Comprehensive Plan Guidance: The Future Land Use Map category for this parcel is Rural Residential 2-4 acres. The parcel is currently zoned RR-16 and a rezone to RR-8 is consistent with the plan. Current and Proposed Zoning: The current zoning of the parcel is RM-16. The proposed zoning would be RM-8 for both proposed lots. Extra-territorial Review: The applicant submitted an application for a CSM to the City of Verona which was approved with the addition of more Right of Way. Due to the modification of the CSM originally approved by the Town of Verona, the Town must approve the change to the ROW dedication. Surrounding Land Use and Zoning: The parcel is located adjacent to the City of Verona to the north. Specifically, land to the north is a City of Verona Veridian Development currently under construction. The large parcel to the west is an AT-35 parcel. To the east is an RM-16 parcel and to the south are two RR-4 parcels. Site Features: The southern portion of the existing parcel is heavily wooded and the majority of the woods would be located on proposed Lot 2 with no anticipated change. Driveway Access: The current driveway that serves the existing residence will be remain unchanged for access to Lot 2. Lot 1 will be granted access by changing an existing field access to a residential driveway. The Plan Commission discussed the application at their March 18 th 2026 meeting and recommended approval of the application subject to the following condition: • Approval of the Joint City/Town Planning Committee, if required The Town Board discussed the application at their April 8 th 2026 meeting and approved the application with the following condition: • Approval of the Joint City/Town Planning Committee, if required _____________________________________________________________________ On April 29th, the Joint City/Town Planning Committee denied the application. The applicant resubmitted the application to the City of Verona after the Boundary Agreement between the Town of Verona and the City expired at the end of June 2026. The City of Verona Common Council approved the CSM with additional ROW on August 10 th 2026. The Town Board needs to approve the updated CSM. Additionally, the initial rezone request from RM-16 to RR-8 was made in error. The applicant is seeking to retain the zoning classification of RM but for the appropriate acreage size – RM 8. TOWN OF VERONA TO: Town Board of Supervisors DATE: October 2, 2026 FROIVI: W. Christopher Barnes, Public Works Director SUBJECT: 2026-27 Contract Snow and Ice Removal Contracts Beginning in 2018, the town Public Works Department began plowing certain private development roads under contract. The snow and ice removal of condominium subdivision roads was approved by the town Board on 1/2/2018 (attached). The specific condominium subdivisions/roads include Woods at Watch Hill, Deer Haven, and Fox Hills private Homeowners Associations (HOAs). For the 2025/26 winter season, the 3 private HOA's were billed and paid the town $15,675 for the service. To date, town staff have not experienced any difficulties or problems in plowing the private roads. Snow and ice removal consists of plowing accumulated snow greater than 2" as part of the standard snowplow routes. Sand and salt materials are applied as needed in accordance with standard practice and "Salt Wise" guidelines. The cost for snowplowing is based upon the annual equipment rental rates established by the Wisconsin Department of Transportation, standard Town labor rates, and annual salt contract cost per ton. For 2026/27 the hourly rate is $300.00 with a 1-hour minimum charge. Each of the three HOA's has communicated their agreement with the hourly rate and has requested the town continue to provide the service. It is recommended the Board approve the 2026/27 hourly rate with the existing HOA's for 2025/26. Robert Proctor noted that the developer could have established the easement after approvals without notifying te Town. He also noted that many municipalities require such easements. Amanda Arnold took over the coordination of the presentation. • Presentation - Justin Temple gave an oven/iew of the project. He was asked to include road easements to adjacent properties to the north and south on the two out lots as the previous project had and he agreed to. • Public comment - None. Amanda pointed out a late arriving letter from a neighbor that she had printed and provided for the Board. • Motion by Duerst to approve the rezoning of lot of Parcel no. 062/0608-961-8295-0 (Lot 2 of CSM 14442), from A3 to R4 conditional upon the review by the Town Attorney and signing by the Town Chair of the Developer Agreement. Discussion and possible action re: plowing for contract in condominium subdivisions - Amanda explained that she had gathered a few more prices from private contractors and discussed the concept with the Public Works Committee, but they had some concerns. Manfred Enburg explained that he feels the Town has enough to do without taking on this extra responsibility. Mark Geller said he's fine with doing It if the Town doesn't compete with local contractors. He suggested charging double the going rate. Maxwell made a motion to approve the plowing of private roads at no cost (because they are already paying taxes). There was no second so the motion failed. Tom Mathies reminded the Board that governments are not supposed to make a profit off of providing services. Mike Duerst made a motion to plow private roads in condominiums and charge 1 .5 times the average of three quotes from private contractors, Second by Maxwell. Manfred Enburg reported on his concept of breaking the public works road budget up into three categories: one fund for large capital project, another for chip sealing and small repairs, and a third for repairs that Mark Judd would make. Jii, Mike Duerst asked for more direction on the purchase of a generator. The Board discussed whether or not the town hall would ever be used as a shelter or an emergency headquarters, and decided that was unlikely. Mark Geller reported that he had talked to the architect of the building and he said it would take a long time for the building to get cold enough for pipes to break. Amanda Arnold added that she had talked to the power company and they said most power outages are in the summer and less than a day. Required Improvements of the development agreement (attached), the public improvements up to binder course of asphalt have been inspected and found to be complete and in accordance with the project specifications. A certificate of substantial completion is attached and recommended for execution. This action will allow the town to perform winter maintenance on these new roads but will not relieve the developer of the other items required under Article II. The final course of asphalt and shoulder gravel is tentatively scheduled for installation in 2027. Execution of the substantial completion form will be one document necessary for the Wisconsin Dept. of Transportation to add the Sugar River Vista network of roads to the approved certified town road mileage. Section 1.02 Standards and Codes. Whenever references are made in this Agreement to standards or ordinances under which the Development is to be performed/ the latest revision of the Town's Ordinances shall apply unless otherwise expressly stated. In case of conflict between any referenced standard or code on the one hand and any provision of this Agreement on the other hand, the more stringent requirement shall govern. All applicable laws, ordinances, statutes, rules, regulations/ or orders in effect when the relevant work under this Agreement is performed shall apply to the Developer and its contractors, employees, representatives, and subcontractors. The Developer shall procure and pay for all permits, licenses, certifications/ and other applicable governing authority requirements and inspections and shall furnish any documentation, bonds, security, or deposits required to permit any work within the Development. Notwithstanding the foregoing, the parties acknowledge that any change to the laws, ordinances/ statutes, rules, regulations/ or orders by the Town during the term of this Agreement shall affect the Town as a whole and not only this Development or the Developer. Section 1.03 Developer is an Independent Contractor. Notwithstanding any other provisions of this Agreement to the contrary, the Developer is an independent contractor/ and nothing herein shall be construed to make the Developer, its contractors/ or consultants' agents of the Town/ or the Town, its employees, agents, or consultants' agents of the Developer. However, this does not limit the Town's regulatory control over the Developer regarding the quality of the required work. Furthermore, nothing contained in this Agreement shall be construed as creating any contractual relationship with the Town's consultants (planning/ engineering/ financial/ and legal) or any persons or entities other than the Town and the Developer. ARTICLE II. REQUIRED IMPROVEMENTS Section 2.01 Public Improvements. The Developer shall complete the construction of all public improvements described in par. 2.01(a) in material compliance with all Town standards and plans and specifications (the "Plans") prepared by the Developer's engineer and approved by the Town Board and all other regulatory agencies having jurisdiction over the improvements/ all at the Developer's sole expense unless otherwise agreed herein. No work shall commence within dedicated rights-of-way or other public lands until such Plans have been approved. The following provisions govern the design and construction of the private improvements: (a) Improvements Required. The required public improvements (the "Improvements") shal! include the construction of the proposed roads as shown on the plat, including all intersection improvements, cluster mailbox parking lane/ street name and regulatory signage, culverts and culvert markers, all of which shall be dedicated to the Town upon Acceptance. The required public improvements will also include raising Sugar River Road adjacent to the new intersection with the plat. (b) Control of Fugitive Emissions. Developer shall use control practices during construction to minimize fugitive dust consistent with those used by developers on similar developments in the Town. (c) Noxious Weeds/Landscape Maintenance. Developer shall maintain grasses at a reasonable height and control noxious weeds on all private lots until they are owned by a party other than the Developer. (d) Damage to Town Roads. The Developer shall be responsible for repairing all damage to Town roads caused by the Developer's construction activities and shall clean any mud or debris from the Town roads adjacent to the Plat during the construction of the Improvements until acceptance by the Town. (e) Permits. Developer shall obtain all required governmental permits for work within the public right-of-way before the commencement of such work and shall comply with all conditions of such permits. (f) Intersection Design. Developer shall ensure that the design of the proposed intersections and cul-de-sac bulb complies with the plans approved by the Town's traffic engineer, which plans shall be developed to maximize traffic safety and maximize visibility for vehicle operators approaching the intersection from all directions. All signs shall be installed in accordance with the Wisconsin Department of Transportation Manual on Uniform Traffic Control Devices (WMUTCD). (g) The Developer shall make such Improvements to the public roads or right- of-way areas, including the installation of additional or different traffic control signage or pavement markings as determined reasonably necessary by the Town Board or Town Staff to assure traffic safety in the intersection and intersection approach areas. All traffic control signage will be installed before the first building permit is issued by the Town. (h) Utilities: The Developer shall install public utility facilities, such as gas, electrical power, telephone, and data transmission, to make adequate service available to each lot. All utility services shall be underground unless the Town Board approves overhead installations. Developer is responsible for making all arrangements with the utility companies and paying all costs associated with utility extensions. Section 2.02 Specifics for Road Construction, All roads shall be constructed to Town standards: The paved surface of all roads in the Development shall be 22-feet wide and be constructed with the following minimum pavement specifications: 10" inches of crushed aggregate base course, firmly compacted, over a firm base of appropriate composition, and 4" inches of asphalt pavement applied in two lifts consisting of 2 %" binder course and 13A" finish surface course/ and 36-inch wide shoulder on both sides of the road. Shoulder materials shall be 4 inches thick of compacted in-place three-quarter inch crushed aggregate base course approved by Town Staff, over a minimum of ten inches of compacted in-place crushed state-approved aggregate base. The shoulder elevation shall match the grade of the pavement. Until such time as the upper course of asphalt is in place/ an interim shoulder with an elevation equal to the height of the lower course of asphalt shall be installed. In areas of maximum road slope of 10%, an alternative to the typical grave! shoulder wi!l be a 24// wide paved concrete valley curb. Before the binder asphalt is applied the gravel base shall be proof rolled to determine the firmness of the base. The proof-rol!ing shall be coordinated with the Town Staff to allow for observation of the test by the Town. Section 2.03 Private Improvements. The Developer shall complete the construction of all private improvements described in par. 2.03(a) in material compliance with all Town standards and plans and specifications (the "Plans") prepared by the Developer's engineer and approved by the Town Board and all other regulatory agencies having Jurisdiction over the private improvements, all at the Developer's sole expense unless otherwise agreed by the parties. The following provisions govern the design and construction of the private improvements: (a) Improvements Required. Section 2.04 Time of Compietion of ImprQvements (a) No construction activity may commence until this Agreement has been executed, and the Developer has provided Security to the Town for the construction of the Public Improvements in the form of a fetter of credit for 115% of the estimated cost for all public Improvements within the phase being developed. Public improvements include filling and grading, the crushed aggregate base/ asphalt paving, appropriate shoulders, culverts, and restoration. Additionally, the Developer, or its contractors, shall have obtained the appropriate County and WDNR permits, delivered to the Town certificates of liability insurance covering any and al! activities related to the construction and installation of public Improvements, and obtained the Town Staffs written authorization to start work. The letter of credit shall be in effect until the later of (a) 24 months; or (b) until the Improvements have been accepted by the Town. If the letter of credit expires and a!l Improvements have not been accepted by the Town/ no building permits or occupancy permits will be issued by the Town until an appropriate letter of credit is provided to the Town for the uncompleted required Improvements. The letter of credit can be reduced periodically to cover 115% of only the remaining Public Improvement work to be completed. (b) No building permits authorizing construction on any private lots wil! be issued by the Town until the base course of asphalt on the public roads is completed and alt regulatory signage and pavement markings have been installed and inspected by the Town for the phase under construction. (c) The construction of all improvements (except for surface asphalt) and placement of all survey stakes shall be completed within 12 months from the date of initial construction start date unless an extension is approved by Town staff. The surface asphalt shall be placed no later than 12 months after the binder asphalt is placed. The developer shall have the option of delaying the installation of the final surface course of pavement for up to an additional 24 months provided that the Developer provides reasonable additional security effective for the period of the approved extension plus 90 days, provided, however, if the extended deadline expires after October 15 of any year, the Security shall remain in effect until at least June 1 of the following year. (d) Starting and Completion Dates. The Developer shall provide a schedule of construction setting forth the approximate dates of commencement and completion of construction for all Improvements. The Developer agrees that no work shall be scheduled for the Improvements, and no construction shall commence without the Town's written approval of the starting date. Any deviation from this schedule will require the approval of the Town Administrator. Section 2.05 Cluster Mailbox Units. The Developer shall install duster-box units or other centralized mail depositories within the proposed road according to the Plans and as approved by the United States Postal Service. A parking lane shal! be added and shown on the Pians to allow for the retrieval of mail without obstructing traffic flow. A letter from the U.S. Postal Service indicating that it has approved the cluster-box units or other mailboxes is required. The Town will not issue any occupancy permits until the mailboxes and parking lane are installed. Section 2.06 Hours of Construction. All work within the public right-of-way/ stormwater management features, and outdoor work on individua! homes shall be done between 7:00 am and 7:00 pm Monday through Friday and 8:00 am to 5:00 pm on Saturday. No outside work is permitted on Sunday. Christopher Barnes, Public Works Director SUBJECT: September 2026 Report The monthly Public Works Department Activity report is submitted for the information and review of the Board and the Committee. September was a very active month with continued callouts for downed trees and completion of town and related construction projects. Seasonal mowing and brush cutting continued along with pothole and asphalt wedging repairs. Numerous citizen and resident concerns and action requests were received and addressed on a daily basis. Road Maintenance Activities • Continued third round of roadside mowing. • Managed downed trees on Bobcat Lane, Spring Rose Road and Paulsen Road. • Continued brush and slope mowing with the boom mower. • Installed/reinstalled 4 signs (likely 2 were stolen) Equipment and Facility Activities • Set up for various community room events. • Continued operation of the olar with system start up. Approx 20kW of daily production. • Completed the stormwater basin clean out with Edgerton Construction. Stormwater Basin cut to grade 2 Sanitary Sewer Utility Activities • Continued working with MMSD on the interceptor sewer replacement from Goose Lake to the Fitchrona Road Pump Station #12. Bids received September 24, 2026. The low bid was submitted by Minger Construction in the amount of $12,849,043. The total Town/City share is $100,625 to be splint proportionally. Engineering Activities • Continued working with Fitchburg city staff and utility companies on the Fitchrona Road Reconstruction project. Two property owners are contesting the city’s right to acquire right of way near the proposed Lacy Road roundabout Without the right of way acquisition. Utility relocations are currently underway. A separate tree and grubbing contract is complete. Additionally, the City of Fitchburg is working to gain approval from the DNR for a non-motorized trail under the Military Ridge State Trail bridge. Subsequently, the project bid opening has been postponed until late fall and construction to begin in early 2027. • Substantial completed the public infrastuce construction on the Sugar River Vista subdivision. Paving is complete through binder and gravel shoulder is installed. Utilities have been installed and all restoration in the right of way is complete. • Began preparation of the 2027 capital improvement and operating budgets. • Began the bi-annual road rating and certification program required by WISDOT. After a discussion of the item on the June 9, 2026, work meeting of the Zoning and Land Regulation Committee (ZLR), the committee requested additional information. The amendment returned before the committee as a substitute amendment for their consideration on August 25, 2026, at which meeting the ZLR set a public hearing on the substitute amendment for September 22, 2026. As an amendment to Chapter 10, towns have the option to review and act on the amendment. While town action is not required, if it is taken, it must be submitted within 30 days of the County public hearing to be counted. Any town action on OA-006 is due by October 22, 2026. Summary The proposed amendment seeks the following changes: • Establish that private burial sites and burials are not a cemetery use. • Indicate that private burials are permitted by right on all lots 5 acres or larger • Establish that a private burial site requires a plat of survey be recorded and filed with Dane County Planning and Development. II. Description In the past year, Dane County Zoning staff have received an increased number of requests from property owners seeking approval to bury human remains on their property. Under the current Chapter 10 definition a cemetery is defined as “Any land, that is used, or intended to be used, for the burial of human remains”, and further provides examples of cemeteries “including, but not limited to, cemeteries, mausoleums, columbarium and burial chapels.” Under this definition, it has been interpreted that any burial of human remains is considered a cemetery. Within zoning districts, cemeteries are either listed as a permitted or conditional use. If it is not listed in a district, it is a prohibited use. Cemeteries are permitted by right in the Hamlet and Heavy Commercial districts. They are prohibited in the Natural Resource Conservation, Farmland Preservation1, Agricultural Transition-35, Agricultural Business, Industrial, and Utility districts. Prior to the comprehensive rewrite of Chapter 10 in 2018 the definition of a cemetery was, "Shall include, but not be limited to, cemeteries, mausoleums, columbarium and burial chapels. Shall be subject to section 157.06 of the Wisconsin Statutes." This previous definition aligns closer to the statutory definition of a cemetery found in Wis. Stat. Ch. 157.061, ““Cemetery” means any land, including any mausoleum on the land, that is used or intended to be used, exclusively for the burial of human remains” (emphasis added). Under state statute cemeteries shall only be organized and operated by a municipality, a religious association, a fraternal or benevolent society, an incorporated college of a religious order, a cemetery association, a corporation, or a limited liability company. Under state statute home and private property burials are not defined as cemeteries. The Wisconsin Historical Society, which requires reporting of home or private burial sites, states that local ordinances determine if a property may be used for human burial. III. Proposed Amendment The proposed OA modifies the Chapter 10 definition of Cemetery by including a clause that specifies the term does not include private burial sites. This language would allow private burial in any district but is further regulated under section 10.103 Special requirements for particular uses. Under the proposed amendment private burial sites would be permitted on lots 5 or more acres. The boundaries of burial sites would be required to be surveyed and recorded with the Register of Deeds and filed with Dane County Planning and Development. Private burial site use would be required to comply with all local, state and federal laws and regulations governing the disposition and burial of human remains. IV. Considerations If approved, this amendment would not change or limit a property owner from establishing a cemetery by right or by conditional use permit if they do not meet the criteria of a private burial site, if a property is located within a zoning district that permits such use. III. Timeline for town action Town action on the proposed ordinance amendment must be provided to the County within 30 days of the County public hearing on the amendment. While it is good practice for towns to take action on text amendments to Chapter 10, it is not required.
