Polls will be open from 7:00 AM to 8:00 PM. Administrator Report Administrator Green provided updates on several matters. The architectural survey that was sent out in late December has received approximately 100 responses so far. The survey is available on the village website. The GFL garbage collection schedule change affecting over 500 village residents went smoothly with only a few confusion -related calls. The baseball diamond project is progressing with fence posts installed, concrete slabs poured for bleachers and dugouts, and foul poles and bases ordered for spring installation. Lake Country Municipal Court has added Palmyra as a new member community. A resolution will be coming to the village board to officially adopt this addition. Trustees noted some issues with accessing the park survey on the website and Administrator Green indicated he would investigate. Unfinished Business A. Discussion & necessary action re: Wesp/ Heinritz CSM (tabled 12/10/25) The board discussed a certified survey map (CSM) for the West Heinrich property that was previously tabled. The CSM involves a 2-lot division, with lot 2 proposed to be rezoned for a storage unit facility. Administrator Green explained that lot 3 and lot 4 currently have access issues under the village code, which only allows a shared driveway to access two homes. The proposed solution includes a dedicated T -shaped turnaround area for public access to lots 3 and 4. This would address the current noncompliance and make the lots buildable. Board members voiced multiple concerns including whether the T-turnaround was the only viable solution ; how this arrangement would impact future access and development ; if this would set a precedent for similar situations ; whether lot configuration could be changed (it cannot without restarting the approval process) ; the impact on property owners and village maintenance responsibilities; and the status of wetland delineation in the area . Trustee Moonen expressed concern that approving the CSM with the T - turnaround would set a precedent and go against village code, while others felt this was a unique situation with few good alternatives. The Plan Commission had previously recommended approval of the CSM contingent on planner and engineer comments. Motion to approve the Wesp/ Heinritz CSM subject to Planner and Engineer comments was made by Trustee Baum and seconded by P resident Gehrke. Motion carried 4:1, with Trustee Moonen dissenting. New Business A. Discussion & necessary action re: letter supporting elimination of at-grade RR crossing on CTH K Administrator Green presented information about Waukesha County's request for a village letter supporting the elimination of the at-grade railroad crossing on Highway K. The letter would support the county's application for federal funding to construct a bridge over the railroad tracks. Village Board Minutes January 14, 2026 Page 3 of 3 Office: (262) 246-6100 | Email: VillageHall@LisbonWI.gov | Website: www.LisbonWI.gov Board members noted that this project would improve traffic flow and reduce noise from train horns, which has been a concern for nearby residents. The county will not proceed with the project without substantial federal funding. Motion to approve the letter supporting elimination of the at -grade crossing on Highway K was made by Trustee Moonen and seconded by Trustee Quinn. Motion carried 5 -0. B. Discussion & necessary action re: possible next steps for quarry water expansion project Ben from Ruekert-Mielke presented an update on the water supply feasibility study related to the quarry water expansion project. The study has been refined to focus on a "critical area" rather than the entire region initially considered, reducing the proje cted cost from over $25 million to approximately $8 million. The presentation covered the revised project scope focusing on high - priority areas affected by quarry operations; technical details of the proposed water main system and connection options ; p otential suppliers (Sussex and Pewaukee) and their limitations ; c ost estimates and potential challenges; and next steps for implementation. The revised plan involves water mains from Sussex along Townline Road to County Highway K, continuing down through the East and West View Drive subdivision. For properties along W eyer Road, the plan recommends connecting to Pewaukee's existing water main. The Board discussed the feasibility of a split system with Sussex serving the northern area and Pewaukee serving properties along Wire Road . There were c oncerns about future water rates and source changes ; requirements for sewer connections if municipal water is provided ; e mergency connections between systems for redundancy ; t imeline for implementation, with construction potentially starting in March 2027 ; and s trategies for public outreach to affected residents . Lannon Stone Products has indicated they would fund the critical area infrastructure improvements. The next steps include submitting formal water service requests to potential suppliers. Motion to auth orize submittal of written formal requests to potential water supplie rs made by Trustee Quinn and seconded by Trustee Baum. Motion carried 5-0. Adjournment There being no further business, motion by Beal, second by Baum, to adjourn the meeting at 8:34p.m. Respectfully submitted, Elisa M. Cappozzo, WCMC Lisbon Village Clerk December 11, 2025 Sent: Via Email Mr. Dan Green Village of Lisbon Administrator W234N8676 Woodside Road Lisbon, WI 53089-1545 Re: Lake Five Farms Development Letter of Credit – Reduction Request No. 4 Dear Mr. Green: Construction of the Lake Five Farms development continues, with all restoration efforts completed, the only item left to complete is the surface course of asphalt . Our office is in receipt of a request from MK/S-EP LLC to reduce the Letter of Credit in the amount of $599,947.14. In accordance with the development agreement, the Village is in position to reduce the letter of credit, computed as follows: Letter of Credit Reduction • Total Letter of Credit (Includes 20% Financial Guarantee) = $3,510,707.52 • Amount of previous reductions = $2,165,642.46 • Total amount of construction completed = $2,765,589.60 • Amount Approved this request = $599,947.14 • Balance of Letter of Credit = $745,117.92 Per Section X of the Developer’s Agreement, the letter of credit will be reduced from time to time providing that the remaining letter of credit is sufficient to secure payment for the remaining improvements. At this time, I feel the balance of the letter of credit is enough to cover the remainder of the work required. Dan, the remaining construction dollars are subject to the 20% financial guarantee, also outlined within the developer’s agreement. The balance of the letter of credit will be eliminated once the construction of subdivision improvements has been completed and accepted by the Village, all lien waivers have been received for contractors, subcontractors and suppliers, and finally all Village invoices for administrative and inspection fees have been paid. Should either you or the Village Board have any further questions please contact me. Our understanding is that the three existing 60-inch culvert system spanning the Bark River dates back to the 1950’s and is in poor condition with obvious signs of the embankments failing. Based upon the age of the culverts and the failing embankment the Village has determined that replacing the overall culvert system would be beneficial for the Village of Lisbon. In addition, this replacement would also allow the Village the opportunity to plan for pedestrian accommodations as part of the bridge replacement project, to meet up with Plainview Road. Kunkel Engineering Group has been providing municipal engineering and consulting services dating back to the 1960’s, which has provided our firm with decades of experience in working with municipalities and other local units of government in undertaking similar projects, including projects for you, at the Village of Lisbon. This experience has given us a strong understanding of the schedules and budgets that drive our client communities. Therefore, we strive to provide our services on time and within budget, developing cost-effective and budget-conscious solutions for the communities we serve. Therefore, Kunkel Engineering Group herein proposes to undertake the design, permitting, bidding, construction-related services, and construction inspection associated with the Lake Five Road Bridge Replacement Project, as outlined within the Project Approach section of this proposal. The estimated engineering cost for this project is $116,890.00. Please note that we believe the services outlined within our scope of work are comprehensive and will provide the Village of Lisbon with a well-engineered, developed, and constructed project intended to meet the needs of the Village and its residents both now and for decades to come. 107 Parallel Street Beaver Dam, WI 53916 • 1115 S Main Street West Bend, WI 53095 • T 920-356-9447 www.kunkelengineering.com Dan, on behalf of Kunkel Engineering Group, we sincerely appreciate the opportunity to work with the Village of Lisbon on the Lake Five Road Bridge Replacement Project. This truck had originally been purchased jointly with the Village of Merton in 2019 as part of the effort to establish the Bark River Fire Consortium. The vehicle was acquired from the Village of Hartland for $30,000. Of tha t amount, Lisbon and Merton each contributed $10,000, and Hartland reduced the purchase price by an additional $10,000 as their contribution. At the time of purchase, the fire chiefs agreed that when the truck was eventually sold, Lisbon would reimburse Merton based on its proportional share of the original contribution. In this case, one -third of the sale proceeds would be returned to Merton. The truck was sold for $28,075.00, resulting in Merton’s share being $9,358.00. This reimbursement has already been processed through accounts payable. Because no formal written agreement between the two communities can be located by either party, it is recommended that the Village Board take formal action to document and properly record this expense. Requested Action Village Staff recommends approving reimbursement of proceeds of the sale of a 2000 Peterbilt Pierce PB330 Straight Stick Single Axle ladder truck in the amount of $9,358.00 . One of the contingencies in the offer to purchase was that a development agreement be approved by both parties by closing. The proposed development agreement is on the agenda for the board’s review and approval, before the final closing. Some key points to the agreement include: • Requirement for the purchaser to have occupancy and complete removal of the fill on the site by December 31, 2028. The original date was December 31, 2027, but was asked by the purchaser to be pushed back, to provide a cushion in, case construction was delayed. • The minimum guaranteed value for the parcel (land and improvements) must be at least $6,000,000 by January 1, 2029. Because the purchaser is looking to push back the occupancy date, a provision has been added that the minimum value in January 1, 2028, must be $3,000,000. If neither are met, a deficiency payment must be made for any gaps in value. • The property cannot be sold for a period of fourteen years, unless they received written consent from the Village. • The Village has a repurchasing option, that allows the Village to buy back the property, if the owner does not follow through on the project. The purchase price shall be the same as the selling price, plus any third-party costs associated with moving the fill on the site, not to exceed $300,000. This provision was added at the request of the purchaser, due to any fill that is removed, which increases the value of the property. The Village Plan Commission approved the site plan and plan of operation for the use of the site. The Development Agreement is the last piece that needs approval before closing. Requested Action Village Staff recommends approval of the Development Agreement between the Village of Lisbon and ST Management, LLC.
