning at the petitioner's other property and questioned
why Lisbon should accept what another municipality refused.
Mr. Selestow acknowledged the complaints and described the steps the business had taken to
self-monitor and extinguish fires when winds picked up unexpectedly. He argued that the
proposed reduction to 14 burning days, confined to the winter quarter, represented a signi ficant
concession, and that without burning, the wood material from landscaping and land -clearing
operations would need to be processed on -site by grinding or chipping over a much longer
period—generating sustained noise complaints from the same neighbors. He also stated that
alternatives such as offsite mulch or compost facilities were limited, as those facilities were
selective about the materials they accepted.
Commissioners acknowledged the difficulty of the choice between burning and the noise of
extended chipping or grinding operations , and a majority indicated a preference for eliminating
burning and allowing expanded on-site chipping and grinding instead.
Motion by Eberle, second by Lesser, to approve the amended Site Plan/ Plan of Operation for Blaze
Landscape at W220N5859 Townline Road, with wood burning entirely eliminat ed, and grinding
and/or chipping of wood permitted Monday through Friday from 7:00AM to 7:00PM for a maximum
of 7 days per calendar month, and subject to Planner comments.
Motion carried 5:1, with Commissioner Howard dissenting.
Unfinished Business
A. Review Bi-annual Compliance Report for Blaze Landscape’s CUP at W220N5859 Townline Road
Planner Sumwalt noted that this item had also been tabled from the April Plan Commission
meeting and was now before the Commission concurrently with the site plan and plan of operation
amendment just acted upon. He stated that, in his view as Village Plann er, the concerns he had

identified in connection with the Conditional Use Permit compliance had been substantively
addressed through the action taken under the preceding agenda item.
Motion by Eberle, second by Howard to find Blaze Landscape to be compliant with conditions under
its existing Conditional Use Permit for their Contractor Yard at W220N5859 Townline Road / LSBT
0244.999.001. The motion carried 6-0.
Planner Sumwalt confirmed that the matter would automatically return for the next scheduled
biannual compliance review in two years. Attorney Larson noted that the Commission retained the
authority to bring the matter back sooner if warranted by complaints or non-compliance.
Planner Report
Planner Sumwalt gave a brief update on recent Planner Appointments and upcoming projects. No
action taken.

There being no further business, motion by Eberle, second by Baum, to adjourn the meeting at 9:02PM.

RE: Swanson – Certified Survey Map
BACKGROUND:
1. Petitioners: Richard Swanson
2. Property Owner: Richard and Amanda Swanson
3. Location/Address: N94 W23611 Hermitage Drive, Colgate, WI 53017
4. Tax Key Number: LSBT 0150.020.002
5. Area: 3.52 AC
6. Existing Zoning: R-1 Suburban Single-Family Residential District, UC Upland Corridor District and
C-1 Conservancy Wetland District
7. Proposed Zoning: NA
8. Future Land Use: Low Density Residential (20,000 SF - 1.49 AC/DU)
Primary Environmental Corridor
OVERVIEW:
The Petitioner is requesting approval of a 2-Lot Certified Survey Map (CSM) to facilitate the creation of a new
parcel on the east end of the lot located at N94 W23611 Hermitage Drive, Colgate, WI 53017. The new parcel
will be for the Swanson’s to construct a new single-family residence.
Lot 1 has an area of 1.19 acres (51,929.8 S.F.) and Lot 2 has an area of 2.33 acres (101,389.3 S.F.). Lot 1 of
the proposed CSM encompasses the Richard Swanson’s existing single-family residence and has access via
an existing driveway on Harmitage Drive. Lot 2 of the proposed CSM encompasses a barn and is expected
to have access from Colgate Road.
PLANNER COMMENTS:
1. Zoning. The subject property is zoned R-1 Suburban Single-Family Residential District, which requires a
minimum area of one (1) acre without sewer, and requires a minimum average width of 150’ without
sewer. The road setback is 50’. Side/rear offsets are 20’ . The proposed lots meet the zoning district
requirements.
2. Barn on Lot 2. As mentioned above, Lot 2 of the proposed CSM encompasses an existing barn. On May
13, 2026, the Village Board adopted Ordinance No. 2026-03 (attached). This ordinance states, The Plan
Commission may allow the creation of a new lot where an existing accessory building(s) will remain on

the new lot prior to the construction of the new residence. Foth recommends the CSM being conditioned
on A and B (below) from Ordinance No. 2026-03.
Foth recommends the applicant shall submit to and obtain approval as to form from the Village Attorney
and as to amount from the Village Building Inspector a letter of credit or cash in the amount of 115% of
the removal and restoration costs relative to the existing access ory building(s) as determined by the
Village Building Inspector. This financial surety shall be submitted to the Village prior to the recording of
the Certified Survey Map.
Foth recommends the applicant shall submit to and obtain approval as to form from the Village Attorney
and the Village Building Inspector an agreement which would allow the Village to access the property
and remove the existing accessory structure(s) at the applicant’s expense if the applicant fails to obtain
an occupancy permit for the new residence on the new lot within two years of creation of the new lot.
Upon the property owner showing valid cause and in the best interest of the Village, the Plan Commission
may grant one extension of the original two-year period set forth above for a period not to exceed twelve
(12) months.
3. Environmentally Sensitive Areas. The property has a wetland and Primary Environmental Corridor, which
are depicted on the face of the proposed CSM in accordance with Section 20.165 and 20.97 (9) of the
Village’s Land Division and Development Ordinance . The Village’s wetland setback is 50’ pursuant to
Section 18.03 (7) b. of the Village Zoning Code.
Foth recommends changing the wetland setback on the proposed Certified Survey Map from 75’ to 50’
in accordance with Section 18.03 (7) b. of the Village Zoning Code.
Foth recommends preservation restrictions to protect the wetland and environmental corridors on Lot 1
and Lot 2 shall be included on the proposed Certified Survey Map.
ENGINEER COMMENTS:
Mitch Leisses, Village of Lisbon Village Engineer has provided separate correspondence regarding technical
review of the certified survey map.
STAFF RECOMMENDATION:

Re: Swanson Certified Survey Map (CSM) – Technical Review
Dear Village Clerk,
Kunkel Engineering has completed its technical review of the Certified Survey Map (CSM)
prepared for the subdivision of Lot 2 of Certified Survey Map No. 7523, located in the East ½ of
the Northwest ¼ of Section 2, Township 8 North, Range 19 East, Village of Lisbon, Waukesha
County, Wisconsin.
Review comments have been noted on the marked-up copy of the submitted Certified Survey
Map and are summarized below for your consideration.
CSM Technical Review Comments:
1. Revise all references from "Town of Lisbon" to "Village of Lisbon" throughout the
Certified Survey Map, including the title block, legal description, surveyor's certificate,
and approval certificates.
2. Update the owner information to include Amanda Swanson wherever ownership is
identified.
3. Provide Wisconsin State Plane Coordinates (South Zone) for all required reference
monuments in accordance with Wis. Admin. Code § A-E 7 and applicable Village
requirements.
4. Verify and correct the curve labeling on Sheet 1. Several curves are identified as "C1"
and should be renumbered or otherwise distinguished to correspond with the curve data
table.
5. Update the Board and Plan Commission approval certificates to reflect the current
Village governmental structure and titles. References to Town Board, Town Chairman,
Town Clerk, and Town Planning Commission should be revised to the appropriate
Village Board, Village President, Village Clerk, and Village Plan Commission, as
applicable.
6. Confirm whether extraterritorial plat review by the Village of Richfield is required. If
the property is no longer subject to Richfield's extraterritorial jurisdiction, remove the
extraterritorial review certificate from the CSM.
This concludes Kunkel Engineering's technical review of the proposed Certified Survey Map.
Should you have any questions or require additional clarification regarding these review
comments, please feel free to contact me.

RE: Doman – Waiver Request
BACKGROUND:
1. Petitioner: Steven Doman
2. Property Owners: Mary Margaret and Steven Doman
3. Location/Address: N77 W24195 Hidden Oaks Drive
4. Tax Key Numbers: LSBT 0201.997.010
5. Area: 3.68 AC
6. Existing Zoning: A-3 Agricultural/Residential Estate
7. Future Land Use: Low Density Residential (20,000 SF - 1.49 AC/DU)
OVERVIEW:
Steven Doman submitted a Waiver Application requesting a waiver from Section 18.03 (9) e. 2. i. of
the Lisbon Zoning Code which states that personal storage buildings shall be located no closer to
the base setback line than the rear line of the residence.
(9) Area regulations.
e. Accessory buildings and structures as defined in this chapter. Building permits are required
for the construction of any accessory building/structure of any size, including detached
garages which are included in the definition of "garage, private" in this chapter.
2. An accessory building or structure is considered a personal storage building if all of the
following are true:
i. It is located no closer to the base setback line than the rear line of the residence.
Mr. Doman lives on the co rner of Hidden Oaks Drive and Ridgefield Drive. As such, the subject
property has two street yards. Mr. Doman’s single-family residence has a setback from Ridgefield
Drive of approximately 82.7 ’ according to his Plat of Survey. Based on the above regulations the
proposed personal storage building would have to meet this same setback. Mr. Doman has

Staff Review
provided evidence that his septic system is located behind his house , which precludes him from
being able to build in this area.
The proposed location of the personal storage building would still meet the minimum 50-foot
setback from Ridgefield Drive.
According to Section 18.03 (9) e. 29. of the Lisbon Zoning Code, “A petitioner may request that the
village board, upon receipt of a recommendation from the village plan commission, waive
enforcement or allow modification of one or more provisions of this chapter dealing with size,
quantity and location limitations stated in this section as follows:”
ANALYSIS:
The Village Board, upon receipt of recommendation from the Village Plan Commission, shall make
a determination which shall include consideration, but not necessarily an affirmative finding, of the
following factors:
a. Whether the request is inconsistent or contradictory to the purpose, spirit or intent of
this chapter.
b. Whether the request violates the spirit or general intent of this chapter.
c. Whether the request is contrary to the public health, safety, or welfare.
7044 S. Ballpark Drive, Suite 200 • Franklin, WI 53132 • (414) 336-7900

Staff Review
d. Whether the request is hazardous, harmful, noxious, offensive or a nuisance by reason
of noise, dust, smoke, traffic congestion, odor or other similar factors.
e. Whether, for any other reason, the request will cause substantial adverse effect on the
property values and general desirability of the neighborhood.
f. Whether the request is incompatible to the surrounding land uses.
After considering the above-listed factors and any other factors that may be relevant to the matter,
the village board, upon receipt of a recommendation from the village plan commission, shall then
determine whether it is objectively reasonable to grant th e request for a waiver or modification. A
request for a waiver or modification may be granted without making an affirmative finding
concerning any one or more of the above-listed factors if, on the whole, it is objectively reasonable
to do so.
CONSULTING PLANNER’S RECOMMENDATION:
Recommend reviewing the evidence presented by the petitioner, consideration of any comments
provided at the meeting, and consideration of all required factors in making a recommendation to
the Village Board on whether the waiver should be granted.

Comprehensive Plan Update 2026
Village of Lisbon, Wisconsin
Approved by Village Board: __ /__ /2026
Recommended by Plan Commission: 8/26/2026
PURPOSE
Recognizing the need for comprehensive planning in accordance with the Wisconsin
“Comprehensive Planning” legislation, Lisbon created a Comprehensive Plan consistent with Wis.
Stats. §66.1001. Per the Statutes, the Village will provide updates to its Compr ehensive Plan at a
minimum of every ten (10) years.
In order for the Comprehensive Plan to operate effectively and to address the needs of the
citizens of the Village of Lisbon, the entire population must be kept informed. The decision -
making process must be open and consistent with state regulations. To ac complish this, the
following plan will be followed:
PROGRAM OVERSIGHT
1. A hybrid Comprehensive Plan Steering Committee consisting of Plan Commission
members, members of other committees, elected officials, and other community
stakeholders will guide the update of the Comprehensive Plan. Membership
should be large enough to ensure diverse viewpoints while remaining small
enough to allow effective discussion and decision-making. The Village
Administrator will recommend members, with formal appointments, made by the
Village Board.
2. A planning process progress report will be provided to the Village Board throughout
the planning process.
CITIZEN PARTICIPATION
1. The Village designates the Steering Committee to guide the update of the
Comprehensive Plan. The Steering Committee will meet periodically throughout
the planning process and serve in an advisory capacity, reviewing project
findings, evaluating public input, discussing policy alternatives and providing
guidance to staff and consultants regarding preparation of the Comprehensive
Plan Update. Members are expected to serve as liaisons to the broader
community, encourage participation in public engagement activities, and help
communicate planning progress and outcomes.
2. Notice of these meetings will be posted by the Village in the standard manner of
posting public meetings.
3. The Village will hold an open house to provide an overview of the draft plan and
recommendations and allow residents of the Village the opportunity to provide input
concerning the Comprehensive Plan. At a later meeting, the Plan Commission may
recommend the Comprehensive Plan to the Village Board for adoption.
4. The Draft Plan will be available for 30 days to allow residents to review and provide

2026 Public Participation Plan
comments. The Village will have a copy at the Village Hall, and on the Lisbon
website, for review.
5. A public hearing will be held at a joint meeting of the Plan Commission and Village
Board to review the Comprehensive Plan. After the public hearing has been held, the
Village Board may approve the Comprehensive Plan Update.
NOTICE OF HEARINGS
1. Per Wis. Stats. §66.1001(4)(d), the required public hearing by the Village Plan
Commission must be preceded by a Class 1 notice under Wisc. S.S. ch. 985 that is
published at least 30 days before the hearing is held. The political subdivision or
regional planning commission may also provide notice of the hearing by any other
means it considers appropriate. The Class 1 notice shall contain at least the following
information:
• The date, time and place of the hearing.
• A summary, which may include a map, of the proposed comprehensive plan or
amendment to such a plan.
• The name of an individual employed by the local governmental unit who may
provide additional information regarding the proposed ordinance.
• Information relating to where and when the proposed comprehensive plan or
amendment to such a plan may be inspected before the hearing, and how a
copy of the plan or amendment may be obtained.
2. At least 30 days before the public hearing is held, the Village will provide written notice
to all of the following:
• An operator who has obtained, or made application for, a permit that is
described under s. 295.12 (3) (d).
• A person who has registered a marketable nonmetallic mineral deposit under s.
295.20.
• Any other property owner or leaseholder who has an interest in property pursuant
to which the person may extract nonmetallic mineral resources, if the property
owner or leaseholder requests in writing that the local governmental unit provide
the property owner or leaseholder notice of the hearing.
REQUIRED PUBLIC HEARINGS
1. A required public hearing shall be held at a joint meeting of the Plan Commission and
Village Board before the Village Board may approve the adoption of the
Comprehensive Plan.
PROGRAM INFORMATION, FILES, and ASSISTANCE
1. Lisbon Staff will maintain, at Village Hall, a record of all citizen participation efforts
including minutes of meetings, and copies of notices and brochures.
NON-ENGLISH SPEAKING PERSONS
1. The Village will make all special efforts to assure them equal opportunity in the citizen
participation process.
