Description of Subject Property and Surrounding Area Subject Property  Lot area and road frontage: The lot contains 2.2 acres and has approximately 330 feet of road frontage along East Side Rd and 250 feet of road frontage along Town Line Rd.  Existing uses/structures: Existing structures contain an accessory residence as well as a detached building that was previously used to house a trade and contractor establishment. The use is currently residential.  Traffic patterns/road usage: Light to moderate traffic along East Side Road and Town Line Road. Surrounding Area – Zoning and Use: There are many lots varying in size surrounding the proposed rezoning location. Lots in this area are primarily zoned Light Industrial (LI) and General Agricultural (GA). The lot to the east appears to contain a bulk storage of fuel products. Further northeast, there are lots zoned Estate (ES) and Countryside (CS) which contain single family residences and wooded areas. Background/History  In 1968, the Town of Washington Island adopted County Comprehensive Zoning.  The three lots zoned Light Industrial in the SE corner of the intersection used to be one lot containing approximately 10.25 acres. The lot contained the residence, barn and shed since at least the mid-70’s. The lot was zoned A-1 at this time.  In 1991, a zoning permit was issued for an addition to the residence, and for the storage of fuel products. The lot was zoned A-4 at this time.  In 1994, a zoning permit was issued for the storage of additional fuel products.  In 1995, the County Comprehensive Zoning Ordinance rewrite occurred and the lot was zoned Light Industrial which deemed the residence as a nonconforming use. A single-family residence is not a permitted use in the LI zoning district.  In 1996, a zoning permit was issued for an addition to the residence.  In 2018, a certified survey map was recorded which created the lot to the east of the subject parcel which is zoned Light Industrial. This is the lot that contains the bulk storage of fuel products.  In 2019, a zoning permit was issued for the establishment of a trade or contractors’ business in the attached garage for woodworking.  In 2022, a certified survey map was recorded which created the subject lot and the lot to the south, both currently zoned Light industrial. The southern lot is vacant.  Nonconforming uses may only expand up to 10% of its floor area with the issuance of a conditional use permit. 6 Page 2 of 4 Zoning Considerations Section 2.03(19): Purpose of the Light Industrial (LI) zoning district: This district is intended to provide for manufacturing, warehousing, and other light industrial operations. It is also intended that this district be used for the location of trade or contractor establishments, commercial storage facilities, and similar businesses. Such uses should not be detrimental to the surrounding area or to the county as a whole by reason of noise, dust, smoke, odor, traffic, physical appearance, degradation of groundwater, or other nuisance factors. Such uses may be subject to requirements which will reasonably ensure compatibility. This district can also be used for industrial or business parks. Lot sizes of at least 60,000 square feet are required for new lots. Section 2.03(5): Purpose of the General Agricultural (GA) zoning district: This district is intended to maintain agricultural lands which have historically demonstrated high agricultural productivity. It is also intended to accommodate certain nonagricultural uses which require spacious areas to operate or where natural resource exploitation occurs. Lands eligible for designation in this district shall generally include those designated as farmland preservation areas in the Door County Comprehensive and Farmland Preservation Plan. This district is also intended to provide farmland owners with additional management options by allowing limited residential development, but with residential density limits and other requirements set so as to maintain the rural characteristics of this district. Lot sizes of at least 20 acres are required for new lots. Principal uses allowed. Please see the attached Table of Principal Uses to compare the types of uses allowed in the existing zoning district as opposed to the proposed zoning district. Rezoning a property means that any use allowed in the new zoning district may be established on the property, now or in the future, not just the use being proposed by the current applicant. Zoning District Requirements. Please see the attached Table of District Requirements to compare minimum lot size requirements, maximum impervious surface ratios and setbacks. Issues for the RPC to consider in evaluating petitions to rezone are below. A brief staff opinion regarding these matters is at the end of the list of questions. The RPC needs to reach its own determinations, though.  Was the existing district due to a mistake in the mapping process?  Have circumstances changed for this property or surrounding properties since the original zoning district designation?  How are the adjacent properties zoned and used?  Will rezoning allow for higher intensity or higher density uses than those allowed on surrounding properties?  Would the new district fit official plan guidelines for the property? Is the existing district a better fit?  Is the request simply to economically benefit one property owner or a small group of property owners?  Is there an overriding public good to be gained by rezoning the property? (If yes, rezoning might be justified even if other considerations point toward denying the petition.) The existing Light Industrial (LI) zoning district was not due to a mistake in the mapping process and circumstances have not changed. The current property owner would like to be able to sell the property and the proposed rezoning will allow the residence to be classified as a conforming use. They are having a difficult time since the residence is not a conforming use. The existing residence may continue to be used as long as the nonconforming use does not cease for more than 12 months. Comprehensive Plan Considerations 7 Page 3 of 4 Below is a summary of County Comprehensive Plan considerations, including the future land use designation and relevant goals/objectives/action items of the Comprehensive Plan. Please note that per Wisconsin Statute §66.1001, Comprehensive Planning:  If the County amends its zoning ordinance, such as rezoning, the amendment(s) shall be “consistent with” the County comprehensive plan.  “Consistent with” means “furthers or does not contradict the objectives, goals, and policies contained in the comprehensive plan.” County Comprehensive Plan Future Land Use Map Designation & Description:  Future Land Use Designation: The subject parcel is designated as “Industrial” on the County Comprehensive Plan Future Land Use Map, as described below and shown on the attached Future Land Use Map.  Industrial Future Land Use Description: Lands designated as “Industrial” are intended for uses such as fabrication, wholesaling, or long- term storage of products and for extraction (mining) or transformation of materials. Note that, as described previously, the “manufacturing” DOR assessment category “includes all land, buildings, structures, and other real property used in manufacturing, assembling, processing, fabricating, making, or milling tangible personal property. It also includes warehouse, storage facilities, or offices in support of the manufacturing property.” While the proposed General Agriculture (GA) zoning district is not consistent with the parcel’s Industrial Future Land Use designation, the rezoning may be beneficial because it would be consistent with the surrounding land use pattern and the parcel’s existing development characteristic of containing a single-family residence since the 70’s. Rezoning the property to General Agriculture would allow the existing residence to function as a permitted use. The existing Industrial designation appears to reflect the parcel’s former relationship to the adjacent light industrial property rather than its current ownership, use, or surrounding land-use pattern. A rezoning to Agriculture would be inconsistent with the parcel’s future land use designation, but the rezoning would promote the goal and policies from the comprehensive plan listed below. Relevant County Comprehensive Plan Goals/Objectives/Action Items:  GOAL 4: Maintain and enhance the community’s rural atmosphere and agricultural heritage by pursuing smart growth and infill development strategies through a compact land use pattern that minimizes conflicts between land uses and preserves the small-town aesthetic of the county. o Objective 1: Preserve rural character by maintaining large areas of natural and open space that provide scenic views. o Objective 2: Work cooperatively with developers and county municipalities to identify future development areas using infill and smart growth development strategies. o Objective 3: Regulate new development to minimize its visual impact and preserve the county’s open spaces between communities. o Policy 1: Consider the appearance of new development, particularly along highway corridors, when reviewing conditional use permits and rezoning petitions.  GOAL 6: Facilitate a diverse variety of quality, year-round and seasonal affordable housing for all income levels for the current and future population, and support economic opportunities that attract and retain residents, particularly young people and their families, to provide an adequate workforce and activate economic growth. o Objective 1: Develop and enforce policies and programs that provide a range of affordable, quality housing to meet the needs of citizens of all income levels, age groups, and those with disabilities. o Objective 2: Maintain and rehabilitate the existing housing stock while promoting infill (re)development to enhance established neighborhoods and encouraging a mix of housing types in newly developed areas. 8 Page 4 of 4 o Objective 3: Promote existing and encourage new housing and commercial/industrial developments that have minimal negative impacts on the environmental and surrounding land uses such as resource protection and agricultural areas. Other Relevant County Comprehensive Plan Text:  Future Land Use Categories (Chapter 8, Volume I; pg. 34): “Future land use category designations are not intended to serve as zoning designations, but rather indicators of desired types of future development and land uses. Mapped future land use categories will, however, be one consideration when petitions are presented to the county requesting county zoning ordinance map amendments. (Other considerations will include input from the affected town[s] with regard to the municipal-level future land use map or any pertinent goals and action items, if any, and any pertinent goals, policies, and action items from the county plan.)” Comprehensive Plan Consistency Analysis: It is staff’s opinion that the proposed rezoning is generally consistent with the County Comprehensive Plan and does not contradict the goals, objectives, and policies contained in the County Comprehensive Plan. Although the proposed rezoning to the General Agricultural zoning district is not technically consistent with the “Industrial” future land use designation, the Committee may take into consideration the proximity of the subject parcel to adjacent areas which are in the “Woodland/Wetland/Natural” and “Rural/Agricultural” land use designations and are similarly developed for residential uses. The Committee may also take into consideration that the existing nonconforming use is grandfathered. 9 Town Level Map - Washington Municipality Town of Liberty Grove Town of Washington Municipality Lake Michigan 8/27/2026 0 1.5 30.75 mi 0 2.5 51.25 km 1:150,000 10 Newman Aerial Neighborhood Map Address Roads Town ROW Easements Conservation Easement Parcel Parcel Boundaries 8/27/2026 0 0.1 0.190.05 mi 0 0.15 0.30.07 km 1:8,000 11 Newman Aerial Map Address Roads Town ROW Parcel Parcel Boundaries 8/27/2026 0 0.01 0.030.01 mi 0 0.03 0.050.01 km 1:1,500 12 Newman Comprehensive Zoning Map Address Roads Town ROW Easements Easement Parcel Parcel Boundaries Comprehensive Zoning Light Industrial General Agricultural 9/8/2026 0 0.08 0.160.04 mi 0 0.1 0.20.05 km 1:6,780 13 Newman Future Land Use Map Address Roads Town ROW Easements Conservation Easement Parcel Parcel Boundaries Future Use Communication/Utility Industrial Roads Rural/Agricultural 8/27/2026 0 0.1 0.190.05 mi 0 0.15 0.30.07 km 1:8,000 14 (3)(a) Table of principal uses – General. We purchased the home in 2023, primarily as a residence, and over time considered renting some space or doing a business (looking forward to a time when we will be scaling back from full-time work). Unfortunately, we need to move and the land is zoned “Light Industrial”. Thus, potential buyers are limited as to what they can do. There have not been many showings and the market here is slow. This has been a residence ever since it was changed from General Agriculture many years ago. It was done so to permit a Propane business (Hansen Propane). The owners lived in the home and ran the propane business and storage, amongst other ventures. The house was listed for sale in 2018 and the land was divided further to break off the Propane Business/Storage area to the east, into it’s own parcel (See attached certified survey). At that time, the house remained on 7.5 acres with a barn and field. In 2022, the parcel was divided again and the owner sold 5.3 acres to the south to another buyer. Then the house was listed as a 2.2 acre parcel. This property no longer fits the Light Industrial need. We listed the home recently and have since learned that this beautiful home cannot be a residence with other options (for example renting). This is a hardship as a very limited amount of people are looking to run an industry out of a home, in the middle of an Island, surrounded by woods, fields and zoned agriculture. The island is in dire need of resident rentals, and hopefully that would take place should it be rezoned. We are requesting that you consider changing the zoning of our property back to General Agriculture, which is the zoning of the properties to the West, Northwest. Southwest, and North (portions). The property across Town Line ((1096) is in a similar situation, time believe, the house itself listed as General Agriculture, with the rest of the property listed Light Industrial. There has not been the need for the expansion of Light Industrial in our area and it has been stagnant for a long time. This is a downgrade in the zoning, but again, it would be returning to the General Agriculture as in long past. We would really appreciate your consideration of this request. Respectfully, Bryan and Lynn Newman 414-861-0595 509-713-9963 (Please note, our tax (etc.) lists an AZ address, which we moved from in 2023. The Island has been our full-time home since.) 29 30 31 32 33 LETTER(S) IN FAVOR MAP TOWN OF WASHINGTON ISLAND 34 35 36 37
