Discussion/ Action regarcling a Special Exception for an Accessory Structure located in front of the primary residence for property located at 668 Esker Ct (TKN: V10_1214006) - Todd . & Lois Zangl, Petitioners/ Zangl .Joint Rev Trust, Owner ASC Calder gave a brief introdubtion of the agenda item. Pursuant to § 170.874 of the Village Code, entitled "Placement of Detached Accessory ,Buildings on a Lot", the Plan Commission is allowed discretion in considering the placement of accessory buildings in places other than the side or rear of properties. The logic and reasoning behind making such a policy decision was that it was recognized by Staff, the Plan Commission, and the Village Board' that there were instances where it would make sense to provide flexibility to property owners thatmight not otherwise be available even through the variance process. In the situation before us tonight,Todd and Lois Zangl are acting as petitioner for the placement of a 896 sqft detached accessory structure in the front yard as defined in our Village Code. The topography on this property is the primarily limiting factor as it slopes down to the north and west. Motion by Vice Chairman Naze to direct Staff to prepare a decision document to conditionally approve the petition by Todd & Lois Zangl, for property located at 668 Esker Court (TKN: VI O 1214006), to allow a proposed accessory structure to be placed ahead of the single-family home as depicted on the site plan, subject to the following Specific Conditions of Approval: Village of Richfield 4128 Hubertus Road Plan Commission Meeting Minutes May 5, 2026 J 7:00 PM Specific Conditions of Approval: 1. The applicant receives a building permit from the Building Inspection Department and satisfies any requirements for the construction of said accessory building. 2. The applicant signs the decision document accepting these and any other conditions the Plan Commission finds prudent and necessary. General Conditions of Approval: 1. The applicant shall satisfy all comments, conditions. and concerns of the Village Administrator. Planning and Zoning Administrator. Village Engineer. Village Planner, Village Attorney and Village Building Inspector. 2. Any unpaid bills owed to the Village by the subject property owner or his or her tenants. operators or occupants. for reimbursement ofprofessionaLfees (as described above): or for personal property taxes: of for real property taxes: or for licenses. permit fees, or any other fees owed to the Village: shall be placed upon the tax.roll for the subject property if not paid within thirty (30) days of the billing by the Village. pursuant to Section 66.0627. Wisconsin Statutes. Such unpaid bills also constitute a breach ofthereguirements of this conditional approval that is subject to all remedies available to the ViUage, including possible cause for termination of this approval. Second by Trustee Schmitt. Motion carried unanimously. b, Discussion/ Action regarding a Lighting and Landscaping Plan for Richfield Service Sales LLC. for property locatedat 1810 Wolf Road (TNK: V10_0344001() and for property identified by Tax Key: Vrn _ 034400G - Richj{eld.Service Sales LLC., Petitioner Administrator Healy gave a 1:iriefintroduction ofthe agenda item. The lighting plan is a resubmittal because the previous plan did not consider the eiitite JJroperty arid only showed the light dispersion on the proposed addition. The proposed addition is greater than 25% of the gross floor area of the existing building as shown above on the(able. As a result, we need to see a Lighting Plan applied over the entireproperty, as thepetitioner has now done. The proposed additional lighting to this building are six(6} full cut-off an.dfully shielded 'Wall pack' lights. Each 'wall pack' light has a lumen Qilfput (per lamp andthere is only Ix in this instance) of 6,030 on these less than 40-watt bulbs (36:7,Watt). The total amount of lurilens for the addition equates to 36,180 leaving a balance of 163,820 "available lumens" for the 2-acre site. The existing building contains 12,050 square feet, and the proposed.addition consists of6,630 square feet. Pursuant to Section 170.1603, because the proposed building addition exceeds50% of the size of the existing structure (approximately 55%), the project does not qualify for the '.;5% reduction in required landscaping standards. As a result, the applicable landscaping requirementSmust be calculated at the full standard rate. The petitioner is proposing landscaping that exce•eds several of the minimum ordinance requirements. For shrubs, a total of twenty-seven (27) are required, while the submitted Landscape Plan identifies thirty-two (32) Spirea shrubs. For decorative trees, only three (3) are required, yet the petitioner is proposing four ( 4). Based on discussions with the petitioner's agent, the selected species include two (2) American Linden (Tilia) and two (2) Carnelian Cherry Dogwoods (Cornus mas). The proposed 1.5-inch caliper size is also consistent with Village standards. Discussion/Action regarding a Temporary Use for Len's Coffee Co. located at 3208 STH 167 (TKN: Vl0_027600E)-Leah Nagel, Petitioner Administrator Healy gave a brief introduction of the agenda item. The petitioner is applying for a Temporary Use Permit to operate her coffee trailer in the parldng lot of 3210 State Highway 167, the business address of Terrace 167. The use is classified under "Seasonal product sales" in our Mnnicipal Code and, while permitted in the B-2 Community Business District, it requires a Temporary Use permit. In early 2023, the Plan Commission decided that temporary uses intended for operation past 30 days needed Plan Commission approval. Previously, unless predicted to be particularly disruptive, temporary uses were all approved administratively. The proposed hours of operation are Monday through Friday, 7:00-12:00PM. They will not operate on the weekend from this location and will likely pull the trailer off-site for weekend sales as they indicated in their submission materials. The applicant hopes to begin operation mid-May, weather permitting; the 150-day permit would then expire mid-October. Motion Trustee Schmitt to direct Staff to prepare a decision documentto conditionally approve the petition by Len's Coffee Co. to temporarily allow a coffee trailer operation for a maximum of 150 days, as presented, proposed to be located at 3210 State Highway {TKN: Vl0 027600E), subject to the • following Specific Conditions of Approval: l. Discussion and possible recommendation to the Village Board on the petition for an "Rural Accessory Building Designation" for property located at 1988 Scenic Road (TNK: V10_023300A)- TimBinwalter, Petitioner Village Administrator Healy introduced the topic. The applicant has been working with Staff to construct an addition (totaling 816 sq. ft.) to the accessory structnre (shed/garage)located on the northeast comer of the property. When reviewing the addition, the accessory structures on the parcel currently exceed the maximum accessory building floor area allowed, The parcel is located in the RS-2, Single-Family Residential District and is 2.99 acres in size. The maximllin floor area for accessory structures is one structure 192 sq. ft. or less and one structure 1,320 sq. ft or less or one structure that cannot exceed the total of both, which is 1,512, sq. ft. ADJOURNMENT: Motion by Vice Chairman Naze, seconded by Commissioner Wittig, to adjourn the Plan Commission meeting at 7:42 PM; Motion carried unanimously. Respectfully submitted, Jim Healy Village Administrator SUBJECT: DATE SUBMITTED: SUBMITTED BY: VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICAT ION FORNI MEETING DATE: June 4, 2026 Accessory Structure - Special Exception located at 4350 Hube1tus Rd (Tax Key: V 10_0440001) - Bee & Youa Hang, Petitioners/Owner May 27, 2026 Brad Calder, Administrative Services Coordinator POLICY QUESTIONS: DOES THE PLAN COM1\lflSSlON WISH TO APPROVE THE SPECIAL EXCEPTION FOR THE PLACEMENT OF A PROPOSED ACCESSORY STRUCTURE IN FRONT OF A SINGLE-FAMILY HOME? ISSUE SUMMARY: Pursuant to § 170.874 of the Village Code, entitled "Placement of Detached Accessory Buildings on a Lot", the Plan Commission is allowed discretion in considering the placement of accessory buildings in places other than the side or rear of prope1ties. The logic and reasoning behind making such a policy decision was that it was recognized by Staff, the Plan Commission, and the Village Board that there were instances where it would make sense to provide flexibility to property owners that might not otherwise be available even through the variance process. In the situation before us tonight, Mr. And Mrs. Bee are acting as petitioner for the placement of a new detached accessory structure in the front yard as defined in our Village Code. In this case, per the Richfield Municipal Code's definitions most of the yard is considered the "front yard". The only pennissible area that a detached structure would be possible to be located in is outlined in green in the picture (shown below). The topography of the "rear yard" makes it virtually impossible to construct any functional accessory buildings on the lot, without receiving a Special Exception. As such, the applicants are requesting the Plan Cmmnission consider a Special Exception for their ro ert . VILLAGE OF RICHFIELD PLAN COMM ISSION COMMUNICATION FORM MEETING DA TE: June 4, 2026 SUBJECT: Accessory Structure - Special Exception located at 4350 Hubertus Rd (Tax Key: V 1O_044000 1) - Bee & Y oua Hang, Petitioners/Owner DATE SUBMITTED: May 27, 2026 SUBMITTED BY: Brad Calder, Administrative Services Coordinator The Section of the Code previously referenced states the following: 170.874 Placement of detached accessory buildings on a lot Except as may be permitted in this section, a detached accessory building must be located behind the front face (i.e., face of the building closest to the street) of the principal building (Exhibit 6-3). In the case of a corner lot, the detached accesso1y building shall meet the minimum setback requirements from all streets. Only accessory buildings for agricultural uses are permitted in front of the principal building. Pursuant to the procedures and requirements in Article 5, the Plan Commission may approve a special exception to allow an accessory building in front of the principal building. In making such decision, the Plan Commission must consider (1) the size of the subiect property, {2j the character o(the area. {3) the size of the proposed accessory building, (4) the extent to which the proposed accessory building is visible from public and private streets and other properties in the area. (5) the practical di(ficultv in placing the proposed accesso1y building in the location described in this subsection, and (6) other factors related to relevant circumstances. The subject property is zoned RS-1, Country Estate District. ( t) The size of this property is 4 acres and is located on the north side of Hubertus Road west Parkview Drive and east of Saint Gabriel Way. The north side of the property abuts the Parkview Estates Subdivision. (7) In terms of the character of the area, the subject property is a mix of woods and lawn in the first half of the propert y. The rear half of the property is completely wooded. The property to the west a 5 acres parcels is undeveloped and completely wooded. The property to the east is 10 acres and consists ofa single-family home and barn/shed with a pasture. The properties to the north are in the Parkvie w Estates Subdivision and are consistent with residential lots in the Village. View of the Property looking west on Hubertus Rd VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DATE: June 4, 2026 SUBJECT: Accessory Strncture - Special Exception located at 4350 Hubertus Rd (Tax Key: V10_0440001)- Bee & Youa Hang, Petitioners/Owner DATE SUBMITTED: May 27, 2026 SUBM ITTED BY: Brad Calder, Administrative Services Coordinator W Given the size of the prope1iy, the petitioner is allowed to build a 1,742 sqft. garage. The proposed garage is 30'x55' for a total of 1,650 sqft. within the limit of what is legally pe1missible and is under the standard by 98 sqft. (4) In tenns of visibility from the roadways and residences, I've included photos of the property, from the road (Hubertus Road). The proposed location is to the west of the home. lt will be visible from Hubertus Road, but it is an obstrncted view as Hubertus Road is lined with Blue Spruce. The structure should not be visible to any of the neighbors as there is sufficient vegetation and distance should obscure it from view. The proposed location exceeds all the required setbacks. See the proposed site in the Application materials. The proposed building is to have a gray metal exterior siding with a stone/masonry wainscoting and metal roof. The exterior materials are not an exact match to the single-family home on the property but due to the property being in the Rs-1 District and the district being agricultural, the requirement for like materials does not apply. Staff believe the proposed exterior materials for the garage will satisfy the exterior materials requirement and are the same materials used on other detached access01y structures that have received special exceptions from the Plan Commission in the Rs-1 District. Exterior (5) There is "practical difficulty" in placing the garage elsewhere that would confom1 with the Village Code. This "practical difficulty" in placing it behind the home is that there is no practical location to place the proposed garage without significant site work to create a building pad and access due to the topography. (6) In the opinion of Staff, these types of reasons are exactly why the Plan Commission and Village Board chose to adopt this provision in the Code. This petition would not be successful in receiving a variance. ISSUE SUMMARY: The Basse Family has approached the Village regarding a proposed modification within the existing "Primary Activity Area" associated with the Conditional Use Permit (CUP) for Basse's Taste of Country. Specifically, the petitioner is requesting authorization to replace an existing play structure/activity on a one-for-one basis with another play structure/activity. The proposal would involve the removal of the existing "Bull Riders" area and replacement with a new activity area featuring child-oriented "heavy equipment" themed play features. VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DATE: June 4, 2026 SUBJECT: Basse's Taste of Country located at 3190 CTH Q (TKN: V10_139200B) - Primary Activity Area, Site Plan Amendment - Basse Trust., Petitioner DATE SUBMITTED: May 29, 2026 SUBMITTED BY: Jim Healy, Village Administrator The existing "Bull Riders Arena" currently consists of stationa1y playground-style riding structures located within an enclosed fenced area. These types of structures are similar in nature to the spring-mounted playground riders commonly found in municipal parks and playgrounds, where children rock back and forth while seated on the equipment. The existing activity area is situated on a pervious playground gravel surface and is enclosed within an approximately 35-foot by 50-foot fenced footprint, based upon GIS measurements. The petitioner is not proposing an expansion of the existing footprint, but rather a replacement and modernization of the existing activity within the same general area and dimensions. As part of their application materials, the petitioner discusses the relationship between agriculture and the use of heavy machinery themed play equipment. The applicant also cites several secondary reference materials, including portions of Wisconsin State Statutes, for the Plan Commission's consideration. Staff believed it more appropriate for the Plan Commission to determine whether the proposed activity is consistent with the "spirit and intent" of the existing CUP and whether the proposed use is 'compatible' with the activities previously authorized on the property. Accordingly, Staff administratively denied the request due to the potential ambiguity associated with interpreting the scope of permitted activities under the CUP since the connection was not readily apparent and was submitted without the narrative the Plan Commission has received for tonight's meeting. Pursuant to the procedures outlined within the Conditional Use Permit, the petitioner subsequently appealed the administrative determination to the Plan Commission for consideration and direction. The existing Conditional Use Permit for Basse's Taste of Country was approved and executed in 2014. Within the CUP documentation, the "Primary Activity Area" contemplates that a variety of outdoor activities, buildings, and structures may occur within the designated area. More specifically, Section Subsection (A)(d) references numerous existing activities occurring within the Primary Activity Area and appears intentionally non-exhaustive in nature. The CUP further provides the Village's Planning and Zoning Administrator with limited authority to administratively review and approve additional activities that are determined to be 'compatible' with the approved operations and 'consistent' with the overall 'intent' of the CUP. Specifically, Page 3, Subsection (A)( 4) entitled "Site Plan, Building, and Operational Plan (SBOP)" states as follows: "If the petitioner would like to add a new activity to the plan of operations, the Zoning Administrator is authorized to review such petition and approve the same in writing if he or she determines that the activity is in keeping with the spirit and intent of this Conditional Use Permit approval and is compatible with the approved activities listed in the Plan of Operation." Over the years, the Plan Commission has generally provided Staff with policy direction indicating that agricultural-themed play activities located within the Primary Activity Area were viewed as relatively innocuous in nature and generally consistent with the overall agritourism character of the property. Staff has historically used examples such as changing one seasonal themed play activity to another - for example, replacing footballs painted like corncobs with basketballs painted like pumpkins - as illustrations of the type of minor operational modifications contemplated under the CUP's administrative approval provisions. Attached for reference are the August 4, 2022 Plan Commission meeting minutes relating to the last petitioned operational improvement request submitted by the Basse Family. Staff further notes that the current proposal differs from prior requests in that the petitioner is proposing to remove an existing activity in favor of a replacement activity, rather than cumulatively adding additional activities or expanding the overall intensity of the site. Staff believes this distinction may help address concerns previously expressed by the Plan Commission regarding incremental site intensification and stormwater impacts. Additionally, because both the existing and proposed activity areas utilize pervious playground-style gravel surfaces and no significant expansion of impervious area is proposed, Staff believes the requested modification would likely have little-to-no measurable stormwater impact on the property. VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DA TE: June 4, 2026 SUBJECT: Basse's Taste of Country located at 3190 CTH Q (TKN: Vl0_139200B) - Primary Activity Area, Site Plan Amendment - Basse Trust., Petitioner DATE SUBMITTED: May 29, 2026 SUBMITTED BY: Jim Healy, Village Administrator Ultimately, the question before the Plan Commission is not necessarily whether the proposed activity is agricultural in the strictest interpretation of the te1m, but rather whether the proposed replacement activity remains sufficiently consistent with the spirit, intent, and character of the previously approved agritourism operations authorized under the existing Conditiona l Use Pennit. FUTURE IMPACT AND ANALYSIS: Forward to Village Board: No. Additional Approvals Needed: No. Signatures Required: No. Another aspect of their petition which will not be discussed tonight, but is part of their submittal and needs to go to the Architectural Review Board is the enclosing of their lean-to that currently exists on their property. Since this building will have an ' occupancy ', it will need to go through that process before being considered by the Plan Conuniss ion in July. The Village Staff makes no comment at this time on that aspect of their petition. ~ti VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DA TE: June 4, 2026 SUBJECT: Basse's Taste of Country located at 3190 CTH Q (TKN: VIO_l39200B) - Primary Activity Area, Site Plan Amendment -Basse Trust., Petitioner DATE SUBMITTED: May 29, 2026 SUBMITTED BY: Jim Healy, Village Administrator ATTACHMENTS I. Wisconsin law defines "farm equipment" broadly as "a tractor or other machinery used in the business of farming," which recognizes that modern farm operations use a variety of machinery beyond traditional tractors and implements. https:/ /docs . legis.wisconsin .qov/1999/statutes/statutes/100/4 7 /1 Major agricultural equipment manufacturers and dealers also recognize excavators as farm and ranch equipment. Caterpillar's agriculture equipment page identifies "multi-purpose agricultu ral machines" for farms and ranches and specifically includes the "Cat mini excavato r." Milton CAT likewise states that "excavators and dozers can also be seen on farms," performing jobs that need to be done, planned or unplanned. Milton CAT's agriculture equipment materials also list "Ag Excavators" as equipment "built for the farm." https://www .cat.com/en US/by-industry/agriculture.html On farms, excavators and compact excavators are commonly used for land management tasks such as drainage work, culvert work, ditch maintenance, grading, pond work, stump/tree removal, fencing, field-road maintenance, and other farm infrastructure needs. Because excavators are recognized as machinery used in modern farming, a small excavator activity is reasonably related to agricultural education, hands-on farm play, and agritourism. For these reasons, the proposed mini excavator attraction should be treated as a farm/agritourism-compatible activity. Please also see attached picture for visual of the mini excavator dig zone. We intend to copy the exact layout and safety fencing seen in the picture. Lean- to Offices: Please see the blue box on the site plan for lean-to-office location. This will be located on the north side of the main retail store. This would be using the existing footprint being used by the lean-to which is on the back side of the store. Which would be enclosing the space currently used by the lean-to. The purpose of this is to just provide the business with an actual office space, as right now, they work in a small storage space in the back of their store, which is used for other non-office related tasks and is accessible by employees. Walter buildings will build and handle this project. 7 I ' ' ' i I 1 RON."-! ll & MARSHA BASTIAN N95W228 7 '5 CTI I 0 LSBTO 14699800 I ,CURRENT DETAILED SITE PLAN /easse's Taste of Country ' 3190 County Line Q, VIiiage of Richfield, WI ______ _ _ • 1 • 11111 1 1 i ll 23 SITE PLAH LEGEND 1.FlyW',gfannerZl!Jlnes 2.RollOO~COunlc l , PlejlArH 4. Discussion/Action regarding the proposed Plan of Operation for Aqua Therpups LLC, located at 3064 Helsan Drive (Tax Key: V10_000200A011) – Ms. Becky Pease, Petitioner Administrator Healy introduced the item which is an animal water therapy business which currently operates two (2) locations in southeastern Wisconsin. Aqua Therapups has employees who are licensed by the International Association of Animal Massage and Body Works (IAAMB) and the Association of Canine Water Therapy (ACTW). They are proposing to be open Monday through Friday from 9AM to 8PM and on Saturday from 8AM to 4PM. This location will have two (2) full-time employees and eight (8) part-time employees. They expect approximately 12-36 customers per day with approximately 20-50 autos per day. There will be no outside storage of any kind as well as no overnight parking at this property. As far as “Special Equipment/Facilities/Requirements” the business owner has indicated they will be constructing an indoor pool at this location for its client’s animals. Motion by Commissioner Berghammer to approve the proposed Plan of Operation for Aqua Therapups LLC, proposed to be located at 3064 Helsan Drive (Tax Key: V10_000200A011), subject the following Specific Conditions of Approval: Village of Richfield 4128 Hubertus Road, Hubertus, WI Plan Commission Meeting Minutes August 4, 2022 7:00 PM 1. The business owner receives a Fire Inspection from the RVFC. 2. All other necessary permits be pulled and approved by the Building Inspection Department, including occupancy. Seconded by Commissioner Naze; Motion passed without objection. b. Discussion/Action regarding the proposed Plan of Operation for PSC Couplings, located at 3062 Helsan Drive (Tax Key: V10_000200A001) – Mr. David W. Olson, Petitioner Administrator Healy introduced the item. For additional background, PSC Couplings has been in business for the last seven (7) years and they specialize in the design, sourcing and assembling of disc couplings. They are primarily focused in the oil and gas industries, but also dredging. Approximately 80-90% of their business is distributions to companies located in the United States and the remaining 10% i s international business. They currently have four (4) full -time employees and two (2) employees who work remotely. With this proposed expansion, it is estimated that within the next six (6) months they will hire approximately three (3) new full-time employees. PSC Couplings is proposed to be open Monday through Friday from 8AM to 4PM. They estimate the number of trucks and autos per day to be one (1) each. The subject property has two (2) loading spaces. There will be no overnight parking and no outside storage. The proposed use is consistent with the listed permitted principal uses in the M-4, Industrial Park District. Motion by Commissioner Berghammer to approve the proposed Plan of Operation for PSC Couplings, proposed to be located at 3062 Helsan Drive (Tax Key: V10_000200A011), subject the following Specific Conditions of Approval: 1. The business owner receives a Fire Inspection from the RVFC. 2. All other necessary permits be pulled and approved by the Building Inspection Department, including occupancy. Seconded by Commissioner Naze; Motion passed without objection. c. Discussion/Action regarding the proposed Site Plan Review for the resurfacing of the parking lot of St. Augustine School, located at 4908 Monches Road (Tax Key: V10_122100B) – Saint Augustine School Inc., Petitioner Administrator Healy introduced the item. The proposal, put together by Payne & Dolan, is to resurface the parking lot with conrete with the limits of the parking lot going up to the northern property boundary line and interior to the lot adding an additional row of parking. After consultation with the Village Attorney, it was his recommendation that the limits of the portion of the parking lot which extend north -south could extend to the northern most boundary of the parcel and continue to exist because it is a non-conforming use which they have a right to. Ordinarily, the setback of a parking lot to an adjacent use which does not have the same zoning requires a 50’ setback purusant to Section 70.185(A) (2) which is the Section of Code which was in place when they submitted their proposal. After speaking with Mr. Loosen, who owns the property directly north, he is amenable to the proposal. The southern access to the parking lot, which is adjacent to Melody Lane, will be maintained to enter the parking lot area. A new culvert will be installed as a part of the process. On the interior of the property, an additional row of parking will be added to make- up for the lost parking now occupied by Mr. Loosen’s private property. Village of Richfield 4128 Hubertus Road, Hubertus, WI Plan Commission Meeting Minutes August 4, 2022 7:00 PM This will net St. Augustine School an additional seven (7) spaces. There is no percentage of lot coverage standard for impervious surface in this District, only building coverage. On July 22, 2022, the Village Engineer provided a letter of review for the proposal. He had three (3) comments, one (1) of them of substance for the discussion. The existing parking lot infringes on the Village’s right-of-way, as does flared asphalt that has been historically utilized for bus and pick -up/drop-off. The area of the Village’s right-of- way is shown with the dotted line below in the exhibit. The earliest aerial photography the County has available which shows this parking lot infringement is from 1980. Given that this has existed in this manner for approximately 42 years, without impediment to the Village’s Public Works Operations, Village Staff is recommending that the Plan Commission recommend to the Village Board that a formal legal instrument be filed at the County Register of Deeds which grants permission for the concrete parking lot and other concrete improvements to exist in the Village’s right-of- way, but also gives the Village permission to enter upon the land should it need to for future road maintenance and road improvement. Motion by Trustee Wolff to accept the recommendation of the Village Engineer for the approval of the proposed concrete resurfacing of the parking lot for St. Augustine School, for property located at 4908 Monches Road (Tax Key: V10_122100B) subject to the following Specific Conditions of Approval: 1. Comments in the Village Engineer’s letter dated July 22, 2022 be corrected to the satisfaction of the Village Engineer. 2. The Village Board approve the proposed legal instrument prepared by Village Staff and the Village Attorney for the proposed right-of-way infringement. Seconded by Commissioner Naze; Motion passed without objection. d. Discussion/Action regarding the proposed construction of a single-family home on property located at 1450 St. Augustine Road (Tax Key: V10_065800A) – Kevan G. Leaf Rev. Trust, Julie A Leaf Rev. Trust, Petitioners Administrator Healy introduced the item. the controlling language in this review is found in Section 70.209 in the Upland Conservancy District. The property (shown above) is entirely zoned UC, Upland Conservancy. The previously constructed buildings on this property are proposed to be torn -down for the construction of a new single -family home and detached garage. Pursuant to Section 70.209(J), “ to encourage uses that are compatible with the resi dential character in the Village in the UC District, building/zoning permits for permitted uses in the UC Conservancy District shall not be issued without prior review by and approval of the Plan Commission. Such review and approval shall be concerned with adjacent uses, general layout, building site and operation plans, building materials, ingreess and egress, parking, loading and unloading, drainage, and screening and landscape plans.” The subject property is 18.4376-acres according to the survey prepared by James Beaty, RLS dated May 3, 2022. In terms of compability with adjacent uses, the parcel is entirely surrounded by single-family homes. Additionally, since there was previously a single-family home on this property which likley pre-dated our Code, Village Staff sees this proposed permitted use to be non-objectionable and consistent with the Code’s intent to have “uses that are compatible with the residential character”. In terms of the layout, the proposed home is proposed to be constructed by Stortz Custom Homes LLC, a local Richfield-based business located at 1717 Wolf Road. The home is proposed to be 4,876sqft and 6,289sqft if you account for the unfinished Village of Richfield 4128 Hubertus Road, Hubertus, WI Plan Commission Meeting Minutes August 4, 2022 7:00 PM basement. The proposed home was reviewed by the Village’s Building Inspection Department an d meets the development standards for the District. Motion by Trustee Wolff to approve the proposed single-family home to be located at 1450 St. Augustine Road (Tax Key: V10_065800A) subject to the following Specific Conditions of Approval: 1. That the petitioners receive all other necessary approvals from the Village of Richfield Building Inspection Department and Washington County. Seconded by Commissioner Berghammer; Motion passed without objection. e. Discussion/Action regarding a proposed Site Plan Review for the construction of a KYBO (shower/bathroom facility) for YMCA Camp Minikani located at 875 Amy Belle Lake Road (Tax Key: V10_0902) – YMCA of Metropolitan Milwaukee, Petitioner Administrator Healy introduced the item. The proposed KYBO building will separate the shower and restroom areas with separate entrances to either side by a standing seam polycarbonate roof panel system over a stamped concrete entryway. The perimeter of the building is proposed to be crushed granite to assist with drainage. The structure is proposed to have a combination of board and batten cement siding (presumably LP Smartside or James Hardieplank) and T&G-stained cedar siding on its exterior. The roof is proposed to be a steel standing seam metal roof with plywood roof sheathing, which is also permissible. On the north and south elevation of the structure, there are two (2) wood clad windows with frosted acrylic panel glazing to allow for natural light and privacy. There is proposed to be 10 transom windows with laminated clear glass and screens along the east and west exterior elevations. There is proposed to be a rainwater cistern that will have water routed from roof fascia, flashing, and continuous gutter along the perimeter of the shower structure to incorporate sustainability practices core to the Camp’s mission. In terms of building programming, there is proposed to be one (1) entrance to the girls’ showers and one (1) entrance to the boys’ showers each consisting of six (6) 3’x3’ standard shower stalls, one (1) 5’x5’ ADA shower stall, and one (1) stone countertop with inlaid sinks with a full-length mirror. Extending from each shower stall, is proposed to be a changing area with lockable privacy partition doors that will have a small shelf and hooks for personal belongings. The shower stalls will be separated on either side by 6” wide glazed brick up to 8’ in height. At the Architectural Review Board on July 20, 2022, the Architectural Review Board approved to proposed building design without objection. In terms of height, the building is less than 35’ tall which is the maximum height allowable in the P-1, Parks and Recreation District pursuant to Section 70.207(F)(1). Also, the sum total of the floor area of all buildings shall not exceed 10% of the total par k area [Sec. 70.207(F)(2)]. At 114 -acres, the maximum allowable coverage for buildings would be a total of 496,584sqft which this property does not even reasonably come close to. The setbacks for all buildings in the P -1 District is 40’ from any property boundary line, which this proposal is also well in excess of. Please refer to the prepared Site Plan by Rink+ for the location of “Explorer’s Hill” which is generally located in the northeastern part of the property. Village of Richfield 4128 Hubertus Road, Hubertus, WI Plan Commission Meeting Minutes August 4, 2022 7:00 PM “Recreational and Educational Camps” like the YMCA Camp Minikani are listed as a Permitted Principal Use pursuant to Section 70.207(B)(5). Motion by Commissioner Berghammer to accept the recommendation of the Architectural Review Board for the approval of the proposed KYBO for YMCA Camp Minikani located at 875 Amy Belle Lake Road (Tax Key: V10_0902), as presented; Seconded by Commissioner Cote; Motion passed without objection. Motion by Trustee Wolff to accept the recommendation of the Village Engineer in his letter dated July 27, 2022 for the approval of the Site, Grading and Erosion Control Plans for the proposed KYBO for YMCA Camp Minikani located at 875 Amy Belle Lake Road (Tax Key: V10_0902), as p resented; Seconded by Commissioner Naze; Motion passed without objection. f. Discussion/Action regarding a proposed Site Plan modification for Basse’s Taste of Country located at 3190 CTH Q (Tax Key: V10_139200B) – Basse Trust, Petitioner Village Administrator Healy introduced the item. Administrator Healy discussed the current compliance with the previously approved Conditional Use Permit. While there are some instances of non -conformity, it was the opinion of Staff that their business ope rations are substantially compliant. The Basse family is proposing to add an additional amenity to their property which is in the keeping and spirit of their previously adopted Conditional Use Permit. It is essentially a piano keyboard that allows people t o step on it and mechanical cows “sing” the notes. Village Staff did not want to administratively approve the proposed additional given the on-going discussion with the Basse’s and the Plan Commission over the last few years, so it was asked of the Plan Commission to determine whether they believed this was unobjectionable. Respectfully Submitted, Jim Healy Village Administrator VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DATE: August 4, 2022 SUBJECT: DATE SUBMITTED: SUBMITTED BY: Site Plan Addition for Basse’s Taste of Country located at 3190 CTH Q (Tax Key: V10_139200B), Basse Trust, Petitioner July 25, 2022 Jim Healy, Village Administrator POLICY QUESTIONS: DOES THE PLAN COMMISSION WISH TO APPROVE THE PROPOSED SITE PLAN MODIFICATION TO ALLOW THE “PIANO COWS” AND ASSOCIATED SHED ROOF? ISSUE SUMMARY: The purpose of the agenda item tonight is to discuss the Basse family’s desire to place a temporary structure on the property that will function like a n interactive piano with keys placed on the ground that individuals can step on which produce various sounds coming through the mouths of the animatronic cows that are the colors of “black” and “white” to mimmick the keys on a traditional 88 -key piano . This proposed modification is consistent with the types of items I have administratively approved, with the permission of the Plan Commission in previous years, but given some of the sensitivities we’ve seen in recent years I wanted to bring this matter before the Plan Commission so that this Body could make the decision whether it was believed to be an appropriate addition to the property. I would add that while this fixture is proposed to be brought in on a skid steer and can easily be moved on/off the property, it will be housed under a shed roof to protect the electrical components and be structurally affixed to the ground for safety reasons. It is proposed to be located between “Tractor Tire Mountain” (#20 on detailed site plan legend) and “Farmer Skee Ball” (#22 on detailed site plan legend). In anticipation of this agenda item, on Monday, June 13th I visited the Basse’s Taste of Country property on CTH Q for the stated purpose of conducting what I am referring to as an “audit” of their existing Conditional Use Permit to determine how closely they are or are not following what was approved by the Plan Commission and Village Board several years ago. Present at the meeting were the Basse family and their Attorney Brian Randall. For approximately two (2) hours, we walked the property and went word-for-word through their Conditional Use Permit. In summary, based on my review and findings, I believe that the Basse’s Taste of Country property is substantially compliant with the terms of their Conditional Use Permit. To assist with our future site visit, the Basse’s commissioned Trio, a civil engineering firm based in Brookfield, to create a “Current Overall Site Plan” and a “Current Detailed Site Plan”. Those are attached herein for your convenience. Each amenity, less light poles, landscaping berms, trees, etc. are specifically noted by name in the “Site Plan Legend” which has a corresponding number on the face of the plan. For the purposes of this Memo, it was the request of the Plan Commission Chairman that we inventory the uses on the property and whether they follow the Conditional Use Permit. Five (5) vehicles exist on the property which by definition are “junk” but they are for decoration. In the end, the Basse family has been a good partner with the Village as we worked through the Zoning Code Recodification and in the opinion of Staff, what they are requesting is the type of amenity that the Plan Commission and Village Board have found unobjectionable in years past . As Staff has said before , whether a football is painted like a corncob or a basketball is painted like a basketball, for these types of interchangeable games/activities, the Plan Commission has historically given wide latitude to Village Staff to allowing them. However, being that we are in the beginnin g stages of potentially a new permitting paradigm with this business, I wanted to defer to the Plan Commission on whether t hese are the types of things this Body wanted to start seeing again or not. The actual dimensions of the shed roof that this electronic entertainment device will fit under is not noted, but one could estimate it to be approximately 20’ wide and an indeterminable width and height. Village Staff will reach out to the Basse family to ask them for appropriate dimensions prior to the Plan Commission meeting on Thursday, August 4th. It should be noted that the Village still aims to have a site visit to the Basse property with both the Plan Commission and Village Board in the coming months prior to their busy season in the fall. ISSUE SUMMARY: In the Village's Charter Ordinance, Section 7-15(0), it states that the Plan Commission shall annually elect a Vice-Chair during the month of June. A Vice-Chair is sometimes chosen to assist the Chairman and can potentially serve as "Acting Chair" in the absence of the Chairman or when a motion involving the Chairman is being discussed. The Vice-Chair should be prepared at a moment's notice to assume the duties of Chairman and may be asked to attend special meetings should the Chairman not be able to attend. VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DATE: June 4, 2026 SUBJECT: Chapter 170- Continuous Improvement Efforts DATE SUBMITTED: May 29, 2026 SUBMITTED BY: Jim Healy, Village Administrator POllCY QUESTlONS: DOES THE PLAN COMMISSION WISH TO DlRECT STAFF TO RESEARCH ANY OF THE FOLLOWING TOPICS (OR OTHERS) AS A PART OF OUR ZONING CODE'S CONTINUOUS IMPROVEMENT PROCESS? ISSUE SUMMARY: The Village's Zoning Code was comprehensively reviewed and updated as part of the Village's 2022 Recodification process, which was undertaken to modernize the Code, improve organization and consistency, eliminate outdated references, and incorporate amendments that had occurred over time. Since adoption of the recodified Code, staff, applicants, property owners, and appointed bodies have continued to work through implementation of the updated regulations. As is common following a major recodification effort, several areas have been identified where additional clarification, policy direction, or refinement may be beneficial based upon practical application, evolving development trends, and interpretation of the ordinance language. The following items are presented for discussion and potential future consideration by the Plan Commission. One area identified for clarification involves the use and administration of financial guarantees. While the Code references financial guarantees in several locations, staff believes it would be beneficial to establish a clear and consistent definition specifying that a financial gu.arantee may consist of either a letter of credit or the required sum of cash held by the Village. Providing a formal definition would assist applicants, staff, and legal counsel by ensuring consistent interpretation and administration of guarantees associated with development projects, site restoration, landscaping, infrastructure improvements, or other conditions of approval requiring financial security. As a matter of policy, we do not like 'bonds' which is another form of a financial guarantee. Staff has also identified inconsistencies related to kennels within the Zoning Code. Specifically, Chapter 118-1 allows kennels within the Agricultural District; however, the Zoning Matrix and associated sections within Chapter 170A, including Sections 170A-2(8.02), 170A-2(17 .15), and 170A-2(17.16), do not consistently reflect that allowance. Clarification and cleanup of these provisions would improve consistency between the text of the ordinance and the zoning matrix, reduce potential confusion for applicants and staff, and ensure that permitted and conditional uses are accurately reflected throughout the Code. Several discussion items relate to accessory structures and how those structures are regulated throughout the Village. In recent years, the Village has processed five special exception requests related to accessory structures, three of which were located within platted subdivisions. This raises a broader policy question as to whether the Plan Commission wishes to continue reviewing all special exceptions associated with accessory structures or whether certain circumstances should be handled administratively. In addition, the current Code limits accessory structure height to 20 feet in most zoning districts. Staff discussion has centered not necessarily on increasing overall massing, but rather on allowing greater flexibility for steeper roof pitches so accessory structures can better match the architectural character and roof pitch of newer homes. One possible approach could include allowing additional overall height while simultaneously limiting wall height to maintain compatibility with surrounding properties. VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DATE: June 4, 2026 SUBJECT: Chapter 170- Continuous Improvement Efforts DATE SUBMITTED: May 29, 2026 SUBMITTED BY: Jim Healy, Village Administrator In conjunction with accessory structure discussions, staff believes the overall method used to measure building height throughout the Zoning Code should be reviewed. As residential architecture continues to evolve, particularly with varying roof designs, grade changes, and larger structures, the current measurement methodology may warrant refinement to ensure it is clear, consistent, and practical to administer. Similarly, the Code currently limits garage door height on primary residences to 10 feet. In situations where applicants are seeldng larger detached accessory structures or where suitable placement on a parcel is limited, staff often recommends considering additions to attached garages as an alternative. Should the Village consider allowing taller garage doors on principal structures, staffs preliminary recommendation would be that any oversized garage doors be limited to the rear-facing side of the residence to minimize visual impacts from the street. Additional cleanup items have also been identified throughout the Code. Staff recommends eliminating references to "front yard" where appropriate because the Zoning Code does not currently contain a definition for that term. Instead, references should be revised to "street yard," which is a defined and consistently applied zoning term within the ordinance. Staff has also identified potential updates to Section 170A-2(17.06) relating to boathouses, specifically tl1e requirement that boathouses contain a garage-type door facing the water body and prohibiting French, patio, or glass doors. Current trends in waterfront development indicate that boathouses are increasingly being utilized as multi-purpose recreational spaces that continue to store watercraft and related equipment but also include seating areas, small bars, gathering spaces, and roll-up style openings designed to enhance !alee enjoyment. The Plan Commission may wish to discuss whether the current standards continue to reflect the intended character and use of such structures. Another topic identified for potential discussion involves the Village's landscaping requirements and whether additional discretion or flexibility should be incorporated into the Code to allow the Plan Commission to consider alternative landscaping proposals on a case-by-case basis. As part of the 2022 recodification effort, the Village strengthened its landscaping provisions by incorporating financial guarantee requirements intended to help ensure that required landscaping improvements are installed and survive beyond initial planting. The ordinance currently allows landscaping installations to occur over two planting seasons in recognition of Wisconsin's climate and practical planting limitations. While the Village's landscaping standards were designed to promote long-term quality development, buffering, screening, and community aesthetics, staff believes it may be appropriate to review whether the required quantities, spacing, and minimum sizes of trees and shrubs remain practical and consistent with current industry standards and development trends. Also, is it unnecessarily complex? In addition, comparison with landscaping standards utilized by surrounding communities may provide useful context in evaluating whether the Village's current requirements continue to strike the appropriate balance between aesthetics, functionality, enforceability, and long-term success of plant materials. One final area of discussion is driveways. Staff often receive calls about the potential for a property owner to have a second driveway. Staff often find Section l 70.1704(B) of the Zoning Code difficult to interpret. Staff would like to reword the section and potentially create a graphic to provide clarity while keeping the intent of the section. If there are any other areas of the Zoning Code that the Plan Commission would like to explore, we are happy to do so. We just need the feedback, so we wanted to create the space for discussion in a public forum.
