That the Common Council consider a motion to grant a 2026 Landfill License to VH

Background: Theapplicanthassubmittedarequestforapprovalofalandfilllicenseforthepropertylocated
at 3521 E. Oakwood Road. The request is associated with proposed filling and grading activities anticipated
to support the future development of Phase 2 of the Millwood Glen subdivision.
The developer has recently submitted preliminary plans for Phase 2,and City staff are currently reviewing
the proposed subdivision layout, grading, drainage, utilities, erosion control, and related infrastructure
improvements. A development agreement for Phase 2 is also anticipated, with final plan approvals,
agreement execution, and construction potentially occurring in 2027.
The landfill license request is being considered in advance of anticipated subdivision construction to allow
for site preparation activities necessary to facilitate the proposed residential development. Any filling or
grading authorized under the license would remain subject to compliance with approved plans, erosion
control requirements, inspection requirements, applicable City standards, and any conditions established by
the City.
Under Section 13.25 of the Municipal Code, landfill license applications are referred to the Common
Councilfor consideration, and the Council may condition approval as necessary to carry out the
requirements of Chapter 13. Approval of the request would allow the applicant to proceed with the proposed
filling and grading activities, subject to City review and oversight and any required coordination with the
forthcoming Phase 2 subdivision approvals and development agreement.
Options/Alternatives: The Common Council could choose not to approve the landfill license request. lf the
grading activities under the landfill license and would need to revise the proposed site work, pursue an
alternative approval path, or resubmit a modified request for future Council consideration.

Fiscal lmpact: The project budget for the Abendschein Biergarten construction project is

Background: Through implementation of the City's Strategic Action Plan, the City identified development
of a seasonal event venue at Abendschein Park as a priority. Final design plans for a biergarten concept were
completed in July 2026. Two separate construction projects were initially advertised for public bidding in
August 2026. The biergarten Prep Work project consists of the site preparation, including footings,
foundation, flat work, and underground utilities. The biergarten Construction Project consists of fabrication
of factory-built shipping containers, delivery, installation, and utility connections.
The City received one bid for the biergarten Prep Work on August 14,2026. The bid was significantly higher
than the engineer's estimate, and the Common Council rejected that bid on Septemberl,2026. The scope
of the Prep Work was subsequently incorporated into the biergarten Construction Project through a
contract addendum.
Bids for the biergarten Construction Project were opened on September 9, 2026. The City received one
responsive bid from Britten, lnc. Following staff review, the bid was determined to be acceptable and
responsive to the project requirements. Staff recommends awarding the biergarten Construction Project
Options/Alternatives: The Common Council could reject the bid and provide staff with alternative direction
regarding the project.

Background: On May 20, 2025 the Common Council awarded this project to the low bidder, Poblocki
Paving Corporation, for an estimated cost of $426,032.00.
Attached to this report is the final project payment cost breakdown, which identifies major contract item
overages and shortages, as well as contract change orders (additions and deletions), that account for the
final contract amount. ln the end the final project cost ($364,900.60) comes out to about 14.3%
($61,131.40) under the awarded price ($426,032.00). Savings were primarily due to Undercut, Stone and
Asphalt quantities which were less than the bid quantities.
Being a unit price contract, bids are evaluated based on quantity estimates and final payment is made on
measured as-built quantities.

COMMON COUNCIL REPORT
Item No \5
Certified Survey Map - 10700,10820 and 10840 S. 27th St.
Critical Success
Factor(s):
That the Council adopts Resolution No. 12733-100626, a resolution approving a
Certified Survey Map for the combination and reconfiguration of the properties
located at 10700,'10820 and 10840 S.27th St. (Tax Key Nos.977-9999-001,977-
9002-000, and 977 -9003-001).
The proposal is to combine and reconfigure three (3) existing parcels to create two
(2) new parcels and an outlot for stormwater to accommodate a proposed commercial
development. Development of the current vacant lots willyield positive fiscal impacts
in terms of assessed value, review fees, and permitting fees. The properties are not
located in a TlD.

Background:
The Applicant received Common Council approval of the Certified Survey Map (CSM) through Resolution
No. 12582-052025 on May 20, 2025, Since that approval, the Applicant has worked closely with the
Wisconsin Department of Transportation (WisDOT) and the City to address road design modifications and
required easements. These efforts have delayed finalization and recording of the CSM.
Wisconsin Statutes S 236.34(2Xb) requires a CSM to be recorded within 12 months of approval by the
local governing body. Because the original approval occurred in May 2025 and the CSM was not recorded
within the required timeframe, the CSM is being presented to the Common Councilfor renewed approval.
This action is administrative and procedural in nature; no substantive changes to the previously approved
CSM are proposed.
The Certified Survey Map (CSM) combines and reconfigures the properties at 10700,10820 and 10840 S.
27th St. into two (2) lots and an outlot. The reconfiquration of the three (3) existing lots yields a22,315-
acre lot (Lot 1), a 3.933-acre lot (Lot 2), and a 3.673-acre outlot. The yielded lots meet minimum lot
standards for the 8-6 lnterchange Regional Retail District set forth in Sec 17.0301(b) of the Municipal
Code, which requires a minimum lot area of 40,000 sq. ft. and lot width of 150 feet. The lot standards are
set forth in Sec 14.122(Ð of the Municipal Code, which includes a minimum lot depth of 115 feet, and depth
and width adequate to provide for the off-street service, parking and loading facilities required by the type
of use and development contemplated.
As proposed, Lot 1 would house the proposed Buc-ee's Travel Center. Lot 2 would house a future
commercial development, user and type to be determined. The Outlot houses a stormwater detention
pond that would accommodate the future development of both Lot 1 and Lot2.
The conditions cited below carry over from the May 2025 approval, and have been met in the meantime.
Minor technical corrections are commonly made to draft CSMs during and after the review process, as
utility details/locations have yet to be refined, and technical corrections do not impact the intent, size and
bulk requirements of the proposed land division.
The Plan Commission reviewed this request during their April 22,2025 meeting and recommended approval
subject to the following conditions:
'1. That all technical corrections, including, but not limited to spelling errors, minor coordinate
geometry corrections, and corrections required for compliance with the Municipal Code and
Wisconsin Statutes, and those that are required per the WDOT, are made prior to recording.
2. That a cross-access easement between Lot 1 and Lot 2 be identified on a revised CSM, and executed
and recorded by the Milwaukee County Register of Deeds prior to the issuing of any permits, if
applicable.
3. That a cross-access easement between Lot 1 and the Outlot, and Lot 2 and the Outlot, for storm
water maintenance purposes, to be identified on a revised CSM, and executed and recorded by the
Milwaukee County Register of Deeds prior to the issuing of any permits, if applicable.
4. That a 25-ft. easement for the water main be identified on a revised CSM, and executed and recorded
by the Milwaukee County Register of Deeds prior to the issuing of any permits, if applicable.
5. That a sanitary sewer easement be identified on a revised CSM, and executed and recorded by the
Milwaukee County Register of Deeds prior to the issuing of any permits, if applicable.
6. That proof of the necessary transfer of ownership be provided through recorded document(s) by
the Milwaukee County Register of Deeds, if applicable.
Options/Alternatives: Council has the discretion to approve, and/or modify the conditon(s) of Certified
Survey Map approval, or deny the request.

the Public Necessity of and Adopting a Relocation Order for the Acquisition of a

Background: Staff is presenting the Common Councilwith Resolution 12732-100626 for consideration. The
resolution would adopt a relocation order for the City's proposed acquisition of a permanent sanitary sewer
easement over a portion of the property at770} South 27th Street. The property is located between South
27th Street and extends to lkea Way.
The proposed easement is intended to accommodate public sanitary sewer facilities planned in connection
with the Prairie development at the northeast corner of South 27th Street and Drexel Avenue. The City has
authority under Wisconsin Statutes chapter 32 to acquire property interests for public purposes, including by
condemnation when authorized and necessary. For a sanitary sewer acquisition proceeding under Wisconsin
Statutes Section 32.05, the City must adopt a relocation order and comply with applicable statutory
acquisition procedures, including appraisaland negotiation requirements, before initiating condemnation
proceedings.
Options/Alternatives: lf the Council does not approve the resolution, it may direct staff to further evaluate
alternative sanitary sewer alignments, pursue a voluntary easement agreement if appropriate, or discontinue
the proposed easement acquisition and sanitary sewer aliqnment as currently planned.

A RESOLUTION DECLAzuNG THE PUBLIC NECESSITY OF AND ADOPTING A
RELOCATION ORDER FOR THE ACQUISITION OF A PERMANENT SANITARY SEV/ER
EASEMENT ACROSS A PORTION OF 77OO SOUTH}TTH STREET IN
THE CITY OF OAK CREEK, MILV/AUKEE COUNTY, \MSCONSIN
(PIN 78s-9e97-001)
WHEREAS, pursuant to V/is. Stat. $$ 62.11(5),62.22 and32.02, the Common Council
of the City of Oak Creek ("City") is authorized to acquire property interests, including
easements, by purchase or condemnation for sanitary sewers and other public purposes; and
WHEREAS, the City has identified a need to extend public sanitary sewer service
through public facilities owned, operated, and maintained by the City or otherwise subject to the
City's control for public utility purposes, to certain lands located generally north of Drexel
Avenue between 27th Street and Interstate Highway 94 (the "Project"); and
WHEREAS, the City evaluated alternative sanitary sewer alignments to meet this need,
including an alignment within the public right-of-way and an alignment across a portion of the
property commonly known as 7700 South 27th Street, Oak Creek, Wisconsin (the "Prope$");
and
WHEREAS, an alignment within the public right-oÊway would require sanitary sewer
construction at depths exceeding 30 feet in certain locations, resulting in increased construction
complexity, more limited construction access, longer installation duration, additional deep utility
appurtenances, and more challenging long-term operation and maintenance; and
WHEREAS, the proposed easement alignment across a portion of the Property would
allow construction al a shallower depth, shorten the required public sanitary sewer facilities,
reduce the extent of public infrastructure requiring City operation and maintenance, and provide
a more practical and maintainable alignment for the public sanitary sewer system; and
WHEREAS, based upon this analysis the City has determined that acquisition of a
permanent sanitary sewer easement across a portion of the Property is necessary to construct,
