a. Convene Meeting and Enter Public Hearing – Brad & Tina Burg Variance
Fischer presented a detailed explanation of the Board of Adjustment process and the three
variance criteria required for approval.
Entered Public Hearing at 6:28 p.m.
i. Brad & Tina Burg are requesting a variance to construct a detached accessory
structure within 75 feet of a navigable waterway on their property at N3002
Lakeshore Drive in the Town of Brothertown.
Giebel read the hearing notice and staff memo into record.
Brad Burg presented an explanation addressing the three variance criteria required
for approval:
• Unique property features preventing compliance with ordinance terms
• Unnecessary hardship
• No harm to public interests if the variance is granted
Giebel read a letter into record from Judy Bloom, a neighbor across the street,
expressing support for the project.
b. Close Public Hearing and Reconvene Regular Meeting
Closed Public Hearing at 6:42 p.m.
i. Proposed Action: Brad & Tina Burg variance to construct an accessory structure 36
feet from a navigable waterway on the property.
The Board deliberated before making their decision.
Motion made by Jannette, second by Peik to approve the variance with the unique
property limitations that they happen to have a stream running through a 2-acre
parcel. It’s limited, it’s unique, they have limited options as to where they can and
cannot build on it. The unnecessary hardship is very similar to the unique physical
quality as they have very limited spots as to where to build. No harm to the public.
I don’t see there would be any harm to the public more than there already is.
Motion carried unanimously.
11. Discuss Next Meeting
Giebel indicated that there are no other petitions filed with the department at this time.
12. Adjournment
Motion by Cousins and second by Jannette to adjourn the meeting at 6:51 p.m.
Respectfully Submitted,
Jennifer Bonlander, Recorder
