VILLAGE OF LISBON W234N8676 Woodside Road Lisbon, WI 53089-1545 MEETING MINUTES PUBLIC HEARING & PLAN COMMISSION RICHARD JUNG FIRE STATION – JUNE 24, 2026, at 6:30 PM Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov Call to Order President Gehrke called the Public Hearing and Plan Commission meeting to order at 6:31PM. Roll Call Present: Village President Gehrke; Trustees Quinn, Moonen, Beal, and Baum; Commissioners Oelhafen, Eberle, Howard, and Lesser; Planner Sumwalt; Engineer Leisses; Attorney Larson; Administrator Green; and Clerk Cappozzo. Absent/Excused: Commissioner McCormack. Public Hearing to consider a request by applicant Connie Neibauer/ Par Tee Time Golf & Sports Bar LLC, for an amendment to the existing Conditional Use Permit for a Restaurant and Tavern to allow an outdoor patio area to be constructed in the B-2 Local Business Zoning District, on the property located at N95W25901 County Line Road/ LSBT 0158.994.011. Clerk Cappozzo read the published Notice of Public Hearing into the record and President Gehrke opened the Hearing. Planner Sumwalt presented an overview of the proposal using Waukesha County's GIS mapping. He explained that the request involved a public hearing for a Conditional Use Permit amendment to allow Par Tee Time Golf & Sports Bar to construct an outdoor patio area for food and beverage service, including the outdoor consumption of alcohol. The proposed patio would occupy approximately 2,900 square feet in the northwest portion of the existing building footprint, utilizing what was formerly a bank drive-through area. Planner Sumwalt emphasized that the proposed footprint would not increase the overall impervious surface on the lot, as the drive-through lanes were already paved. Planner Sumwalt reviewed the zoning context, noting that the B -2 district allows restaurants, supper clubs, taverns, dance halls, and similar uses as conditional uses. He also recalled that when the business was originally approved, the Commission had adop ted a text amendment creating a permitted use for "theaters, arcades, video game parlors, and other indoor amusement places" in the B-2 district—limited to uses under 10,000 square feet in total. He noted that the existing indoor golf simulator use occupie d approximately 5,200 square feet, and that adding the proposed 2,900 - square-foot patio would still remain under the 10,000 -square-foot threshold. He posed the question to the Plan Commission as to whether the proposed outdoor patio area would be considered screened to their satisfaction. PLAN COMMISSION June 24, 2026 Page 2 of 6 Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov Planner Sumwalt summarized key details from the proposal: the site plan showed approximately 16 outdoor tables, a 6 -foot fence proposed along the south side of the patio, and new landscape beds proposed along the north and west sides to connect existing la ndscape islands. He noted that approximately 128 shared parking stalls existed on the shopping center lot. He highlighted two key conditions of approval: that the patio would be subject to Village Board approval of a Class B alcoholic beverage license amendment to include the outdoor premise area, and that the premise description and the Conditional Use Permit must be consistent with respect to where the outdoor alcohol service area is approved. Clerk Cappozzo read a written comment into the record that was submitted by Jill Miles, N95W25938 Rivers Hollow Court (see attached). Mr. Subedi responded, noting that additional landscaping had already been installed as part of the original conditional use approval, and that the landscaping and the fence on the south side of the patio would provide a layered buffer. He stated the busine ss had operated since opening without neighbor complaints regarding noise or disturbance. Theresa Nelson, N95W25850 Riverview Drive, read her written comments into the record (see attached). Darren Becker, N95W25357 Norwauk Road, addressed the Commission in support of the application. Dee Freeman, 805 West Monroe Ave . Hartford, addressed the Commission in support of the application. Ashley Hallberger, 384 River Grove Drive, Unit 8, Milwaukee, a bartender at Par Tee Time, addressed the Commission in support of the application There being no further comments, President Gehrke closed the Public Hearing at 7:20PM. ********************************* Citizen Comments None. Approval of Meeting Minutes – 5/27/2026 Plan Commission Motion by Baum, second by Howard, to approve the minutes as presented. Motion carried unanimously. PLAN COMMISSION June 24, 2026 Page 3 of 6 Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov New Business A. Par Tee Time Golf for addition of outdoor patio area at N95W25901 Countyline Rd/ LSBT 0158.994.011: i. Amendment to existing Conditional Use Permit for Restaurant/ Tavern Having reviewed all applicable conditional use standards, Attorney Larson advised the Commission that, based on the manner in which the standards had been evaluated, the Commission was in a position to approve the amended Conditional Use Permit subject to reasonable conditions. He proposed the following additional conditions beyond those recommended by staff: • The site plan shall be revised to comply with all applicable village ordinances, including those governing fencing of outdoor licensed premise extensions. • Landscaping along the south side of the patio shall be extended westward to the greatest extent feasible, recognizing limitations posed by setback requirements and subsurface infrastructure. • Any amplified music shall be directed away from the south and maintained at a level consistent with the Village's nuisance ordinance; live music is expressly prohibited. Motion by Baum, second by Lesser, to approve the proposed amendment to the existing Conditional Use Permit for a Rest aurant/ Tavern for Par Tee Time Golf & Sports Bar at N95W25901 County Line Roa d, subject to Planner and Engineer comments , and the three additional conditions proposed by Attorney Larson. The motion carried 5:1, with Commissioner Howard dissenting. ii. Amendment to existing Site Plan/ Plan of Operation (SPPOO) President Gerke turned the Commission's attention to the Site Plan and Plan of Operation amendment. The Commission confirmed that the conditions discussed under the Conditional Use Permit—including the fencing requirement consistent with the municipal alco hol licensing ordinance, landscaping, and music restrictions —would be incorporated into the Site Plan and Plan of Operation as well. A discussion arose regarding the proposed patio operating hours. Planner Sumwalt clarified the distinction between business hours (the hours the establishment is open to the public), patio hours (the hours the patio area is accessible to customers), and op erating hours (the hours during which anyone, including staff, may be on -site). Ms. Neibauer clarified that the hours she had listed—8:00 AM to 10:00 PM, Tuesday through Saturday—were intended to reflect the full range of hours anyone might be present on the property, not that the patio would be open to customers at 8:00 AM. She indicated that realistically, patio service to customers would begin no earlier than approximately 11:00 AM. The Commission discussed setting patio customer hours specifically. After deliberation, consensus was reached to amend the patio hours to reflect that on Tuesdays, Wednesdays, and Thursdays, the outdoor patio would close at 9:00 PM rather than 10:00 PM, wi th 10:00 PM PLAN COMMISSION June 24, 2026 Page 4 of 6 Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov remaining as the closing time on Fridays and Saturdays. The opening time would remain as submitted, providing operational flexibility for staff preparation. The establishment would remain closed Sundays and Mondays. Motion by Eberle, second by Oelhafen, to approve the proposed amendment to the existing Site Plan/ Plan of Operation for Par Tee Time Golf & Sports Bar at N95W25901 County Line Roa d, subject to Planner comments, amended patio hours, the conditions from the Conditional Use Permit being incorporated into the Plan of Operation, and requiring a landscape plan for the southern plantings to be reviewed and approved by the Village Planner. Motion carried unanimously. B. Condon Properties 2-Lot CSM to adjust common lot line of LSBT 0257.070 & LSBT 0257.071 Motion by Eberle, second by Howard, to approve the proposed Certified Survey map for LSBT 0257.070 and LSBT 0257.071, subject to Planner and Engineer comments , and recommendation to Village Board of the same. Motion carried unanimously. C. Amend existing SPPOO for Blaze Landscape at W220N5859 Townline Rd/ LSBT 0244.999.001 Planner Sumwalt explained that this item was a follow-up from the Commission's April meeting, at which consideration of the biannual compliance review for Blaze Landscape's Conditional Use Permit had been tabled pending the submission of an updated site pl an and plan of operation amendment application. The petitioner had since submitted those materials. Planner Sumwalt summarized the proposed amendments to the site plan, which included an expanded boulder storage area, expanded wood chip storage area, a new used oil containment tank on a concrete slab, a second dumpster, a relocated temporary topsoil stockpile, and a revised general storage area replacing the former log stockpile. He noted changes to employee numbers and details regarding the wood burning operation, which he had codified in a new section of the Plan of Operation. He noted that wood burning had been a source of neighbor complaints, primarily from the residential subdivision to the east in the Village of Menomonee Falls. Planner Sumwalt identified two key questions for the Commission: first, whether the Commission was comfortable with the petitioner's proposed changes to the wood burning provisions — specifically a reduction to 14 burning days per calendar year, confined to January 1 through March 31, with burning limited to periods when winds were 8 miles per hour or less and between 7:00 AM and 7:00 PM; and second, whether the large wood chipper that had recently been added to the petitioner's equipment list was intended to be used on -site, and if so, whether the Commission wished to establish operating hours for that equipment. Petitioner Blaze Selestow clarified that the equipment list had been drawn from the business's insurance records and reflected all equipment owned by the company across both its Lisbon and Menomonee Falls properties, not solely what was stored in Lisbon at any given time. He explained PLAN COMMISSION June 24, 2026 Page 5 of 6 Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov that the large chipper —capable of processing trees up to 24 inches in diameter —was primarily used on job sites, but had been used on -site on one occasion when a burning day was available and was instead used to chip material, at which point the Village received a complaint, erroneously believing it to be concrete crushing. He indicated that the chipper's noise level was comparable to or less than that of the grinding equipment already permitted on-site. The discussion on wood burning was substantive and reflected strong differences of opinion among commissioners. Commissioners stated they did not believe burning should be allowed at this location, characterizing it as incompatible with the surrounding residential area and noting that the smoke—particularly on calm days with low winds —simply hangs in the air and migrates to neighboring scho ols and residences , raised concerns about health impacts, comparing the smoke to the Canadian wildfire smoke events of recent summers, with one member noting that Menomonee Falls had declined to permit burning at the petitioner's other property and questioned why Lisbon should accept what another municipality refused. Mr. Selestow acknowledged the complaints and described the steps the business had taken to self-monitor and extinguish fires when winds picked up unexpectedly. He argued that the proposed reduction to 14 burning days, confined to the winter quarter, represented a signi ficant concession, and that without burning, the wood material from landscaping and land -clearing operations would need to be processed on -site by grinding or chipping over a much longer period—generating sustained noise complaints from the same neighbors. He also stated that alternatives such as offsite mulch or compost facilities were limited, as those facilities were selective about the materials they accepted. Commissioners acknowledged the difficulty of the choice between burning and the noise of extended chipping or grinding operations , and a majority indicated a preference for eliminating burning and allowing expanded on-site chipping and grinding instead. Motion by Eberle, second by Lesser, to approve the amended Site Plan/ Plan of Operation for Blaze Landscape at W220N5859 Townline Road, with wood burning entirely eliminat ed, and grinding and/or chipping of wood permitted Monday through Friday from 7:00AM to 7:00PM for a maximum of 7 days per calendar month, and subject to Planner comments. Motion carried 5:1, with Commissioner Howard dissenting. Unfinished Business A. Review Bi-annual Compliance Report for Blaze Landscape’s CUP at W220N5859 Townline Road Planner Sumwalt noted that this item had also been tabled from the April Plan Commission meeting and was now before the Commission concurrently with the site plan and plan of operation amendment just acted upon. He stated that, in his view as Village Plann er, the concerns he had PLAN COMMISSION June 24, 2026 Page 6 of 6 Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov identified in connection with the Conditional Use Permit compliance had been substantively addressed through the action taken under the preceding agenda item. Motion by Eberle, second by Howard to find Blaze Landscape to be compliant with conditions under its existing Conditional Use Permit for their Contractor Yard at W220N5859 Townline Road / LSBT 0244.999.001. The motion carried 6-0. Planner Sumwalt confirmed that the matter would automatically return for the next scheduled biannual compliance review in two years. Attorney Larson noted that the Commission retained the authority to bring the matter back sooner if warranted by complaints or non-compliance. Planner Report Planner Sumwalt gave a brief update on recent Planner Appointments and upcoming projects. No action taken. Adjournment There being no further business, motion by Eberle, second by Baum, to adjourn the meeting at 9:02PM. Respectfully submitted, Elisa M. Cappozzo, WCMC Lisbon Village Clerk
