laws don’t just apply to dairy operations and think of the broader spectrum than just our immediate dairy

These include an in-ground fence, and they have rehomed one of the dogs. The Board asked them to consider

nominate and vote for candidates. Nominations for Supervisor I, Supervisor II, Town Chair, Clerk, and
Treasurer will be accepted at the caucus on 1/21/25.
WINTER REMINDERS
Pushing snow across the road is a safety hazard. Thepractice of pushing snow across the road when plowingcreates a safety hazard for the traveling public andcreates a problem for the road plowing operation. If you believe your mailbox was damaged during a snowevent, assess if the mailbox was hit by the force of thesnow hitting the mailbox or was it physically hit by theplow equipment. The mailbox policy states that adamaged mailbox will be replaced with a plainstandard mailbox when it is evident that the snowremoval equipment damaged the box. If you believe thedamage was caused by the plow equipment, call theTown Chair to report the damage.
UPDATE FROM THE ROADS COMMITTEE
In October, we celebrated the completion of a 2 year
resurfacing project on 770th Ave with a picnic at the
Town Hall.
Looking ahead to 2025, the Town plans to start work on
resurfacing 850th Street north of State Road 29. Other
projects will include cold patch, sealcoating and more
tree work.
ABANDONED WELLS
Wells no longer used or maintained should consider formal
abandonment and closure because they act as direct
conduits to groundwater and make it more vulnerable to
contamination from the surface. Most well abandonments
are eligible for costing sharing assistance through the
Pierce County Land Conservation Department.

STREAM CULVERTS (NAVIGABLE WATERWAYS)—BEST MANAGEMENT PRACTICES (Sept. 2015)
Non-erodible coffer dams up and downstream to isolate the pipe during excavation. Common methods include sand
bags wrapped in plastic sheeting, other reinforced plastic sheeting, steel sheeting, and water bladder barrier.
Treat water from the culvert trench to prevent cloudy water from reaching waterways or wetlands. Common methods
include temporary settling basin, infiltration basin, filtration bag, sediment tank. Water applied polymer may be needed
in conjunction with these methods.
Maintain streamflow downstream to protect aquatic life. Common methods include by-pass pumping, plastic and rock/
rock bag lined channel, by-pass culvert, and diverting water to one culvert (at sites with 2 or more culverts only).
Trenched in silt fence, fiber
logs, or other method Topsoil and seed protected
by mulch or erosion mat
Place geotextile fabric then
cover with clean, sediment
free riprap 6” to 24” in di-
ameter as appropriate for
the site.
DURING Construction:
AFTER Construction:
At sites with water quality
issues (road overtopping,
bank erosion, streambed
scour, etc.), installing a
larger culvert that does
not constrict the stream
channel is an important
best management practice
for water quality protec-
tion and flood resiliency.

BEFORE Construction: Devise an erosion control plan for the project site. Be sure the plans include stockpile protec-
tion. Further, be sure all stockpiles and borrow/waste sites are setback from waterways, wetlands, and floodplains.
Begin to install erosion control items before any ground is disturbed. Common methods include: construction site
diversion, silt fence, ditch checks, vegetative buffers, inlet protection, sediment traps, and tracking pads.
The following example describes typical best management practices that are needed to protect water quality at culvert
replacement projects.
2
STREAM CULVERTS (NAVIGABLE WATERWAYS) —BEST MANAGEMENT PRACTICES (Sept. 2015)
Construction Timing: Once waterway work begins (below the ordinary high water mark (OHWM)), all construction activities
in those waterways must be continuous to the greatest extent practicable until the work is completed and the site is stabilized.
If periods of inactivity are unavoidable, the site must be temporarily stabilized until the work is resumed and completed.
Timing Restrictions: To minimize adverse impacts on fish movement, fish spawning, and egg incubation periods, work below
the OHWM may not occur during the following time periods:
September 15th to May 15th for all trout streams.
March 1st through June 15th for ALL other waters.
The timing restrictions listed may be waived or modified by the WDNR Transportation Liaison.
Wetlands: Vegetation, material, soil stockpiles, or equipment cannot be stored in wetlands (even on a temporary basis). The
project needs to be constructed in a manner that will maintain natural hydrology in the wetland complex.
Erosion and Sediment Control Practices: The project site shall implement erosion and sediment control measures that ad-
equately control or prevent erosion, and prevent damage to waterways and wetlands as outlined in NR 151, Wis. Adm. Code.
All erosion control measures must meet or exceed the WDNR Technical Standards.
All grading, excavation and disturbance will be confined to the minimum area necessary for the placement of the structure.
Construction equipment should not operate on the bed of the stream, below the OHWM, except for that which is necessary
for the placement of the structure.
Unless the waterway is dry for the duration of the construction activities, you must install a cofferdam upstream and down-
stream of your project area. The coffer dam needs to be installed in conjunction with a method to maintain downstream
flow .
Cofferdams and temporary diversion channels must be constructed of non-erodible material and secured with rock/ rock-
bags at the bottom of the channel and top of the banks. No earthen cofferdams are permitted.
Pump intakes and discharges shall prevent impacts to fisheries, wildlife, and their habitat, and must be placed to prevent the
disturbance, removal and/or scour of bed material.
Temporary bypass structures used to maintain streamflow (i.e. diversion channel, pump bypass system, diverting to one cul-
vert at a time, etc.) need to be adequately sized to prevent damage from upstream flooding and downstream siltation, wash-
out, or scouring.
Construction and dewatering activities shall be accomplished in such a manner as to prevent erosion and siltation into sur-
face waters and wetlands.
Remove all coffer dams in such a way that minimizes the release of sediment and other downstream impacts. Conventional
practice is to remove the downstream coffer dam first then slowly remove the upstream coffer dam. When no longer need-
ed, restore any bypass channel to original condition.
Unless it is an emergency situation, avoid construction during periods of high water to avoid flooding the construction site.
Suitable Fill Material: All fill must consist of clean suitable soil material, as defined by s. NR 500.03(214), Wis. Admin. Code,
free from hazardous substances as defined by s. 289.01(11), Wis. Stats., and free from solid waste as defined by ss. 289.01(11)
and (33), Wis. Stats.
Dredging: Any dredging necessary to bury the culvert will be limited to the greatest extent possible and deposition of sand,
gravel, or stone will only occur immediately underneath and within 2 feet of the culvert. The width and depth of the water-
way must not be altered.
Site Maintenance: The replacement stream culvert must be maintained in good condition. Remove accumulated brush, de-
bris or other obstructions that are trapped in or underneath the structure regularly.
Invasive Species: Invasive species pose adverse effects to waters of the state. Any equipment that has been in contact with
waters of the state needs to be properly cleaned and decontaminated.
Note: If the project includes any wetland fill, approval from DNR and the U.S. Army Corps of Engineers (ACOE) is required. If the project in-
cludes land-disturbance activity in excess of one acre, a Construction Site Stormwater Permit may be needed. Municipalities are responsible
for obtaining any other permit or approval required by local zoning ordinances, other local authority, other state permits and by the ACOE be-
fore starting your project.
Ditch Maintenance
Best Management Practices (BMPs)
(11/2018)
The Wisconsin Department of Natural Resources (WDNR) appreciates the
opportunity to work with municipalities on road improvement projects. Ditch creation and maintenance is an
important component of road improvement projects. The best management practices outlined below will aid
municipalities in completing these projects.
Ditching, the removal of accumulated sediment to the original construction configuration, is a basic
maintenance procedure, provided the best management practices to protect water quality are followed.
However, creating or deepening existing ditches in wetlands may cause negative water quality impacts and
result in costly road maintenance and safety concerns in certain situations.
Please contact the WDNR Transportation Liaison for your county
(https://dnr.wi.gov/topic/Sectors/documents/transportation/Liaisons.pdf) before working in ditches.
Ditch Maintenance:
If you are proposing to change the depth, width, or direction of flow in an existing ditch through or near a
wetland, please contact the WDNR Transportation Liaison for your area.
❖ Work should take place during dry conditions, whenever possible.
❖ A municipality can remove accumulated sediment or vegetation from a ditch provided the
materials removed are deposited in an upland (non-wetland) area.
❖ Maintenance equipment should not be operated in wetland areas. Ditch cleaning should be done
with a back-hoe from the road to avoid compaction of wetland soils.
❖ The ditch dimensions cannot be greatly altered by ditch maintenance activities. Please check the
size and elevations of the ditch prior to maintenance.
Ditch Creation: If you are planning on creating a new ditch in
wetland, you must coordinate with your WDNR Transportation Liaison
prior to starting this operation for necessary permits or approval.
• Ditching in a wetland could severely alter the hydrology of the
wetland resulting in a loss of wetland functions and values.
• Ditching in a wetland will not take water away from the road, it
will just create a place for more water to gather next to the road.
Sometimes a ditch, isn’t a ditch!
Often in Wisconsin, natural streams travel along roads and are not ditches
at all. It is important to contact the WDNR Transportation Liaison for your
area to determine if the area next to your roadway is a wetland or
waterway before doing any maintenance work. For any work in ditches,
check out the NHI Public Portal
(https://dnr.wi.gov/topic/erreview/publicportal.html) to determine if your
project might impact endangered resources.
Road improvements in wetland areas can minimize the need for ditching
Note that some of these options may require a WDNR or USACE permit approval.
• Install equalizer pipes (cross drainage culverts) to distribute the water evenly along the road corridor.
• Raise the road elevation or improving the road base.
• Reduce potential beaver problems by using equalizer pipes with beveled edges, installing end grates, and
cleaning culverts frequently.
Erosion Control BMPs (NR 151.225)
Wisconsin Administrative Code NR 151.225 describes erosion control BMPs required to protect waterways
and wetland from excessive sediment deposition during and after construction. Transportation facility
authorities are required to maintain erosion and sediment control practices at each site where land disturbing
construction activity is to occur and prevent or reduce all of the following (from NR151.225(3)):
(a) The deposition of soil from being tracked onto streets by vehicles.
(b) The discharge of sediment from disturbed areas into on-site storm water inlets.
(c) The discharge of sediment from disturbed areas into adjacent waters of the state.
(d) The discharge of sediment from drainage ways that flow off the site.
(e) The discharge of sediment by dewatering activities.
(f) The discharge of sediment eroding from soil stockpiles existing for more than 7 days.
(g) The transport by runoff into waters of the state of chemicals, cement and other building compounds and
materials on the construction site during the construction period. However, projects that require the placement of
these materials in waters of the state, such as constructing bridge footings or BMP installations, are not prohibited
by this paragraph.
BMPs shall be located so
that treatment occurs
before runoff enters waters
of the state. The BMPs
used to comply with this
section shall be
implemented as follows
(from NR151.225(5)):
(a) Erosion and sediment control practices shall be constructed or
installed before land disturbing construction activities begin.
(b) Erosion and sediment control practices shall be maintained until final stabilization.
(c) Final stabilization activity shall commence when land disturbing activities cease and final grade has been
reached on any portion of the site.
(d) Temporary stabilization activity shall commence when land disturbing construction activities have
temporarily ceased and will not resume for a period exceeding 14 calendar days.
(e) BMPs that are no longer necessary for erosion and sediment control shall be removed by the responsible
party.
