RE: Chapter 321 Park Rules — Discussion Draft
Summary
Staff asks the Committee to review proposed changes to Chapter 321, the City's parks and recreation code.
The attached draft ordinance would update general park rules, establish formal rules for North Park RV
Campground (including seasonal sites), and set basic minimum standards for all campgrounds in the City.
The Committee's feedback will shape the final draft before it goes to the Common Council.
Background
General Park Rule Updates
Chapter 321 was last updated in 2004. A few gaps need to be addressed:
• Fireworks – North Park's posted rules ban fireworks, but the City code has no formal prohibition.
The draft adds one.
• Drones – The code covers radio-controlled planes but says nothing about drones. The draft adds
a matching rule.
• Overnight camping – The code bans overnight camping in all City parks. That conflicts with
North Park. The draft adds an exception for designated campground areas.
• Park closing hours – The 11:00 p.m. park closure also conflicts with overnight campground use.
The draft adds an exception for campground areas.
North Park RV Campground (proposed §321-10)
North Park offers nightly RV sites at $35 per night and seasonal sites at $650 per month. The rules posted
on the City website — quiet hours, 7-day stay limit, pet leash rules — have no formal legal backing. The
draft puts those rules into the City code so they can be enforced.
The draft also addresses seasonal sites for the first time. Key rules:
• Seasonal stays are limited to May 1 – October 31 (see policy question below)
• No seasonal site can be used as a permanent home address
• Recreational vehicles and any attachments must meet state standards
Minimum Rules for All Campgrounds (proposed §321-11)
The draft creates a short set of conduct rules that apply to all campgrounds in the City — public and private
— without requiring a City license or permit. If a campground changes owners, the rules still apply
automatically. The seven rules cover: quiet ho urs, fire safety, trash disposal, keeping roads clear for
emergency vehicles, having an on -call emergency contact, and prohibiting use of any campsite as a
permanent home.
104 Maple Street W., Suite A Office: 715.268.7486
Amery, WI 54001 Fax: 715.268.4870
Note: Soldier’s Field CUP
The Council will vote on the Soldier’s Field private campground conditional use permit on May 6.
That is a separate action. §321-11 would apply to Soldier’s Field once it opens, along with any
additional conditions set by the CUP .
Policy Questions for Committee Direction
Please provide direction on the following before staff prepares the final ordinance draft:
Policy Question Options Staff Recommendation
Quiet hours 10:00 p.m.–7:00 a.m. vs. 11:00 p.m.–
6:00 a.m. (current practice)
10:00 p.m.–7:00 a.m.
Maximum nightly stay 7 days (current) vs. 14 days Retain 7 days
Seasonal site end date October 31 vs. November 1 October 31
Generator hours Off during quiet hours vs. no
restriction
Off during quiet hours
Drone rule Prohibited except in designated areas
vs. flat prohibition
Prohibited except
designated areas
Fiscal Analysis
These changes do not require new spending. A few items to note:
• Fee schedule – Current North Park rates are set by staff, not by Council resolution. A fee
resolution should be adopted along with the ordinance.
• State campground license – North Park is required to hold an annual license from the Wisconsin
Department of Agriculture, Trade and Consumer Protection (DATCP). The fee is $175 per year.
Staff will confirm the license is current.
• No administrative cost for §321-11 – The minimum conduct rules require no City staff time to
administer. Enforcement happens the same way as any other code violation.
Recommendation
Staff recommends the Committee:
1. Provide direction on the policy questions in the table above.
2. Support the §321-11 minimum-conduct approach (no City campground license required).
3. Recommend the Common Council introduce the ordinance at the June 2026 meeting.
4. Direct staff to verify North Park's DATCP license status.
5. Direct staff to prepare a fee schedule resolution to accompany the ordinance.

exclusive use of municipally owned parks, park facilities, park shelters or parts thereof in the City to
the end that the general welfare of the City is protected.
B. Reservation of park space. A person or group, firm, organization, partnership or corporation may
reserve the use of a park facility or a park shelter by written application filed with the City
Administrator/Clerk-Treasurer for a permit for exclusive use of the same. The City Administrator/

expenses.
E. Action on application. The City Council shall act promptly on all applications for permits for

Code.
(2) If the granting of the permit would conflict with another permit already granted or for which
application is already pending.
(3) If the application does not contain the information required by Subsection C above.
(4) The application is made less than the required days in advance of the scheduled exclusive use.
(5) If it is for a use of the park or park facility at a date and time when, in addition to the proposed
use, anticipated nonexclusive use by others of the park or park facility is expected and would be
seriously adversely affected.
(6) If the law enforcement requirements of the exclusive use will require so large a number of
persons as to prevent adequate law enforcement to the park, park facility or shelter area involved
or of the rest of the City.
(7) The exclusive use will reasonably create a substantial risk of injury to persons or damage to
property.
(8) The exclusive use is so poorly organized that participants are likely to engage in aggressive or
destructive activity.
G. Indemnification. Prior to granting any permit for exclusive use of the park, the City may require the
permittee to file evidence of good and sufficient sureties, insurance in force or other evidence of
adequate financial responsibility, running to the City and such other third parties as may be injured or

Committee on Public Welfare shall be subject to removal upon 10 days' written notice given by said
Committee to either the person who has erected such pier or boat hoist or who maintains or uses said

person shall be subject to a forfeiture under § 1-5 for each offense, and shall also be liable at the suit
of the City for the cost of removal.

ORDINANCE NO. ___-2026
An Ordinance Amending Chapter 321 of the Municipal Code of the City of Amery
Parks and Recreation
Formatting key: strikethrough = deleted underline = new language * = committee policy question (see
footnote)
↳ This document shows proposed changes to existing code and full text of new sections. New §321 -10 and
§321-11 are shown in underline as entirely new provisions.
AMENDMENTS TO EXISTING SECTIONS
§321-1(B)(24) — Camping [amendment]
(24) Camping. Overnight camping is not permitted in any City park except in areas designated by the City
Council as a recreational vehicle park or campground pursuant to §321-10. Within any such area,
camping and overnight stays are permitted subject to §321-10.
§321-1(B)(35) — Fireworks [new subsection]
(35) Fireworks. No person shall ignite, discharge, or possess consumer fireworks, as defined in Wis. Stat.
§167.10, in any City park or designated campground area, except as part of a City Council-authorized
display under a permit issued pursuant to Wis. Stat. §167.10.
↳ Codifies the prohibition already posted at North Park. Current posted rule has no §1 -5 forfeiture authority
behind it.
§321-2 — Radio-Controlled Model Aircraft [retitled; new subsection B]
§321-2. Radio-controlled model airplanes prohibited in parks. Radio-Controlled Model Aircraft and
Unmanned Aerial Vehicles.
A. No person shall fly a radio-controlled model airplane or helicopter in any park in the City of
Amery except in areas specifically designated and posted for such purpose.
B. No person shall operate an unmanned aerial vehicle (drone) as defined under 14 C.F.R. Part 107
in any park in the City of Amery except in areas specifically designated and posted for such purpose
or tied in with a City sponsored event. Operators remain responsible for all applicable federal and
state requirements.1
§321-4(A) — Park Hours [amendment]
A. Park hours. All grounds and facilities in the City park system, except the City beach and any area
designated as a recreational vehicle park or campground under §321-10, shall be closed between 11:00
p.m. and 5:00 a.m. the following day. Within a designated campground area, registered overnight guests
and facility staff are permitted access at all hours; all other persons remain subject to the 11:00 p.m.
closing hour.
NEW SECTION — §321-10: CITY-OWNED RECREATIONAL VEHICLE PARKS AND CAMPGROUNDS
↳ Entirely new section — all text is new.
A. Purpose and Designation
1Drone rule scope: The 'designated area' exception mirrors the existing RC airplane approach. Remove
the exception language for a flat prohibition if preferred.
Strikethrough = deleted language | Underline = new language | * = committee discussion item
This section governs recreational vehicle (RV) parks and campgrounds on City-owned property and
provides a statutory basis for the North Park RV Campground operation. The City Council may, by
resolution, designate any City-owned park area as an RV park or campground, identifying the site
boundaries, maximum number of sites, and any site-specific conditions. No City land may operate as an
RV park or campground without such designation.
B. Operations
A designated facility may be operated directly by the City under the City Administrator, or by a private
operator under a written agreement approved by the City Council specifying term, fee arrangements,
insurance, maintenance obligations, and grounds for termination.
C. Registration
All persons occupying a site must register upon arrival, providing the responsible party's name and
contact information, vehicle license plate number(s), site number, dates of stay, and payment of
applicable fees.
E. Seasonal Sites
(1) A seasonal site is a site reserved by a single party for recurring occupancy across a defined
season under a written seasonal agreement.
(2) Seasonal occupancy shall not begin before May 1st and shall end no later than October 31.
(3) No seasonal campsite constitutes a primary residence. No occupant may claim a seasonal
campsite as a domicile or legal address. All campsite occupants — including seasonal — are
licensees, not tenants; Wis. Stat. Ch. 704 does not apply to campsite occupancy.2
(4) No permanent structure, deck, fence, or enclosure may be constructed on a seasonal site.
(5) Seasonal site fees shall be established by Council resolution and communicated to occupants
before the start of each season.
F. Abandoned Units
Any recreational vehicle or personal property remaining on a City campsite after the seasonal close date
without written approval is declared abandoned. The City shall post written notice on the unit and mail
notice to the registered owner's last known address. If not removed within 15 days of notice, the City
may remove and store the unit at the owner's expense. Any net proceeds from disposal shall be applied
to accrued storage and removal costs.3
G. Permitted and Prohibited Uses
Permitted: recreational vehicles; tent camping in designated areas; one associated passenger or tow
vehicle per site; portable grills and camp stoves per §321-1(B)(8); quiet recreational activity.
Prohibited: use of any site as a primary residence; storing unlicensed or unregistered vehicles not
associated with an active stay; permanent structures; dumping holding tank waste outside the
designated dump station; fireworks (§321-1(B)(35)); subletting any registered site.
2Wisconsin-specific: Express licensee language protects against Wis. Stat. Ch. 704 landlord-tenant
claims. A seasonal occupant paying monthly rent with exclusive possession of a specific site could
otherwise argue tenancy rights, converting eviction into a full Ch. 704 proceeding.
3Note: §321-10(F) and §321-11(H) address abandoned units for the first time. Wisconsin's abandoned
vehicle statute (§342.40) was not written for campground units — express code language avoids
ambiguity.

H. Quiet Hours and Generators
Excessive noise, amplified music, and generator operation are prohibited between [10:00 p.m. / 11:00
p.m.]4 and 7:00 a.m.
*Policy question — see footnote 1
I. Pets
Pets must be leashed (8 feet or less) at all times outside a registered unit. Pet waste must be removed
immediately. Pets posing a safety hazard may be required to leave. Pets are prohibited in restroom and
shower facilities and in any swimming or beach area.
J. Unaccompanied Minors
No person under age 18 may register for or occupy a campsite without a parent or legal guardian
registered on the same or an adjacent site.
K. Utilities and Sanitation
Guests shall use only utility connections at their assigned site. Tampering with infrastructure or using
connections at unoccupied sites is prohibited. The City or its operator shall maintain restroom and
shower facilities in clean and sanitary condition, provide a sanitary dump station accessible to all
registered guests, and maintain adequate refuse receptacles. Guests shall leave sites in the condition
found upon arrival.
L. Fees, Reservations, and Alcohol
Fees shall be established by Council resolution and posted at the facility and on the City's website.
Reservations are available through a process established by the City Administrator; the City may
designate a portion of sites as first-come, first-served. Possession and consumption of alcohol is
permitted within a registered site; open intoxicants are prohibited in common areas. Sale of alcohol
requires a license under Chapter 163.
M. Enforcement
The City Administrator, Police Department, and any authorized facility manager may enforce this
section. Any person who violates this section may be required to vacate immediately without refund.
Violations are subject to forfeitures under §1-5.
N. State Law Compliance
City campgrounds shall maintain a current operating license under Wis. Admin. Code Ch. ATCP 79
(DATCP or designated local public health agent, per Wis. Stat. §97.67).
NEW SECTION — §321-11: MINIMUM CAMPGROUND CONDUCT STANDARDS
↳ Applies to all campgrounds in the City — public and private — by operation of law. No City license required.
Enforced by forfeiture under §1-5. CUP conditions for any private campground supplement this section.
A. Applicability
This section applies to any parcel within the City on which four or more campsites are offered for
transient or seasonal overnight occupancy on a fee or non-fee basis, consistent with the scope of Wis.
4Policy choice: Staff recommends 10:00 p.m.–7:00 a.m. consistent with industry norms and §321-11(C).
Adopting 10:00 p.m. requires updating the North Park website and posted campground signage.
Strikethrough = deleted language | Underline = new language | * = committee discussion item
Admin. Code Ch. ATCP 79. Compliance with this section does not substitute for ATCP 79 licensure or any
CUP conditions.
B. Quiet Hours
No campground operator shall permit, and no guest shall engage in, excessive noise — including
amplified music or motorized equipment — between [10:00 p.m. / 11:00 p.m.] and 7:00 a.m. Quiet
hours shall be posted prominently at the campground entrance and at each sanitary facility.
C. Fire Control
No open burning or fires outside designated fire rings, grills, or fireplaces provided at individual sites or
common areas. DNR fire restriction status shall be posted when a restriction is in effect. No fire shall be
left unattended. Ashes shall be fully extinguished before departure.
D. Refuse and Waste
Operators shall provide adequate refuse receptacles and arrange collection at a frequency sufficient to
prevent overflow and pest attraction, not less than twice weekly during the operating season. Dumping
of holding tank waste on the ground or into storm drains is prohibited. Where a sanitary dump station is
provided, it shall be maintained in a clean and functional condition.
E. Operator Responsibility for Guest Conduct
The operator is responsible for ensuring guest compliance with this section.
F. Emergency Access
All interior roadways shall be maintained to accommodate emergency vehicles at all times during the
operating season. No vehicle, unit, or equipment may obstruct emergency access to any portion of the
facility.
G. Emergency Contact
Operators shall designate an emergency contact reachable by phone at all hours during the operating
season. The contact's name and phone number shall be posted at the facility entrance and at each
sanitary facility, and filed with the Police Department before each season opens. Any change shall be
filed within 72 hours.
H. Abandoned Units
Any unit remaining on a private campground site beyond the last day of a registered stay or seasonal
agreement, without operator approval, may be treated as abandoned. The operator shall post written
notice on the unit and make a reasonable effort to notify the registered owner. If not removed within 15
days, the operator may have the unit removed at the owner's expense.
I. Residential Use and Seasonal Limits
No campsite may be used as a primary residence or legal domicile. All occupants are licensees; Wis. Stat.
Ch. 704 does not apply. No operator shall permit a single party to occupy a seasonal site continuously
for more than six months in any twelve-month period, or outside May 1–October 31, without City
Administrator approval.
J. Firewood
In accordance with Wisconsin DNR guidance on invasive species and tree disease, no person shall bring
firewood into any campground from a source more than 10 miles away. Operators shall post this
requirement at the campground entrance.
Strikethrough = deleted language | Underline = new language | * = committee discussion item
K. Unaccompanied Minors
No person under age 18 may register for or occupy a campsite without a parent or legal guardian
registered on the same or an adjacent site.
L. City Inspection Authority
The City Administrator or designated enforcement officer may inspect any campground subject to this
section during normal operating hours upon reasonable notice to confirm compliance with this section.
Operators shall provide access and cooperate with all inspections.
M. Enforcement and Forfeitures
Violations are subject to forfeitures under §1-5. Each day of continuing violation constitutes a separate
offense. Nothing in this section limits the City's authority to seek injunctive relief or other available
remedies.
