Adjournment subject to call of the chair Village of Plover Board Meeting 9-16-26 Village Board Meeting Wednesday, September 16, 2026 6:00 p.m. Members Present: Steve Fritz, Ross Ballard, Al Haga, Al Tessmann, Gary Wolf Members Excused: Tim Durigan, Adam Raabe Others Present: Steve Kunst, Julia Mann, Tammy Wojtalewicz, Scott Klemm, Ryan Fox, Joe Terry 1. Mr. Wolf called the meeting to order at 6:00 p.m. Pledge of Allegiance. 2. Mr. Fritz motioned, and Mr. Haga seconded, to approve the minutes of the meeting of September 2, 2026, as printed. Motion carried. 3. PERSONS WISHING TO ADDRESS THE BOARD - None 4. CORRESPONDENCE Mr. Kunst advised of a notice received from ATC regarding transmission line upgrades and public comment period. He will send a copy to board members. 5. APPROVAL OF VOUCHERS Mr. Tessmann motioned, and Mr. Fritz seconded, to approve the vouchers as listed. Motion carried. 6. ROAD PLANS FOR HARVEST ACRES 2ND ADDITION Mr. Kunst reviewed the request. He noted two existing lots have twin homes on them. Previously in 2021 there was to be an apartment complex with a private drive. The developer and staff came up with an alternative that allows for twin homes and single family homes as well as a through street instead of cul-de-sacs. The developer is also willing to dedicate land for a future park. Mr. Tessmann motioned, and Mr. Fritz seconded, to approve the road plans for Harvest Acres 2nd Addition. Ditch sections along lot lines and sewer management plans were discussed. Motion carried. 7. HARVEST ACRES 2ND ADDITION SEWER AND WATER PLANS Mr. Kunst reviewed the request and noted a difference in manhole distances as recommended by the Wastewater Manager. Reasons why these types of things come before the board were discussed. Village of Plover Board Meeting 9-16-26 Mr. Haga motioned, and Mr. Tessmann seconded, to approve the sewer and water plans for Harvest Acres 2nd Addition. Motion carried. 8. CROSSROADS COMMONS MAINTENANCE AGREEMENT RENEWAL/EXTENSION WITH SKIERKA LAWN AND LANDSCAPING Mr. Kunst reviewed the request. He explained this is for the common area maintenance work, so the majority gets billed back to the property owners at Crossroad Commons which is how it has been done since Crossroad Commons was created. Mr. Haga motioned, and Mr. Fritz seconded, to approve the Crossroads Commons maintenance agreement renewal/extension with Skierka Lawn and Landscaping. Motion carried. 9. PUBLIC SAFETY FACILITIES SPECIAL INSPECTION CONTRACT Mr. Kunst reviewed the request. Due to a change in state building codes, certain special inspections are required for various commercial building projects such as our public safety facilities project. The Village heard back from three qualified entities. Point of Beginning submitted the lowest contract price, which did not include the structural steel inspections. He provided details regarding the structural steel inspections. Mr. Haga motioned, and Mr. Tessmann seconded, to accept Point of Beginning’s bid not to exceed $50,000. Mr. Kunst noted this was included in the Village’s borrowing as we knew we would have to do this. He also clarified the $42,990 in his memo included an estimate of ten trips needed for the service. Motion carried. 10. TEMPORARY CLASS “B” BEER AND TEMPORARY “CLASS B” WINE RETAIL LICENSE – PORTAGE COUNTY HISTORICAL SOCIETY , RHYTHMS OF THE RIVER EXHIBIT CLOSING CELEBRATION FEATURING OTIS & THE ALLIGATORS – 2700 MADISON AVENUE – OCTOBER 24, 2026 Ms. Wojtalewicz reviewed the request. Mr. Haga motioned, and Mr. Tessmann seconded, to approve the temporary Class “B” Beer and temporary “Class B” Wine retail license – Portage County Historical Society, Rhythms of the River Exhibit Closing Celebration Featuring Otis & The Alligators – 2700 Madison Avenue – October 24, 2026. Motion carried. 11. RELIANCE FUEL LLC – CHANGE OF AGENT FOR RETAIL ALCOHOL BEVERAGE LICENSE AND CIGARETTE, TOBACCO, AND ELECTRONIC VAPING DEVICE LICENSE – CHRISTINE ANDREW, FOR FUEL ON – 1011 POST ROAD, PLOVER, Wi Ms. Wojtalewicz reviewed the request. Village of Plover Board Meeting 9-16-26 Mr. Fritz motioned, and Mr. Haga seconded, to approve the Reliance Fuel LLC – Change of Agent for Retail Alcohol Beverage License and Cigarette, Tobacco, and Electronic Vaping Device License – Christine Andrew, for Fuel On – 1011 Post Road, Plover, WI. Ms. Wojtalewicz clarified the applicants for change of agent of Cigarette, Tobacco, and Electronic Vaping Device Licenses also go through a background check. Those licenses are not required to come before the board, but the alcohol change of agent requests are. Motion carried. 12. VILLAGE PROJECT CHANGE ORDERS, SUBSTITUTIONS, OR CONSTRUCTION APPROVALS None. 13. ENGINEER’S UPDATE Mr. Terry reviewed his report highlighting the Arbor Haven and Green Tree projects. Copy attached. He noted they met with the design engineer for the Green Tree project regarding soils. He received notification that the following want to proceed with their projects this fall: Portage County – utility work, Harvest Acres 2nd Addition, Arbor Haven next phase. 14. ADMINISTRATOR’S UPDATE Mr. Kunst gave an update on the railroad crossing closures on Hwy. 54 and the progress of the new public safety building project. Taking drone footage and photos of the progress of the public safety building project was discussed. The elevator in the municipal building is currently out of service due to the phone not working. Village staff attended the ground breaking ceremony for the Portage County jail. The annual Fire Department Open House will be held at Station 2 in Whiting rather than Station 1 in Plover on October 2. Mr. Haga commented he attended the groundbreaking for the jail after which Sheriff Lukas advised him, he forgot to thank the Village of Plover. The sheriff would have liked to have acknowledged the Village of Plover for their work through this process. Mr. Ballard advised that while attending a Cubs/Brewers game recently, he encountered a person who issued the Village’s Municipal Bonds. This person had nothing but nice things to say about our community and our bond rating, noting it is not normal to see a community with our bond rating. Mr. Ballard thanked Mr. Kunst, Ms. Mann, and the people that came before, putting the Village in a good position. Mr. Kunst added that because of the quality of the sale, the Village received a premium on Village of Plover Board Meeting 9-16-26 that sale resulting in the Village’s portion related to the public safety building project being about half what we have been stating it would be for year one. He also advised the newsletter will be coming out soon. Mr. Fritz advised discussion at the Highway Commission regarding the Hwy. 54 project included talk about an app truckers use regarding road closures which the DOT puts out. Truck traffic has been going through that area as the app is showing the road is open due to the DOT providing late information and having troubles with the app, 15. The overall budget remains consistent with 2026, with the largest changes related to staffing. First is the post-employment health plan payout for a retiring long- term employee, and the second being a projected increase in health insurance. The Court is intended to operate through revenues generated by its operations, and in the event there is a shortfall, a cost-share agreement between the Village and City kicks in. The joint Municipal Court Oversight Committee comprised of both Village and City officials voted to recommend approval of the budget at their last meeting. Now each community needs to formally approve the budget. Recommendation: I recommend approval of the 2027 Joint Municipal Court budget, as presented. BACKGROUND: Empire Estates is a proposed single-family and twin-home residential subdivision. The project has proceeded through the Village’s development review process and is anticipated to commence construction in October. DISCUSSION: The Development Agreement outlines standard developer terms and obligations consistent with Village ordinances, specifications, adopted policies, and conditions of approval. The Agreement primarily addresses public infrastructure improvements, including streets,sewer/water utilities, associated warranties, stormwater management, and construction coordination, to ensure a quality development. RECOMMENDATION: Approval of the attached Development Agreement ATTACHMENTS: • Development Agreement (Draft) DRAFT 10/1/2026 DEVELOPMENT AGREEMENT Village of Plover, Wisconsin (Empire Estates Subdivision) THIS DEVELOPMENT AGREEMENT (this "Agreement") is entered into as of the _ _ day of __ __ , 2026 (the "Effective Date") between the Village of Plover, Wisconsin, a Wisconsin municipal corporation (the "Village"), and Empire Holdings LLC, a limited liability company organized and existing under the laws of the State of Wisconsin ("Developer Entity"), and Chrisopher J. Brooks, an individual, and Bruce F. Woyak, an individual, (collectively, the "Developer Principals") (the Developer Entity and Developer Principals are collectively referred to herein as the "Developer"). RECITALS WHEREAS, the Developer desires to develop a residential subdivision, known as "Empire Estates Subdivision" (the "Project") on certain real estate located within the Village, as such real estate is legally described on the attached Exhibit A (the “Property”); and WHEREAS, the Developer prepared utility plans, road plans, stormwater management plans, subdivision development plans, and other construction documents (collectively, the “Plans”) included as Exhibit B for the development of the Project; and WHEREAS, the Village seeks to protect the health, safety and general welfare of the community by requiring the completion of various improvements in accordance with the requirements of the Village of Plover Municipal Code (the “Code”), the Plans, and the terms of this Agreement; and WHEREAS, the applicable provisions of the Code require, among other things, that provisions be made for the installation of sanitary sewer mains and laterals, water mains and services, erosion control, the grading of public and private lands, storm water management facilities, street improvements, electric, natural gas, and communication facilities, required to serve the Project; and WHEREAS, the Developer agrees to develop the Property in compliance with this Agreement, all approval conditions, and all applicable Village and other governmental regulations; and WHEREAS, the Village and the Developer wish to agree on terms and obligations for each party to ensure the successful Project; NOW, THEREFORE, the Village and the Developer, in consideration of the terms and conditions contained in this Agreement and for other good and valuable consideration, receipt of which is hereby acknowledged, agree as follows: 1. DEVELOPER OBLIGATIONS. 1.1 Recordation of Development Agreement. The Developer shall record a short form memorandum of this Agreement in the form attached as Exhibit C hereto (the “Memorandum”) executed by both the Developer and the Village, to be recorded with the Register of Deeds for Portage County, Wisconsin. The Memorandum shall be recorded prior to the recordation of any mortgages or other liens. In the event that a mortgage is recorded - 2 - prior to the Memorandum, then, no later than thirty (30) days after the purchase of the Property, Developer shall record one or more subordination agreements in form and substance reasonably acceptable to the Village which have been executed by the holder(s) of any mortgages or liens affecting the Property as of the date or recording of the Memorandum which subordinates such mortgage(s) and lien(s) to this Agreement. 1.2 Preparation and Approval of Plans. Prior to commencement of construction, and to the extent not already completed, the Developer shall prepare and submit all Plans required for the Project, in form and substance acceptable to the Village. Such Plans shall include, without limitation, stormwater management plans, utility plans, roadway plans, construction plans, and civil engineering plans. 1.3 Engineering and Professional Services Costs. The Developer shall pay, within thirty (30) days of invoice, all engineering and professional services expenses incurred by the Village, associated with the Project, including but not limited to, plan review, construction inspection and observation, materials testing, preparation of as-built drawings, and other fees associated therewith, not to exceed the sum of Fifty-Five Thousand Dollars ($55,000.00). 1.4 Construction of the Project. Subject to receipt of all required governmental approvals, the Developer shall design, construct, and pay all costs associated with the Project on the Property. This includes, without limitation, all public streets, public utilities, private utilities, sewer, water, appurtenances, and any required easements necessary to serve the Project. All construction and uses of the Property shall conform to the approved Plans and all applicable Village ordinances, codes, and regulations. The Developer shall use commercially reasonable efforts to diligently continue and complete construction of the Project on a reasonable schedule. 1.5 Private Improvements. Developer agrees that it will construct private Project improvements in conformance with the accepted Plans and in conformance with the Village municipal code. Private improvements shall include, without limitation: 1.5.1 Residential Development. Construction of a single-family and twin- home residential subdivision in conformance with approved Plans, approval conditions, and applicable Village Code. 1.5.2 Private Utilities. The Developer shall cause the Project to be served by all required utilities, including but not limited to electric, water, sanitary sewer, gas, telephone, television, cable, and internet services. 1.5.3 Cluster Mailbox. The Developer shall coordinate with the United States Postal Service (USPS) regarding the design, location, and installation of all required cluster mailbox units (CBUs) serving the Project. Developer shall be responsible for the purchase and installation of all CBUs in accordance with USPS requirements, approved Plans, and applicable Village of Plover specifications. At no time shall the Village be responsible for the ownership, maintenance, repair, replacement, or snow and ice removal associated with the CBUs. - 3 - 1.5.4 Private Stormwater Management Facilities. The Developer shall be responsible for the construction of all private stormwater management facilities in accordance with the Village accepted Stormwater Management Plan. Such facilities include, without limitation, front and rear yard infiltration basins and swales located along or adjacent to property lines, together with any associated grading, appurtenances, and easements. Roadside swales shall be fully constructed as part of the street/utility project. 1.5.5 Other. Other private improvements as detailed in the Village approved Plans shall be the responsibility of the Developer. 1.6 Public Improvements. As a part of the Project, Developer shall install and construct, at its own expense, and upon receipt of all required approvals, the following public improvements in accordance with approved Plans and Village standards: 1.6.1 General Requirements. Developer agrees that it will construct public improvements in conformance with the accepted Plans, including, without limitation, stormwater facilities, water systems, sanitary sewer systems, roadways, and utility improvements. 1.6.2 Street Improvements. The Developer shall be responsible for grading and construction of all public streets, including installation of base course, curb and gutter, and asphalt pavement, in accordance with the approved Plans and the Village’s standard specifications. The streets shall be constructed to the binder course of asphalt prior to issuance of any Certificate of Occupancy for buildings served by such streets. The Developer shall install the final surface course of asphalt upon achievement of (75%) build-out of the development, as measured by issuance of building permits, or within two (2) years of installation of the binder course, whichever occurs first, unless otherwise approved in writing by the Village due to seasonal or weather-related constraints. The Developer shall remain responsible for maintenance and repair of the binder course until installation and acceptance of the final surface course. The Village is not responsible for snow removal or maintenance prior to the binder course. 1.6.3 Dedication of Public Streets and Utilities. At reasonable intervals following completion of Public Streets and Utilities, and upon determination by the Village that such improvements are constructed in a condition acceptable to the Village, the Developer shall dedicate such Public Streets and Utilities to the Village, at no cost, in fee simple (with easements as appropriate). All dedication instruments shall be in form and content acceptable to the Village. 1.6.4 Public Access to Oak Park. Developer shall dedicate to the public a 10’ wide public access to Oak Park. Developer shall clear, grub, grade, and properly seed access. - 4 - 1.6.5 Street Lighting. The Developer shall coordinate with Wisconsin Public Service (WPS) to install a streetlight at the northwest corner of Wilson Avenue and proposed Larry Drive. 1.6.6 Street Signage. The Developer shall be responsible for the costs of signage, materials, and installation of street name signs and regulatory/public safety signs (speed limit, stop sign, etc). The Village will install the signs, and the Developer will be invoiced by the Village when complete. 1.6.7 Shared Utility Oversizing Costs. The Project does not require utility oversizing or shared utility oversizing costs. All utility improvements serving the Project shall be constructed at the Developer’s sole cost, and the Village shall have no responsibility for utility oversizing costs or reimbursement. 1.6.8 Inspection Rights. The Village shall have the right to inspect the construction of Public Improvements at such times and locations as it deems necessary to ensure compliance with approved Plans, Village specifications, applicable laws, and sound engineering and construction practices. 1.7 Warranty - Public Infrastructure. Developer agrees to warrant all Public Improvements and infrastructure work performed under this Agreement, against defects in workmanship or materials, as follows: 1.7.1 Roads. Developer warrants that all roads constructed within the development, including but not limited to subgrade preparation, base course, asphalt pavement, curb, gutter, swales, and grading shall be free from defects in materials and workmanship for a period of twenty four (24) months from the date of final inspection, walk-through, and acceptance by the Village Public Works Department. The final inspection shall be arranged by the Developer. If any defects or failures occur during this warranty period, the Developer shall, at its own expense, repair or replace the defective portions of the roadway to the satisfaction of the Village. The Developer shall arrange an inspection walk-through with the Village Public Works Department prior to the end of the warranty period. The Village may withhold acceptance of the roads until they meet all design and construction standards outlined in the approved plans. 1.7.2 Water. Developer warrants that all water infrastructure, including but not limited to water mains, valves, hydrants, service laterals, and associated appurtenances, shall be free from defects in materials and workmanship for a period of twelve (12) months from the date of final testing, walk through, and acceptance by the Village Water Department. Any defects, leaks, or failures occurring during this warranty period shall be promptly repaired or replaced by the Developer at no cost to the Village. - 5 - 1.7.3 Sanitary Sewer. Developer warrants that all sanitary sewer infrastructure, including but not limited to sewer mains, manholes, service laterals, and related appurtenances, shall be free from defects in materials and workmanship for a period of twelve (12) months from the date of final inspection, walk-through, and acceptance by the Village Wastewater Department. In the event of any defects, blockages, or failures during the warranty period, the Developer shall repair or replace the defective portions of the sanitary sewer system at the Developer’s expense and to the satisfaction of the Village. 1.7.4 Other. All warranties for materials or workmanship which extend beyond the above-referenced warranty period shall be assigned by Developer to the Village. 1.8 Construction Meetings. The Developer shall be responsible for coordinating and conducting construction update meetings with Village staff as needed, during active construction. 1.9 Construction Observation and Monitoring Services. Developer shall pay within 30 days of invoice for all construction observation, inspection, and monitoring services expenses incurred by the Village, associated with the project, subject to the limitation described in Section 1.3 above. 1.10 As-Builts and Record Drawings. The Village’s engineering firm – AECOM, will be responsible for completing and submitting all required as-built and record drawings for improvements constructed pursuant to this Agreement. Developer shall pay within 30 days of invoice for all as-built and record drawing expenses incurred by the Village, associated with the project, subject to the limitation described in Section 1.3 above. 1.11 Stormwater Maintenance Agreement. Developer shall sign and record the accepted Stormwater Maintenance Agreement within 30 days of final plat approval. 1.12 Stormwater Engineer’s Certification. To ensure proper installation of stormwater management practices in accordance with approved Plans and calculations, the Village requires that the Developer’s Engineer, licensed in Wisconsin, certifies construction of stormwater management practices on the property. The Developer’s Engineer shall submit a signed and stamped certification that he/she has successfully completed site inspections and that construction of all storm water management improvements were according to the approved Plans and these improvements are functioning as intended. 1.13 Erosion Control. The Developer shall install and maintain erosion control measures using best management practices and in accordance with approved Plans. The Developer shall comply with all applicable Wisconsin DNR permits and stormwater regulations. 1.14 Easements. Developer shall execute any necessary easements required of the Project prior to the final acceptance of the facilities by the Village, including but not limited to, utility and private stormwater easements. 1.15 Qualified Contractors. The Developer shall engage only qualified contractors and subcontractors for construction of Public Improvements. Contractor qualification shall - 6 - be demonstrated through reasonable evidence of experience and expertise sufficient to perform the required work in compliance with Village standards and specifications. 1.16 Environmental Approvals. The Developer shall be responsible for all costs associated with obtaining any required environmental reports, permits, approvals, and any necessary remediation required by any approving authorities. 1.17 Permits. The Developer shall obtain all permits required by the Village, Wisconsin Department of Transportation, Wisconsin Department of Natural Resources, U.S. Army Corps of Engineers, and any other applicable governmental agency. 1.18 Park Impact Fees. At the time of building permit application and prior to permit issuance, the Developer, builder, or property owner, shall pay all required park impact fees in accordance with Village of Plover Chapter 323 – Impact Fees. 2. VILLAGE OBLIGATIONS. 2.1 Acceptance of Public Improvements. Upon completion of the public improvements, and upon determination by the Village that such improvements have been constructed in accordance with the approved Plans, Village specifications, and the requirements of this Agreement, the Village shall take the necessary action to formally accept the public improvements. The Village shall have no obligation to accept any public improvement that has not been completed in substantial accordance with the approved Plans and applicable requirements. 3. PRECONDITION TO VILLAGE OBLIGATIONS; TERMINATION; TERM. The Village's obligations under this Agreement are conditioned upon the Developer's compliance with each and every term and condition set forth herein. If those conditions are not satisfied or the Developer is in material default of the terms of this agreement and such default continues for a period of sixty (60) days following Developer’s receipt of written notice of such default, the Village, at its option, in its absolute and sole discretion, may at any time thereafter terminate this Agreement by giving notice in writing thereof to Developer. In such event, this Agreement shall be terminated and neither party shall have any further liability or obligation to the other. 4. SUBSEQUENT PHASES OF DEVELOPMENT. This Agreement relates solely to the development of the Property. Any subsequent phases of development (including but not limited to development by the Developer of properties adjacent to the Property) will be addressed in one or more separate development agreement(s). Such separate development agreement(s) will or will not be entered into in the sole and absolute discretion of the Village and no provisions of this Agreement shall be deem a commitment to enter into such a development agreement(s) or to offer any incentives to the Developer. 5. In the event that either the Village or the Developer defaults under any material terms or conditions of this Agreement and such default continues for a period of sixty (60) days following receive of written notice, the non-defaulting party may seek any remedy available to such party under the terms of this Agreement or take any other action, including legal or administrative action, in law or equity, which may appear necessary or desirable to enforce performance and observance of any obligation, agreement, or covenant of the defaulting party under this Agreement. The defaulting party shall be responsible for all costs and expenses incurred by reason of such default including, but not limited to, any legal expenses incurred by the nondefaulting party. The rights and remedies of the nondefaulting party shall not be limited to those, if any, specified in this Agreement, but the nondefaulting party shall have all rights and remedies to which it may be entitled, either at law or in equity. Developer Entity and Developer Principal shall be jointly and severally liable for the payment and performance of all obligations of the Developer under this Agreement and the Village may bring suit against each such entity, jointly or severally, or against any one or more of them. 7. MISCELLANEOUS PROVISIONS. 6.1 Assignment; Covenants Run with the Land. This Agreement shall not be assignable by the Developer without the prior written consent of the Village, subject to all terms and conditions of this Agreement. No assignment of this Agreement shall serve to release the Developer from any liability or obligations under this Agreement. The provisions of this Agreement shall run with the land and inure to the benefit of and be binding upon the successors and assigns of the parties and all assignees, mortgagees, purchasers and transferees of all or any part of or interest in the Property. 6.2 Indemnification; No Personal Liability. The Developer shall indemnify, save harmless and defend the Village and its respective trustees, board members, officers, agents and employees from and against any and all third-party liability, suits, actions, claims, demands, losses, costs, damages and expenses of every kind and description, including reasonable attorney costs and fees, for claims of any kind including liability and expenses in connection with the loss of life, personal injury or damage to property, or any of them brought because of any injuries or damages received or sustained by any persons or property relating to or in connection with the Property, including, without limitation, on account of or arising out of the construction and/or operations of the Project, except to the extent caused by the negligence or willful misconduct of the Village or any of its employees or agents. Under no circumstances shall any trustee, officer, official, director, administrator, attorney, employee or agent of the Village have any personal liability arising out of this Agreement, and no party shall seek or claim any such personal liability. - 8 - 6.3 No Third-Party Beneficiaries; Relationship of the Parties. This Agreement is intended solely for the benefit of the Developer and the Village, and no third party (other than successors and permitted assigns) shall have any rights or interest in any provision of this Agreement, or as a result of any action or inaction of the Village in connection therewith. The Developer and its contractors and subcontractors shall be solely responsible for the completion of the Project. This Agreement does not create the relationship of principal and agent, or of partnership, joint venture, or of any association or relationship between the Village and the Developer or any contractor or subcontractor employed by the Developer in the construction of the Project. 6.4 Entire Agreement; Waiver; Amendment; Severability. This Agreement and the documents executed pursuant to this Agreement contain the entire understanding of the parties with respect to the subject matter hereof. There are no restrictions, promises, warranties, covenants or undertakings other than those expressly set forth in this Agreement and the documents executed in connection with this Agreement. This Agreement and the documents executed in connection herewith supersede all prior negotiations, agreements and undertakings between the parties with respect to the subject matter hereof. No waiver, amendment, or variation in the terms of this Agreement shall be valid unless in writing and signed by the Village and the Developer, and then only to the extent specifically set forth in writing. Nothing contained in this Agreement is intended to or has the effect of releasing the Developer from compliance with all applicable laws, rules, regulations and ordinances in addition to compliance with all terms, conditions and covenants contained in this Agreement. If any covenant, condition, provision, term or agreement of this Agreement is, to any extent, held invalid or unenforceable by a court of competent jurisdiction, the remaining portion thereof and all other covenants, conditions, provisions, terms, and agreements of this Agreement will not be affected by such holding, and will remain valid and in force to the fullest extent of the law. 6.5 Additional Provisions. Recording of this Agreement is prohibited except as expressly allowed herein. This Agreement is governed by the laws of the State of Wisconsin. Time is of the essence with respect to the performance of every provision of this Agreement in which time of performance is a factor. This Agreement may be executed in several counterparts, each of which shall be deemed an original but all of which counterparts collectively shall constitute one instrument representing the agreement among the parties. RECOMMENDATION: Approval of the attached Development Agreement ATTACHMENTS: • Development Agreement (Draft) DRAFT 9/28/2026 DEVELOPMENT AGREEMENT Village of Plover, Wisconsin (Harvest Acres Second Addition) THIS DEVELOPMENT AGREEMENT (this "Agreement") is entered into as of the _ _ day of __ __, 2026 (the "Effective Date") between the Village of Plover, Wisconsin, a Wisconsin municipal corporation (the "Village"), and Denyon Homes INC, a corporation organized and existing under the laws of the State of Wisconsin ("Developer Entity"), and Heath Tappe, an individual ("Developer Principal") (Developer Entity and Developer Principal are collectively referred to herein as the "Developer"). RECITALS WHEREAS, the Developer desires to develop a residential subdivision, known as "Harvest Acres Second Addition" (the "Project") on certain real estate located within the Village, as such real estate is legally described on the attached Exhibit A (the “Property”); and WHEREAS, the Developer prepared utility plans, road plans, stormwater management plans, subdivision development plans, and other construction documents (collectively, the “Plans”) included as Exhibit B for the development of the Project; and WHEREAS, the Village seeks to protect the health, safety and general welfare of the community by requiring the completion of various improvements in accordance with the requirements of the Village of Plover Municipal Code (the “Code”), the Plans, and the terms of this Agreement; and WHEREAS, the applicable provisions of the Code require, among other things, that provisions be made for the installation of sanitary sewer mains and laterals, water mains and services, erosion control, the grading of public and private lands, storm water management facilities, street improvements, electric, natural gas, and communication facilities, required to serve the Project; and WHEREAS, the Developer agrees to develop the Property in compliance with this Agreement, all approval conditions, and all applicable Village and other governmental regulations; and WHEREAS, the Village and the Developer wish to agree on terms and obligations for each party to ensure the successful Project; NOW, THEREFORE, the Village and the Developer, in consideration of the terms and conditions contained in this Agreement and for other good and valuable consideration, receipt of which is hereby acknowledged, agree as follows: 1. DEVELOPER OBLIGATIONS. 1.1 Recordation of Development Agreement. The Developer shall record a short form memorandum of this Agreement in the form attached as Exhibit C hereto (the “Memorandum”) executed by both the Developer and the Village, to be recorded with the Register of Deeds for Portage County, Wisconsin. The Memorandum shall be recorded prior to the recordation of any mortgages or other liens. In the event that a mortgage is recorded - 2 - prior to the Memorandum, then, no later than thirty (30) days after the purchase of the Property, Developer shall record one or more subordination agreements in form and substance reasonably acceptable to the Village which have been executed by the holder(s) of any mortgages or liens affecting the Property as of the date or recording of the Memorandum which subordinates such mortgage(s) and lien(s) to this Agreement. 1.2 Preparation and Approval of Plans. Prior to commencement of construction, and to the extent not already completed, the Developer shall prepare and submit all Plans required for the Project, in form and substance acceptable to the Village. Such Plans shall include, without limitation, stormwater management plans, utility plans, roadway plans, construction plans, and civil engineering plans. 1.3 Engineering and Professional Services Costs. The Developer shall pay, within thirty (30) days of invoice, all engineering and professional services expenses incurred by the Village, associated with the Project, including but not limited to, plan review, construction inspection and observation, materials testing, preparation of as-built drawings, and other fees associated therewith. 1.4 Construction of the Project. Subject to receipt of all required governmental approvals, the Developer shall design, construct, and pay all costs associated with the Project on the Property. This includes, without limitation, all public streets, public utilities, private utilities, sewer, water, appurtenances, and any required easements necessary to serve the Project. All construction and uses of the Property shall conform to the approved Plans and all applicable Village ordinances, codes, and regulations. The Developer shall use commercially reasonable efforts to diligently continue and complete construction of the Project on a reasonable schedule. 1.5 Private Improvements. Developer agrees that it will construct private Project improvements in conformance with the accepted Plans and in conformance with the Village municipal code. Private improvements shall include, without limitation: 1.5.1 Residential Development. Construction of a single-family and twin- home residential subdivision in conformance with approved Plans, approval conditions, and applicable Village Code. 1.5.2 Private Utilities. The Developer shall cause the Project to be served by all required utilities, including but not limited to electric, water, sanitary sewer, gas, telephone, television, cable, and internet services. 1.5.3 Cluster Mailbox. The Developer shall coordinate with the United States Postal Service (USPS) regarding the design, location, and installation of all required cluster mailbox units (CBUs) serving the Project. Developer shall be responsible for the purchase and installation of all CBUs in accordance with USPS requirements, approved Plans, and applicable Village of Plover specifications. At no time shall the Village be responsible for the ownership, maintenance, repair, replacement, or snow and ice removal associated with the CBUs. - 3 - 1.5.4 Stormwater Management Facilities. The Developer shall be responsible for the construction of all private and public stormwater management facilities in accordance with the Village accepted Stormwater Management Plan. Such facilities include, without limitation, roadside ditches, swales, infiltration basins, together with any associated grading, appurtenances, and easements. 1.5.5 Other. Other private improvements as detailed in the Village approved Plans shall be the responsibility of the Developer. 1.6 Public Improvements. As a part of the Project, Developer shall install and construct, at its own expense, and upon receipt of all required approvals, the following public improvements in accordance with approved Plans and Village standards: 1.6.1 General Requirements. Developer agrees that it will construct public improvements in conformance with the accepted Plans, including, without limitation, stormwater facilities, water systems, sanitary sewer systems, roadways, and utility improvements. 1.6.2 Street Improvements. The Developer shall be responsible for grading and construction of all public streets, including installation of base course, curb and gutter, and asphalt pavement, in accordance with the approved Plans and the Village’s standard specifications. The streets shall be constructed to the binder course of asphalt prior to issuance of any Certificate of Occupancy for buildings served by such streets. The Developer shall install the final surface course of asphalt upon achievement of (75%) build-out of the development, as measured by issuance of building permits, or within two (2) years of installation of the binder course, whichever occurs first, unless otherwise approved in writing by the Village due to seasonal or weather-related constraints. The Developer shall remain responsible for maintenance and repair of the binder course until installation and acceptance of the final surface course. The Village is not responsible for snow removal or maintenance prior to the binder course. 1.6.3 Dedication of Public Streets and Utilities. At reasonable intervals following completion of Public Streets and Utilities, and upon determination by the Village that such improvements are constructed in a condition acceptable to the Village, the Developer shall dedicate such Public Streets and Utilities to the Village, at no cost, in fee simple (with easements as appropriate). All dedication instruments shall be in form and content acceptable to the Village. 1.6.4 Park Dedication. Developer shall dedicate ±3 acres of land to the public for a future park. This includes a 12’ wide public pedestrian access from proposed Trinity Lane. 1.6.5 Additional Road Right-of-Way Dedication. Developer is the owner of Lot 51 of Harvest Acres Subdivision and shall dedicate 5’ of additional road right-of-way via Certified Survey Map. - 4 - 1.6.6 Street Lighting. The Developer shall coordinate with Wisconsin Public Service (WPS) to install a streetlight at the intersections of Green Pastures Trail / Hanover Street, Green Pastures Trail / Moreland Road, and where the public pedestrian access intersects to Trinity Lane. 1.6.7 Street Signage. The Developer shall be responsible for the costs of signage, materials, and installation of street name signs and regulatory/public safety signs (speed limit, stop sign, etc). The Village will install the signs, and the Developer will be invoiced by the Village when complete. 1.6.8 Shared Utility Oversizing Costs. The Project does not require utility oversizing or shared utility oversizing costs. All utility improvements serving the Project shall be constructed at the Developer’s sole cost, and the Village shall have no responsibility for utility oversizing costs or reimbursement. 1.6.9 Inspection Rights. The Village shall have the right to inspect the construction of Public Improvements at such times and locations as it deems necessary to ensure compliance with approved Plans, Village specifications, applicable laws, and sound engineering and construction practices. 1.7 Warranty - Public Infrastructure. Developer agrees to warrant all Public Improvements and infrastructure work performed under this Agreement, against defects in workmanship or materials, as follows: 1.7.1 Roads. Developer warrants that all roads constructed within the development, including but not limited to subgrade preparation, base course, asphalt pavement, curb, gutter, swales, and grading shall be free from defects in materials and workmanship for a period of twenty four (24) months from the date of final inspection, walk-through, and acceptance by the Village Public Works Department. The final inspection shall be arranged by the Developer. If any defects or failures occur during this warranty period, the Developer shall, at its own expense, repair or replace the defective portions of the roadway to the satisfaction of the Village. The Developer shall arrange an inspection walk-through with the Village Public Works Department prior to the end of the warranty period. The Village may withhold acceptance of the roads until they meet all design and construction standards outlined in the approved plans. 1.7.2 Water. Developer warrants that all water infrastructure, including but not limited to water mains, valves, hydrants, service laterals, and associated appurtenances, shall be free from defects in materials and workmanship for a period of twelve (12) months from the date of final testing, walk through, and acceptance by the Village Water Department. Any defects, leaks, or failures occurring during - 5 - this warranty period shall be promptly repaired or replaced by the Developer at no cost to the Village. 1.7.3 Sanitary Sewer. Developer warrants that all sanitary sewer infrastructure, including but not limited to sewer mains, manholes, service laterals, and related appurtenances, shall be free from defects in materials and workmanship for a period of twelve (12) months from the date of final inspection, walk-through, and acceptance by the Village Wastewater Department. In the event of any defects, blockages, or failures during the warranty period, the Developer shall repair or replace the defective portions of the sanitary sewer system at the Developer’s expense and to the satisfaction of the Village. 1.7.4 Other. All warranties for materials or workmanship which extend beyond the above-referenced warranty period shall be assigned by Developer to the Village. 1.8 Construction Meetings. The Developer shall be responsible for coordinating and conducting construction update meetings with Village staff as needed, during active construction. 1.9 Construction Observation and Monitoring Services. Developer shall pay within 30 days of invoice for all construction observation, inspection, and monitoring services expenses incurred by the Village, associated with the project. 1.10 As-Builts and Record Drawings. The Village’s engineering firm – AECOM, will be responsible for completing and submitting all required as-built and record drawings for improvements constructed pursuant to this Agreement. Developer shall pay within 30 days of invoice for all as-built and record drawing expenses incurred by the Village, associated with the project. 1.11 Stormwater Maintenance Agreement. Developer shall sign and record the accepted Stormwater Maintenance Agreement within 30 days of final plat approval. 1.12 Stormwater Engineer’s Certification. To ensure proper installation of stormwater management practices in accordance with approved Plans and calculations, the Village requires that the Developer’s Engineer, licensed in Wisconsin, certifies construction of stormwater management practices on the property. The Developer’s Engineer shall submit a signed and stamped certification that he/she has successfully completed site inspections and that construction of all storm water management improvements were according to the approved Plans and these improvements are functioning as intended. 1.13 Erosion Control. The Developer shall install and maintain erosion control measures using best management practices and in accordance with approved Plans. The Developer shall comply with all applicable Wisconsin DNR permits and stormwater regulations. 1.14 Easements. Developer shall execute any necessary easements required of the Project prior to the final acceptance of the facilities by the Village, including but not limited to, utility and private stormwater easements. - 6 - 1.15 Qualified Contractors. The Developer shall engage only qualified contractors and subcontractors for construction of Public Improvements. Contractor qualification shall be demonstrated through reasonable evidence of experience and expertise sufficient to perform the required work in compliance with Village standards and specifications. 1.16 Environmental Approvals. The Developer shall be responsible for all costs associated with obtaining any required environmental reports, permits, approvals, and any necessary remediation required by any approving authorities. 1.17 Permits. The Developer shall obtain all permits required by the Village, Wisconsin Department of Transportation, Wisconsin Department of Natural Resources, U.S. Army Corps of Engineers, and any other applicable governmental agency. 1.18 Park Impact Fees. At the time of building permit application and prior to permit issuance, the Developer, builder, or property owner, shall pay all required park impact fees in accordance with Village of Plover Chapter 323 – Impact Fees. 2. VILLAGE OBLIGATIONS. 2.1 Acceptance of Public Improvements. Upon completion of the public improvements, and upon determination by the Village that such improvements have been constructed in accordance with the approved Plans, Village specifications, and the requirements of this Agreement, the Village shall take the necessary action to formally accept the public improvements. The Village shall have no obligation to accept any public improvement that has not been completed in substantial accordance with the approved Plans and applicable requirements. 2.2 Park Improvements. The Village is responsible for making improvements to the public park associated with the Project, subject to available funding and budgetary authorization. The timing, scope, and nature of such improvements shall be determined by the Village in its sole discretion. 3. PRECONDITION TO VILLAGE OBLIGATIONS; TERMINATION; TERM. The Village's obligations under this Agreement are conditioned upon the Developer's compliance with each and every term and condition set forth herein. If those conditions are not satisfied or the Developer is in material default of the terms of this agreement and such default continues for a period of sixty (60) days following Developer’s receipt of written notice of such default, the Village, at its option, in its absolute and sole discretion, may at any time thereafter terminate this Agreement by giving notice in writing thereof to Developer. In such event, this Agreement shall be terminated and neither party shall have any further liability or obligation to the other. 4. SUBSEQUENT PHASES OF DEVELOPMENT. This Agreement relates solely to the development of the Property. Any subsequent phases of development (including but not limited to development by the Developer of properties adjacent to the Property) will be addressed in one or more separate development agreement(s). Such separate development agreement(s) will or will not be entered into in the sole and absolute discretion of the Village and no provisions of this Agreement shall be deem a commitment to enter into such a development agreement(s) or to offer any incentives to the Developer. - 7 - 5. In the event that either the Village or the Developer defaults under any material terms or conditions of this Agreement, the defaulting party shall be responsible for all costs and expenses incurred by reason of such default including, but not limited to, any legal expenses incurred by the nondefaulting party. The rights and remedies of the nondefaulting party shall not be limited to those, if any, specified in this Agreement, but the nondefaulting party shall have all rights and remedies to which it may be entitled, either at law or in equity. Developer Entity and Developer Principal shall be jointly and severally liable for the payment and performance of all obligations of the Developer under this Agreement and the Village may bring suit against each such entity, jointly or severally, or against any one or more of them. 7. MISCELLANEOUS PROVISIONS. 6.1 Assignment; Covenants Run with the Land. This Agreement shall not be assignable by the Developer without the prior written consent of the Village, subject to all terms and conditions of this Agreement. No assignment of this Agreement shall serve to release the Developer from any liability or obligations under this Agreement. The provisions of this Agreement shall run with the land and inure to the benefit of and be binding upon the successors and assigns of the parties and all assignees, mortgagees, purchasers and transferees of all or any part of or interest in the Property. 6.2 Indemnification; No Personal Liability. The Developer shall indemnify, save harmless and defend the Village and its respective trustees, board members, officers, agents and employees from and against any and all liability, suits, actions, claims, demands, losses, costs, damages and expenses of every kind and description, including reasonable attorney costs and fees, for claims of any kind including liability and expenses in connection with the loss of life, personal injury or damage to property, or any of them brought because of any injuries or damages received or sustained by any persons or property relating to or in connection with the Property, including, without limitation, on account of or arising out of the construction and/or operations of the Project. Under no circumstances shall any trustee, officer, official, director, administrator, attorney, employee or agent of the Village have any personal liability arising out of this Agreement, and no party shall seek or claim any such personal liability. 6.3 No Third-Party Beneficiaries; Relationship of the Parties. This Agreement is intended solely for the benefit of the Developer and the Village, and no third party (other than - 8 - successors and permitted assigns) shall have any rights or interest in any provision of this Agreement, or as a result of any action or inaction of the Village in connection therewith. The Developer and its contractors and subcontractors shall be solely responsible for the completion of the Project. This Agreement does not create the relationship of principal and agent, or of partnership, joint venture, or of any association or relationship between the Village and the Developer or any contractor or subcontractor employed by the Developer in the construction of the Project. 6.4 Entire Agreement; Waiver; Amendment; Severability. This Agreement and the documents executed pursuant to this Agreement contain the entire understanding of the parties with respect to the subject matter hereof. There are no restrictions, promises, warranties, covenants or undertakings other than those expressly set forth in this Agreement and the documents executed in connection with this Agreement. This Agreement and the documents executed in connection herewith supersede all prior negotiations, agreements and undertakings between the parties with respect to the subject matter hereof. No waiver, amendment, or variation in the terms of this Agreement shall be valid unless in writing and signed by the Village and the Developer, and then only to the extent specifically set forth in writing. Nothing contained in this Agreement is intended to or has the effect of releasing the Developer from compliance with all applicable laws, rules, regulations and ordinances in addition to compliance with all terms, conditions and covenants contained in this Agreement. If any covenant, condition, provision, term or agreement of this Agreement is, to any extent, held invalid or unenforceable by a court of competent jurisdiction, the remaining portion thereof and all other covenants, conditions, provisions, terms, and agreements of this Agreement will not be affected by such holding, and will remain valid and in force to the fullest extent of the law. 6.5 Additional Provisions. Recording of this Agreement is prohibited except as expressly allowed herein. This Agreement is governed by the laws of the State of Wisconsin. Time is of the essence with respect to the performance of every provision of this Agreement in which time of performance is a factor. This Agreement may be executed in several counterparts, each of which shall be deemed an original but all of which counterparts collectively shall constitute one instrument representing the agreement among the parties. Upon review of bids the Public Works Department recommends the approval of the bid packet submitted by American Asphalt for $59,650.00. The initial bid had a completion date of November 13th, 2026, however after further review with American and the Village the completion date has been mutually agreed to be changed to May 31st, 2027. With the completion of an acceptable project the Village will be reimbursed $12,891.78 through the Local Roads Improve- ment Plan sponsored by WISDOT. Item #1 Background: I have worked extensively with two different vendors for storage solutions for the new police department. I started working with Bradford Solutions in February of 2024 and Bernies Equipment in February of 2025. Bradford’s initial quote was $299,290. Bernie’s Equipment Company’s initial quote was $322,129.84. After numerous design meetings and price negotiations with each vendor, below are their final quotes. Bradford Systems: $289,830.00 Bernie’s Equipment Company: $294,314.41 Recommendation: I recommend Bradford Systems and the approval of their quote. Item #2 Background: Every year there are police departments across our country that are deliberately targeted with gunfire. Our employees deserve to come to work in a safe and secure environment. That is why laminating our exterior windows will help in keeping them safe. I tried to get a quote from another company in Wisconsin for this service, but they declined our business. Therefore, I was only able to work with and recommend the approval of Safe Haven Defense in Scottsdale, AZ. The project total is $105,985.80 V.OF PLOVER ENGINEER REPORT submitted September 24, 2026 DESIGN PROJECTS STH 54 Parallel Sanitary Interceptor 2/27/26: Design is complete. Project is being held open un*l project is let for bid by WisDOT. 5/15/26: WisDOT has requested the submi/al of a u*lity permit applica*on. This permit is not part of the design scope, but there is some design budget le1, so the permit and accompanying environmental checklist was prepared, reviewed by Village staff, and submi/ed to the DOT 5/14/2026. At Lyle’s request, the DNR sewer extension permit is also in the process of being prepared. 5/29/26: The DOT had some follow-up comments. These were addressed and on 5/28 the DOT has informed the Village the permit has been approved. The DNR sanitary extension permit has been prepared, submi/ed, and the DNR has confirmed it has been received. There is approximately $400 of project budget remaining. 6/12/26: The DNR had follow up data requests related to the Village’s sanitary collec*on master plan and wastewater facili*es plan. Those plans were obtained and provided as requested along with follow-up communica*ons. Unan*cipated addi*onal planning and permiBng work has resulted in a budget exceedance of approximately $1,200. I will be mee*ng with Lyle to discuss and collaborate on a recommenda*on for a change order. 9/24/26: No new informa*on to report Standard Specifica*ons 2/2/26: Work has started on the Plover Standard Specifica*ons project. An index is being created that is organized and numbered as a hybrid of WisDOT and APWA. When the index is complete, it will be reviewed by Village department heads before work con*nues. 2/27/26: The index is dra1ed and is being reviewed prior to forwarding to Village department heads. 3/12/26: The index has been forwarded to Village department heads for comment. 4/10/26: Department head comments have been received. Content work will con*nue. 6/12/26: The general organiza*on and formaBng of the standard specifica*ons is complete. Specifica*on language is being developed. 6/25/26: About 80% of the items are dra1ed. I an*cipate a copy for staff review will be available within a few weeks. 9/24/26: Work on the standard specifica*ons has resumed. Over 90% of the items are dra1ed and are currently going though quality review. CONSTRUCTION PROJECTS Green Tree Farms subdivision 4/10/26: A preconstruc*on mee*ng was held March 30. Construc*on is an*cipated to start mid-April. DNR NOI permits have been received, so clearing and grading work can proceed. Sanitary and water permits are pending. Plan updates to address Village comments are s*ll pending. 5/15/26: Contractor is clearing the site. AECOM field staff have set some survey control points. No u*lity materials are yet on site. 6/12/26: The design engineer requested some specifica*on related informa*on for the DNR sanitary sewer extension permit, which has since been approved. The contractor intends to begin installa*on/opera*on of dewatering pumps on Monday, 6/15 and to begin construc*on on Wednesday, 6/17/26: Ayden Hellenbrand will be the primary inspector on site. Communica*ons with the contractor to date have been excellent. 6/25/26: Work to *e into the first manhole commenced. A drop manhole existed but is at a lower eleva*on than an*cipated. Further work has been paused while dewatering con*nues un*l water levels are suitable for installa*on work. 7/10/26: Work on sanitary sewer main and laterals has con*nued. 7/30/26: Sanitary sewer work is complete with all main and services installed. Work has begun on water main and progress is faster than an*cipated. 8/13/26: Water and sewer service installa*on work began on August 3. As of August 12, water and service laterals have been installed on all the lots on Pear Lane and some of the lots on Juneberry Road. Pressure and mandrel tes*ng took place during the a1ernoon of August 6 from the exis*ng sanitary manhole at the downstream end of the project to manhole 938. On 8-10 the crew worked on some rough grading on Pear Land from sta*on 0+00 to 10+00. On 8-11 It was discovered that three sanitary laterals were shorter than planned. The contractor was made aware of the issue and indicated they would take correc*ve ac*on later when they return to lateral work. 9/10/26: Work from August 13 through September 10 consisted primarily with the installa*on of service laterals, insula*on, water pressure and clean water tes*ng, and preliminary grading work. Road base was placed from Pleasant Drive to a few hundred feet north to facilitate construc*on of the first several homes. On August 24 the final valves hydrant, and main was installed in the northeast por*on of the development. On September 4 sanitary sewer mandrel and pressure tes*ng began, and on September 9 the final water system pressure tes*ng was completed. All tests were completed sa*sfactorily. A mee*ng was held to discuss the construc*on of the stormwater management swales, and the means and methods were confirmed to everyone’s sa*sfac*on. The over-excava*on and swales will be constructed prior to the roadway and throughout the en*re project. This will ensure the stormwater swales will infiltrate based on the design parameters and will allow driveway fill and driveways to be installed without limita*ons on loca*ons. 9/24/26: Work between 9/11 and 9/23 included rough grading, excava*ng test holes approximately every 50 feet to test for stormwater permeability, installing roadside swales, preparing subgrade, and installing base coarse. On 9/17, the developer, design engineer, AECOM geotechnical technician, and construc*on oversight technician met with the contractor to perform test excava*ons. It was determined that over excava*on of between 0.4 to 1.9 feet was required to reach permeable soils. Arbor Haven Phase 4b 8/13/26: The contractor had availability to start earlier than expected, and everyone was able accommodate, so construc*on started the week of August 10. Farhner mobilized and construc*on commenced on August 12 th . Work on the sanitary started from the stub le1 from the previous phase (Sta 163+54). Approximately 325’ of sanitary was installed and 5 wyes for services at plan loca*on. 9/10/26: Work from August 14 through September 10 included comple*ng the sewer and water mains and installing the service laterals. 9/24/26: Work has generally paused un*l sewer and water tes*ng will be performed. DEVELOPMENT PROJECTS MULLINS CHEESE 10/10/25: We are expec*ng updated u*lity and stormwater plans due to the decision not to vacate a por*on of Corporate Ave. 8/13/26: No new informa*on to report Empire Estates 2/2/26: U*lity plans were submi/ed on 1/9/26 and stormwater plans were submi/ed on 1/16/26. Plans have been reviewed. A condi*onal recommenda*on to accept plans for both the u*li*es and stormwater plans was sent to Village staff and the development team on 2/2/2026. Condi*ons include minor adjustments to the u*li*es and some clarifica*ons on the stormwater plan. A task order for construc*on services is being developed, an*cipa*ng start of construc*on mid-April. 2/27/26: Due to the developer pausing requests for approval, the task order development for construc*on services has been paused. 3/12/26: Updated plans have been submi/ed and comments have been sa*sfied. 4/10/26: A task order for construc*on inspec*on services has been submi/ed. The developer has put the project on HOLD for the *me being. 9/10/26: The developer is ready to move forward with comple*on of design and plat approval an*cipa*ng fall construc*on. AECOM will submit a revised task order for construc*on observa*on services. 9/24/26: A revised task order for construc*on observa*on has been submi/ed. A preconstruc*on mee*ng was held on Tuesday, 9/22. U*lity construc*on is an*cipated to begin mid-October. Portage County Facility 8/29/25: A preliminary concept plan has been received for review 9/12/25: Some addi*onal preliminary plan informa*on has been received. Providing sanitary sewer will require some evalua*on and direc*on. Some high-level cost es*mates and loca*on of sanitary sewer as compared to Plover’s sanitary sewer master plan have been discussed between AECOM engineers and Village staff. A preliminary review mee*ng was facilitated by Village staff on 9/10/25. 4/10/26: Updated civil/site plans have been submi/ed for review. Village staff met on March 30 to discuss with the County and their engineers. An aggressive design/construc*on calendar for u*lity work has been proposed. 6/11/26: Updated plans have been received. Lyle and I share concerns with the proposed sanitary and will relay those concerns to Portage County and request their plans be adjusted accordingly. 7/10/26: Stormwater plans and updated u*lity plans have been submi/ed for review. 7/30/26: Stormwater and u*lity comments were presented to Portage County on July 24. We an*cipate the comments will be addressed quickly as there is a desire to begin work as soon as possible. 9/10/26: Plans were resubmi/ed for review. There are some stormwater related comments that have yet to be addressed to sa*sfac*on, but the u*lity plans have been accepted, and the developer is submiBng DNR u*lity extension permits. AECOM will be submiBng a task order for construc*on related services to inspect the installa*on of the water main and public sanitary (most of the sanitary is private and will not be inspected by the Village). 9/24/26: A task order for construc*on oversight of the public water main and sanitary sewer has been submi/ed. While there are some plan comments that have yet to be reviewed, those approvals will not affect the ability for the County to start work on the u*li*es. Empire Square 5/15/26: A commercial development is proposed at the SW corner of Post Rd and Plover Rd. The developer met for a pre-development mee*ng back in January and on 5/8/26 submi/ed site and stormwater plans. Plan review is underway. 5/29/26: The plan review has been conducted and comments forwarded to the developer on 5/22/26. 9/24/26: No new informa*on to report Harvest Acres 2 nd Addi*on 9/10/26: The plat for the 2 nd Addi*on and u*lity plans have been submi/ed for review. Comments have been made and updated u*lity plans have been received. The developer will be submiBng DNR sewer and water extension permits while they prepare stormwater management plans. Their intent is to construct u*li*es this fall, so AECOM will be preparing a task order for construc*on related services. 9/24/26: A task order for construc*on oversight has been submi/ed, an*cipa*ng the developer may wish to begin u*lity construc*on yet this fall.
