Disallowance of Clain
This item concerns a claim submitted by Kristin Lewis alleging that the Village posted her medical records online. The
Village's liability insurance claims administrator, Statewide Services, has reviewed the claim and determined that the
Village has no liability. They recommend that the Village Board formally disallows the claim in accordance with standard
procedures and authorize issuance of a Notice of Disallowance to the claimant within the required statutory timeframe.
Aspen Sky Application
The annual Permit for Aspen Sky to sell liquor at Richfield days is once again before the board. They have made no changes
since last year. As the board knows, we can put qualifications or limits on them, but cannot outright deny the permit. There

6. DISCUSSION/ACTION ITEMS
a. Discussion/ Action regarding Resolution R2026-06-01 Resolution Supporting Participation
in the Washington County Countywide EMS System and Authorizing Execution of the
Countywide EMS system Service Provider Agreement
Administrator Healy introduced Chief West and Dave Sager to speak on the proposal. Chief West spoke on
how this effort started, and the three years of work that has happened so far to set up the proposal, that would
establish a new tax levy at the County to administer and help fund a portion of the County EMS system. The
fire department planned pay scale raises eclipse the additional levy the Village gets for net new construction.
Mr. Sager spoke on the County's special ability to raise levies without the need of a referendum. The County
would never be the majority owner, in any department, and is only helping to financially support each EMS
department in the County. Chief West gave an overview of the exact finances and procedures outlined in the
proposal.
President Jeffords went through a summarized financial document with the Board on how the proposal
would function. The Village President stated that it was much more cost effective to have the County levy
the tax across all taxable prope1ties in Washington County instead of the Village.
Trustee Schmitt asked how much notice the Village would need to give in order to leave the agreement. Mr.
Sager said it is set at 18 months, because it is a tax. Even if the Village were to exit the agreement, our
residents would still be taxed for a proportional share of the cost to administer the agreement countywide.
Administrator Healy said several other counties are watching what Washington County is doing, and we may
be a model that others will follow.
Motion by Trustee Wolff, seconded by Trustee Lietzau, to approve Resolution R2026-06-01, A Resolution
suppo1ting participation in the Washington County Countywide EMS system and authorizing execution of
the Countywide EMS system service provider agreement; Motion carried without objection.
b. Discussion/action regarding Resolution R2026-06-02 Fee Schedule Update for Special
Assessment Letters
Administrator Healy introduced the fee schedule change, to remove the rush fee, and raise the fee to $35.
Motion by Trustee Wolff, seconded by Trustee Lietzau. to approve Resolution R2026-06-02, A Resolution
Amending the Fee Schedule related to Special Assessment services. Motion carried without objection.
c. Discussion/ Action regarding the execution of a software service agreement with CYVL
Administrator Healy introduced the topic. It is a method to get survey data for roads, and give measurable
data on all village roads using lidar. We could use data driven methods to choose what roads to work on each
year. The cost of the agreement is approximately $10,000/annually for three (3) years.
Motion by Trustee Wolff, seconded by Trustee Lietzau, to authorize DPW Supervisor Brett Thicke to
execute an agreement with CYVL for software services pursuant to the terms of the proposed agreement,
subject to the review and approval by the Village Administrator; Motion Carried 4-1.

Administrator Healy introduced the agenda item. This was brought up by the Board during the last budget
meeting. For the Richfield RAGE program 9 I out of 157 kids are non-residents for example. In the Richfield
Rockets program, over 40 of their 88 children are from outside our community. We would use this money
for improving the parks, like adding a bubbler, or improving accessibility.

Update for the creation of a Non-resident Youth Baseball Fee in the Village's Adopted Fee Schedule, and to

Gregory West, Fire Chief
MEMORANDUM
To: Village of Richfield Board of Trustees
Re: May Fire Department Activity Update
Date: 2 July 2026
PERSONNEL EDUCATIONAL ACHIEVEMENT
RFD members continue to complete their spring course offerings and state ce1tification testing.
Firefighter /EMT Joe Urlakis successfully completed the state's Officer I certification process in
June.
GRANT APPLICATIONS
For whatever reason, June is a popular month for grant applications. The RFD completed and
submitted two grant applications as follows:
• WI Department of Natural Resources (DNR) Forest Fire Protection (FPP) Grant
Safety Helmets
This grant makes funds available to purchase equipment to help support fire department
efforts related to wildfire (bmsh/grass) control and extinguish.ment. Currently , RFD
employees must wear their stmctural firefighting helmets to provide head protection
when mitigating these fires. While these helmets work ve1y well for their designed
purpose, they are heavy , cumbersome, unventilated , and not built for exterior operations
at a bmsh/grass fire. To address this, the RFD requested funds to purchase 50 rescue
helmets designed for exterior firefighting operations. The helmets include eye protection
(goggles), fire resistant hoods/shrouds, and flashlights . As an added bonus, the helmets
could also be worn by members whenever head protection is required, yet a stmctural
firefighter helmet is not the best solution ( e.g., technica l rescue, extrication).
This DNR grant is capped for such purchases, so the cost sharing for the RFD is greater
than the 50% cost share typically associated with this grant. (Each helme t costs $397 and
the DNR will pay only $ 155.50 per helmet.) The total cost is $ 19,850 with a prospective
DNR award of $7,775. If awarded the grant, the RFD does have adequate personal
protective equipment (PPE) budget funds available to address the remaining $12,075 that
would not be covered by the DNR FPP grant program.

The RFD should find out whether the grant app lication was successfu l in early fall.
• FEMA U.S. Fire Administrat ion (USFA) Assistance for Firefighters Grant (AFG)
Diesel Exhaust Source Point Capture System
This will be the third year in which the RFD (and RVFC previously) has applied to the
FEMA USF A AFG program to help support the purchase and installation of a diesel
exhaust source point capture system for Station 1. As discussed with the Board
previously , diesel exhaust is recognized as a cancer-causing carcinoge n, firefighters have
a higher rate of developing cancer when compared to the public , and there is a
presumptive cancer law in Wisconsin that estab lishes a presumption that a firefighter who
is diagnosed with cancer contracted the disease within the scope of his or her
employment (meaning it is a duty-related injury/disease that falls under the Village's
worker's compensation policy). The USF A recognizes higher cancer risk to firefighters
when they are at the statio n on a 24/7 basis and their sleeping and living quarters are
physically connected to the apparatus bay in which diesel apparatus are housed. While
Station 1 does have an exhaust system in the apparatus bay, it does not collect diesel
exhaust at the source, nor does it eliminate 100% of diesel exhaust soot, chemica ls, and
particulates from the atmosphere prior to inhalation by personnel in the apparat us bay.
The cost of these systems continues to increase and a current bid (May 2026) for such a
system at Station l is $ 151,428 (an annual increase of about $13,000). The AFG program
will only fund $100,000 for a diesel exhaust source point capture system per station . If
the grant application is successful, the plan would be to use a portion of the $73,000
(approximate) that was raised by the RVFC and had been eam1arked for that purpose
prior to transfer of those funds to the Village. (As Station 2 is not staffed by any fire
department personnel , there are no plans to seek the purchase and installation of such a
system at Station 2 at this time.)
If notifications are made along the same timeframes as last year, the RFD shou ld find out
the status of the grant application in October ( or thereabouts).
The RFD is also planning on submittin g the following grant in July. (It is included here in the
June update as a heads up because, if grant funds are not awarded, we may want to ensure the
purchase is funded intemally through the CIP proce ss.)
• Firehouse Subs Public Safety Foundation Grant
Replacement Extrication Equipment
As the Board is aware, the RFD will be selling an old rescue vehicle as soon as internal
work on its utility trnck is completed. (The functions served by the vehicle have been/will
be assumed by a new fire engine and the former grass fire pickup trnck once work is
completed.) This vehicle does hold the RFD's second set of extrication equipment , which
Richfield Fire Department
2 July 2026
is available for redundancy if the primary engine (which canies the RFD's battery
powered extrication equipment) is otherwise engaged in another response or there is
some type of failure in the primary equipment ( or it is receiving annual serv ice). This old
extrication equipment is hydraulically powered, which requires a po11able generator with
hydraulic pump and, given the age of the equipment, maintenance is becoming more
expensive as parts become more difficult to find. A battery-powered replacement set of
extrication equipment will cost approximately $35 ,000.
Rather than hying to budget for this replacement through the traditional CIP process (as
this equipment was not on the previous CIP schedule through the RVFC) , the RFD will
be applying to the Firehouse Subs Public Safety Foundation for pos sible grant funding .
The caveat is that the grant application pe1iod opens on July 9 (9:00 AM) and closes as
soon as the Foundation receives 600 applications (which occurs rather quickly). [f this
window is missed, the next opportunity to apply will be in late October. The maximum
individual grant award is $40,000.
The RFD will provide a follow-up to the Village Board next month with the status of this
grant oppo11unity (specifically, whether or not the grant was accepted).
SLEEP IN HEAVENLY PEACE
Sleep In Heavenly Peace (www.shpbed s.org) is a charitable organization that builds and delivers
free beds to socioeconomically depressed children (so they do not have to sleep on the floor,
sofa, or something other than their own bed). The RFD is supporting these efforts by providing a
drop off location for bedding (and even received some direct-ship bedding from a woman in
lndiana who saw the RFD 's Facebook posting regarding the need). Later this year, the RFD will
allow the organization to use its Station #3 (on Highway 164) for a few hours on a weekend to
build the beds while being protected from the elements (rain, in pai1icular).
WISCONSIN EMS ASSOCIATION (WEMSA) VISIT
The RFD (and RVFC previously) belongs to the Wisconsin EMS Association and, on June 9, the
Association Director and additional staff visited the RFD to talk about EMS, the depat1ment's
needs, and what WEMSA has been doing at the state level to aid EMS services. Some of their
highlights included work on the following pieces of legislation (which were passed and are now
law in Wisconsin):
• 2025 Wisconsin Act 35: Provides reimbursement funding for EMS agencies who send
people through EMS schooling (including paramedi c). This law and the resultan t funding
provides an avenue for the RFD to possibly send people through param edic school
(which costs approximately $10,000 in tuition and fees).

• 2025 Wisconsin Act 145: Extended PTSD workers' compensation coverage to EMS
personnel (firefighters were previously covered but, up until this bill was passed , EMS
only individuals were not).
• 2025 Wisconsin Act 36: Increased maximum Medicaid reimbursement for treatment, but
no transport calls to $17 5.
FIREFIGHTER/EMT HORNUNG RETURN FROM DEPLOYMENT
Firefighter/EMT Zach Hornung was called up to active duty (Air National Guard Refue ling
Wing) in May to suppo1t the U.S. effort in Iran. Zach returned home in early June and has since
returned to his duty crew at RFD. Please join us in welcoming Zach back home!

VILLAGE OF RICHFIELD
VILLAGE BOARD COMMUN ICATIO N FORM
MEETING DATE: July 16, 2026
Liquor License for The Alpine
February 20, 2025
Jim Healy, Village Administrator
POLICY QUESTION: DOES THE VILLAGE BOARD WISH TO APPROVE THE APPLICATION FOR A CLASS "8 "AND "CLASS B " LIQUOR
l!CENSE FOR THE ALPINE
ISSUE SUMMARY:
The Village Board is being asked to consider an original application for a Class "B" Beer License and "Class B" Liquor
License submitted by ILA Investments LLC for 1380 Friess Lake Dr, formerly Alpine Retreat. They would be doing
business as The Alpine , with Scott Motto designated as the agent.
In February 2025, Scott Motto bought Alpine Retreat; he applied for a liquor license and was denied. The motion was:
"Motion by Trustee Neu; Seconded by Trustee Lietzau to deny the Application for a Class "B" and "Class
B" Liquor License for Alpine Retreat , pursuant to State Statute 125.04, and based on his history of
threatening behavior, disregard for public property , and ongoing conflicts with local authorities , which
demonstrate a pattern of disruptive actions that are not in alignment with the values and standards of our
community . Motion carried without objection. "
In March2025 , the business was once again before the board, now Margo DeCluw e as the agent. The motion was:
"Motion by Trustee Lietzau, seconded by Trustee Neu, to approve the Alcohol Beverage Retail License
Application for a Class "B" Beer License and "Class B" Liquor License for Alpine Retreat , located at 1380
Friess Lake Road, conditional on the surrender of the current license; Motion carried without objection. "
Alpine Retreat was to remain operating just as it had for years, without any significan t changes. They were issued their
Class B Combo License and began to operate.
In Spring 2026 , Mr. Motto filed his paperwork for a renewal of his license, however when doing routine checks, Deputy
Bautz found that the LLC had filed to be dissolved with the State , and the license could not be issued to a business that
officially no longer exists. Staff was in contact with Mr. Motto and exploring options with him, once this issue was
discovered. Mr. Motto stated he was unaware that dissolving the business that held the liquor license would affect the
license. He decided to reapply with a new LLC for the July meeting. Through a few iteration s, and various ideas, Mr. Motto
has found a new chef and is currently working on their business plan. They plan to bring that plan to the Plan Commission
once they have the details nailed-down.
The issue before the Board now, is an original application for a Class "B" and "Class B" license for the newly formed ILA
Inve stments LLC . The agent for the LLC would be Mr. Motto. As this is a new license, the Board has full discretion over
whether to approve it. Denials of a renewal require going through the intense revocation process, require proof , and a full
hearing. At this point , the Board has the authority to deny this application for an abundance of reasons that would not be
able to be applied if it were a renewal. Staff feel the Board should be fully informed before making their decision. As such
Deputy Bautz has been investigating and has spoken to multiple current and former employees.
There have been no citations or convictions of Mr. Motto or against the, now dissolved, S James Investments LLC. There
have been multiple complaints regarding behavior in the workplace and accusations of sexual harassment , drinking on the
job, and wage theft.

VILLAGE OF RICHFIELD
VILLAGE BOARD COMMUNICATION FORM
MEETING DA TE: July 16, 2026
Reserve "Class B" Alcoho l Beverage Retail License, and Class "B" Beer License - BJ's
Tailgate Tavern located at 1907 STH 175 (Tax Key: V 10 _ 0309002) - BJ's Tailgate Tavern,
LLC., Petitioner
July 8, 2026
Madeline Moltzan , Deputy Clerk
POLICY QUESTION: DOES THE VILLAGE BOARD WISH TO CONDITIONALLY APPROVE A RESERVE "CLASS B "ALCOHOL BEVERAGE
RETAIL LICENSE, AND A CLASS "B" BEER LICENSE TO BJ's TAILGATE TAVERN LLC?
ISSUE SUMMARY :
The app licant, BJ's Tailgate Tavern LLC, is requesting approval of a Reserve "Class B" Alcohol Beverage Retail License
and a Class "B" Beer License for the property located at 1907 State Highway 175.
The propetiy has experienced several changes in ownership and operation over the past several years . In 2023, Fat Charlie's
was sold and reopened as Bill and Roxy's Shenan igans. That business operated for a relatively short period before closing,
and the property has since remained vacant. As a result, the Board is once again being asked to consider licensing a new
operator for this location.
The proposed business would be owned and operated by BJ's Tailgate Tavern LLC. Applicant Brittany Trzebiatowski
previously served as manager of Fat Charlie 's and is familiar with both the property and its customer base. She has indicated
a desire to reestabli sh the location as a successful neighborhood establishment. Together, with business partner Jared
Wilson, the applicants propose to renovate and reopen the property as a sports bar offering food and beverage service. If
approved , the business would return an existing cotmnercial property to active use and restore a licensed hospitality
business within the Village.
As part of its review, the Village Board must determine the fee to be charged for the Reserve "Class B" Alcohol Beverage
Retail License. Wisconsin Statutes establish a minimum fee of $10,000; however, municipalit ies have the autho rity to
establish a higher fee by ordinance or Board action. When the Village last issued a Reserve License to Bill & Roxy 's
Shenanigan 's in 2023, the Board established the fee at $25,000.
The Village curren tly has three (3) Reserve Alcohol Beverage Licenses available for issuance. Because the number of
ava ilable liquor licenses is tied to a municipality's population, Reserve Licenses are a finite public asset. The Board should
consider whether the previously established fee remains appropriate or whether a different amount better reflects the current
value of the license and the Village's policy objectives.

Our Mission
Our mission is to create a welcom ing, community-centered sports bar where residents of
Richfield and the surrounding communities can gather to enjoy great food, exceptiona l service,

----, Why Richfield? Why This Property?
Investing in an Existing Local Business
We believe that investing in an existing commercia l property is an opportunity to strengthen the

Rather than building from the ground up, our plan is to renovate and modernize the current
establishment into a welcoming neighborhood sport s bar that reflect s the values of Richfield
and serves residents for years to come.
By improving the existing building, we hop e to enhance the property's appearance, increase its
long-term value, and create a destination that contributes positi vely to the surroundin g area.
Why Richfield
Richfie ld continues to be a community where fami lies, local businesses, and comm unity
organizations thrive . We see an opportunity to create a gathering place where neighbor s can
come together to enjoy great food, watc h sporting events, celebrate local teams , and
participate in community activities.
Our vision complements the character of the Village by offering a welcoming, respectf ul
environment that encourages people to stay local and support a hometown business.
Our Commitment to the Community
We are committed to being active members of the Richfield community through:

visitor s experience the hospitality that Richfield is known for.
We want to build a business that residents are proud to recommend and that the Village is
proud to have as part of its business commu nit y.
"Our investment is more than a renovation-it 's a commitment to the ViHage of Richfield and
the people who caH it home."

VILLAGE BOARD COMMUNICATION FORM
MEETING DATE: July 16, 2026
SUBJECT: Groundwater Protection Ordinance Modification Discussion and Voluntary Water
Testing Program
DATE SUBMITTED: July 7, 2026
SUBMITTED BY: Jim Healy, Village Administrator
POLICY QUESTION: DOES THE VILLAGE BOARD WISH TO DIRECT STAFF TO DRAFT AN AGREEMENT AND CREATE A
PROGRAM FRAMEWORK FOR THE BOARD 'S CONSIDERATION FOR REVIEWING WATER TESTING
SAMPLES?
ISSUE SUMMARY:
Groundwater Protection Ordinance - Possible Amendments
Rather than simply reviewing groundwater models, the ordinance shou ld formally authorize the Village
Hydrologi st to:
• Determine whether Tier 2 review is necessary;
• Approve water balance methodologies;
• Evaluate recharge calculations;
• Recommend mitigation measures;
• Review long-term maintenance plans;
• Require additional hydrogeologic information where site conditions warTant.
The current ordinance reflects an approach common when groundwater protection programs were first
developed: requiring a technically rigorous hydrogeologic evaluation for nearly all regulated development. A
two-tier framework would modernize the ordinance by making the level of review proportional to anticipated
groundwater impacts. Most residential, small commercial , and redevelopment projects that demonstrate no net
loss of groundwater recharge could proceed through an administrative Tier 1 review using a simplified water
balance analysis, while projects with greater water demand , reduced recharge, sensitive hydrogeologic
conditions, or potential off-site impacts would undergo the more comprehensive Tier 2 review. This preserves
the ordinance's existing groundwater protection objectives and technical perfonnance standards, while focusing
detailed analysis where it is most likely to provide meaningful environmental and regulatory benefit. The
following summary is how it would be expected to be rewritten:
Existing Section
§167-29 Findings
§167-30 Purpose
§167-31 Pennit
Required
Recommendation
Retain with minor additions recognizing proportional review and
groundwater recharge.
Retain; broaden to include maintaining groundwater recharge and
proportional review.
Rewrite into Tier 1 and Tier 2 review pathways.
Existing Section
§ 167-31 Application
§167-3l(C) New Pennit
§167-32 Review

§ 167-32 Perfonnance
Standards
Recommendation
Split into Tier 1 worksheet requirements and Tier 2 hydrogeologic
study requirements .
Retain with minor updates for recharge and BMP modifications.
Separate into streamlined Tier 1 review and detailed Tier 2 review.
Keep drawdown standards but apply them only to Tier 2 projects
requiring hydrogeologic analysis.
Voluntary Groundwater Quality Monitoring Program
As the Village continues evaluating its long-term groundwater protection strategies, an opportunity exists to
complement regulatory efforts with a voluntary groundwater quality monitming program for residents. Rather
than imposing additional regulation s, this initiative would provide homeowners with affordable access to
information about their privat e drinking water while expanding the Village's understanding of regional
groundwater conditions.
Unlike municipal water systems, which undergo routine monitoring, private wells are typically tested only at a
homeowner' s discretion. Consequently, many residents have limited knowledge of their drinking water quality or
changes that may occur over time. A Village-sponsored program would help address this gap by offering
coordinated, cost-effective annual testing opportunities.
The Village would establish an annual "Groundwater Quality Week" and competitively select a qualified
environm ental laboratory to provide standardized testing panels at negotiated rates. Testing options could include
volatile and non-volatile organic compounds (VOCs and NVOCs), along with common groundwater indicators
such as nitrate, bacteria , hardness, iron, manganese, and other parameters recommended by the Village's
hydrologist.
Homeowners would voluntarily participate through the Village at predetermined prices, benefiting from reduced
laboratory, shipping, and administrative costs achieved through a community-wide sampling event. Multiple
testing packages could accommodate varying interests and budgets, with Village staff providing instructions for
sample collection using laboratory-supplied kits. Program fees would recover administrative costs while
maintaining affordability.
Laboratory results would be reviewed by the Village's contracted hydrologist, Mr. Dale Buser, with a portion of
each participant's fee supporting his professional evaluation. Homeowners would receive their individual results
along with an explanation of findings, generalized observations by Village quadrant , identification of any
parameters of concern, and recommendations for additional testing or consultation when appropriate.
Individual results would remain confidential, while aggregated data would provide the Village with valuable
information on groundwater characteristics and long-term trends. Over time, repeated sampling could establish
meaningful baseline conditions, identify emerging water quality concerns, and strengthen future groundwater
management decisions.
This voluntary program offers a collaborative benefit to both residents and the Village. Homeowners gain
affordable, professionally interpreted information about their drinking water, while the Village develops a growing
groundwater quality database to support informed policy decisions and responsible resource stewardship. Similar
programs in mral Wisconsin communities have demonstrated the value of coordinated sampling in increas ing
public awareness, reducing testing costs, and estab lishing reliable groundwater quality baselines.
At our last Village Board meeting attended by Mr. Buser, the Board seemed interested in learning more about the
potential creation of a Voluntary Groundwater Quality Monitoring Program. Mr. Buser is going to be reaching out
to laboratories that h e is familiar with to start to assemble costs. It is assumed he will have a reasonable estimate of
the panel review the night of the meeting. This infonnation could be advertised in the Village 's newsletter to help
boost awareness as well as posted on our website and socia l media accounts.

Chapter 167. Erosion Control and Stormwater Management
Article Ill. Groundwater Protection
[Adopted 8-4-2009 by Ord. No. 2009-8-9 (Ch. 59 of prior Code)]
§ 167-29. Findings.
The Village Board finds that land development activities in the Village can have a significant adverse
impact upon groundwater levels, which can adversely impact upon the health, safety and welfare of the
community. In particular, and without limitation, the Village Board finds that development can:
A. Cause temporary or permanent loss of adequate water supply for the community from existing
wells and infrastructure;
B. Diminish the capacity of water resources to support recreational and water supply uses and a
natural diversity of plant and animal life; and
C. Reduce groundwater recharge, which may diminish stream base flows and/or lower water levels in
local lakes, ponds and wetlands.
§ 167-30. Purpose.
The purpose of this article is to set forth requirements for groundwater protection related to
development, aimed to minimize the impact upon steady state groundwater levels, in order to diminish
the threats to public health, safety, welfare, and the natural resources of the Village.
§ 167-31. Groundwater protection permit.
A. Permit required. A groundwater protection permit is required for all development of land as defined
herein.
(1) No subdivision without permit. No land shall be divided by plat or certified survey map unless
the requirements of this article are satisfied and approved as follows. Residential properties
created by certified survey map are exempt from this article.
(a) Certificate of compliance. No preliminary plat or certified survey map shall be accepted for
filing unless it is accompanied by a certificate of compliance issued from the Village
Administrator or designee, dated not more than 12 months prior to the date of submission,
documenting compliance with the requirements of this article. The Village Administrator or
designee shall grant certificates of compliance upon request when it appears from
available information that the requirements of this article will be satisfied if the land is
divided and developed as proposed by the land division documents. The issuance of a
certificate of compliance is a preliminary determination only, however, and it does not
warrant or guarantee that a groundwater protection permit will be issued.
(b) Groundwater protection permit. No land shall be divided by plat or certified survey map
unless a groundwater protection permit is issued prior to approval of the final plat or
certified survey map, but after the issuance of a stormwater permit.
(2) No multifamily without permit. No multifamily residential buildings with two or more units shall
be constructed unless the property owner has been granted a groundwater protection permit
prior to, and not more than 12 months prior to, the issuance of the building permit.
(3) No commercial, agricultural, industrial, or other nonresidential development without permit. No
commercial, agricultural , industrial, or other nonresidential development of land shall be
allowed unless the property owner has been granted a groundwater protection permit prior to,
and not more than 12 months prior to, the commencement of the development. For purposes if
this subsection, a development commences on the date of commencement of construction of
any improvement, whether public or private, or site development, or approval of the final plat or
certified survey map, if applicable, or the date of commencement of the development use,
whichever date is earliest.
B. Application procedure. To request a groundwater protection permit under this article, the following
information shall be submitted to the administering authority:
(1) A completed application on a form provided by the Village Administrator for that purpose.
(2) The applicable fees, as determined by the Village Board by separate resolution from time to
time.
(3) The additional information required as specified in Exhibit A to Ordinance No. 05-07-06,
adopted July 22, 2005, which is on file and available for inspection in the office of the Village
Clerk and incorporated herein by reference.
C. New permit. The issuance of a groundwater protection permit authorizes only those activities
explicitly contemplated when the permit is issued. The Village may require the applicant to obta in a
new permit in the event the Village Administrator finds in the Village Administrator's discretion that
adverse groundwater impacts may arise, or may have arisen, on the property due to any of the
following circumstances:
(1) There has been, or will be, a change in use of the property that will increase the amount of
water pumped.
(2) Additional wells have been installed, or will be installed, on the property.
(3) Water use has expanded, or will be expanded, due to irrigation or decorative uses.
(4) The impervious surfaces of the property have been expanded or will be expanded.
(5) The runoff drainage has changed or will change on the property. Such changes may include,
but are not limited to, modifications involving retention/detention ponds, stormwater
conveyances and drainage patterns.
(6) The wastewater system has been modified or will be modified. Such modifications may
include, but are not limited to, changing from on-site wastewater systems to sewer, holding
tank, or other methods that convey wastewater off site.
(7) Natural vegetation has been removed or will be removed.
§ 167-32. Application review procedures.
A. Within 30 working days of receipt of a completed application form and fee, unless extended as
described herein or otherwise extended by the applicant, the Village Administrator shall:
(1) Determine if the requirements of this article have been met, including the following criteria:
(a) The applicant must provide proof to the satisfaction of the Village Administrator that the
drawdown at the property boundary shall not exceed one foot; in the case of a property
line which abuts a road right-of-way, the property boundary may be considered to be the
property line at the opposite side of the road right-of-way for purposes of this requirement;
and
(b) The applicant must provide proof to the satisfaction of the Village Administrator that the
drawdown at any perennial stream, wetland or lake shall not exceed 1/2 foot;
(2) Determine if more information or additional review is needed; and
(3) Notify the applicant accordingly. Notification shall be in written or electronic form, unless
otherwise waived by the applicant.
B. The Village Administrator may request comments from other agencies or units of government within
the thirty-day review period, and the review period shall be extended to allow for comments to be
received. The Village Administrator shall notify the applicant if additional comments are being
requested and shall have 10 working days from the receipt of those comments to notify the
applicant of the results of the review.
C. I f a ll of the applicable requirements of this article have been met, the Village Administrator shall
issue a g roundwater protection permit. If the requirements of this article have not been met, the
Village Administrator shall notify the applicant of the permit denial.
Logistical Memorandum

From: Dale Buser, Village Hydrologist

Proposed Oaks Development
Subject: Hydrology-Related Work Suggestions for the Coming Year
This memorandum summarizes our conversation of yesterday afternoon . As we
discussed, to ensure Village resources are well allocated, we will work together to
develop an anticipated scope of services for the Village Hydrologist position . The scope
of services will list tasks, will outline work associated with each task, will provide a labor
estimate for each task, and will provide a basic list of anticipated deliverables. This
memorandum provides information to consider for this effort.
Basic Services
From what we discussed, the following work items represent a base-level service set:
• Review and comment on ordinance-mandated groundwater studies. The
Village Hydrologist will review and comment on groundwater studies related to
development proposals within the Village. Four studies are anticipated each year,
but the actual number of studies may vary. These studies would be prepared by a
consultant chosen by the developer and will follow the requirements outl ined in
the Village's existing groundwater ordinance. The amount of labor the Village
Hydrologist expends on each study will fluctuate on account of varying project
complexity and the inherent quality of the consultant's submittal. For lack of any
other number, assume 20 hours of professional labor per submittal for an
estimated total of 80 hours per year.
• General questions. The Village Hydrologist will be available for gene ral
hydrologic, geologic, and environmental/water resource engineering questions
from time to time. For sake of estimation , assume 16 hours would be allocated to
this task per year (one hour per month plus 4 hours of meeting time).
• Annual Report. The Village Hydrologist will analyze data and prepare an annual
hydrologic report for oral presentation to the Village Board. This presentation
would be similar in subject matter to that presented by Wei Intel in 2026.
However, as we discussed yesterday, efforts will continue to make the
Proposed Oaks Development
interpretations more understandable to nonscientists and avoid unanticipated
connotations. The Village Hydrologist would cont inue to work with Wellntel staff
for data procurement. Supplemental interpretations and judgements may be
presented. Assume 20 hours for evaluating data and orally presenting updated
information at a public meeting.
From the bullets above, an estimated base-level labor commitment of 116 hours per
year results. Obviously, the labor total is heavily influenced by the amount of
development occurring within the Village during a given year.
Optional Future Services
Since meeting you last year, we have discussed a variety of topics that may be of future
interest to Village and its residents. Some of these topics supplant existing and ongoing
endeavors while others are new considerations. Some of these topics are outlined
below.
• Review and potentially modify the Village's groundwater ordinance. From
our conversations, I understand there may be questions regarding the continuing
utility of the Village 's groundwater ordinance. In the past, I have described a
concept for a two-tier ordinance that would be more adaptable to the variability
of proposed development scenarios. This two-tier approach could reduce the
cost and time needed to prepare hydrologic analysis for many, if not most,
development proposals. The basic premise is based upon the development
proposal 's site-specific water balance. In basic terms, if the site does not reduce
(or better yet increases) net infiltration/groundwater recharge within the
proposed project footprint, the detailed groundwater study could become
optional. Factors to be considered include water sources and projected demand,
wastewater management, overall site infiltration/groundwater recharge volumes,
soil/geology considerations , maintenance of planned stormwater management
features, and other, potentially offsite, actions that could improve the Village's
hydrology. The Village Hydrologist could assist with rolling out this approach.
• Consider 3D groundwater interpretations. At the present time, groundwater
elevations are examined in a two-dimensional fashion. Well depths/well
completion intervals are not considered. Since groundwater flows in a three
dimensional space, contrasting water levels from shallow wells to those from
deep wells can confound interpretations. Furthermore, shallow wells may react
Proposed Oaks Development
more rapidly to weather patterns than deep wells. Well depth/completion interval
data is commonly available, enriching the existing well inventory data set. To
minimize cost, the Village Hydrologist suggests that Village interns or temporarily
underutilized Village staff help collect such info rmation. The Village Hydro logist
can coach Village staff to achieve this goal and work with Wei Intel to post the
resultant information.
• Identify threats to existing and potential future drinking water sources. A
variety of ticking time bombs threaten groundwater quality across Wisconsin's
landscape. Examples include forgotten municipal and private dumps, indust rial
and/or commercial enterprises, and transportation features. The Village
Hydro logist would map such features and map areas that have the potential to
have groundwater quality influenced by t he presence of such featu res. The
Village Hydro logist would work with Village staff to map this information in a way
providing value to Village government and helping protect its citizens.
• Initiate voluntary potable water testing program for Village residents. Over
the years, homeowners have become increasingly concerned with the suitability
and healthfulness of domestic drinking water supplies. Whereas municipal and
communal water supplies must be sampled on a regular schedule, the quality of
water from private wells supplying individual residences is rarely, if ever,
evaluated. Therefore, homeowners may be unable to easily obtain information
about their own residential water supply. This initiative wou ld establish a "water
quality week" where residents can obtain information about their own drinking
water supply.
The Village would sponsor thi s initiative and could charge a tiered fee for service.
The fee would depend upon homeowner- chosen factors including the length of
the parameter list, the level of service requested (advice versus actual sample
collection), subsidies, etc. Given amalgamation of many properties, volume
discounts, and shipping cost reductions, the Village's program would likely cost
much less than private entities offering such a service to individual homeowners . I
have initiated similar programs in other rural Wisconsin communities and could
do the same for the Village.
• Actively monitor groundwater quality. The current groundwater ordinance
focusses solely upon the amount of groundwater available in the Village. The
suitability of groundwater for use as drinking water is not considered. The Village
Proposed Oaks Development
could establish a program regularly evaluating groundwater quality across the
Village using existing and newly collected information. This element ties in with
several of the optional elements described above.
