These are the measurements that I calculated on site: From County Highway MM, I estimated that the very farthest and largest cleared location was 225' from the edge of the road as it went by the south side of the existing house. For this purpose, I measured a straight line from the road edge past the south side of the house to the farthest area on the west side of the property that was cleared. Using DCImaps and utilizing the measuring function software on Dane County's website Access Dane, for a line on the same south side of the house, the distance from the road edge to the western edge of the large triangular piece owned by the adjacent landowner is 124'. Measuring from the road edge to the western edge of the small triangular piece owned by the adjacent landowner using the same Dane County software is 140' (since the small triangular piece adds on to the western side of the large triangular piece). As mentioned in my memo to the Board, the permission granted to the adjacent landowner for clearing on both sides of the property line did not have a specific numerical footage outlined, but was assumed to be plus or minus the tallest trees on either side which would be approximately 60' on either side of the property line. If one took the 140' distance above (road edge to small triangular lot line adjacent to Bicentennial Park) and added 60' to it (the assumed permission granted), the total allowable distance would be 200' compared to the 225' of estimated distance (above) from the road edge to the largest clearing farthest from the road. Utilizing those numbers, it appears that the adjacent landowner may have exceeded the assumed estimated allowance for land clearing on either side of the property boundary by a little more than 10%* at the point where the land clearing was farthest from the road edge (225' versus 200'). I only measured one straight line to delineate what I considered would be the worst case scenario where the land clearing by the adjacent landowner may have exceeded what was discussed and approved previously in the most potentially egregious example possible. I did not calculate on site or with DCIMap any other potential multiple points on the properties to see whether at those points the land cleared was less, equal to, or more Page 4 of 74 than the agreed upon criteria. Based on my evaluation of the property on site and the land dimensions on Access Dane, I think it would be highly likely that any other land clearing measurement overages would be less than the example calculated above. Given that the property lines may not have had clear and easily visually identifiable delineations all along the boundaries and that the approved clearing involved heavy equipment and a significant number of downed or widowmaker trees (see the accumulated burn pile currently at the site; note that all of the material from the first clearing that was done last fall was completely burned last fall), and that the approval granted was on an approximate basis based on good faith representations by the adjacent landowner and that the potential maximum overage is in the 10-12% range, I feel comfortable that the adjacent landowner has substantially complied with our agreement regarding the extent of land clearing allowed and that there is no substantial negative impact to Bicentennial Park property. Dave Frankson Chair, Town of Oregon Parks Committee *(More precisely, 11.11% if using the total distance as the denominator; 12.5% if using the estimated allowable distance as the denominator) On Sun, May 17, 2026 at 4:51 PM Jennifer Hanson < jhanson@townoforegonwi.gov> wrote: Hi Dave, Thank you for the memo.¶ I am unsure if Carl received so I am forwarding him a copy.¶ The town attorney is going to be present tomorrow and before the board decides a path forward it should be asked if you were able to view the park since returning? ¶ Is the cleared park property consistent with your agreement with the landowner?¶ It does seem like perhaps there are differing opinions on what was approved to be cleared and what was cleared. While walking the site, we saw he has done a lot of work clearing the site and cleaning up rubbish. The house is now quite visible from the road. What is of concern is that he has cleared a lot of park land, in the process. We estimate he has cleared over100 into the park. It is a lot of bare exposed dirt with no erosion control measures in place for the entire area. He feels the property is worth at least $200,000 which we told him was not something the Town would do. This also raises the concern that any potential buyer may look at the cleared Parkland and think it is part of the parcel he is trying to sell. The boundaries of the property should be clearly defined. We restated the Town’s offer to provide the survey and legal work to finish the title work and transfer of lands that was agreed to but not fully completed 50 years ago. This would create a CSM for a rectangular lot of 110’ x 274’ and finish the transfer of the triangular parcel to become part of the Bicentennial Park. We made it clear to him the triangular parcel near the entry was part of a land swap 50 years ago and we need to clear up the clouded title. We may need to £ check with the Town Attorney if we need to notify the Title company that we have a claim on that parcel. We did not dwell on the fact that he has trespassed onto the Town Park lands and removed trees, brush and ground cover. I am composing a letter/email to him that will ask him to stop work on the Park property and minimally reseed the ground with appropriate vegetation. I will run the letter past you prior to sending to determine if we need to run this by legal. Tim has taken photos of the site. This needs to be verified, but it is a larger area than I thought as it goes further South and up to the neighbor’s ground. This could be more than an acre of land. This needs to be documented. You had been given permission to cross over the property line to clean up the existing fence line, not proceed into the Park land by what appears to be about 100’+/- . The current condition of the area has all ground cover removed along with an unknown number of trees. The ground is now bare unprotected dirt with no provision for erosion control or containment. Do not proceed with any remediation without getting authorization from the Town of Oregon. There is a row of T-stakes marking the north boundary of the property; I paced off the distance from the circled stake to the end of the cleared area, and it's about 60 feet. I don't know what the next-door neighbors think about this, but he has cleared all the way up to their driveway including the part next to the road.£ The clearing on park property up to parking area we knew about because he did it last fall, but I hadn't realized he had gone so far south and west. Thanks for looping me in on happenings at Bicentennial.
