MEETING MINUTES
PUBLIC HEARINGS & PLAN COMMISSION
RICHARD JUNG FIRE STATION – December 3, 2025, at 6:30 PM
Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov
Call to Order
President Gehrke called the Public Hearings and Plan Commission meeting to order at 6: 31p.m.
Roll Call
Present: Village President Gehrke; Trustees Quinn (via Zoom) and Baum; Commissioners Eberle,
Howard, McCormack, and Lesser; Planner Mularkey; Engineer Leisses; Attorney Larson; Administrator
Green; and Clerk Cappozzo.
Absent: Commissioner Oelhafen and Planner Sumwalt were absent and excused.
Public Hearing No. 1: Joint Public Hearing, pursuant to Section 18.04(g)(1) Lisbon Municipal Code, to
consider whether to terminate a Conditional Use Permit issued to American Tower Corporation
(previously Waukesha Tower Associates) and John & Myrtle Condon/ Condon Properties L imited
Partnership for a communications tower that has since been removed from the property located at
W260N6035 Mary Hill Road/ LSBT 0257.071 in the Celtic Ridge Estates subdivision .
Clerk Cappozzo read the published Notice of Public Hearing into the record , and President Gehrke
opened the Hearing.
Planner Mularkey presented an overview of the situation, explaining that in May 2022, a public hearing
was held to terminate the conditional use permit for the tower, but no action was taken because there
was still an active lease on the property. Since then, the tower has been removed, and the lease has
been canceled with evidence provided to that effect. The Conditional Use Permit still remains on the
property and limits the development of two adjacent parcels (lots 26 and 30) in the subdivision for
single-family use.
Planner Mularkey explained that the Village can terminate a conditional use permit for two reasons:
inactivity or through a public hearing. Since the lease ended in summer and it hasn't been a year yet,
it must be terminated through the public hearing process. Last month, the Village Board directed staff
and the Planning Commission to proceed with the termination hearing.
The termination would be based on two provisions in the zoning ordinance:
● Non-conformity with conditions - The use is not continued in conformity with the conditions of
the CUP. The original conditional use permit mandated ongoing maintenance and removal
within 60 days of lease termination.
PLAN COMMISSION

Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov
● Incompatibility due to changed circumstances - The zoning subdivision has evolved over the
years into a residential neighborhood, and the tower's 130 -foot original fall easement would
occupy surrounding lots, conflicting with the comprehensive plan's goals for housing diversity
and a safe residential environment.
No members of the public spoke on this issue, and the public hearing was closed at 6:39 p.m.

Public Hearing No. 2: A request by owner/applicant Chad Aumueller, for a Conditional Use Permit to
allow excavating for the purpose of improving wildlife habitat via a wetland scrape in the AD -10
Agricultural and C -1 Conservancy Zoning Districts, on the property located at W222 N8944 Elmwood
Road / LSBT 0148.999.005.
Clerk Cappozzo read the published Notice of Public Hearing into the record , and President Gehrke
opened the Hearing.
Planner Mularkey explained that the 56+ acre property was part of a 3 -lot certified survey map
approved earlier in the year. There is an isolated wetland less than half an acre in the front yard of the
property. The applicant proposes to take just under 10,000 square feet to create a pond to enhance
wildlife in the area and provide an aesthetic feature for the property.
The wetland has been delineated, and the DNR has issued a statewide general permit specifying
maximum slopes of 8:1 with an average depth of about 5 feet. Material from the scrape would be
dispersed elsewhere on the site, and the edges of the pond would be restored with a wetland wet
meadow native seed mix.
While establishment of wildlife habitat is a permitted use in the C -1 Conservancy zoning district,
excavating within wetlands for that purpose requires a conditional use permit. The applicant has
submitted the conditional use permit application, grading pe rmit application, grading and erosion
control plan, and DNR permit.
Commissioner Howard raised questions about correspondence from the Army Corps of Engineers and
restoration plans for the spoils site. Chad Aumueller clarified that the Army Corps had signed off on
the project, and the spoils would be used as fill for his h ouse construction site, which is already under
construction with an approved grading plan.
Mary Steproth and Tim Steproth, neighbors from W222N8992 Elmwood Road, expressed concerns
about the existing wet conditions, mosquitoes, wildlife impact, and safety. Mary asked about the
pond's depth and whether fencing would be required. Administrator Gre en clarified that fences are
not required for wetland or landscape ponds under the village code. Aumueller explained that the site

is already wet in spring (usually 3 feet deep some years), the project would maintain the wetland
character, and that he had ordered tamarack trees and wetland grass seed mix from the DNR for part
of the property.
There being no further comments, the public hearing was closed at 7:01 p.m.

A. Termination of CUP for Communications Tower issued to Waukesha Tower/ John & Myrtle Condon
Motion by Howard, second by McCormack, to recommend to the Village Board revocation of a
Conditional Use Permit issued to Waukesha Tower Associates together with the equitable owners
of the real property, John Condon and Myrtle Condon for the property located at W260N6035 Mary
Hill Rd, Lisbon, WI 53089, (LS BT 0257.071) on the grounds that the use has not “continued in
conformity with the conditions of the CUP” pursuant to Section 18.04 (g)(1)(C)(i)) of the Village of
Lisbon Zoning Code as the 1997 CUP mandates ongoing maintenance and evidence has been
presented confirming the lease has been terminated and the tower structure removed from the
property, and that “A change in the nature or character of the surrounding area, or of the
conditional use itself, causes it to be no longer compatible with surrounding uses” pursuant to
Section 18.04 (g)(1)(C)(ii)) of the Village of Lisbon Zoning Code, as Celtic Ridge Estates has evolved
into a developed residential neighborhood since 2006, with adjacent R -1 zoning and rural -
residential parcels and the tower’s 130 -foot fall easement occupies buildable area on Lots 26 -32,
conflicting with the Comprehensive Plan’s goals for housing diversity and safe residential
environments. Motion carried unanimously.

Staff Review
PLANNER COMMENTS:
1. Comprehensive Plan. The Future Land Use designation of Industrial is consistent with the
existing zoning of M-2 General Industrial District.
2. Zoning District Requirements. The property is zoned M-2 General Industrial District in which,
“Any use as permitted in the M -1 Limited Industrial District”, is allowed as a permitted use per
Section 32 (b.) 1. of the Lisbon Zoning Ordinance . The M-1 Limited Industrial District allows
“Trades or industries of a restrictive character which are not detrimental to the district or to the
adjoining residential areas by reason of appearance, lighting, noise, vibrations, dust, smoke,
fumes, odor, pollution, fire, or explosion provided the location, building plan, and a Site Plan and
Plan of Operation have been submitted to and approved by the plan commission …” as a
permitted use per Section 31 (b.) 2. of the Lisbon Zoning Ordinance . Therefore, a concrete
contractor facility to be used as an office and accessory storage for associated equipment,
vehicles, and supplies is allowed as a permitted use.
3. Plan of Operation. The proposed plan of operation includes:
a. Uses and activities: The operation of a concrete contractor facility to be used as an office
and accessory storage for associated equipment, vehicles, and supplies.
b. Number of Employees:
i. Full time: 4
ii. Part-time: 0
iii. Seasonal: 0
iv. Minimum 0 employees at any given time.
v. Maximum 4 employees at any given time.
c. Hours of operation: Staff confirmed these hours with the petitioner.
i. Business Hours: 7:00 a.m. to 4:00 p.m. Monday – Friday
Closed Saturday and Sunday
ii. Operating Hours: 24 hours per day, 7 days per week
d. Outdoor Storage: The petitioner is proposing to store pallets and c oncrete forms as
depicted in Exhibit A behind the building in the storage location depicted on Exhibit B.
According to a review of the 2024 aerial photo of the site, there is currently outdoor storage
along the east side of the parking lot in the rear of the building. While this outdoor storage
is screened from the view of the public right-of-way, some of it appears to be located within
an area of C-1 zoning associated with Sussex Creek , which flows thro ugh the site from
north to south. Part of the petitioner’s proposed storage location as depicted on Exhibit B
also appears to be located within the C-1 District. Outdoor Storage is not allowed in the C-1
District.
Foth recommends the petitioner submit a revised Exhibit B that depicts the storage location
completely outside of the C-1 District and any existing items moved also located outside of

the C-1 District for review and approval by the Village Planner , prior to the issuance of an
Occupancy Permit.
Foth recommends all use of the property be according to the submitted application
materials, the municipal code, and all other applicable ordinances, regulations, and permits.
e. Parking: According to Section 18.03 (10) a. 7. Village of Lisbon Zoning Code, industrial
buildings require one space for each employee during any 12 -hour period and one space
per 300 square feet of office floor area. The lease space has appr oximately 641 S.F. of
office space. Applying this standard, the proposed use would require six (6) off -street
spaces. The property has an asphalt parking area located in front (west side) of the building,
which has 43 off-street parking stalls (including five (5) ADA accessible stalls) . The
petitioner has identified three (3) off-street parking spaces dedicated for employees of the
business’ use in the application materials. The petitioner also clarified that the 4th employee
is a mech anic who would only be on site as needed and wou ld park his truck in the
warehouse area when on site. The petitioner doesn’t anticipate any customers at this
location. The Plan Commission should determine whether the existing parking lot is
sufficient to accommodate the proposed use.
f. Buildings: One (1) story multitenant industrial building.
g. Exterior Lighting: No outdoor lighting proposed at this time.
h. Signage: No signage proposed at this time. Any business signage shall be required to
obtain signage approval through the Village of Lisbon sign application process.
i. Odor, Smoke, Noise: No.
j. Chemicals/Hazardous Materials: No.
k. Storage of Petroleum Products: No.
l. Stormwater Management and Erosion Control: No.
m. Refuse Disposal: Dumpsters are located in the rear of the building.
4. Landscaping: No new landscaping is being proposed at this time.
5. Traffic, Circulation and Access. The site is accessible via two (2) existing driveways on Indian
Grass Lane.
STAFF RECOMMENDATION:
Depending on confirmation by the Village of Lisbon Plan Commission of the above -described
comments, the Village of Lisbon Plan Commission may take the following actions:
