Page 2 of 63 Portage County WATER Project Well Owner Assistance and Treatment for Economic Recovery Page 3 of 63 SLFRF Funds – Invest in Water, making necessary investments to improve access to clean drinking water • In April 2022, Portage County set aside funds from the American Rescue Plan Act – State and Local Fiscal Recovery Funds (ARPA-SLFRF) for projects to improve access to and provide safe drinking water for Portage County residents • The project was specifically for testing and identifying nitrate-nitrogen concentrations above the health standards and providing funding for treating those wells • Broken up into two categories • County residents with private wells • Transient non-community drinking water sources Page 4 of 63 Private Residential Wells • Approx. 15,000 active private residential wells in Portage County. • Roughly 21% of them exceed the drinking water standard of 10mg/L of Nitrates. That translates to ~3,000 wells that require treatment/replacement 14% are between 10-20 mg/L and 6% are over 20mg/L • NOTE: If a well qualified for the state well compensation program at the time, we directed them to that program first. TO: THE HONORABLE CHAIRMAN AND MEMBERS OF THE PORTAGE COUNTY BOARD OF SUPERVISORS: RE: TOWN OF BUENA VISTA COMPREHENSIVE PLAN AMENDMENT AND PORTAGE COUNTY ZONING ORDINANCE MAP AMENDMENT, DULKSE WHEREAS, David and Charlene Dulske, owners, request an amendment to the Town of Buena Vista Comprehensive Plan Future Land Use Map and Portage County Zoning Ordinance Map for parcel 010220918:09.01, totaling 41.63 acres, located in Section 18, T22N, R9E, in the Town of Buena Vista; and WHEREAS, the owners are requesting to change the Future Land Use Map designation from L1 Enterprise Agriculture to L2 Intermediate Agriculture; and WHEREAS, the owners are also r equesting to change the zoning classification from A1 Exclusive Agricultural to A3 Low Density Agricultural; and WHEREAS, the Town of Buena Vista Comprehensive Plan is incorporated into Portage County Comprehensive Plan 2024- 2044 through Chapter 8 of that document, and the Portage County Zoning Ordinance is in force within the Town of Buena Vista; and WHEREAS, the Portage County Planning and Zoning Committee held a public hearing on the proposed amendment in Conference Room s 1 & 2 of the County Annex, 1462 Strongs Avenue, Stevens Point, on August 25, 2026, after due notices were published in the Stevens Point Journal. At said hearing all those who wished to be heard were heard and pertinent facts constituting the testimony were recorded; and WHEREAS, the Portage County Planning and Zoning Committee, after carefully considering the testimony at the August 25, 2026, meeting, including the attached report, has placed a recommendation with the County Board that the request be approved; and WHEREAS, the proposed amendment, with the information furnished in the attached report, has been given due consideration by the County Board. FISCAL NOTE: There are no fiscal obligations for the County associated with this resolution. NOW, THEREFORE, BE IT RESOLVED, that the Portage County Board of Supervisors does enact and ordain as follows: The Future Land Use designation of parcel 010220918:09.01, totaling 41.63 acres, is hereby changed from L1 Enterprise Agriculture to L2 Intermediate Agriculture on the Town of Buena Vista Comprehensive Plan Future Land Use Map and is incorporated into Chapter 8 of the Portage County Comprehensive Plan 2024-2044; and the Portage County Zoning Ordinance Map is hereby amended by changing the zoning classification from A1 Exclusive Agricultural to A3 Low Density Agricultural. Page 25 of 63 Page | 2 Wisconsin Statute 66.1001 requires zoning map amendments to be c onsistent with the local Comprehensive Plan. The requested A3 Low Density Agricultural District is not compatible with the parcel’s current L1 Enterprise Agriculture future land use designation within the Town of Buena Vista Comprehensive Plan. Therefore, the petitioners also request a Future Land Use Map amendment to L2 Intermediate Agriculture to ensure zoning and future land use designations are consistent going forward. Findings 1. The A3 Low Density Agricultural District is intended to “provide for a broad range of rural - oriented land uses, including agriculture, forestry and open space. This District is also intended to preserve the rural character of certain outlying areas of Portage County, where only large lot residential developme nt is desirable, particularly where identified in locally adopted Comprehensive Plans.” This differs significantly from the A1 Exclusive Agricultural district, which is designed primarily to preserve productive farmland and support participation in the Farmland Preservation Program. Permitted uses in the A3 zoning district include but are not limited to single-family residences; parks and playgrounds; accessory buildings (no size limit); home occupations and professional offices; general agricultural uses (including crop production, dairying, livestock, hobby farms and beekeeping); greenhouses and plat nurseries; roadside produce stands; ponds; forest management, pine plantations, and Christmas tree farms. Additional uses may be allowed upon approval of a Special Exception. 2. The area surrounding the subject parcel contains a mix of agricultural zoning districts. County Road BB function as a dividing corridor. Lands east of the road are predominantly zoned A3 Low Density Agricultural, while the lands west of the road have a more varied pattern of agricultural districts, A1, A20, A2, A3 and A4. Furthermore, the Portage County Drainage District is located west of County Rd BB. All lands within the District are zoned A1 Exclusive Agriculture, consistent with the Town of Buena Vista Comprehensive Plan ( agricultural policy #8 ) , which recommends A1 zoning in the Drainage District. Although the subject property is near the Drainage District, it is not within it, so a change from A1 zoning may be appropriate. 3. The requested zoning is not consistent with the Future Land Use Map and Zoning/Land Use Compatibility Table found within the Town of Buena Vista Comprehensive Plan. According to the map, the subject parcel is planned for a future land use of L1 Enterprise Agriculture, but the Zoning/Land Use Compatibility Table does not indicate compatibility between the requested A3 zoning and L1 future land use. The petitioners request to amend the Future Land Use Map designation of the parcel to L2 Intermediate Agriculture is compatible with A3 zoning. Therefore, if the Future Land Use Map is amended, the subsequent rezoning to A3 will be consistent with the amended future land use designation. 4. Land Use Goal 3 of the Town of Buena Vista Comprehensive Plan seeks to “Preserve and protect lands that are aesthetically important to the community because they help give Buena Vista its rural character”. The associated policy limits development densities to one lot per 10 acres (“four per forty”), with a minimum lot size of 5 acres. The proposed 5-acre lot aligns with this density policy. Page 26 of 63 Page | 3 As noted in Fi nding #2, agricultural policy #8 recommends A1 zoning for lands within the Portage County Drainage District. The subject parcel is not located in the Drainage District, so the policy doesn’t restrict consideration of A3 zoning. 5. Housing Goal 1 of the Portage County Comprehensive Plan calls for maintaining an adequate supply of housing to meet citizen’s needs. The creation of one rural 5-acre homesite contributes to the County’s housing supply and provides an additional low density housing option within the Town of Buena Vista. 6. On June 8, 2026, the Town of Buena Vista Plan Commission passed a resolution recommending approval of the Comprehensive Plan amendment and recommended approval of the rezoning. 7. On June 8, 2026, the Town Board of Buena Vista approved the Comprehensive Plan amendment by Ordinance and approved the rezoning. The purpose is to construct a 70 x 140’ commercial building that will include office Page 42 of 63 P age | 2 space for garage door sales and service business, as well as warehouse space for storing overhead garage doors, openers, tools and related equipment. The business currently leases warehouse space elsewhere, and the proposed development would allow operations to consolidate and expand. The property is currently zoned A1 Exclusive Agricultural, which presents two conflicts with zoning requirements. First, the A1 district requires a minimum lot size of 35 acres for new ly created parcels. Neither the proposed 4-acre lot nor the remaining 25.27 acres meets this requirement. Second, the A1 district does not permit the proposed commercial use, which is technically considered a “contractor business and related storage yard”, a use that is permitted in the C4 Highway Commercial zoning district. To allow both the land division and the proposed commercial use, the applicant requests rezoning 4 acre to C4 Highway Commercial and the remaining 25.27 acres to A2 Agricultural Transition. The A2 district allows parcels as small as 1 0 acr es, making it an appropriate classification for the remainder of the property. Because Wisconsin Statute 66.1001 requires zoning map amendments to be c onsistent with the local Comprehensive Plan, a Comprehensive Plan Amendment is also necessary. The Town of Plover’s Future Land Use Map designates the p roperty as L3 Limited Agriculture/Mixed Use. While A2 is compatible with L3, C4 is not. As a result, a Comprehensive Plan Amendment is required to change the future land use designation for the 4-acre lot to Commercial. Findings 1. The intent of the C4 Highway Commercial District is to “ provide appropriate areas for large scale commercial uses, which serve a county-wide or larger regional area. Such uses shall be those generating large traffic volumes and/or requiring visibility and convenient access to major highways. It is not intended to be applied where access would be provided via roadways designated as minor collectors or local roads. Furthermore, it is not intended in close proximity to existing or planned concentrations of single family residential development.” In t his case, both Porter Drive and Kennedy Avenue are classified as local roads, which generally do not meet the access expectations described in the C4 district intent. However, the proposed contractor business and associated storage represent a low‑impac t commercial use that does not generate the high traffic volumes typically associated with C4 type development. As such, the nature of the proposed use may be more compatible with local‑road access than some other commercial operations. 2. T he intent of the A2 Agricultural Transition District is to “provide for a broad range of rural- oriented land uses, including agriculture, forestry and open space. P ermitted A2 uses include single-family residences, agricultural operations, home occupations, plant nurseries , roadside produce stands , and forestry related uses. While A2 Agricultural Transition zoning exists along Porter Drive to the west, approximately 0.36 miles from the subject property, it is not adjacent to the parcel. The nearest C4 Highway Commercial district is located 1.14 miles away along County Road R. Commercial zoning in the Town has historically been applied on a case -by-case basis. The nearby Feltz Dairy Store represents a commercial use that is accessory to agriculture (dairying ) and shows that limited commercial activity does exist in the area, but under agricultural zoning. 4. The proposed rezoning is partially consistent with the Town of Plover Comprehensive Plan. The Future Land Use Map designates the subject property as L 3 Limited Agriculture/Mixed Use, a classification that is compatible with the proposed A2 Agricultural Transition zoning, but not C4 Highway Commercial. Amending the Future Land Use map to designate the 4-acre commercial lot as Commercial will bring the proposed C4 rezoning into full consistency with the Comprehensive Plan. 5. The proposed rezoning to C4 Highway Commercial is supported by several C omprehensive Plan goals, objectives, and policies: a. Economic Development Goal A: Promote stabilization and expansion of the current economic base and creation of a range of employment opportunities. The proposed commercial building will expand the Town’s economic base by consolidating and growing an existing business, while also supporting local employment. b. Economic Development Policy #3: Direct commercial, industrial and other larger - scale business development to appropriate areas as identified on the land use map. This policy shows the Town intent to guide commercial development to suitable locations. Once the Future Land Use Map is amended to designate the 4- acre lot as Commercial, the proposed C4 Highway Commercial zoning will be fully consistent with his policy. c. Land Use Objective #6: “Commercial, industrial, and manufacturing uses are encouraged in a manner that minimizes conflicts with surrounding uses and enhances the Town’s tax base.” The proposed use is low‑impact, consisting primarily of storage of garage doors, parts and equipment for installation off -site. The development will also contribute positively to the Town’s tax base. 6. The proposed rezoning to A2 Agricultural Transition is supported by Comprehensive Plan goals and policy that future agri-business and preserve agricultural land: a. Land Use Policy #7: Support the continuance and growth of agri-business and agri-industry in appropriate locations. Rezoning the remainder to A2 maintains agricultural viability and ensures the land continues to support agricultural uses. b. Agricultural Goal #1: Preserve agricultural lands and maintain local conditions that support the Town’s economy . The A2 classification allows the majority of the original parcel to remain in agricultural production, supporting the Town’s agricultural economy while accommodating a small, separate commercial lot. 5. This request aligns with the Portage County Comprehensive Plan economic goal to “promote the stabilization and expansion of the current economic base and the creation of a range of sustainable employment opportunities”. 6. Special Meeting Attendance Reports (Portage County Ordinance 3.1.47 & 3.1.48) PUBLIC HEARING 2. REQ-2026-011 — A request by Tyler Ignatowski, agent for owners Kyle Kluck Investments LLC, and Koshnick Properties LLC, to amend the Town of Hull Comprehensive Plan Future Land Use Map designation of .5 acres of parcel 020240822-09.04 from Rural Residential to Commercial; and rezone .5 acres of parcel 020240822-09.04 from A4 General Agricultural to C4 Highway Commercial and .5 acres of parcel 020240822-09.05 from C3 Commercial to C4 Highway Commercial. Chris Mrdutt, Zoning Coordinator, gave an overview of the request. A motion was made by Larry Raikowski, seconded by Steve Cieslewicz, to close the public hearing. Motion carried by voice vote, with no negative votes. 3. MOD-2026-001 – A request by Koshnick Properties LLC and Kyle Kluck Investments LLC, owners, Tyler Ignatowski, Agent, for a Modification of Sec. 7.4.5 (1)(d) of the Portage County Subdivision Ordinance, which states, “Depth and Width. In general, the depth of a lot should not exceed three times its width as its widest point. Lot width shall be in accordance with the provision of section 7.4.5(a)(a).” The proposed lot has a depth of ~976 feet by 100 feet wide. This would require a modification of 676 feet. Chris Mrdutt, Zoning Coordinator, gave an overview of the request. A motion was made by Steve Cieslewicz, seconded by Suzanne Ohelke, to close the public hearing. Discussion/Possible Action RE: REQ-2026-011: Tyler Ignatowski Future Land Use Map Amendment and Rezoning - Town of Hull A motion was made by Larry Raikowski, seconded by Suzanne Ohelke to approve the Ignatowski Future Land Use Map Amendment and Rezoning. Motion to approve carried by voice vote, with no negative votes. 9. Discussion/Possible Action RE: MOD-2026-001: Tyler Ignatowski Modification Request- Town of Hull A motion was made by Larry Raikowski, seconded by Nathan Sandwick to approve the Ignatowski Modification request. Motion to approve carried by voice vote, with no negative votes. 10. Discussion/Possible Action RE: Resolution Approving and Adopting the Portage County Comprehensive Safety Action Plan A motion was made by Steve Cieslewicz, seconded by Suzanne Ohelke, to adopt the Portage County Comprehensive Safety Action Plan. Motion to approve carried by voice vote, with no negative votes. 11. Discussion/Possible Action RE: Resolution Approving and Adopting the Portage County Bicycle and Pedestrian Plan A motion was made by Suzanne Ohelke, seconded by Steve Cieslewicz, to adopt the Portage County Bicycle and Pedestrian Plan. Motion to approve carried by voice vote, with no negative votes. 12. Discussion/Possible Action: Refund of permit fees (Richter) due to delay caused by Planning and Zoning Department. A motion was made by Barry Jacowski to waive the fees for Richter CSM and Zoning permit. Motion failed for lack of a second.
