CONDITIONAL USE PERMIT REQUEST
First floor apartment in rear of commercial building
Property Address: 7 Marion Street
Parcel Number: 0806-093-5631-8
§415-21 C
B-1 Commercial Conditional Uses
“The following are permitted as conditional uses in the B-1 District, provided that no nuisance shall be
afforded to the public through noise, the discharge of exhaust gases from motor-driven equipment,
unpleasant odors, smoke, steam, harmful vapors, obnoxious materials, unsightly conditions, obstruction
of passage on the public street or sidewalk, or other conditions generally regarded as nuisances, and
provided that where operations which are necessary or incident to the proper performance of these
services or occupations would tend to afford such nuisances, areas, facilities, barriers, or other devices
shall be provided in such a manner that the public is effectively protected from any and all such
nuisances. These uses shall be subject to the consideration of the Plan Commission and Village Board
with regard to such matters.
(11) First-floor residential apartments in a building's rear with a reasonable amount of floor area left for
store space in front.
Background and Permit History
The tenant at 7 Marion Street has occupied the first-floor apartment since 2019, when the property was
under prior ownership. At that time, the previous owner received a Conditional Use Permit (CUP)
allowing a residential apartment on the first floor at the rear of the commercial building.
The property was sold in 2021. Because Conditional Use Permits do not transfer to subsequent owners,
the current owner, Thomas Wangard, is requesting a new CUP to allow continued occupancy of the
existing first-floor apartment.
Site Layout and Proposed Use
The first-floor apartment is located at the rear of the commercial building and is separate from both the
storefront and the second-floor apartment space. It has its own means of ingress and egress, and the
proposed use would continue the existing residential occupancy without changing the building’s general
arrangement.
• The residential use has existed at the property since pre-2016.
• The requested CUP would allow the current owner to continue the established first-floor
residential use.
• Access to the apartment will maintain a separate ingress and egress from the storefront
through an entrance on Marion Street.
Recommendation
Staff recommend the approval of the Conditional Use Permit request for 7 Marion Street to allow
continued use of the existing first-floor apartment at the rear of the commercial building, subject to
compliance with all applicable Village ordinances and any conditions established by the Plan
Commission and Village Board.
The Plan Commission shall consider the following conditions regarding the issuance of the CUP:
1. Property maintenance
a. Complaints have previously been issued for violations of Section 355-8 Garbage
accumulation; declaration of nuisance (2021).
b. See pictures for current conditions of the property.
2. Parking issues on Marion Street
a. Marion is a narrow street. There are often more cars parked on the street than properties
creating a challenge for snow removal.
b. A suggestion to limit a maximum of 2 cars for the residence could be implemented.

housing, such as blight, and any additional factors that
come to light during the assessment phase. Consultant
