NACE Executive Committee Update By: Matt Machado, PE, LS, NACE Secretary / Treasurer, Deputy CEO, Director of Community Development & Infrastructure, Santa Cruz County, CA The History of Fuel Taxes—and What It Means for Cou nties For counties across the country, maintaining local roads and bridges isn’t optional—it’s essential to public saf ety, economic vitality, and day-to-day mobility. Counties maintain more than 40% of the nation’s roads and bridges, often while managing substantial deferred maintenance. That’s why understanding the history of federal and state fuel taxes is so important for county engineers and transportation leaders. The fuel-tax model helped build America’s highway Page 3 of 44 2 system—but its design also created predictable fund ing challenges over time, especially as inflation and vehicle efficiency changed what “per-gallon” revenue can co ver. Federal fuel taxes: A system that hasn’t kept pace with inflation. The first federal gasoline tax was created on June 6, 1932 through the Revenue Act of 1932, starting at 1 cent per gallon during the Great Depression. Key federal milestones include: • 1932 – 1 cent (President Herbert Hoover): emergency budget balancing • 1956 – 3.1 cent increase (President Dwight Eisenhow er): helped finance the Interstate era • 1983 – 5 cent increase (President Ronald Reagan): aimed at repairing national transportation assets • 1990 – 5 cent increase (President George H.W. Bush) : included deficit reduction/infrastructure funding • 1993 – 4.3 cent increase (President Bill Clinton): dedicated infrastructure funding response The core issue is that the federal gas tax is not indexed to inflation. Since 1993, it has lost roughly 60% of its purchasing power—meaning the revenue counties rely on for syst em preservation buys far less today than it did decades ago. To match the purchasing power of 1993, the fuel tax would need to be over $0.50 per gallon rather than the current rate of $0.184 per gallon. State fuel taxes: growth, then “funding drift” with time. Fuel taxes spread quickly at the state level in the early 20th century. By the 1930s, states were already collecting meaningful per-gallon revenue to support highways. Page 4 of 44 3 However, as with the federal tax, many state fuel tax structures struggled to keep pace with: • rising construction and maintenance costs • changing vehicle fuel economy shifting vehicle technology (including electrification) California as a case study: how counties feel the impacts California’s fuel-tax evolution illustrates what happens when revenue mechanisms lag behind real costs—and how ta rgeted policy changes can help, but not solve everything. Key California milestones • 1923: first state gas tax at 2 cents per gallon • 1940s–1980s: incremental increases as the highway system expanded (reaching 9 cents by 1983) • 1990s: hikes pushed the rate to 18 cents by 1994 for more than a decade • 2010 “Fuel Tax Swap”: reduced the sales tax portion on gasoline while shifting toward a variable excise structure • 2017 SB 1 (Road Repair and Accountability Act): added a 12-cent increase and introduced annual inflation adjustments Today’s result (and its significance) California’s state excise tax is now 63.4 cents per gallon — the highest in the nation. This matters for county engineers because when state revenue is stable, counties can better plan capital projects and lifecycle maintenance. When it isn’t, deferred maintenance grows—and that creates cascading costs for local jurisdictions. Fuel taxes aren’t the only charges counties consider—but they’re foundational. Page 5 of 44 4 California’s roadway maintenance funding is transitioning from traditional, gas-tax-based revenues to user-based models and targeted state investments. The future relies on inflation-adjusted fuel taxes, localized sales tax measures, expanded Zero- Emission Vehicle (ZEV) fees, and pilot programs aimed at replacing gas taxes with a permanent Road Charge. Because electric vehicles do not pay gas taxes, California enforces annual registration surcharges (up to $165 depending on the vehicle) to ensure drivers contribute to infrastructure wear and tear. California has moved past pilot phases toward evaluating a permanent statewide Road Charge system. This would tax drivers based on vehicle miles traveled (VMT) rather than fuel consumed, protecting the revenue stream as gas-powered cars are phased out, or as fuel efficient cars continue to improve. And for counties—especially those not capturing the same revenue streams as the state or federal government— predictable transportation funding is directly tied to asset condition, staffing, and delivery capacity. A reliable funding system must match today’s realities. Whether the question is pavement preservation cycles, bridge deck rehabilitation, storm-related drainage improvements, or ADA and safety upgrades, counties face the same challenge: The per-gallon fuel tax model has lagged (historically) behind: • inflation and construction cost escalation • changes in fuel consumption (efficiency, market shifts) • evolving vehicle technology and future revenue risk Counties need to band together to support solutions that help local governments: • maintain transportation assets in a state of good repair • plan multi-year capital programs confidently Page 6 of 44 5 • protect public safety without forcing constant emergency repairs Updating the system is a county infrastructure issue. The history of federal and state fuel taxes shows why today’s funding can fall short — especially when revenue mechanisms don’t automatically respond to inflation and evolving travel patterns. To meet county infrastructure needs, the funding system must better align with the lifecycle realities of roads and bridges. Subject: Commissioner’s Report Please see below for a number of Highway Department Updates. Staffing – All full-time positions are filled. A c ivil technician candidate accepted an offer and took the pre-employment testing but was a no-call, no-show during his first scheduled day of work. We have not had any other seasonal laborer applicants as of the past two months. Training – Three to four supervisors and foreman will be att ending the WCHA Leadership Development conference in October. Also, please mark your calendar for our annual Roadeo Training event which will be held on October 20 th . Committee members are welcome to attend for all or part of the day. Operations – The second round of mowing on the County system is nearly complete. State crews have been assisting on our bridge maintenance list for cleaning, concrete repairs, and crack sealing. The CTH D project continues to progress with the lower layer of paving complete for the first phase. The second phase has been pulverized and spot grading areas are nearly complete. The one parcel acquisition is completed and the large culvert installation is scheduled for the end of August/beginning of August. All chispealed roads are swept and centerline is painted. County crews also completed the Town of Dewey culvert aid project on Park Road this past month. Budget – Below is the 2026 budget analysis through July 18, 2026. Winter maintenance is at 60% of the overall budget which is tracking lower than last year and is still in the typical range for this time of year. General maintenance is at 60% of the overall budget which is tracking approximately 10% higher than typical. This is primarily due to the additional ice storm clean-up. Staff has provided all Highway data to Emergency Management and Finance for their submittal to the Wisconsin Disaster Fund to attempt to be reimbursed for a portion of those costs. Paving costs are averaging approximately $65/ton which is under our Highway Department estimate of $70/ton. The final asphalt surface and shouldering of the first phase is scheduled to be completed in the next two weeks. Paving of the lower layer for Phase 2 is also scheduled in the next two weeks. Chipsealing – All major costs are entered for the c hipsealing season and are approximately $1.03M which is $120k under budget. The Machinery Operation budget is still tracking with higher revenues resulting in a current surplus of $236k. Below is a summary of the net surplus/loss through the year. January + $15k July +$236k February +$261k March +$233k April +$333k May +$280k June +$242k The DOT Routine Maintenance Agreement is tracking within 5% of the budgeted costs for winter and general maintenance activities. The overall budget is tracking higher as our January invoice includes our billing for radio, storage reimbursement, and winter readiness charges. Projects -Safe Streets for All(SS4A) Grant – The Portage Cou nty Bicycle and Pedestrian Plan and Comprehensive Safety Action Plan are on the next County Board meeting for adoption. -WisDOT Structure 6’-20’ Program – Please refer to the letters in correspondence. Unfortunately, the CTH E structure of the Wisconsin River and the CTH A structure over Spring Creek were not selected for funding. Future funding of the program is unknown until the next state budget. Staff is evaluating options of other funding sources. -CTH R(STH 54 to CTH B) –The Design Study Report i s completed and accepted by the consultant. The final plat and relocation order is scheduled for committee action at this meeting. Construction is scheduled for 2028 for this project as part of the WisDOT STP-Urban Program. -CTH II Bear Creek Bridge – Final design has been submitted to WisDOT for review and has been accepted. WisDOT and WDNR have reviewed and concurred with this option . Construction is set for 2027 for this project with is part of the WisDOT STP-Bridge Program. There is a resolution for a boating restriction ordinance on this meeting’s agenda for consideration. -CTH HH and Hoover Development – A preconstruction meeting was held by the Contractor with planned work within the CTH HH right-of-way scheduled for later this fall. -Highway Addition and Renovation – No updates. The project is still waiting final close-out and payment to Miron as there are some HVAC issues still unresolved. -WCHA Updates – The WCHA Executive Committee contin ues to work on a number of WisDOT issues which include management of the STP-Rural project awards, Trans 206 re- write(this is the LRIP administrative code), Trans 276 policy updates(oversize/overweight regulations), and the future of the Local Small Structure Inspection and future funding options. In addition, the WisDOT has forwarded a formal 13.10 state budget request to ask the state legislature for additional funding due to the severe winter and spring weather. -WisDOT Surface Transportation Program 2026-2031 Cycle –No new updates. Staff has applied for STP-Rural funding for CTH A(STH 161 to CTH Z) roadway and Local Bridge funding CTH O bridge rehabilitation. WisDOT’s initial plan was to release project selections in the Spring but they have delayed this notice until late Summer. New Updates -WisDOT Construction Projects – WisDOT has multiple construction projects starting this spring. Additional information will be posted to their website: https://projects.511wi.gov/region/north-central/ -WIS 13 (2nd Street North to County P) - Wood and Portage counties – Pavement replacement project with full closure and detour. -WIS 54 (26 Street to County B) - Wood and Portage counties – Concrete joint repair project with single lane closures. -Standing Rocks Road(Custer Rd to Townline Rd, Town of Stockton) -Reconditioning project funded under STP-Local. Road closed to through traffic with access to the park maintained. -Request for Proposals(RFP) – CTH A(CTH Z to STH 66 ) – Staff has worked with Purchasing to issue a RFP for the design of this STP-Rural project which is scheduled for construction in 2029. Applications are due August 21 st . -McDill Dam Fence – There has been communication over the past year regarding the fence along the McDill dam and CTH HH sidewalk in the Village of Whiting between the McDill Lake District, City of Stevens Point, Village of Whiting, and the Highway Department. There are sections of fence missing and others in need of repair. Based on the Highway Department’s and Corp Counsel’s review of the past agreements, we do not believe that the fence is in the County’s responsibility. Staff has sent a letter to all parties and requested a meeting. The Lake District representative has asked that the meeting be deferred until a new representative is elected for their group. -CTH HH/Bremmer Street Intersection – Due to concerns from the increased traffic being rerouted due to the Bus 51 project, staff has received calls from the owner and a tenant for the office building along Bremmer Street at the McDill Pond. This intersection was analyzed previously due to sight distance concerns and the intersection was ultimately converted to a Right Turn only intersection. There are increased concerns with speed which staff has forwarded onto the Sheriff’s office and also gather speed data for the area. The date was collected for both weekday and weekend traffic and we found decent compliance with the posted speed limit with an 85th percentile speed of under 39 mph(means that 85% of traffic is going under 39 mph) and the average speed of just over 35 mph. The department also updated the additional flagging over the intersection warning sign. More discussions are likely as we continue to evaluate the intersection. -Next Meeting Date – The next regularly scheduled meeting would be September 15 th . Separating the snow and ice equipment into separ ate contracts allow for additional vendors to bid on the build contracts 3. Build-time and issue response times for the snow and ice equipment have improved through the direct contact. Over the years, costs have continued to increase and staff has researched other possible vendors. As stated in last year’s memo, the Highway Department would be completing a full review as part of the 2027 builds to evaluate other vendors as well. One vendor with comparable products and positive reference checks was Universal Truck who has also supplied our underbodies in the past. They also have pricing through a Minnesota DOT state contract. Analysis: Pricing for the equipment was compared between the two vendors and are summarized below. 1. Universal $106,326.00 2. Burke $137,933.13 For comparison, last year’s price from Burke was $104,595.00 for similar equipment. Fiscal Impact: The 2027 equipment budget will include $440,000 per truck for the new patrol trucks which will cover the chassis, equipment, and build costs. As part of the agency and environmental coordination for the project, the Wisconsin Department of Natural Resources(DNR) is requiring boating restrictions under the bridge during construction due to safety concerns Analysis: Wisconsin state law allows counties, towns, villages, cities, public inland lake protection and rehabilitation districts and town sanitary districts to enact local boating regulations in the interest of public health, safety or welfare, which includes the public’s interest in preserving the state’s natural resources. State boating law provides a general framework for regulation, but it is up to the governing entity to provide regulations tailored to local conditions. The DNR provides a template ordinance to utilize for these types of projects and it is attached. It is a similar ordinance which was utilized during the 2019 CTH A bridge over the Tomorrow River project. While Bear Creek has less recreational traffic than the Tomorrow River, it does provide for an extra level of safety to pass the ordinance and restrict boat traffic during construction. Fiscal Impact: There is no fiscal impact on the County for passing the ordinance. Recommendation: Staff recommends that the Committee review and approve the attached resolution and ordinance. The provisions of this Ordinance shall apply to the waters of Bear Creek. This chapter shall be enforced by the officers of Portage County. 2.29.2 - Intent. The intent of this ordinance is to provide safe and healthful conditions for the enjoyment of aquatic recreation consistent with public rights and interests and the capability of the water resources. 2.29.3 - State Boating and Safety Laws Adopted. State boating laws as found in Wis. Stats. §§ 30. 50 – 30.71 are adopted by reference. 2.29.4 - Penalties. Wisconsin state boating penalties as found in Wis. Stats. § 30.80 and deposits established in the Uniform Deposit and Bail Schedule established by the Wisconsin Judicial Conferences, are hereby adopted by reference and all references to fines amended to forfeitures and all references to imprisonment deleted. 2.29.5 - Severability. The provisions of this ordinance shall be deemed se verable and it is expressly declared that Portage County would have passed the other provisions of this ordinance irrespective of whether or not one or more provisions may be declared invalid. If any provision of this ordinance or the application to any person or circumstances is held invalid, the remainder of the ordinance and the application of such provisions to other persons or circumstances shall not be affected. 2.29.6 - Boat Restriction Area. No person shall operate a motorboat or nommotoriz ed boat, as defined in Wis. Stats. §§ 30.50(6) and 30.50(7) on the waters of Bear Creek within the right of way at the crossing of County Highway II during the bridge construction project. The boat restriction area will be in pla ce from April 1, 2027 to October 31, 2027. 2.29.7 - Posting Requirements. Portage County shall place and maintain a synopsis of this ordinance at all public access points within the jurisdiction of the County pursuant to the requirements of Wis. Admin. Code § NR 5.15. 2.29.8 - Effective Date. This ordinance shall take effect on April 1, 2027. 2.29.9 - Sunset Date. Subject: Discussion on 2027 Highway Department Budget Background: The budget guidelines have been issued and the Highway Department has its budget hearing scheduled with Finance and the County Executive on August 27 th . The Highway budget is still a work in progress as final allocations for insurance and other items have not been finalized but attached is a high-level overview of the major accounts. Analysis and Fiscal Impact: Special Revenue Summary – Below is a summary of the overall anticipated bud get request for Special Revenue(County road/bridge related work). - Staffing –Wages are anticipated to be increased by 3% plus a step for all employees per the budget guidelines. We will also continue to add funding for CDL training in the event we need to hire a new employee without one, or we will begin to start sending employees with Class B CDL’s to get their Class A CDL’s. - 2027 Preservation – Work includes approximately 51 miles of crackfilling, chipsealing, and wedging. Pavement repairs such as wedging, overlays, and bridge maintenance will also be budgeted. - 2027 Construction and Paving –. The original plan f or the next reconditioning and resurfacing project for 2027 would be CTH T(CTH B to STH 161). This may change if CTH A(STH 161 to CTH Z) is not selected in the WisDOT Surface Transportation Program-Rural. Staff had submitted the application for CTH A last October which would complete the entire corridor between STH 161 and STH 66 as the northern portion was selected for STP funds and will be constructed in 2029. Additional paving projects may include an overlay on CTH D from I39 to CTH J which would also include paved shoulders. Structures are also being evaluated as both CTH E and CTH A structures have not been selected for funding under the WisDOT’s initial Local Small Structure program. - 2027 Design – The budget includes design funds for the CTH T corridor and multiple carried over local share design costs for the STP projects-CTH R and CTH A.. - Wetland project – Funds will be accounted for in a separate County account. In addition to the CTH A(STH 161 to CTH Z) project application, we are also waiting to hear from WisDOT on our Local Bridge Assistance application for the CTH O overlay project. - Bridge/Culvert Aid – Applications from towns are du e August 21 st which will be brought to the September Committee meeting for approval. Enterprise Summary – The Machinery Operations budget is projected to have small increases to the expenses for labor and parts which would be offset by the DOT equipment rates. The 2027 equipment purchases will be brought to a future meeting for approval. Recommendation: Staff recommends that the Committee provide input on the budget.
