6. Derek & Anna Behnke, application for Rezoning from Multiple-Family
Residence District (R-2) Zoning to Agricultural District (A) Zoning.
Derek Behnke presented a Rezoning application for his property. There was one
typo on the agenda of his property is zoned as R1 not R2. The purpose is to zone
part of his property to agricultural for the reasons of
• He can utilize his property to better suit his family
• Does not meet city residential requirement and ordinance and would like
this fixed.
Concerns and Questions from the Public and Planning Committee
➢ How many acers do you want to keep as R1? Three to four acers.
➢ Were you looking for agricultural land when you first bought it and if
so, why did you buy residential then? Yes, when we bought it and did
not look into if it was zoned agricultural because it did not fit the
description or ordinances of residential and was labeled
agricultural.
➢ What would you do with the agricultural land? Would like it to meet
the city ordinances and zoning. Would like to utilizes the current
fallen lumber. With it zoned now as residential now a resident can
only have one structural building and would like the option for
another. Children are coming of age and would like to bow hunt
could place a deer stand.
➢ Did you look into all this when you bought the property? Yes and no,
we did. Our taxes classified it agricultural but did not look closer
into it to see how land was zoned.
➢ When you first applied for this in 2022 you wanted to place horses on
there. Is this still an interest? No not at this time or near future. I’m
building a business and don’t have the time for horse now. Dose not
mean in future it might not happen.
➢ If land goes to agriculture would the taxes be less for the city? No
because Behnke’s are paying for it right now as listed as
agricultural but zoned as R1.
➢ If this property goes into agricultural if it were to be sold to a
developer, would it then have to go back into residential? Yes, it
would.
➢ Is this spot zoning? No because there are other agricultural
Planning Commission May 29, 2025 3
properties next to them.
➢ If Behnke’s get this granted they would be able to have large animals
like cows, horses. Yes
➢ How much money would be lost from the city if it went to
agricultural and who’s budget will it come out of? The city will not
lose money because Behnke’s are paying for it right now as listed as
agricultural.
➢ Can a variance be done? No because it will direct you to do a zoning
change first.

Article III. Conditional Uses
§ 480-14. Application for conditional use permit.
Application for a conditional use permit shall be submitted to the Building Inspector on forms provided
by the Inspector and shall be accompanied by a plan showing the location, size and shape of the lot(s)
involved and of any proposed structures and the existing and proposed use of each structure and lot.
§ 480-15. Review and approval.
In all cases of proposed establishment of a conditional use specified in this chapter, the Planning
Commission shall review the site, existing and proposed structures, architectural plans, neighboring
uses, parking areas, driveway locations, highway access, traffic generation and circulation, drainage,
sewerage and water systems and other aspects of the proposed use and make a recommendation to
the Common Council as to the issuance of the permit. Actual approval or denial of conditional use is
vested with the Common Council.
§ 480-16. Standards for issuance of permit.
No permit for a conditional use shall be granted unless the Planning Commission shall find that the
following conditions are present:
The establishment, maintenance, or operation of the conditional use will not be detrimental to or
endanger the public health, safety, morals, comfort or general welfare.
The uses, values and enjoyment of other property in the neighborhood used for purposes already
permitted shall be in no foreseeable manner substantially impaired or diminished by the
establishment, maintenance or operation of the conditional use.
The establishment of the conditional use will not impede the normal and orderly development and
improvement of the surrounding property for uses permitted in the district.

are being provided.
Adequate measures have been or will be taken to provide ingress or egress so designed as to
minimize traffic congestion and traffic hazards in the public streets.
§ 480-17. Conditions and guarantees.
Prior to recommending the granting of a permit for a conditional use, the Planning Commission may

community and to secure compliance with the standards specified in § 480-16 above. Establishment,
maintenance and operation shall be construed to include, but shall not be limited to, such factors as
landscaping, architectural design, type of construction, construction commencement and completion
dates, sureties, lighting, fencing, operational control, hours of operation, traffic circulation, deed
restrictions, access restrictions, and yard and parking requirements, insofar as the Planning
Commission shall find that conditions applying to these factors are necessary to fulfill the purpose and
intent of this chapter. In all cases in which a permit for conditional use is recommended to the Council,
the Planning Commission shall require such evidence and guarantees as it may deem necessary as
proof that the conditions stipulated in connection therewith are being and will be complied with. As a
means of determining neighborhood opinion of the proposed conditional use, the Planning Commission
may hold a public hearing on the matter.
§ 480-18. Compliance with other requirements.
Conditional uses shall comply with all other provisions of this chapter, such as lot width and area, yards,
height, parking and loading.
§ 480-19. Effect of denial.
No application for a conditional use which has been denied wholly or in part by the Common Council
shall be resubmitted for a period of one year from the date of said denial, except on the grounds that
substantial new evidence or proof of change to compliance with the applicable conditions is included in
the resubmitted application.
§ 480-20. Referral to Community Development Authority.
Conditional use applications and renewals in the industrial zoned areas shall be referred to the
Community Development Authority, which shall act in behalf of and have the same powers as the
Planning Commission with respect to these matters.
Editor's Note: Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. II).
§ 480-21. Home occupations.
Conditional uses issued for home occupations shall be subject to annual renewal. Renewal shall be
automatic unless written complaints have been filed with the Planning Commission on the operation or
maintenance of the conditional use. In this event the Planning Commission will reexamine the use,
applying the standards per § 480-16 above. In the event that it is determined that the standards have
been violated, the Planning Commission shall recommend to the Common Council that the permit be
revoked or the operation of the conditional use modified so as not to be in violation of the standards.

OFFICE OF
PLANNING AND ZONING
A Division of
Land & Water Resources Department
Dear Oconto County Conditional Use Permit Applicant,
Thank you for working with Oconto County Planning & Zoning staff regarding your development proposal.
Zoning is a system of land use regulation that controls the physical development of land. It is a legal
mechanism by which Oconto County is able to regul ate use of property for the sake of protecting the
public health, safety and general welfare. Lands throughout Oconto County are mapped into different
zoning districts with the primary purpose of promoting compatible land uses while separating
incompatible uses. Decisions regarding how land is zoned are determined, in part, by consistency with the
Oconto County 20-Year Comprehensive Plan, which lays out broad policies to implement a shared vision
for the future, and adopted town plans. Each zoning distric t has permitted uses and conditional uses.
Your development proposal has been determined to require a conditional use permit.
The following steps are also outlined in the conditional use permit packet with a document titled
“Conditional Use Permit Guide”.
After discussing your development proposal with county staff, your next steps will involve meeting with
the town Plan Commission and Town Board. In the conditional use packet you will find a document titled
“Town Contact and Meeting Information”, which will provide you with contacts, meeting dates and times,
as well as required materials for the meeting. Both the plan commission and town board will need to sign
the “Town Recommendation Form” that is also part of this conditional use packet.
Once you have met with the town and the town recommendation form has been signed your next step is
submitting the completed conditional use application which also must include a detailed explanation and
plans showing the location of the proposed area of use with dimensions, signed town recommendation
form, and application fee with the Oconto County Planning & Zoning Office. In the conditional use packet
you will find a document titled “Oconto County Board of Adjustment Public Hearing and Business Meeting
Dates”, which will provide you with rezone application deadlines as well as public hearing dates. Once
the complete conditional use application is submitted and scheduled for an upcoming public hearing date
you will be notified of the date and specific time for the onsite and subsequent public hearing.
At the public hearing the Oconto County Board of Adjustment (BOA) will review your application and take
public comment. As part of the public hearing the Board of Adjustment will conduct an on-site inspection
prior to the hearing. You must attend both the on -site inspection and the public hearing. If you cannot
attend the on-site inspection and the public hearing, or if you wish to have someone ac t on your behalf,
for example a surveyor, a real estate agent or a potential purchaser of the property, you may assign agent
status to that individual by filling out the agent section of the conditional use permit application and by
having the agent, as well as yourself, sign the application. The agent must t hen attend both the on -site
inspection and public hearing. The Board of Adjustment will make a formal decision regarding the
conditional use permit application after listening to all testimony, reviewing the staff report, and other
applicable evidence.
If you have any questions please contact the Oconto County Planning and Zoning Office at 920.834.6827.

CONDITIONAL USE STANDARDS AND DIAGRAM OF PLANS
GENERAL STANDARDS: General performance standards and specific design standards for approval of a conditional use
are provided for each zoning district. Below are general standards that the Board of Adjustment Committee will address
in review of an application for a conditional use. These conditions include, but are not limited to, specifications of:
1. Minimum parcel size
2. Parking availability
3. Minimum setbacks
4. All state approvals required for public buildings and/or made part of the zoning permit
5. Attractiveness or physical appearance
6. Ingress / Egress
7. Maintenance
8. Safety of nearby roads
9. Traffic
10. Waste management
11. Erosion control standards
12. The period of time in which all or part of the use may be permitted
13. Landscaping and planting screens
14. Operational controls
15. Deed restrictions
16. Location of structures, docks, piers, or signs
17. Type of construction
18. The obtaining of other permits required by the State of Wisconsin, Federal Government Agencies, and any other
Oconto County Ordinances as a condition of the conditional use permit, must be completed prior to the issuance
of the Conditional Use Permit.
Please include information in the application on these general standards as they would apply. An applicant must
demonstrate that the proposed project complies with the standards noted for th e appropriate zoning district. The
decision to grant or deny a conditional use permit is discretionary. (i.e. permit may be denied if the project cannot be
tailored to a site without significant harm to ordinance standards and objectives)
Where the zoning district contains no standards unique to that district or use, the following standards shall apply:
1. That granting of a conditional use will not violate the spirit or intent of the zoning ordinance.
2. That the use allowed would not be contrary to the public health, safety, general welfare, or which would be
substantially adverse to property values in the neighborhood affected.
3. That the use shall not constitute a nuisance by reason of noise, dust, smoke, odor, or other similar factors.
Diagram of Plans: In most applications a diagram of plans must be submitted. This diagram must provide sufficient detail
for review of the standards that may apply to the application. This may include locations of existing or proposed buildings,
accommodations for parking ar eas, proximity to navigable waters, floodplain delineation, contour lines for review of
excavations and erosion control measures, detailed cross sections, etc…
Although it may not be necessary in all applications, a survey by a registered land surveyor is recommended for showing
detail. Detailed proposals assist the Board of Adjustment in the review of the conditional use application. As noted above,
the applicant must demonstrate that the proposed use complies with the standards noted for the zoning district.
All applications must be received by the Oconto County Planning and Zoning Office prior to the application deadline in order
to be scheduled for an upcoming public hearing. Please note that incomplete applications will not be processed. Once the
complete application has been processed, you will be notified of the date and time that the Board of Adjustment will conduct
an onsite of the property and time and location of the public hearing. You or your agent are required to attend both the
onsite and the public hearing.
Please note that postponement / rescheduling of an onsite and/or public hearing due to the applicants error in submittal
or failing to attend the onsite and/or public hearing will be charged a rescheduling fee.
Steps to applying for a Conditional Use Permit Guide
Note: Certain uses are of such nature or their effects are dependent upon specific circumstances as to make
impractical the determination in advance of where and when and under what conditions they should be
permitted. Conditional uses are land uses listed as such in each zoning district as found in the Oconto County
zoning ordinance. Pursuing a conditional u se permit in Oconto County requ ires prior review and
recommendation from the town in which the proposal is located. This local recommendation will be considered
by the Oconto County Board of Adjustment when deciding on the application for conditional use permit . The
steps to pursuing a conditional use permit are as follows:
Step 2
Contact the town in which the parcel is
located. (Refer to “Town Contact and Meeting
Information” included in the rezone application
packet which includes town contact information,
meeting dates, meeting times, locations and
required materials.)
Step 3
Attend the town Plan Commission meeting.
(The town Plan Commission will review your
conditional use permit proposal to determine if it
is consistent with the town 20 -Year
Comprehensive Plan and then make a
recommendation to the Town Board. The town
plan commission will need to complete applicable
parts of the “Town Recommendation Form”.)
Step 4
Attend the Town Board Meeting.
(The Town Board will review and make a
recommendation on your conditional use permit
proposal. The town plan board will need to
complete applicable parts of the “Town
Recommendation Form”.)
Step 6
The Oconto County Board of Adjustment will
conduct an onsite of the property and then
hold a public hearing. You and/or your agent
will need to attend both the onsite and the
public hearing. The Board of Adjustment will
then either recommend approval, approval
with conditions, or disapproval of the
application for a conditional use permit. The
Board of Adjustment decision is final. Any
decision of the Board is appealable for 30
days from the d ate shown on the decision
and order signed by the Board.
Step 1
Consult with Oconto County Planning &
Zoning staff regarding your proposal to
ensure compliance with the Oconto County

Description of Business: (Describe the number of employees, customers, hours of operation, and nature
of your business in detail on the following lines - attach if additional space is needed)
Regulations: The following regulations of Section 17.16.140(19) of the Zoning Ordinance shall apply to the
proposed home occupation:
Home Occupation. Description: Home occupations are economic activities performed within any dwelling unit
which comply with the following requirements and are compatible with the character of nearby residential areas.
Examples include personal and professional services, handicrafts and other items produced on-site, and the sale
of Tupperware, Shaklee, Amway, and Avon products or other similar activities that are customarily conducted
from a residence as determined by the zoning administrator, which comply with all of the special use regulations
listed under subsection (19)(b) of this section. Certain home occupations by their very nature require additional
review and public hearing comment through the conditional use process to ensure the promotion of the public
health, safety, comfort, and welfare. These uses are listed under subsection (19)(c) of this section:
a. Permitted by right: Not applicable.
b. Special use regulations (all districts).
i. The home occupation shall not be conducted on any porch, deck, patio or other unenclosed
or partially-enclosed portion of the dwelling unit or lot, nor shall any use other than storage
be conducted in any accessory structure except the garage.
ii. No more than twenty-five percent (25%) of the total living area of the dwelling (exclusive of
garage and porch areas) shall be used for the home occupation and/or storage for a business
conducted elsewhere.
iii. No alterations or improvements to the home which are designed to meet commercial or
industrial standards or which substantially alter the residential character of the structure shall
be permitted.
iv. Signs shall comply with Section 17.40.050.B, sign regulations applicable to home
occupations.
v. No on-site production shall be conducted which is typically only permitted in the industrial
zoning districts.
vi. In no instance shall a home occupation create a nuisance for neighboring properties. There
shall be no noise, odor, dust, vibration, smoke, glare, television or radio interference,
electrical interference, fire hazard, traffic, or any other hazard emanating from the dwelling
so as to create a nuisance other than that usually experienced in a typical dwelling under
normal circumstances wherein no home occupation exists.
vii. The sale of goods from the location of the home occupation shall be limited to items
produced on-site and the sale of Tupperware, Shaklee, Amway, and Avon products or other
similar activities that are customarily conducted from a residence as determined by the
zoning administrator. No more than two customers (or two parties of customers) shall be
within the residence at any one time. In addition, two group gatherings or sales shall be
permitted per calendar year. Goods intended for sale off-site may be delivered by passenger
motor vehicle or by parcel or letter carrier mail service using vehicles typically employed in
residential deliveries. The direct sale of goods produced off-site other than those described
above to the consumer from the dwelling is prohibited.
viii. The provision of services at the location of the home occupation shall be conducted on an
appointment basis only. No more than two customers (or two parties of customers) shall be
within the residence at any one time. In addition, two group gatherings shall be permitted per
calendar year.
ix. The home occupation shall be conducted by a resident of the dwelling unit, and no more than
one other person shall be employed, on either a part-time or full-time basis, in the business.
x. A minimum of two off-street parking spaces reserved for business use shall be provided on-
site for home occupations engaged in the provision of a service, the sale of items produced
on site, or the sale of Tupperware, Shaklee, Amway, and Avon products or other similar
activities that are customarily conducted from a residence as determined by the zoning
administrator.
xi. No more than two home occupations shall be carried on in any single-family detached
dwelling unit and associated accessory structures, and no more than one home occupation
shall be carried on in any attached dwelling unit and associated accessory structures.
xii. Property owner's written permission is required as part of the special use application.
c. Conditional use regulations (all districts). Any home occupation that involves one or more of the
following activities shall comply with standards listed in subsection (19)(b) of this section and
Section 17.44.050, procedures applicable to all conditional uses:
i. The handling of food or foodstuffs;
ii. The handling or growing of live plant or vegetation;
iii. The handling, use, or production of noxious, toxic, or harmful materials including weapons
and/or other dangerous objects;
iv. The care or treatment of animals, including birds, fowl, fish, and reptiles;
v. The care or treatment of humans; except day care uses which shall comply with subsections
17.16.140(21) and (22), family and intermediate day care homes.
Petitioner Affidavit:
