Wisconsin Statutes Section 62.23 (7)(de)1.b., which means facts and information other than merely
personal preferences or speculation, directly pertaining to the requirements and conditions an applicant
must meet to obtain a CUP and that reasonable persons would accept in support of a conclusion. A

A. The proposed conditional use shall comply with all regulations of the applicable zoning district in
which it is located.
Petitioner’s Response: All regulations proposed for the patio will be complied with.
B. The establishment, maintenance, or operation of the proposed use shall not be detrimental to or
endanger the public health, safety, or general welfare.
Petitioner’s Response: The site will remain safe for the public.
C. The proposed conditional use shall be compatible with the character of the neighborhood within
the immediate area in which it is located. In making such a determination, consideration shall be
given to the following:
i. The type and extent of landscaping and screening on the site.
Petitioner’s Response: The south side of the patio will have a six (6) foot fence installed.
The west side has an existing garden bed that will remain and plants added. The north side
will have a six (6) foot wide garden bed running the full length of the patio. The east side is

Staff Review
Petitioner’s Response: The public interest and welfare are important to us. We have been asked by
customers to make a patio so they can enjoy the weather while still supporting our business. The
customers have been so wonderful and happy we are here close to their homes.
J. All other conditional use standards identified in 4 (h) or elsewhere in this Ordinance are met.
Petitioner’s Response: We plan to follow all of the rules and regulations.
Per 2017 Wisconsin Act 67, conditional use authority is now specifically addressed within the statutes.
In summary, conditional use decisions must be made based on substantial evidence – facts and
information, other than merely personal preferences or speculation, directly pertaining to the
requirements and conditions an applicant must meet to obtain a conditional use permit and that
reasonable persons would accept in support of a conclusion. The applicant must present substantial
evidence demonstrating that the application and all requirements and conditions established by the
Village relating to the conditional use are or shall be satisfied. Any condition imposed by the Village
through ordinance or by the Village Board must be reasonable and, to the extent practicable,
measurable and may include conditions such as the permit’s duration, transfer, or renewal. The
Village’s decision to approve or deny the application must be supported by substantial evidence. In
addition, per Wis. Stats. 66.1001(2m) (b), a conditional use permit that may be issued by a political
subdivision does not need to be consistent with the political subdivision’s comprehensive plan.

The petitioner’s response to the specific conditional use standards proposes new landscape bed(s)
along the north side of the proposed patio area, enhancements to the existing landscape bed along
the west side of the patio and the addition of a six (6) foot fence along the south side of the patio.
The Plan Commission should determine whether the proposed patio is screened to its satisfaction.
f. Parking: No additional off -street parking proposed. According to Section 18.03 (10) a. 12 of the
Village of Lisbon Zoning Code, restaurants, taverns, clubs, etc. require one (1) space per three (3)
patrons based on maximum capacity plus two spaces for every three employees of the larges work
shift. Applying this standard, the proposed Par Tee Time Golf & Sports Bar with the addition of the

1. Comprehensive Plan. The Future Land Use of Commercial is consistent with the zoning of B-2 Local
Business District.
2. Zoning District Requirements. The property is zoned A-10 Agriculture District in which “contractor’s
yards” are a conditional use per Section 18.13 (d) (6).
3. Plan of Operation. The proposed plan of operation includes:
a. Uses and activities: The operation of a fill site to include dumping of structural material brought in
from off-site subject to compaction testing by CGC, Inc. over the approximately 5–10-year duration
of the project, and a contractor’s yard for Blaze Landscape Contracting, In c. to include the storage
of landscape material and equipment, including equipment for the filling operations.
b. Number of Employees:
i. Full-time 2
ii. Part-time: 10
iii. Maximum 5 employees at any given time.
c. Hours of operation:
i. Fill Site: 7:00 a.m. to 7:00 p.m. Monday – Saturday
Staff is on site 5:00 a.m. to 10:00 p.m.
ii. Contractor’s Yard: 7:00 a.m. to 7:00 p.m. Monday – Friday
7:00 a.m. to 5:00 p.m. – Saturday
Staff is on site 5:00 a.m. to 10:00 p.m.
Property maintenance as needed – 24/7
iii. Grinding Wood Material: 7:00 a.m. to 7:00 p.m. Monday – Friday
Once per month with 48-hour written notice given to the Town

“According to Condition No. 14.a. of the contractor’s yard conditional use permit, “No use is hereby
authorized unless the use is conducted in a lawful, orderly, and peaceful manner. Nothing in this
permit shall be deemed to authorize any public nuisance or to constitute a waiver, exemption or
exception to any law, ordinance, order, or rule of either the municipal governing body, the County of
Waukesha, the State of Wisconsin, the United States of America, or other duly constituted authority,
except only to the extent that it authorizes the use of the subject property above described in any
specific respects described herein…”.
The Village has received numerous complaints including evidence that the burning operations
associated with the contractor’s yard use for Blaze Landscape Contracting, Inc. constitute a
nuisance. Please see Exhibit C for further details. The Plan Commission should evaluate whether the
burning activities associated with the contractor’s yard operations for Blaze Landscape Contracting,
Inc. are consistent with the intent and limitations of the site’s original approval. “
e. Wood grinding process:
At the April 22, 2026, Plan Commission meeting Blaze mentioned using a Vermeer Tree Chipper –
WC2300XL (see link below) recently and getting a noise compliant from a neighbor. It was
understood that grinding would occur onsite. As such, sound levels for the horizontal grinder were
included in the original packet materials (see snip below). Furthermore, this is why hours of
operation for grinding were limited in the approval.
https://www.vermeer.com/na/whole-tree-chippers/wc2300xl
The originally approved Site Plan depicts an area for the “Wood grinding process”, which appears
as “Wood Processing Area” on the Current Site Plan.

The Plan Commission should determine whether it’s appropriate for this large chipper to be used
on site
f. Outdoor Storage: According to the applicant, landscape material will be stored throughout the site
in an organized manner. Equipment will be stored west of the existing buildings & fill equipment will
typically be left in the pit. The SPPOO must include the type and quantity of equipment and vehicles
owned or leased by the property owner, per Section 4, (h) 11. E. of the Town of Lisbon Zoning
Ordinance. The petitioner has provided a n upd ated list of eighty-one (81 ) pieces of equipment
(Exhibit A) that will come and go from the property as needed. Equipment will be stored on the west
side of the western building as identified on the submitted site plan. The original equipment list only
included twenty-three (23) pieces of equipment. The Plan Commission should determine whether
the equipment list submitted by the applicant is appropriate. The site plan identifies the location of
the proposed outdoor storage of landscape materials including logs, topsoil, boulders, wood chips,
brush to be ground, non -structural fill, & recycled materials – reclaimed gravel or asphalt . Material
piles will be limited to 20’ in height from the existing grade. In addition, plant materials will be kept in
a “heel-in” area on the north side of the property. Furthermore, the project narrative states that all
materials will be stored in bin areas made of concrete bin blocks to maintain the site in an “organized
manner”. The Plan Commission should determine whether the proposed outdoor storage of
materials and equipment is adequately screened from any public place and any surrounding private
property.
g. Parking: No changes to the off-street parking are being proposed. The existing parking area is
approximately 9’ x 18’ (162 SF) with a total of eight (8) spaces.
h. Buildings: There are two (2) existing metal, slab on grade storage buildings on the north side of the
property. Each building is approximately 70’ x 40’ or 2,800 square feet.
i. Exterior Lighting: No new lighting proposed. Each of the existing buildings has one (1) security light,
which will run from dusk to dawn.
j. Signage: No signage proposed.
k. Odor, Smoke, Noise: Yes.
l. Chemicals/Hazardous Materials: Yes. An existing 500-gallon off-road diesel storage tank on an 8’ x
12’ concrete slab and an added used oil tank for temporary storage of used oil from vehicles and
equipment. According to the petitioner the tank is regularly pum ped and the oil recycled. The
petitioner should clarify whether the used oil tank is also on a concrete slab.
m. Stormwater Management and Erosion Control : No proposed changes to the existing stormwater
management facilities on site.
n. Refuse Disposal: Yes. A second dumpster was added along the west side of the eastern existing
building as indicated on the current site plan (Exhibit B).
4. Traffic, Circulation and Access. The site is accessible via a driveway on Town Line Road (CTH V).

Village of Lisbon Plan Commission may take the following actions:

PLANNER COMMENTS:
1. Potential Nuisance: According to Condition No. 14.a. of the contractor’s yard conditional use permit, “No
use is hereby authorized unless the use is conducted in a lawful, orderly, and peaceful manner. Nothing
in this permit shall be deemed to authorize any public nuisance or to constitute a waiver, exemption or
exception to any law, ordinance, order, or rule of either the municipal governing body, the County of
Waukesha, the State of Wisconsin, the United States of America, or other duly constituted authority,
except only to the extent that it authorizes the use of the subject property above described in any specific
respects described herein…”.
The Village has received numerous complaints including e vidence that the burning operations
associated with the contractor’s yard use for Blaze Landscape Contracting, Inc. constitute a nuisance.
Please see Exhibit C for further details. The Plan Commission sh ould evaluate whether the burning
activities associated with the contractor’s yard operations for Blaze Landscape Contracting, Inc. are
consistent with the intent and limitations of the site’s original approval.
2. Current Site Plan. The petitioner’s compliance report submittal includes Exhibit B - Current Site Plan,
which is the last page of the report. Please note this site plan includes several differences from the Site
Plan that was originally approved in 2022. Foth has requested Blaze Landscape Contracting, Inc. provide
a summary of these changes. Condition No. 2 of the Site Plan and Plan of Operation approval states,
“This Site Plan/Plan of Operation approval is subject to the Petitioner complying at all times with the
plans and documents presente d to the Town of Lisbon Plan Commission on June 2, 2022 .” Foth
recommends Blaze Selestow (Blaze Landscape Contracting, Inc) apply for a Site Plan and Plan of
Operation amendment by the May submittal cut-off date for the June Plan Commission meeting, or this
will become a matter of zoning enforcement.
Foth recommends the Plan Commission make no finding at this time regarding compliance of the conditional
use permit, pending a Site Plan and Plan of Operation (SPPOO) amendment. The SPPOO amendment shall
address burning hours, burning procedures, the source of materials for burning, and the frequency of burning
on site.
STAFF RECOMMENDATION:
Depending on confirmation by the Village of Lisbon Plan Commission of the above-described comments and
subject to any additional information received at the meeting, the Village of Lisbon Plan Commission may
take the following actions:
2-Year Compliance Review of the Conditional Use Permit

Subject: Blaze Burn Permit
Dear Lisbon village board members,
This is Terry Krause at W216N5841 Memorial Dr. Menomonee Falls, Wisconsin, representing our
neighborhood group near the site of Blaze landscape burning. I filed a general complaint (request ID 7) on the
Lisbon Village website on 2/19/25 requesting the revocation of Blaze Lands cape's burning permit (W220N5859
Town Line Rd, Lisbon, WI 53089). Your response was to make Blaze aware of their permit conditions, notify
the Sheriff of those conditions, and request increased vigilance from the Sheriff regarding enforcement. I
appreciated the response, but the hazard continues to be substantial. Over the last year and particularly
throughout January and February 2026 burning has continued, many times under conditions that violate permit
requirements. Sheriff records I obtained from an open records request indicate some violations occurred with
winds from 24 to 34 MPH. Other records show Blaze was allowed to continue letting the fire smolder overnight.
Still other records show the deputy took no action on a legitimate complaint because Blaze staff told him/her
they had a burn permit. Days when the conditions were met (under 9MPH) smoke conditions in the
neighborhood were actually worse as the smoke can then linger in our neighborhood for days. It is unsafe to
burn heavy amounts of material within 100 yards of the grounds of Halquist Athletic Field, SSI, Templeton and
Hamilton High School and residential neighborhood. I believe any reasonable person (jury) would see it that
way. Videos I shared with you and those I've attached today well document the level of harmful smoke after
your interventions were implemented. The videos provide ample evidence that the smoke is particularly heavy
and hazardous even when permit conditions are met. The smoke has caused my neighbor to have asthma
attacks and other neighbors to have sore throats because smoke is penetrating their houses even with
windows sealed. It has prevented us from walking in our neighborhood and using our yards. Here is a petition
asking you to revoke Blaze's burning permit, signed by 390
individuals. https://www.change.org/Blazehazardoussmoke Here are links with credible medical journals
explaining the health risks of this level and type of smoke: National Institute of Health: Health effect of
particulate matter ; American Lung Association: hazards of particulate-matter ; EPA: Heath Risks of Particulate
Matter from smoke; Journal of Medical Toxicology: Health effects of PM; Yale Medicine: How bad is smoke?
The situation warrants a revoking of the burning permit of Blaze Landscape by the town of Lisbon and a ban on
burning at that site. Dan Green informed me that he has discussed the situation with Matthew Gehrke, the
board president. Also that the review of Blaze’s conditional use burn permit will occur in February or March
2026. Dan said he would be working with the clerk to set a date and would let me know as soon as it is on the
agenda. We have been monitoring the Planning Commission's agenda. The March Agenda just came out, and
the Blaze permit review is not on it.
Dan informed me that the videos I sent put the hazard in perspective. Please watch the two additional videos
attached today to gain additional perspective. One shows smoke pouring onto SSI playground on 2/18/26 while
children are playing. That video was taken after the loading of debris and the fire had subsided, the smoke had
been much worse earlier. The other video shows the volume of smoke entering our neighborhood taken 1/4
mile from the site just as the smoke begins arriving. Imagine the homes just across the street.
In the past we have set deadlines that we let pass without action in order to give the board time to fix this
hazardous situation. We have waited a year. Our patience has run out and this next deadline is firm. Please
2
see the actions steps we will be taking if the permit is not revoked by the May 20, 2026 meeting. We will set
up meetings with the media for the week of May 25 and already have a meeting scheduled with attorny Todd
E. Palmer (Michael Best & Friedrich). We will only cancel those if the permit is permanently revoked by
May 20, 2026 Because this significantly impacts the health and safety of our families, school kids and
community, we will relentlessly follow through on each step and continue to formulate and implement new
steps until the permit is revoked, no matter how long it takes.
Steps already taken steps 1-4 with updates
1. Continue calling the Lisbon Police to cite Blaze each time they violate their burning permit. Open records
request for all violations to share with the media and the attorney. Demand that the fire be extinguished, not
just continue to linger as it has many times in the past. (documented by sheriff's records)
2. Our neighborhood group started a petition: (390 signatures as of 3/22/25, 50 signatures close to the burn site)
petitioners were given an update email on 3/22/26. Link to petition,
https://www.change.org/Blazehazardoussmoke
•
•
• Distributed petition flyer to 200 neighborhood families and parents of students at TMS,
• HHS, SSIS, completed 2/28/25
•
•
•
•
•
•
3. Make a formal request via email to Lisbon board members asking them to revoke Blaze's burning permit.
Completed 3/2/2025 and again 3/22/26 New: Documentation of all corraspondance will be made available to
the media and the attorney.
4. On 3/22/2026 Blaze burning hazard concerns were made available to 500+ on area neighborhood group
app with video of smoke covering Silver Spring Intermediate School playground with students on the
playground. Shared that they will be updated with action steps if the permit is not revoked..
The following steps will be initiated if we do not have documentaion that the burn permit is revoked by
May 20, 2026.
5. Burn Permit not revoked by May 20, 2026. Distribute 500 more updated petition flyers to Hamilton Parents,
include youtube link of all smoke videos in the flyer, highlighting video with smoke covering SSI. Include these
in the petition and on the flyer with encouragement to share with other parents, to contact Lisbon board
members, to attend Lisbon board meetings, to share on social media and with news outlets to share with
Hamilton school board members.
6. Contact local media to run stories: Waukesha Freeman, Sussex Sun, Milwaukee Journal, and Channels 4,
6, 12, and 58. Share all correspondence, petitions, sheriff complaint records, credible medical journals,
documentation comparing particulate matter levels during burns to non-burn times, and video footage of smoke
entering neighborhoods and school grounds. Offer interviews and testimonials from residents about their
experiences with the smoke and health hazards. Emphasize the refusal of Blaze and the Village of Lisbon to
stop this community health hazard.
3
7. Inform 390 petition signers via the change.org portal that the request for the burn permit revocation was
denied by the Village of Lisbon and encourage them to file general complaints with the Village of Lisbon,
attend planning commission meetings, and share concerns on social media and contact local media .
8. Send petitions, along with the attached video showing smoke covering SSI while children play, to TMS, ISS
and Hamilton High School District parent organizations. This will ensure they are aware of the risks to their
children on school grounds and encourage them to share the petition with all parents and take action steps
including contacting local media, using social media, filing complaints with the Village of Lisbon, attending
Lisbon Village meetings and sharing concerns at school board meetings and school board members and their
own villiage jurisdiction.
9. Meet with the Hamilton District School Board and Superintendent sharing videos and informing them of the
risk to students and staff from Blaze Landscaping burning and encourage them to use district lawyers and
leverage from parents to address and stop the health risk.
10. Start a gofundme and request donations from the neighborhood and petition signers to fund air quality
testing during non burn periods and during burn periods downwind of the burning and to hire an environmental
lawyer Todd E. Palmer (Michael Best & Friedrich), to begin a lawsuit against the village and Blaze
Landscape. Also possible soil testing for hazardous residue.
11. Share all concerns, videos and correspondence with the Menomonee Falls Village, Butler and Sussex
Village board members to make them aware of the hazard to students and their community. Ask if they have
the resources or jurisdiction to stop the hazard or assist with air quality testing or use village lawyers to protect
affected Menomonee Falls Sussex and Butler residents and students.
12. The neighborhood group will attend a Lisbon Village Board meeting to explain the hazard using the most
credible medical journals, share documentation of logged events, share video footage, share testimonials from
residents about their experiences with the smoke and health hazards. So our concerns are further
documented.
13. Monitor health events of residents and students near Blaze during burn events correlating those health
issues with the health issues detailed in credible medical journals. Use particulate matter levels collected
during Blaze burns to show the correlation between the health events near Blaze burning and the particulate
matter levels proven harmful by credible medical journals. Initiate legal liability action related to those health
events. (heart attacks, respiratory issues, asthma attacks, cancers) toward Blaze and the Village of Lisbon.
14 . Those who have signed the petition, are neighborhood app members, and are parents will be directed to
go to all Blaze review sites and give a one-star review. Explain that the one star relates to Blaze's and the
Town of Lisbon's uncaring refusal to respond to community requests to stop creating a health hazard for the
community.

Subject: Revoke Blaze Landscape's Burn Permit
To Whom It May Concern:
Hello! My name is Alison Hipp and I am a home owner living in the Silver Spring Estates neighborhood off of
Town Line Road near Silver Spring. I am writing in regards to the continuous, hazardous burning Blaze
Landscapes is inflicting on its neighbors. I a
m asking for the Blaze Landscape burning permit to be revoked due
to the excessive amount of burning, continuous stench and the unhealthy air quality it is creating for our
neighborhoods and schools. I signed the online petition regarding concerns of this burning over a year ago and
prior to that have called the Town of Lisbon to personally complain about Blaze Landscape's continual burning.
I was told Blaze has been fined, but continues to burn regardless of time of day and burning restrictions.
My husband and I have two children in the Hamilton School District. One attends Silver Spring Intermediate
and the other Hamilton High School. Both of these schools are in Blaze Landscape's backyard and they are too
often polluted with smoke from the fires coming from Blaze property. When the smoke isn't blowing in the
direction of the schools and harming our children, it meets them at home in our neighborhood. I can't tell you
the countless times I have had to close open windows due to the smell of burning brush. On a few occasions,
when it was too cold to even have open windows, the smoke was so strong it was seeping through our front
door wall with no way for us to cease it from entering our home. The large smoke plumes hovering over our
neighborhood, the one next to ours, and the surrounding schools is deeply disturbing, especially when
considering the harmful toxins we are breathing in without opportunity to avoid it because it is literally in our
yards, surrounding our homes and schools..
I am asking the Village of Lisbon to revoke, not renew, the burning permit for Blaze Landscape on Townline
Road. The periodic weekly burning of thousands of pounds of debris is a public health crisis affecting residents
and students at Silver Spring Intermediate, Templeton Middle, and Hamilton High School. Our families deserve
clean air. Please deny the permit renewal.
Sincerely,
Alison Hipp

Hello,
I am writing to demand that the Village of Lisbon revoke, not renew, the burning permit for Blaze
Landscape on Townline Road.
The periodic weekly burning of thousands of pounds of debris is a public health crisis affecting residents
and students at Silver Spring Intermediate, Templeton Middle, and Hamilton High School.
In addition, we live in the neighborhood right across the street from Blaze. We cannot have our windows
open on nice days, my kids are playing outside on nice days and we can smell the smoke in the air. My
husband and son have asthma and the poor air quality is a huge health hazard.
Our families deserve clean air. Please deny the
permit renewal.
Thank you for your time and attention to this matter.
