Re: CUP: Mary O Schaefer Family Living Trust Proposed Lift
Greetings,
The Department of Natural Resources has received the hearing notice for the March 26, 2026, public hearing
concerning the following conditional use permit application. Mary O Schaefer Family Living Trust, requests a
conditional use permit in the Lower St. Croix Riverway Overlay District, as required by St. Croix County
Ordinance Section 17.36.F.3.a.3 (Stairways and lifts) to construct a lift in order to provide access to the St. Croix
River waterfront, on a 2.39-acre property located at 1250 HWY 35, Hudson, WI 54016, Sec35/T30N/20W,
Parcel# 030-2065-20-110, Town of St. Joesph.
Please read this letter into the record for the Mary O Schaefer Family Living Trust CUP. The department supports
the granting of the conditional use permit for the construction of a lift. A review of the application shows that
the project can comply with the criteria. They are as follows:
NR 118.07(: Lift Standards.
(a) The lift is required to provide pedestrian access to the river because of steep, rocky, unstable or wet site
conditions. Meets this criterion.
(b) The car of the lift may not exceed 4 feet by 6 feet. Meets this criterion.
(c) Canopies and roofs are not allowed. Meets this criterion.
(d) All visible parts of the lift shall be painted or finished in earth−tone, non−reflective materials and shall be
visually inconspicuous. The application contains no description of the color for the lift system. The board should
clarify and condition that the track system comply with (d).
(e) Lifts and their transporting device or power source shall be visually inconspicuous and shall be located in the
most visually inconspicuous portion of the lot. Applicant should provide information to meet this criterion.
(f) Native vegetation plantings shall be used to form a vegetative canopy to screen the lift from the river. Two
photos in the staff report show the proposed corridor for the lift from the top landing.
(g) Existing vegetation may be removed within one foot on either side of the lift route and up to 8 feet above the
lift floor. No mention within the application, suggest this be a condition of the permit.
(h) Only one lift may be permitted on a lot that abuts the Lower St. Croix River. Meets this criterion.
The site should be stabilized, and erosion control methods should be utilized during construction if necessary.
Sincerely,
Sue Vanden Langenberg

Re: CUP: Westby Proposed Lift
Greetings,
The Department of Natural Resources has received the hearing notice for the March 26, 2026, public hearing
concerning the following conditional use permit application. Timothy Westby, requests a conditional use permit
in the Lower St. Croix Riverway Overlay District, as required by St. Croix County Ordinance Section 17.36.F.3.a.3
(Stairways and lifts) to construct a lift in order to provide access to the St. Croix River waterfront, on a 4.34-acre
property located at 1310 HWY 35, Hudson, WI 54016, Sec27/T30N/20W, Parcel# 030-2049-80-300, Town of St.
Joesph.
Please read this letter into the record for the Westby after-the-fact request for a CUP. The department would
not be opposed to the granting of the conditional use permit for the existing lift provided the applicant can
demonstrate that the project complies with all the criteria below.
NR 118.07(8): Lift Standards.
(a) The lift is required to provide pedestrian access to the river because of steep, rocky, unstable or wet site
conditions. Meets this criterion.
(b) The car of the lift may not exceed 4 feet by 6 feet. No information provided.
(c) Canopies and roofs are not allowed. Meets this criterion.
(d) All visible parts of the lift shall be painted or finished in earth−tone, non−reflective materials and shall be
visually inconspicuous. According to the photos from the staff report, it appears the carriage is brown.
Photos
of exiting vegetation and lift provided.
(g) Existing vegetation may be removed within one foot on either side of the lift route and up to 8 feet above the
lift floor. It is not possible to know how many feet of vegetation have been removed on either side of the lift.
(h) Only one lift may be permitted on a lot that abuts the Lower St. Croix River. Meets this criterion.
The site should be stabilized, and erosion control methods should be utilized during construction if necessary.
