Guzikowski x Also present were City Attorney Melissa Karls, Deputy City Administrator / Finance Officer Maxwell Gagin, IT Director Thomas Kramer, Community Development Director Kristin Laine, Marketing Communications Manager Kelly Shoff, Assistant City Administrator / City Engineer Matthew Sullivan, HR Director Toni Vanderboom, City Administrator Andrew Vickers, and City Clerk Catherine Roeske. *********************************** *** A motion was made by Ald. Gehl to convene into Closed Session at 8:09 p.m., pursuant to Wisconsin State Statutes, Section 19.85 to discuss the following: (a) Section 19.85(1)(e) for competitive or bargaining reasons, to discuss the Agreement between the City of Oak Creek and Abendschein Park Beer Garden, LLC (“APGB”) dba Abendschein Biergarten and deliberate the investing of public funds. (b) Section 19.85(1)(g) to confer with legal counsel who is rendering oral or written advice concerning strategy to be adopted with respect to litigation in Tyler Buerger v. City of Oak Creek, et al. (Case No. 2:26-cv-1310). This motion was seconded by Ald. Guzikowski. Roll call: Ald. Haase x Ald. Marshall excused Ald. Loreck x Ald. Gehl x Ald. Ruetz x Ald. Guzikowski x A motion was made by Ald. Gehl, to reconvene into Open Session at 8:48 p.m. pursuant to Section 19.85 (1)(e) and (g) of the Wisconsin State Statutes. This motion was seconded by Ald. Guzikowski. On roll call: Roll call: Ald. Haase x Ald. Marshall excused Ald. Loreck x Ald. Gehl x Ald. Ruetz x Ald. Guzikowski x Action on Closed Session, if posted for possible action: No action taken on Item (a) (b) Ald. Gehl, seconded by Ald. Guzikowski, moved to approve the Settlement Agreement and Mutual Release Agreement in Tyler Buerger v. City of Oak Creek, et al (Case No. 2:26-cv-1310) and authorize the Mayor and City Administrator to sign the agreement. On roll call, the vote was as follows: Ald. Haase, aye; Ald. Loreck, aye; Ald. Ruetz, aye; Ald. Gehl, aye; and Ald. Guzikowski, aye. The meeting adjourned at 8:49 p.m.
