Town of Montrose Land Use Committee
October 27, 2025 Meeting Report
All Present: Deb Brucaya (recorder), Junior Eichelkraut (chairman), Jerome Gobel, Tom Sarbacker, Tim Schmitt
Minutes are not official until approved by land use committee (LUC) members at a subsequent meeting
NOTE: CUP means Conditional Use Permit FP means Farmland Preservation CSM means Certified Survey Map
Junior called the meeting to order. Tim moved and Tom seconded to approve the September 22, 2025 LUC meeting report. Motion carried unanimously.
Dave Wade Judd and Melissa Huggins presented the request for a CUP from David and Patricia Judd to permit two secondary farm residences located above an existing horse barn, for family and staff of the horse stable business, as a conditional use under FP-35 zoning. Already in use, the Judds are working with Dane County departments and agencies to ensure these two apartments comply with all zoning and health code regulations. Currently three of the six employees live in these two apartments. After discussion, Tim moved and Deb seconded to recommend town board approval of David and Patricia’s request to allow two secondary residences above a horse barn at 6412 County Road A in Section 13 contingent on:
1) Should the Judd’s Green Meadows Stables go out of business, be sold to new owners, or undergo a name change;
2) Should these two apartments not meet county public health regulations for septic mound capacity, holding tank requirements, or any sanitary sewer related concerns; and
3) Should these residences not pass building and zoning inspections of electric, plumbing, heating, water and related services;
then this CUP would become invalid and the apartments would need to be vacated if no new CUP was obtained. This request meets the standards for approval of a CUP under s. 10.101(7) of Dane County’s zoning ordinance. Motion carried unanimously.
After the vote, Junior pointed out that the density study provided to the township for this farm is not correct. Melissa will provide the revised one from the county.
Next, Nic Mink of Seven Acre Dairy has shelved the earlier plan to have five free-standing condo/cabins built north of the primary dairy building on currently unused land. Now, at this same location, he plans to construct a 30’ x 60’ - 1800 sq. ft., 12’-14’ high, one-story lodge. For this to happen he is asking to amend the current CUP to increase the current eight-room capacity. After a brief discussion, Deb moved, seconded by Jerome to recommend town board approval of the Paoli Cheese Factory Association LLC’s request to amend the commercial indoor lodging portion of its current CUP #2648 to provide up to 14 rooms at 6858 Paoli Road in Section 3. This request meets the standards for amending a CUP under s. 10.101(7) of Dane County’s zoning ordinance. Motion carried unanimously.
Last, Junior said that an ad hoc committee is forming to update and revise the town’s comprehensive plan, of which the LUP is one element. Joining LUC committee members Deb Brucaya, Junior Eichelkraut, and Tim Schmitt will be Tim Bahls and Corey Brown.
The meeting adjourned after unanimous approval of Junior’s motion and Tim’s second to do so.
