RE: Conditional Use Permit for Soldier’s Field
Summary: Partners Properties LLC (Scott Lee and Jenna Johnson) applied for a Conditional Use Permit
(CUP) to construct and operate a private campground and RV park on the Soldier’s Field property. An RV
Park is an allowed conditional use within this parcel's CD-1 Conservancy District zoning. The access alley
and South Twin gazeebo are not included in the sale of the parcel.
The Plan Commission reviewed the application against the City’s statutory standards for conditional uses
(§ 450-45). After evaluating the proposal, the Plan Commission voted to recommend approval of the
Conditional Use Permit to the City Council, subject to the conditions set forth in the Plan Commission’s
motion, which incorporated staff’s recommended conditions from the staff memorandum submitted to
the Commission, pursuant to § 450-47.
The City Council is now tasked with holding the final public hearing and rendering a final decision on the
permit and its associated conditions.
Background: The Developer intends to execute a phased build-out of the campground and has indicated
the ability to perform the necessary site work, including the removal of the buried concrete bleachers. If
the Developer agrees to the conditions attached to the Permit, the City must issue the permit. Any
denial must be supported by factual findings tied to the standards in § 450-45.
• Campsites & Access: The site will feature approximately 60 campsites (25’x40’) with a mix of
electric-only and full hook-up capabilities, along with a larger group campsite. Access will be
primarily off Memorial Drive, utilizing 30-foot gravel driveways.
• Phase 1 Amenities: Initial construction will include a bathroom and an office.
104 Maple Street W., Suite A Office: 715.268.7486
Amery, WI 54001 Fax: 715.268.4870
• Future Amenities: Depending on costs, future phases may include a recreation room,
bathhouse, and a semi-public pool or play pond area.
• Utilities: The Developer will independently install necessary sewer and water service
improvements, notably including a lift station.
Plan Commission Findings & Recommended Conditions: Under § 450-47(A), the City Council may
stipulate conditions upon the establishment and operation of a conditional use to promote public
health, safety, and general welfare.
In their recommendation for approval, the Plan Commission determined that the project meets the
required standards provided that the following conditions and guarantees are formally attached to the
permit:
• Operational Control & Hours: To minimize potential disturbances to the surrounding
neighborhood, an employee must be onsite daily from 8:00 a.m. to 10:00 p.m..
• Quiet Hours: Campground quiet hours shall be enforced daily from 10:00 p.m. to 8:00 a.m.
Quiet hours shall be posted on-site and distributed to all guests at check-in.
• Fencing & Buffering: The Developer must install a fence surrounding the campground along the
south and east sections where the property abuts neighboring parcels to provide a physical and
visual buffer.
• Utility Infrastructure & Approvals: As proposed, the Developer is responsible for the installation
of all necessary water and sewer improvements, including the lift station. These specific sewage
disposal and water supply systems must undergo full City Engineering review and approval prior
to construction.
• Lighting (Item 5): Ensuring campground lighting is directed inward and does not cause glare for
neighboring residential properties.
• Construction Commencement & Sureties (Items 3 & 4) Financial sureties are required to
guarantee the infrastructure improvements.
Council Action: Following the public hearing, the Common Council is requested to review the Plan
Commission's recommendation, discuss the stipulated conditions, and pass a motion to approve, deny,
or modify the Conditional Use Permit for the Soldier's Field development.

RE: Ordinance 05-2026 Repealing Municipal Code §47-13 Ethics Board
Summary: The attached ordinance repeals §47-13 of the Municipal Code establishing the Ethics Board.
This section is no longer necessary due to the adoption of the City’s Fraud Prevention and Whistleblower
Policy in April 2026, which provides a comprehensive and more administratively efficient framework for
addressing ethical concerns and misconduct.
Background: Section §47-13 established an Ethics Board responsible for administering and enforcing the
City’s Ethics Code, including complaint investigation and advisory opinions. In April 2026, the City
adopted a Fraud Prevention and Whistleblower Policy that centralizes reporting, investigation, and
enforcement authority under the City Administrator, City Attorney, and City Council, while also
providing clear reporting channels, investigation procedures, and anti-retaliation protections.
The policy effectively replaces the functional role of the Ethics Board while reducing administrative
complexity and improving responsiveness.
Recommendation: Staff recommends approval of Ordinance 05-2026 repealing §47-13 Ethics Board as
redundant and unnecessary given the adoption of the Fraud Prevention and Whistleblower Policy.
ORDINANCE NO. 05-2026
AN ORDINANCE TO REPEAL §47-13 ETHICS BOARD OF THE MUNICIPAL CODE OF THE CITY OF AMERY,
WISCONSIN
WHEREAS, Section §47-13 of the Municipal Code establishes an Ethics Board responsible for
administering and enforcing the City’s Ethics Code; and
WHEREAS, the Common Council adopted a Fraud Prevention and Whistleblower Policy in April 2026
establishing procedures for reporting, investigating, and addressing fraud, waste, abuse, and ethical
misconduct; and
WHEREAS, the Fraud Prevention and Whistleblower Policy centralizes administrative responsibility for
ethical oversight and provides clear reporting channels, investigation procedures, and protections
against retaliation; and
WHEREAS, the Common Council finds that the Ethics Board established under §47-13 is now redundant
and unnecessary; and
WHEREAS, the repeal of §47-13 will eliminate duplicative processes and improve administrative
efficiency;
NOW, THEREFORE, the Common Council of the City of Amery, Wisconsin, does ordain as follows:
Section §47-13 of the Municipal Code of the City of Amery, entitled “Ethics Board,” is hereby repealed in
its entirety.
This ordinance shall take effect upon its passage and publication as required by law.

RE: Gifts and Memorial Policy Review and Adoption Resolution 8-2026
Summary: Staff is recommending a revised Gifts and Memorials Policy for Finance Committee
consideration. The revision streamlines the policy's length and readability without changing any
approval thresholds, procedural requirements, or legal protections.
Background: The Gifts and Memorials Policy was originally adopted in December 2023 and last revised
in April 2026 as part of the City's annual financial policy review cycle. Following that review, the Mayor
raised a concern about the policy's length. Staff reviewed the policy with that feedback in mind and
identified significant consolidation opportunities — primarily in the introduction, definitions, and
evaluation criteria sections — where content was either redundant or could be expressed more
concisely without affecting substance.
The revised policy preserves all operative elements: The Minor/Major Donation thresholds ($1,500), the
City Administrator's administrative approval authority, City Council approval requirements for Major and
conditioned donations, Plan Commission and Arts & Parks Committee review for real property (including
the 60-day timeframes), donor recognition object standards, private construction requirements,
removal authority, and the City Attorney referral for donor anonymity requests. The revision reduces
the document from approximately nine pages to approximately two.
Recommendation: Staff recommends the adoption of Resolution 8-2026 adopting the revised Gifts and
Memorial Policy.
RESOLUTION NO. 8-2026
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AMERY, WISCONSIN,
REVISING THE CITY'S GIFTS AND MEMORIALS POLICY
WHEREAS, the City of Amery previously adopted a Gifts and Memorials Policy in December
2023 to establish guidelines and procedures for considering and receiving donations to the City;
and
WHEREAS, the City Council conducted a comprehensive financial policy review in 2026,
resulting in minor revisions to the Gifts and Memorials Policy that were adopted in April 2026;
and
WHEREAS, following that review, the City Administrator further revised the policy to improve
its conciseness and readability while preserving all substantive approval thresholds, procedural
requirements, and legal protections contained in the previously adopted version; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Amery,
Wisconsin, that the revised Gifts and Memorials Policy, attached hereto as Exhibit A, is hereby
adopted and shall supersede all prior versions of the Gifts and Memorials Policy effective upon
passage of this Resolution.
BE IT FURTHER RESOLVED that the City Administrator is authorized and directed to
distribute the revised policy to all applicable City staff and departments and to post the policy on
the City's website.

City of Amery. This policy covers all monetary, property, endowment, and memorial donations made to the City
and any of its departments.
POLICY STATEMENT
The City of Amery retains sole discretion to accept or decline any proposed gift or donation, and to control the
placement, location, and number of memorials on public property. Acceptance of a gift under this policy does not
create any obligation on the City to maintain the donation beyond its reasonably expected lifespan, or to replace it
if lost, stolen, damaged, or destroyed.
DEFINITIONS
Major Donation: Any donation of $1,500 or more, or any request for naming rights beyond minor structures (trees,
benches, bricks).
Minor Donation: Any donation under $1,500, which may be approved administratively without City Council
approval.
Donation/Gift: Any item proposed to be given to the City, including money, negotiable securities, real or personal
property, public art, memorials, tributes, monuments, or public improvement projects.
APPROVAL AUTHORITY
The City Administrator is authorized to accept or reject: (a) Minor Donations; (b) donations to previously
established and approved funds or capital campaigns; and (c) donations of materials for previously approved
projects made without condition or restriction. All Major Donations, conditioned or designated monetary
donations, donations of real property, and non-monetary gifts of a substantial or conditional nature require City
Council approval following a recommendation from the City Administrator.
Donors wishing to make a Major Donation are encouraged to contact the City Administrator as early as possible to
discuss the review process.
DONATION AGREEMENT FORM
The City Administrator may require a Donation Agreement Form for any gift. A completed form is required for all
donations of real property. The form documents the donor's intent, restrictions, cost estimates, proposed location,
maintenance requirements, and other relevant details. For real property donations, the City Administrator shall
initiate Plan Commission review within 60 days of receiving a completed form. Donations intended for park
purposes shall also be reviewed by the Arts & Parks Committee within 60 days.
EVALUATION CRITERIA
All proposed gifts and donations will be evaluated against the following criteria, as applicable: consistency with the
City's mission and policies; benefit to public amenities, historical and cultural preservation, environmental
conservation, or education; suitability for the proposed purpose and location; aesthetic compatibility with the
surrounding area; financial implications including installation and ongoing maintenance costs; public safety and
ADA compliance; and whether the donation carries discriminatory characteristics or restrictions that limit public
use.
DONOR RECOGNITION
City of Amery | Gifts & Memorials Policy
Donor recognition objects (e.g., plaques, signs) must be identified and submitted with the donation proposal for
approval. Recognition objects should be small in scale. The City Administrator may approve recognition objects
consistent with this policy; all others require City Council approval.
PRIVATE CONSTRUCTION
If a donor coordinates construction of a public improvement, the donor is responsible for compliance with all
applicable laws, including competitive bidding and prevailing wage requirements, and for all associated permitting
and project management costs unless waived by the City Council. All improvements on public property become
City property upon completion.
REMOVAL
The City reserves the right to remove any donation or recognition object for any reason in the public interest,
including safety, deterioration, or inability to fund maintenance. The City will make reasonable efforts to notify the
donor or donor's family before removal and to offer return of the item, with transfer costs borne by the donor.
ANONIMITY AND ACKNOWLEDGEMENT
Non-anonymous donations shall be acknowledged with a letter of appreciation. The City cannot guarantee donor
anonymity under Wisconsin Public Records Law. Donors seeking anonymity should consult with the City Attorney
regarding available options.
APPRAISAL / TAX LIABILITY / WAIVER
The City may require appraisals of real or personal property at its discretion. Donors are solely responsible for
assigning value to gifts for tax purposes and are encouraged to seek independent financial and legal advice. The
City Council may waive any criteria in this policy upon a finding that doing so is in the City's best interest.
