Box Elder Road Change Order Information: Lukasz Lywza explained with the WE Energies
changes- it affected the grading, tree lines, , WE Energies did not want to move the utility poles as
originally determined-which changed the Box Elder design, there was a gas line found under the
culvert which raised the le vel of Box Elder Road roughly 16 inches and affected 3 driveways (Jim
and Donna Hellenbrand, Bev Hellenbrand and Darrel l Klopmaker)-Darrell will have 30 inches, Jim
and Donna Hellenbrand are level and Bev Hellenbrand is roughly 30 inches off - everything will be
graded as needed from the roadway -The original estimates for paving the approaches for the
driveways in question was $3000 -$5000-with the changes to the road -that estimate has grown
exponentially to approximately $30,000.00 for 3 driveways. Darrell would like to see the gravel added
50 feet additionally. Additionally, the gate and the fence on Darrell’s property are on the right of way-
33 feet from the center of the road -50 feet x 11 feet=30 tons of asphalt for Darrel l’s
driveway=$7500.00. The paving contractor is asking $250.00 a ton for driveway work -to just pave
the road straight the price is $75.00 a ton for asphalt . The issue before the board is what exactly to
pave on each driveway. Darrell driveway would be originally 25 feet and he is asking for an additional
50 feet paved -$10,500.00 additional, Bev Hellenbrand’s driveway 12 tons=$3000.00 – to do
additional paving up to the house (110 feet) would be $14 ,000.00-in exchange for the effects to her
land-loss of trees and grading differences-Supervisor Phillip Braithwaite pointed out that the property
owners didn’t ask for the road project-however any driveway beyond the right of way belongs to the

property owner-this project would only set a precedent if the town lets it, Supervisor John Hellenbrand
abstained from saying too much, Supervisor Sue Zingshiem pointed out that the Town made the
driveway portions inconvenient to the parties involved, Chairman Todd Weinberger would like 2 no
damage clauses signed once drawn up by the attorney. Jim Hellenbran d has a contract already
determined with the contractor that was done between him and the contractor. Chairman Todd
Weinbeger had a conversation with a representative from the Town’s Association that recommended
the town stay away from any agreements doing/going over a property owner’s personal driveway.
Getting a private entity to come and do the driveways separately would not be covered in the LRIP
grant-it would be a separate cost to the Town of Medina. Darrell Klopmaker 5675 Box Elder Road -
