HILLCREST DRIVE SIDEWALK DESIGN
Final design for the Hillcrest Drive project is currently on hold pending completion of the property
acquisition process. Once this process is finalized, any necessary updates will be incorporated into
the project plans.
The project team is continuing to move forward with design and coordination efforts in preparation for
the next major milestone—the 90% design submittal, scheduled for June 2026. In the coming months,
work will focus on coordinating with utilities, refining plan details, preparing construction specifications,
completing required coordination (including railroad coordination), and updating cost estimates. One
utility conflict that has been identified is the City’s fire hydrants along the corridor.
One specific fire hydrant will require the City’s Utility to relocate the utility in advance of the construction
project. MSA will assist the Utility in receiving a proposal for this work from the City’s contractor that is
selected for construction.
Following the June submittal, the plans will be reviewed by both WisDOT and the City. Any feedback
received will be addressed before submitting final plans, which are currently anticipated in August
2026. At this time, overall construction costs remain consistent with previous estimates, with updated
figures to be included in the June submittal.
Property acquisition efforts are also progressing:
A key study supporting property valuation has been completed and approved.
The Sales Study and Nominal Payment Parcel Report have been completed, and the
documents were delivered to the City for their review and final approval.
Once approved, the next step will be making offers and meeting directly with property owners.
There are no changes to the project schedule at this time.

ZONING CODE REWRITE
The City is nearing completion of Phase 1 of its zoning code update. During this phase, the project
team collaborated with the Planning Commission and City Council to develop recommendations for
the overall structure of the updated zoning code and proposed new zoning districts. Both groups have
reviewed the approach and provided direction to move forward.
Input from the community and stakeholders has also been an important part of this phase. Interviews
have been conducted as schedules allow, and the project team has worked with City staff at key
milestones to ensure alignment throughout the process.
The team has completed analysis of development standards, such as lot sizes and dimensional
requirements, and has reviewed this with the Planning Commission as well as a draft zoning map with
the new districts.
The project is now moving into Phase 2, which will focus on preparing a draft of the updated zoning
code and making updates to the zoning map. This phase will include:
Drafting a clearer, more user-friendly zoning code with updated language and visuals
Reviewing the draft for compliance with Wisconsin law
Coordinating with the City Attorney to address any legal considerations
Ensuring consistency with the City’s broader municipal code
Upcoming work at the May Planning Commission will include an updated map based on Planning
Commission and Staff Comments, draft district standard visuals, a discussion on accessory structure
requirements, and uses.
As Phase 2 progresses, the project team will continue to meet with City staff and leadership at key
milestones to review progress, gather feedback, and refine the draft before moving forward.

RE: Building Code Update – DSPS Commercial Delegation and Chapter 193 Amendment
Summary. The City of Amery has received delegation approval from the Wisconsin Department of Safety
and Professional Services (DSPS) for commercial building code enforcement authority, effective May 7,
2026. This delegation closes a longstanding gap in the City’s regulatory authority that was identified during
the transition to West Wisconsin Inspection Agency (WWIA). Council action is requested to adopt an
updated Chapter 193 – Building Construction of the Amery Municipal Code that formalizes this authority
and incorporates updated code references.
Background. During the transition to a new building inspector, Benjamin Campbell of West Wisconsin
Inspection Agency, LLC (WWIA), it was identified that the City of Amery had not previously obtained formal
delegation of commercial building code enforcement authority from DSPS. While the City held commercial
electrical delegation, structural and HVAC plan review authority for commercial projects and
corresponding inspection authority had not been established. The City immediately initiated an
application to DSPS to remedy this.
DSPS issued four delegation approvals on May 6, 2026, each effective May 7, 2026:
1. Commercial Building (Structural and HVAC) Plan Review and Inspections – Per Wis. Stat.
101.12(3)(b) and (g), the City may now perform structural and HVAC plan review for small
commercial buildings (under 50,000 cubic feet) and conduct commercial building inspections of
all sizes without limitation. Inspector: Ben Campbell, WWIA (Credential #658622).
2. Fire Suppression and Fire Alarm (FS/FA) Plan Review – Per Wis. Stat. 101.12(3)(b), the City may
perform FS/FA plan review for small commercial building projects. Inspector: Ben Campbell, WWIA
(Credential #658622).
3. Commercial Electrical Permitting and Inspections – Per Wis. Stat. 101.02(5) and (15) and
101.82(2m), this delegation was previously held by the City and has been updated to reflect a
change in the contracted inspector. Inspector: Joshua Melstrom, Melstrom Inspections, LLC
(Credential #976538-CEI).
4. Uniform Dwelling Code (UDC) and Camping Units – Per Wis. Stat. 101.65(1)(a) and (2m), and
101.63(1), this delegation covers permitting and inspections for new one - and two -family
dwellings and camping units. Inspector: Ben Campbell, WWIA (UDC Credential #030500029).
In addition to formalizing the new delegation authority, Chapter 193 requires two substantive code
updates: (1) the addition of Wis. Admin. Code Chapter SPS 327 (Camping Units) to the adopted UDC
chapters in § 193 -3, consistent with the UDC delegation appr oval; and (2) the update of adopted
international code edition references in § 193 -6 from the 2015 editions of the IBC, IECC, IMC, IFGC, and
IEBC to the current 2021 editions, consistent with current DSPS -adopted standards. The attached
ordinance reflects both changes.
Fiscal Impact. Adoption of the ordinance has no direct fiscal impact. Permit and inspection fees are
established in the City’s adopted Schedule of Fees and are collected at the time of permit issuance. The
commercial building inspection services are provided under the C ity’s contract with West Wisconsin
104 Maple Street W., Suite A Office: 715.268.7486
Amery, WI 54001 Fax: 715.268.4870
Inspection Agency; costs and fee-sharing arrangements are governed by that agreement. The commercial
electrical inspection services are provided under the WWIA’s arrangement with Melstrom Inspections,
LLC. No additional appropriation is required.
Recommendation. Staff recommends that the Common Council adopt the attached Ordinance amending
Chapter 193 – Building Construction of the Amery Municipal Code to: (1) add SPS 327 (Camping Units) to
the adopted Uniform Dwelling Code chapters in § 193 -3; and (2) update the adopted international code
edition references in § 193 -6 from 2015 to 2021. Adoption will bring the ordinance into alignment with
the City’s new DSPS delegation authority and with current state code standards.

2027 CIP projects: Key capital projects scheduled include the Airport Terminal Building
construction ($190K), Hillcrest Safe Routes to School ($84k), Street Sweeper replacement
($350K), North Park Redesign master plan ($25K), Squad Car regular replacement ($75k) and
continued annual programs in streets, utilities, and public safety.
Personnel cost pressures: Health insurance, WRS pension contributions, and salary adjustments
are expected to drive a 4–6% increase in personnel costs, the City's largest budget category.
Levy limit constraints: Wisconsin levy limits will continue to constrain property tax revenue
growth. Staff will build revenue projections consistent with allowable growth once equalized
value data is available.
