All terms carry forward unchanged from the current agreement, including the $1,000 annual fee, the scheduled court use at South Twin Park, and the insurance and indemnification requirements. Background: The Council approved the initial Recreational Facility Use Agreement in 2025. It granted the Amery Pickleball Club scheduled use of the eight pickleball courts at South Twin Park while keeping a portion of the courts open to the general public at all times. The agreement entered into in 2025 provides for optional annual renewal. No concerns regarding the agreement or its administration have been brought before the City to date. The renewal carries the same terms: • Regular use: Exclusive Club use of six of the eight courts, Monday through Friday, 8:00 a.m. to 12:00 p.m. The remaining two courts stay open to the public on a first-come, first-served basis. • League and tournament use: Up to 12 full-day reservations of all eight courts per calendar year, requested in writing at least 30 days in advance. The City may deny a request based on previously scheduled events or other City obligations but will not unreasonably withhold approval. • Insurance and indemnification: The Club must carry commercial general liability coverage of at least $1,000,000 per occurrence, name the City as an additional insured, and provide a certificate of insurance before any full-day use. The Club indemnifies the City, and event participants must sign a waiver. • Term and termination: One year with optional annual renewals. Either party may terminate for cause if the other fails to cure a material breach within 30 days of written notice. Fiscal Impact: The Club will pay the City $1,000, due in full upon execution, to support maintenance, repair, and the eventual resurfacing of the courts. The City's maintenance obligation is unchanged and remains consistent with other public park facilities, so the fee offsets existing costs rather than adding new ones. Recommendation: Staff recommends that the Common Council approve readoption of the Recreational Facility Use Agreement with the Amery Pickleball Club for the term of September 1, 2026 through August 31, 2027, and authorize execution of the agreement on behalf of the City. 104 Maple Street W., Suite A Office: 715.268.7486 Amery, WI 54001 Fax: 715.268.4870 TO: The Common Council of Amery FROM: Taylor Larson, Zoning Administrator DATE: 8/10/2026 RE: Policy Discussion and Possible Action – Waiving Zoning Fees for Charitable Organizations Installing Temporary Access to Residences Summary Staff requests Council action to waive zoning permit fees when a charitable organization installs a temporary, removable ramp or similar means of ingress and egress at a private residence to accommodate an occupant with limited mobility. The waiver covers fees only. All applicable zoning standards continue to apply, and the installation still requires a zoning permit application so the City retains a record of the improvement. The Plan Commission reviewed this proposal at its June 25, 2026 meeting, concurred, and recommended it to the Council. Background Service clubs, faith organizations, and nonprofit accessibility programs periodically build and donate ramps for Amery residents who cannot safely enter or leave their homes. These installations are typically modular or wood -framed units that rest on the g round or on surface blocking, are assembled in a day, and are removed once the occupant no longer needs them or leaves the residence. The sponsoring organization absorbs the material and labor cost, and the resident pays nothing. Under the zoning code, a ramp is an improvement that requires a zoning permit so staff can verify setbacks, right-of-way encroachment, and vision triangle clearance. That review remains appropriate. The permit fee, however, falls on a volunteer -funded project that produces a direct public benefit at no cost to the City, and the dollar amount is small enough that it generates more friction than revenue. Wis. Stat. sec. 66.0628 requires that a fee imposed by a political subdivision bear a reasonable relations hip to the service for which it is imposed. Nothing in that section obligates the City to charge a fee where the Council determines the cost is better absorbed as a service to residents. Staff recommends the waiver apply only where all of the following are met: • The work is performed by a nonprofit, charitable, or service organization at no cost to the property occupant. • The ramp or lift is temporary and removable, meaning it is not set on frost footings or a permanent foundation and can be dismantled without altering the structure of the dwelling. • The installation serves an occupant of the dwelling with a documented mobility limitation. • A zoning permit application is filed and approved before installation, at no charge, and the ramp is removed within a reasonable period after it is no longer needed. Fiscal Impact Minimal. The City would receive only a few permits of this type in a given year, and the current zoning permit fee under t he adopted fee schedule is $75 . Based on expected volume, the forgone revenue is expected to be under $225 annually. Staff review time is unchanged, since the application is still filed and reviewed. Building permit fees for permanent ramps are not affected and continue to be collected under the existing contract with West Wisconsin Inspection Agency. 104 Maple Street W., Suite A Office: 715.268.7486 Amery, WI 54001 Fax: 715.268.4870 Alternatives Permanent ramps remain fully permitted and inspected. A ramp set on frost footings, poured piers, or a permanent foundation, or one that is structurally attached to the dwelling, is permanent construction subject to the Wisconsin Uniform Dwelling Code. Tho se projects require a building permit and the associated inspections, and the fees for them are n ot waived under this proposal. For permanent ramps footing depth, guard and handrail construction, landing dimensions, and slope are life -safety items that warrant an inspector on site, and there is a real third-party inspection cost for that work. The Council could instead take no action and continue charging the zoning permit fee on all ramps. This preserves a small amount of revenue and avoids drawing a line between temporary and permanent construction, at the cost of leaving a modest financial barrier in front of donated accessibility work. The Council could also extend the waiver to building permit and inspection fees for permanent charitable ramps. Unlike the zoning permit, the building permit carries an out -of-pocket cost to the City for inspection services, and waiving it shifts that cost to the general fund rather than eliminating it. Recommendation: The Plan Commission voted to recommend that the City Council adopt the policy of not charging zoning permit fees for charitable organizations seeking to install temporary means of egress/ingress to a residential property. The City Administrator is recusing himself due to his membership in the Amery Lions Club, one such charitable organization that performs this work. First, our sewer cleaning contractor found a sewer main on Hyland Street that may be collapsing. They believe it needs to be relined now. The estimated cost is $40,000. Second, staff reviewed all sewer fund activity through August 10. Revenue is running well ahead of budget. So are debt payments, operating, and capital costs. The 2026 budget needs to be updated to reflect both. Staff recommends approving the Hyland Street work and amending the sewer budget to match what is actually happening. The amendment adds more revenue than expense. Even so, spending will exceed revenue by about $17,000 this year. The utility has enough cash on hand to cover that. BACKGROUND The Sewer Lining Program The Capital Improvement Plan the Council adopted in November 2025 includes $40,000 a year for sewer lining, every year from 2026 through 2030. The goal is to line one section of the system each year. Faye & Aspen Streets were relined this year. That was a 423 ft. section of sewer main that totaled $37,921 total for the lining. This lining is expected to last 50 years. Hyland Street would be a second lining project this year. It is on top of what the CIP planned for 2026. Cash on Hand The sewer utility has $621,463 in cash it can use. It has another $178,563 in two certificates of deposit. That CD money is set aside for equipment replacement and is not part of this request. The treatment plant project is not using this cash. From January through July we received $2,952,633 from the state loan and paid all of it out to the contractor and the engineer. FISCAL IMPACT Revenue Is Running Ahead of Budget The 2026 revenue budget of $1,183,623 was based on the 2025 adopted figure of $1,024,250, since 2025 had not closed when the budget was prepared. Actual 2025 collections finished at $1,226,060, and 2026 is tracking above that. Two quarters of billing have brought in $727,193. That is 61 percent of the entire year's budget. At this pace the year should finish near $1,416,000. Sewer Revenue Budgeted Expected Difference Charges for services $1,183,623 $1,412,000 $228,377 104 Maple Street W., Suite A Office: 715.268.7486 Amery, WI 54001 Fax: 715.268.4870 Sewer Revenue Budgeted Expected Difference Other revenue $0 $4,000 $4,000 Total $1,183,623 $1,416,000 $232,377 Spending Is Higher Too The sewer fund has spent $969,781 of its $1,183,624 budget. That leaves $213,843 with about four and a half months to go. Category Budgeted Spent to 8/10 Left Operations and maintenance $690,026 $444,524 $245,502 Debt payments, principal $276,259 $378,619 ($102,360) Debt payments, interest $217,339 $146,638 $70,701 Capital, sewer lining $40,000 $0 $0 Total $1,223,624 $969,781 $213,843 Operating costs are running about $60,600 a month. That comes to roughly $731,000 for the year against $690,026 budgeted. Insurance came in at $19,979 instead of $9,000. Biosolids hauling is on pace to pass its budget as well, partially due to the delay in the operating capacity of the dewatering process at the WWTP earlier this year. Debt Payments Are the Bigger Problem We paid the state $525,257 on April 14. That single payment is already more than the $493,598 budgeted for the whole year. As the WWTP pr oject continued to utilize contingency, its debt service obligations increased proportionately. The loan schedules in the 2025 audit explain why. Both sewer loans charge interest on May 1 and November 1. Principal is due May 1. So the April payment covered a full year of principal plus half the year's interest. A second payment, interest only, is due November 1. 2026 Sewer Debt Payments Amount Paid April 14 $525,257 Estimated November 1 payment $132,913 Total for the year $658,170 Amount budgeted $493,598 Additional amount needed $164,572 The November figure is an estimate based on what is still owed on each loan. The state will send the exact bill. Where the Year Ends Up 104 Maple Street W., Suite A Office: 715.268.7486 Amery, WI 54001 Fax: 715.268.4870 Sewer Utility (Fund 620) Budgeted Expected Difference Total revenue $1,183,623 $1,416,000 $192,377 Operations and maintenance $690,026 $735,000 ($44,974) Debt payments $493,598 $658,000 ($164,402) Capital, sewer lining $40,000 $80,000 ($40,000) Total spending $1,223,624 $1,473,000 ($249,376) Revenue minus spending ($0) ($17,000) The $17,000 gap would come out of the $621,463 in cash. Two things are worth keeping in mind. Nearly all of the gap is loan principal and the lining work. It is not the cost of running the system day to day. The utility still takes in what it costs to operate. Looking Ahead to 2027 The treatment plant loan is still paying out to us. The principal this year came in $45,189 above what the audit schedule showed, because we borrowed more after that schedule was written. The state will redo the schedule when the project is finished, and t he payments will go up again. Staff will get the current schedule before finishing the 2027 budget. Until then, treat the 2027 debt figure as an estimate. The Cost of the Hyland Street Work The $40,000 is about 6 percent of the cash on hand. It fits inside the $213,843 still left in the sewer budget. Relining extends the life of the pipe, so it counts as a capital improvement rather than a repair. That matches the City's policy and the 20 year life the CIP assigned to this work. ALTERNATIVES 1. Approve the Hyland Street work and adopt the budget amendment. This fixes the sewer problem now and brings the budget in line with actual activity in one step. It also puts the full picture in front of the Council now, rather than leaving it for the auditors to raise next spring. The Council would be accepting a $17,000 draw on cash. 2. Wait on Hyland Street until 2027. This saves $40,000 now and lets us bid the work as a planned project. The risk is that the main fails first. A collapse would cost well more than $40,000 to fix. This is not recommended. 3. Do nothing. Not recommended. The sewer fund will go over budget when the November payment is made, whatever the Council decides about Hyland Street. And the Hyland Street problem would still be there. RECOMMENDATION Staff recommends Alternative 1. Specifically: • Adopt the attached resolution amending the 2026 Sewer Utility (Fund 620) budget. • Approve the Hyland Street sewer main relining, not to exceed $41,000. 104 Maple Street W., Suite A Office: 715.268.7486 Amery, WI 54001 Fax: 715.268.4870 A budget amendment requires a two-thirds vote of the entire Council under Wis. Stat. sec. 65.90(5)(a). A notice must also be published in the newspaper within fifteen days. One last note. We have had two sewer main problems in a single year against a progr am that funds one project a year. Staff is evaluating sewer system conditions and is working with the City’s engineering firms for options to address system-wide improvements. 104 Maple Street W., Suite A Office: 715.268.7486 Amery, WI 54001 Fax: 715.268.4870 RESOLUTION NO. 12-2026 A RESOLUTION AMENDING THE 2026 SEWER UTILITY (FUND 620) BUDGET WHEREAS, the Common Council adopted the 2026 annual budget in November 2025, including a Sewer Utility (Fund 620) appropriation of $1,183,624; and WHEREAS, sewer revenues have exceeded the amounts budgeted for 2026, and revenues recorded through August 10, 2026, representing two quarters of billing, support a revised full -year estimate of $1,416,000; and WHEREAS, debt payments made to the Wisconsin Department of Administration on April 14, 2026 totaled $525,257, exceeding the full-year appropriation of $493,598; and WHEREAS, the Revenue Bonds of 2021A and the Revenue Bonds of 2025 both carry interest dates of May 1 and November 1, and a further payment estimated at $132,913 is due November 1, 2026, bringing total 2026 debt payments to approximately $658,170; and WHEREAS, the 2026 -2030 Capital Improvement Plan adopted by the Common Council includes project SEWER2-2026, Sewer Lining Repairs, at $40,000 annually; and WHEREAS, sewer main relining was performed on Fay & Aspen Street in 2026, and further relining has been identified as necessary on Hyland Street; and WHEREAS, Wis.
