Call to Order/Approval of Meeting Agenda – Geller called the meeting to order at 6:30 pm. Motion to approve the agenda by Mathies, second by Lukens. Motion carried by voice vote. 2. Public Comment • Jim Butler, 6713 Sunset Drive; opposed to the development due to current water issues with his property and potential impact to his well; five years ago his property was flooded and the well ran dry as a result • Mary Thompson, 6420 Sunset Drive; would like to see Sunset Drive widened to accommodate pedestrian and bicycle use; additional traffic would be challenging • Larry Jones, 1864 Deerhaven Trail; nominated by HOA to speak on their behalf; supportive of the development and appreciate of the opportunity DH residents were given to build their homes; good sense of community has been created 3. Approval of Minutes from May 21 st, 2026 Motion by Lukens, second by Mathies with change as suggested. Motion carried by voice vote. 4. Discussion and Possible Action: Land Use Application 2026-06 submitted by Rick North for a CSM located at 6359 Pheasant Lane Motion by Geller to approve the CSM, second by Lukens. Motion carried by voice vote. 5. Discussion and Possible Action: Land Use Application 2025-01 Concept Plan for a Conservation Subdivision to be located on Sunset Drive (parcels 062/0608-362-8000-9, 062/0608-362-8500-4, 062/0608-362-8570-0, 062/0608-351-8000-2, 062/0608-362-9070-3, 062/0608-351-9500-5) • Applicant Comment • Matt Shreiner, Vierbicher; the applicant has looked closely at how lots could be laid out via the Land Division Ordinance; lots are clustered to intentionally maximize open space and existing drainage patterns; wetland delineation is underway; topography informed the design; 35% open space with an additional easement across several lots to increase the size of the prairie; access to the site was analyzed with consideration of headlights impact on neighboring properties • Commissioner Comments • Geller: likes the layout and Ice Age Trail easement and access; stormwater management of this property will make a positive impact on historic drainage patterns which is a high priority for the Town; phasing plan to be determined • Saalsaa – Miller: supports the layout; can lots 9-11 be better aligned to the roadway; open space between lots 12-19 needs to come further west to buffer the outlot for screening purposes • Mathies: road grades will need determination; the culvert on Sunset is weight limited and may have an effect on construction if approved; would like to consider a stub to Red Stone Lane; remove the points from lots 44 and 45 because they will be unused land; would like to see the results of the TIA as traffic is a concern • Lukens: TIA will inform the types of roads appropriate, and any changes required to Sunset Avenue; mailbox locations – plan for multiple clusters No action 6. Comprehensive Plan Guidance: The Future Land Use Map category for this parcel is Rural Residential 2-4 acres. The parcel is currently zoned RR-16 and a rezone to RR-8 is consistent with the plan. Current and Proposed Zoning: The current zoning of the parcel is RM-16. The proposed zoning would be RM-8 for both proposed lots. Extra-territorial Review: The applicant submitted an application for a CSM to the City of Verona which was approved with the addition of more Right of Way. Due to the modification of the CSM originally approved by the Town of Verona, the Town must approve the change to the ROW dedication. Surrounding Land Use and Zoning: The parcel is located adjacent to the City of Verona to the north. Specifically, land to the north is a City of Verona Veridian Development currently under construction. The large parcel to the west is an AT-35 parcel. To the east is an RM-16 parcel and to the south are two RR-4 parcels. Site Features: The southern portion of the existing parcel is heavily wooded and the majority of the woods would be located on proposed Lot 2 with no anticipated change. Driveway Access: The current driveway that serves the existing residence will be remain unchanged for access to Lot 2. Lot 1 will be granted access by changing an existing field access to a residential driveway. The applicant resubmitted the application to the City of Verona after the Boundary Agreement between the Town of Verona and the City expired at the end of June 2026. The City of Verona Common Council approved the CSM with additional ROW on August 10th 2026. The Town Board needs to approve the updated CSM. Additionally, the initial rezone request from RM-16 to RR-8 was made in error. The applicant is seeking to retain the zoning classification of RM but for the appropriate acreage size – RM 8. This email is intended to further address the rationale for presenting the option of a private cul de sac to the Town on the west side of the project. Initial feedback during the Plan Commission review of the Concept Plan back in May was positive, with an understanding that we should keep moving forward with the layout as presented, which included a new cul de sac on the west side along with keeping Flint Lane as a Town Road. The Plan Commission visits to the site did not include any conversations about abandoning Flint Road. Lastly, our meetings with Town Engineer Chris Barnes centered around how to build a new cul de sac, while leaving Flint Lane mostly unchanged so that it could continue to serve one Town residence. Based on that input, we were very disappointed to hear the recommendation from Public Works that the cul de sac layout would not be acceptable, but instead this road should be extended to the SW corner, and Flint Lane be abandoned. Extending the road to the SW corner would likely result in this being a through road someday, since it would be approximately 1700’ long, way beyond the County guideline of 1000’ dead end. It would lead to Bruce Allison extending it through his property someday, or to the Rodrigues parcel possibly being further subdivided. Having a through road drastically changes the dynamics of the 7 lots that would have otherwise been on a cul de sac. Not only does it diminish the value of each of the 7 lots, there is considerable additional road cost to extend it to the SW corner. The ROW needed for the road extension would take up valuable land, and run through what would have been 2 of the premium lots on the cul de sac. Taking all of that into consideration, we thought it would be in the best interest of all parties to create a private road. The new homeowners would be able to live on a cul de sac, and the Town would not have additional road to maintain in this area. Flint Lane could remain as is to serve the Rodrigues, who have been using it in its current condition for the entire time they have lived there. Bruce Allison would not need to extend it someday to create a loop road. His land can be fully developed at some future date without that loop, thereby saving him the cost of at least 1500’ of additional Town Road, and the Town saves by not having to maintain that additional length of road. I hope that is helpful for the Town to understand where the Developer is coming from on this latest revision. We look forward to discussing this with the Plan Commission and Town Board to see if we can come to an agreement on how to move forward. Based on the Neighborhood meeting, site visits by the Town Plan Commission, and additional discussion since that time, we are re-submitting the Concept Plan. All of the other documents that were submitted back then and reviewed at the May 21 Plan Commission meeting remain essentially the same (including the additional map that was sent on 5/14 which shows how Bruce Allison’s land could be developed at some point in the future with a loop back through Kurt’s project). The updated Concept Plan that is attached is very similar to what was reviewed previously, in regards to road and lot geometry. What makes this plan different from the old is the proposal of making the western cul de sac, Oak Ridge Court, a private road that will be owned and maintained by the homeowners living on that road. All seven of these lots would take access to the cul de sac, and no access would be allowed to Flint Lane nor Riverside Road. Flint Road would remain as a Town Road serving Rodrigues and Allison, and the new private road would connect to it as shown. There are some logistical details that would need to be worked out with a private road. This western section of the project would be developed as a Condo Plat, similar to Deer Haven or Fox Hill. The zoning would be MFR-08, same as those other condo plats, in order to allow multiple buildings on one “parcel”. However, in the overall scheme of things, this project would still be at the density allowed by the Comp Plan, and the Conservation Subdivision requirements would still be met, with well over 30% green space provided. The Town Comprehensive Plan has included this area in the category of Rural Residential 4 -8 acres. That would allow 19 single family homes to be built within the project. Lots will range from 1.6 acres to 3.5 acres. Open space will exceed the 30% requirement. All Dane County stormwater requirements will be met, including peak runoff, sediment reduction, and infiltration. This parcel is predominately being farmed, with a small woodlot in the NW corner and some scattered trees and N/S tree line in the middle of the parcel. There are no buildings on the property, and no significant natural, archeological, or historical featu res. The topography is characterized by rolling hills and valleys between, with defined drainageways. Due to the topography, the Concept Plan has a block of 7 homes on the west side with access from Flint Road, and another 12 home sites on the middle and east with access from Sugar River Road. Sight distance is good at both intersections. Existing Sugar River Road extends beyond this parcel and onto the property to the south, and exceeds the maximum length allowed under County ordinances. However, based on discussions with the owner to the south, Sugar River Road will someday be looped back into this project, thereby meeting the County ordinances. Based on the average of 10 trips per day per household from the ITE manual, this project would generate app roximately 190 trips per day. The existing road network can easily handle that increase. Surrounding land uses are mainly ag, with some residential properties scattered about. To the south and east there are public lands, including the Madison School Forest and Dane County Parks. The Concept Plan includes a wide open space along Riverside Ro ad with grass hiking trails, along with a large stormwater pond that will be provide both natural features for wildlife as well as recreational opportunities for the residents. Trees will be planted along Riverside Road to provide a natural buffer, maintain the rural character, and help reduce the visual impact. All open space, trails, and the pond will be owned and maintained by the HOA. The homes will be on well and septic. Town services will be required for plowing and maintaining the new roads. The DNR has inspected the property and determined that there is no navigable stream. They support the inclusion of the stormwater pond and believe it will enhance the natural features of the property. An endangered resources review is also underway by th e DNR, and that information will be presented to the Town when completed. The existing Flint Road does not meet Town standards for maximum grade, and it is impractical to rebuild it in the current location. However, the homeowners at the south end of Flint Road need it for access to their property, so it would remain in place for that purpose. The Concept Plan shows a new Town road splitting off from Flint to serve the 7 homes on the west side, with the new road meeting Town standards for grade and max length. No access to the existing Flint Road would be allowed by the new lots.
