Adjournment: 12:00 p.m. 5 Town of Oregon Residents: (DRAFT ONLY) The Township has enlisted a Road Traffic Safety Advisory Committee to investigate and make recommendations to the Town Board to improve our roadways . A reoccurring issue the Committee has identified is traffic hazards, which are erected or growing in the right of way adjacent to roadways. Such hazards can directly impact road safety by impairing sight lines or preventing mow ing. Lando wners may not be aware of such traffic hazards. In some cases towns/lando wners have been found liable for damages incurred as a result of such road hazards. A 2015 legal memorandum from the Wisconsin Towns Association clarifies the authority and responsibility of a Town to enter the right of way or private land to remove vegetation and/or cultivation when it creates a hazard. Wisconsin Towns have an easement into the right of way and authority to mow, cut, and remove road safety hazards. WI Statute 82.03 (5). The Town of Oregon has determined that landowners will first be notified and given an opportunity to remove any identified hazard within their property lines/r ight of way. The Committee and Town would prefer the landowner them selves remove such hazards to ensure: (1) mowing is possible along the road; and (2) sight lines are not impaired. When identified hazards are not removed the Township has both the authority and respons ibility to enter and rectify these issues. If contacted, your cooperat ion is greatly appreciated. Construction to driveways or use of heavy machinery within the right of way requires a permit from the Town of Oregon. The Town of Oregon is cogniza nt and respectful of private property rights, however this must be balanced with road safety for everybody.
