PC Chairman’s report for BoS 11-3-2025 meeting
I had about 18.25 hours on Plan Commission tasks in October, including:
Answered an inquiry from the Town of Sevastopol about regulating CAFOs.
Received an inquiry about KFI boring under 3 town roads to install piping for their 360 Rain system. This became a CUP application and hearing on October 27th;
Discussed a rezoning application for Brent and Dixie Eisenman with ZA Joe Jerabek. This involved replying to surveyor Mike McCarthy as to why Eisenmans need a CSM for their rezoning (It’s required by their lender);
Drafted a resolution for GLC to acquire 420 acres in the Black Ash Swamp;
Explained to Chair Jesse why Srnka Farms does not need a building permit to remove part of their old feed pad and buildings—nice to know that they are complying;
Also discussed with Jesse another operator that is a problem to deal with;
Drafted a CUP for KFI to bore under 3 roads for pipes for their 360 Rain irrigation system;
Also drafted a CUP for KFI for their barn and roof rebuild;
Researched GLC’s 420 acres on the National Wetlands Inventory website, the go-to site for information on wetland areas that cannot be developed, like possibly Balsam Lane for GLC access. The website stated: “Due to the government shutdown, the Wetlands Inventory Mapper and its services are not being updated…”;
Had a discussion with Jesse about a local damaging a town road with farm equipment; Jesse had to call the sheriff’s department;
Conversation w/ ZA Joe about a CUP and building permit for KFI to pipe Sedron effluent in ROWs to Casco Creek;
Reviewed the CUP docs for KFI plumbing Sedron effluent in the town RoWs to Casco Creek;
Had a subsequent discussion with Jesse about billing applicants a per foot charge for burial of utilities in ROWs versus a building permit. Jesse concurred that both the building permit and the per foot charge applied, not one or the other;
Also had a discussion with Jesse about an “uncooperative” landowner (my words) damaging a town road at their driveway access;
When I dropped off my well sample to LWCD, I asked Davina if the KC Shoreland Preservation Ordinance applied to ToL. Davina responded that “if it’s within 300’ of a stream, yes.” This had application to Silver Creek on Black Ash Road and we need to pay attention to this in the future. Someone got away with something. Joe Bader needs to be aware of this too.
ZA Joe and I will be updating the ToL official zoning map in November for the BoS to approve at the December meeting.
We held one PC meeting on October 27th. At that meeting, the PC:
Entertained a request for a resolution to support GLC’s acquisition of 420 acres in the Black Ash Swamp. The PC approved and the BoS has that resolution to approve at this meeting with one edit;
Recommended a rezoning request from Brent and Dixie Eisenman;
Recommended a CUP for KFI to rebuild their barn due to the failing roof. The CUP was revised to accommodate a better setback to Tamarack Road;
Recommended a CUP for KFI to bore under Spruce, Tamarack, and Townline Roads for pipes to serve their 360 Rain Irrigation System;
All four are up for approval by the BoS thus evening;
We Don’t have a PC meeting scheduled for November yet, but could schedule one for:
Perhaps a CUP hearing for KFI to pipe their Sedron effluent in the town RoWs to Casco Creek;
Steve Albers multiple shipping containers and rezoning issues;
The Records Retention Ordinance;
KC’s Shoreland Preservation Ordinance;
Job descriptions for town officials and appointees.
Let me know your availability for a November PC meeting.
