Administrator Report
Administrator Green gave a brief update on current Village projects and departments.
Unfinished Business
A. Discussion & necessary action re: Conceptual Park Plan Options
Administrator Green indication there were no updates needing action at this time.
New Business
A. RESO 2026-04 authorizing issuance and sale of $4,120,000 GO Promissory Notes
President Gehrke introduced the item. Ariana Schmidt, the Village's financial advisor, presented the
sale day results for the General Obligation Promissory Notes, Series 2026A. She noted that the
results had not been available in advance of the meeting and that the sale day report had been
compiled specifically for the Board's review that evening.
Ms. Schmidt described the outcome as very strong. The true interest cost came in at 2.86%, which
she noted was approximately one full percentage point lower than the presale estimate. Six
competitive bids were received, which she characterized as an excellent level of participation, with
the highest bid just over 3.1% — representing a spread of approximately 20 basis points between
the best and worst bids. Ms. Schmidt observed that this range illustrated the clear benefit of
pursuing a competitive bid process rather than a negotiated sale with a single dealer. The winning
bidder was TD Financial Products.
Ms. Schmidt further explained that because the winning bid was structured as a premium bid —
whereby the underwriter pays the issuer more than the face amount of the notes at a slightly lower
interest rate, analogous, she noted, to receiving cash back at a car dealership — the Village was
able to reduce the principal amount of debt issued by approximately $45,000. As a result, the final
principal amount was reduced from the presale figure of $4,120,000 to $4,075,000. She reported
that, in total, principal a nd interest payments over the five -year term of the notes would be
approximately $100,000 less than the presale estimate.
Ms. Schmidt also informed the Board that the Village's bond rating with Moody's had been affirmed
at Aa2, which she credited as a contributing factor to the favorable interest rates achieved. She
noted that the full bid tabulation and updated financing tab les reflecting the actual sale results
were attached for the Board's reference. Closing was scheduled for June 30th, at which time the
Village would receive the proceeds.
Ms. Schmidt advised that, in addition to approving the resolution, both Administrator Green and
President Gehrke would need to sign a bid form to formalize the Village's acceptance of the
winning bid, which she would take with her that evening to transmit to the underwriter.
Administrator Green noted for the Board that the resolution included in the meeting packet
referenced the original presale amount of $4,120,000, and that a corrected resolution reflecting the

updated principal amount of $4,075,000 had been prepared but had not yet been printed due to
a power outage at Village Hall. He confirmed that the corrected resolution bore the same resolution
number and needed only to be signed by the appropriate parties.
Motion by Moonen, second by Quinn, to approve and adopt Resolution 2026 -04 authorizing the
issuance and sale of $4,075,000 General O bligation Promissory Notes, Series 2026A . Motion
carried unanimously.
B. Authorize DPW purchase of Grapple Rake
Motion by Moonen, second by Baum, to approve DPW purchase of a Grapple Rake for the loader,
for an amount not to exceed $26,000.00. Motion carried unanimously.
C. Authorize DPW purchase of Dump Body for 2005 Sterling truck
Motion by Moonen, second by Baum, to approve DPW purchase of a Dump Body for the 2005
Sterling patrol truck, for an amount not to exceed $23,920.00. Motion carried unanimously.
D. Ordinance 2026-07 prohibiting parking on Oakwood Road
Administrator Green recommended that the Board remand Ordinance 2026-07 back to the Public
Works & Utility Committee rather than acting on it at this meeting. He explained that, upon further
review, a blanket prohibition on parking along both sides of Oakw ood Road would also restrict
residents who live along that road from parking in front of their own homes — a consequence he
believed had not been fully communicated to or considered by those residents, some of whom
had originally requested the restriction.
Administrator Green noted that the original impetus for the request had come from concerns
about increased parking along Oakwood Road in connection with baseball games at the nearby
park, with attendees choosing to park there rather than in the designated parking area off Park
Parkway. He cautioned that without broader outreach to all residents on the road, the Village risked
imposing unintended consequences, such as residents being unable to accommodate parking
for private gatherings.
Trustee Moonen elaborated, confirming that two residents had contacted him with the original
concern, and that the focus of those conversations had been specifically on event -related
overflow parking rather than any broader restriction. He noted that conditional parking restrictions
— such as limiting the prohibition to specific hours or event days — had been considered but
ultimately were not recommended, as such conditions complicate enforcement and place a
significant evidentiary burden on the Village if citations are challenged.
The discussion turned to alternative approaches. Administrator Green suggested that a more
targeted restriction — limited to one side of the road, or to the stretch of Oakwood Road
immediately adjacent to the athletic fields — could accomplish the goal of discouraging event
parking without affecting residents living farther from the park. Trustee Baum raised a concern that
Village Board Minutes

pushing parking off Oakwood Road entirely might simply redirect vehicles to Oakwood Court,
which is adjacent to the area and where the impact on residents could be even greater given the
cul-de-sac character of that street.
Trustee Quinn supported referring the matter back for further research and expressed interest in
whether conditional restrictions could be structured appropriately. She added that she believed
some of the original residents who made the request may not hav e fully considered that the
restriction would apply to them as well.
President Gehrke noted the broader context: that the situation would change materially within
approximately two seasons once a new, larger parking lot adjacent to the athletic fields was
completed. He suggested that understanding how the parking situation evolves over the coming
season before imposing any permanent restriction would be prudent, and indicated that outreach
to residents along the road — noting that most are known personally to Board and staff — would
be straightforward before the matter returns.
Motion by Moonen, second by Baum, to remand the ordinance back to the Public Works & Utility
Committee for reconsideration, with the expectation that a revised recommendation would be
brought back to the full Board no earlier than August, after a full season of observation and
following appropriate resident notification. Motion carried unanimously.

There being no further business, motion by Quinn, second by Moonen, to adjourn the meeting at

the initial construction and warranty period, that the original surface and storm water
drainage plan as designed and/or constructed does not provide reasonable storm
water drainage within the development and/or creates additional storm water runoff
impacts to the surrounding areas. If DEVELOPER fail s to construct the additional
improvement within a reasonable period of time, the VILLAGE may cause such work
to be carried out and shall charge the cost of the same against the financial guarantee
held by the VILLAGE pursuant to this Agreement. If the amount of the financial
guarantee is not sufficient to pay the costs incurred by the VILLAGE, the VILLAGE shall
invoice the DEVELOPER for any deficiency, and upon the DEVELOPER’S failure to

or delayed.
3. The DEVELOPER shall cause all grading, excavation, open cuts, side slopes and other
land surface disturbances on or adjacent to the Property to be so seeded and mulched,
sodded or otherwise protected that erosion, siltation, sedimentation and washing are
prevented in accordance with the plans and specifications reviewed and approved by
the VILLAGE Engineer, Wisconsin Department of Natural Resources and Army Corps
of Engineers, if applicable. If needed, the DEVELOPER is responsible for obtaining all
necessary consents from neighboring property owners required to comply with this
Section II(C )(3); In the event the DEVELOPER is unable to obtain such consents
despite its commercially reasonable good faith efforts, the VILLAGE and the
DEVELOPER agree to cooperate in good faith to perform any required erosion control
measures in a manner reasonably acceptable to the VILLAGE.
4. All disturbed areas of the Property and adjacent to the Property shall be restored in
accordance with the approved plans and to the reasonable satisfaction of the VILLAGE
Engineer. Any cash or letter of credit posted with the VILLAGE will not be released

listed in Section 20.243 of the Land Division and Development Ordinance.
G. OTHER UTILITIES: The DEVELOPER shall cause gas, electrical power, telephone, and cable
television facilities to be installed in such a manner as to make adequate service available
to each lot. All new electrical distribution lines, television cables, and telephone lines from
which lots are individually served shall be underground unless the VILLAGE Board, in its
sole discretion, specifically allows overhead poles for the following reasons:
1. Topography, soil, water table, solid rock, boulders, or other physical conditions
which would make underground installation unreasonable or impractical; or
2. The lots to be served by said facilities can be served directly from existing
overhead facilities.
H. ADDITIONAL IMPROVEMENTS: The DEVELOPER hereby agrees that i f, at any time after
plan approval and during construction, the Engineer determines that modifications to the
plans including additional improvements such as additional drainage ways, erosion control

provided for in this Agreement.
B. The DEVELOPER shall, at the DEVELOPER’S expense, retain the services of a consulting
engineer and such other professionals as necessary to provide construction administration
and staking. The VILLAGE will provide periodic construction observation and material
testing as necessary during the construction of the Improvements. The DEVELOPER shall
reimburse the VILLAGE for the actual costs of these services as set forth in Section XIV.
Said construction review shall not relieve the contractor of any obligation to construct the
Improvements in conformity with the plans and specifications, nor shall it in any manner
make the VILLAGE or VILLAGE Engineer, an insurer of, nor relieve the contractor of, any
obligations or guarantees concerning the contractor’s performance.
C. In addition to other site visits conducted by the VILLAGE to observe construction, the
VILLAGE shall, in the company of a representative of the DEVELOPER’S construction

shall conduct testing, including density testing, for binder and surface lifts according to the
VILLAGE’S Public Infrastructure Inspection and Testing Policy. If results from pavement
testing yield densities below specified minimums, the DEVELOPER shall be charged an
amount as determined by the Fee Schedule in effect on the date of testing. The amount
due shall be paid to the VILLAGE within 15 days of receipt of notice from the VILLAGE. If

ultimate acceptance of all the improvements in the completed development as a whole, and
shall be granted specifically be separate resolution of the VILLAGE Board. It is understood
that building permits may be issued by the VILLAGE prior to the time of Final Acceptance
of all of the improvements in the development. The one-year guarantee period provided
for in the Agreement shall not commence to run until Final Acceptance is granted by the
VILLAGE Board of all im provements. The issuance of building permits and approval of
various items of development shall not commence the one -year guarantee period.
Acceptance of the improvements by the VILLAGE does not constitute a waiver of its right to
draw on funds under the required letter of credit in the event of defects or failure of any
improvement which is discovered or occurs following such acceptance and prior to the
expiration of the guarantee period.
B. The Final Plat may be approved with conditions , in accordance with State Statutes, local
and county ordinances, and all other applicable laws. If so, the DEVELOPER agrees to
satisfy those conditions of approval prior to the VILLAGE signing the Final Plat.
IV. DEDICATION OF IMPROVEMENTS
Subject to all of the other provisions of this Agreement, the DEVELOPER shall, without charge to the
VILLAGE, upon completion of the above -described improvements, unconditionally give, grant, convey
and fully dedicate the public improvements to the VILLAGE, its successors and assigns, forever, free and

enumeration, any and all land, buildings, structures, mains, conduits, pipes, lines, plant machinery,
equipment, appurtenances and hereditaments which may in any way be a part of or pertain to such
improvements and together with any and all necessary easements for access thereto. After such
dedication, the VILLAGE shall have the right to connect or integrate other improvements as the VILLAGE
decides, with no payment or award to, or consent required of, the DEVELOPER.
Dedication shall not constitute acceptance of any improvement by the VILLAGE Board. All improvements
will be accepted by the VILLAGE Board by separate resolution at such time as such improvements are in
acceptable form and according to the VILLAGE specifications. Said resolution shall be recorded, if
needed, with the Waukesha County Register of Deeds. DEVELOPER will furnish proof to the VILLAGE ,

VI. GUARANTEES OF IMPROVEMENTS
GUARANTEE: The DEVELOPER shall guarantee, after Final Acceptance, the public improvements
and all other improvements described in Section I hereof against defects due to faulty
materials or workmanship, provided that such defects appear within a period of one year
from the date of Final Acceptance (such one year period is referred to herein as the
“guarantee period”), The DEVELOPER shall pay for any damages to VILLAGE property
and/or improvements resulting from such faulty materials or workmanship. This guarantee
shall not be a bar to any action the VILLAGE might have for negligent workmanship or
materials. Wisconsin law on negligence shall govern such situations. If, during the
guarantee period, the DEVELOPER fails to pay for any damages or defects to VILLAGE
property and/or improvements, and the VILLAGE is required to draw against the Letter of
Credit on file with the VILLAGE, the DEVELOPER is required to replenish said monies up to
the aggregate amount of ten percent (10%) of the total cost of all improvements. If any
Improvements are uncompleted, in addition to the guarantee of 10%, the VILLAGE may
require the Developer to provide the VILLAGE additional security for the total cost of any
uncompleted Improvements, as set forth in Wis. Stat. § 236.13(2)(am).
A. OBLIGATION TO REPAIR: The DEVELOPER shall make or cause to be made, at its own
expense, any and all repairs which may become necessary under and by virtue of the
DEVELOPER’S guarantee and shall leave the improvements in good and sound condition,
satisfactory to the VILLAGE Board at the expiration of the guarantee period. DEVELOPER
shall be responsible for the costs of repairs to existing roadways and infrastructure for
damage caused in areas immediately adjacent to the construction limits as a result of the
construction activities called for hereunder.
B. NOTICE OF REPAIR: If during said guarantee period the improvements shall, in the
reasonable opinion of the VILLAGE Staff, require any repair or replacement which, in their
judgment, is necessitated by reason of settlement of foundation, structure of backfill, or
other defective materials or workmanship, the DEVELOPER shall, upon notification by the
VILLAGE of the necessity for such repair or replacement, make such repair or replacement,
at its own cost and expense. Should the DEVELOPER fail to make such repair or replacement
within the time specified by the VILLAGE in the aforementioned notification, after notice has
been sent as provided herein, the VILLAGE Board may cause such work to be done, but has
no obligation to do so, either by contract or otherwise, and the VILLAGE Board may draw
upon the Letter of Credit to pay any costs or expenses incurred in connection with such
repairs or replacements. Should the costs or expenses incurred by the VILLAGE Board in
repairing or replacing any portion of the improvements covered by this guarantee exceed
the amount of the Letter of Credit, then the DEVELOPER shall immediately pay any excess
cost or expense incurred in the correction process. Any such cost or expense not paid by
DEVELOPER within thirty (30) days of being invoiced may be imposed against the
development land as a special charge pursuant to §66.0627, Wis. Stats. or assessed. Any
such charges or assessments may be imposed on the SUBJECT LANDS or any portion thereof

improvements shall expire at the expiration of the guarantee period.
2. Street sweeping and dust suppression shall be done by the DEVELOPER upon a regular
basis as needed to ensure a reasonably clean and safe roadway until Final Acceptance
by the VILLAGE Board. If after reasonable notice to the DEVELOPER, the DEVELOPER
fails to meet this requirement, the VILLAGE Board will cause the work to be done and

that the DEVELOPER has restored all areas which were disturbed because of this
development.
D. DEFINITION: For purposes of this Agreement and by way of definition, the parties agree to
comply with the general standards acceptable in the particular industry or common practice.

Unless otherwise approved by the VILLAGE Administrator, the VILLAGE shall NOT be responsible to
perform repair maintenance or snowplowing on any improvements until Final Acceptance by the VILLAGE
Board.
VIII. RISK OF PROCEEDING WITH IMPROVEMENTS PRIOR TO APPROVALS OF FINAL PLAT
If DEVELOPER proceeds with the installation of public improvements or other work on the site prior to
approval of the final plat, it proceeds at its own risk as to whether or not the final plat will receive all
necessary approvals. The DEVELOPER, prior to commencement of the installation of public
improvements or other work on site, shall notify the VILLAGE of the DEVELOPER’S intention to proceed
with the installation of public improvements or other work on site, prior to approval of the final plat.
Additionally, DEVELOPER shall make arrangements to have any public improvements and/or other work

approved by the VILLAGE Engineer as a guarantee that the DEVELOPER will perform all terms of this
Agreement no later than one year from the signing of this Agreement , except as otherwise set forth in
this Agreement. If at any time any of the following events occur, the DEVELOPER shall be deemed to

Credit is sufficient to secure payment for any remaining improvements and also provided that no
reduction shall occur until it is approved in writing by the VILLAGE Engineer and VILLAGE Board.
XI. RESERVATION OF RIGHTS AS TO ISSUANCE OF BUILDING PERMITS
This Agreement is necessary to ensure public safety. No permit to commence construction of a foundation
or any other noncombustible structure shall be granted before substantial completion of all public
improvements, unless the VILLAGE Administrator determines that all public improvements related to
public safety are complete. Any violation by the DEVELOPER of the terms of this agreement concerning
completion of public improvements, or timing of completion, or lack of completion regardless of violation,
exposes the VILLAGE to safety risks associated with construction sites, and therefore is related to public

the VILLAGE will do so at the DEVELOPER’S expense. The VILLAGE will do its best to enforce
existing ordinances that require builders to clean up their mud from construction.
O. ZONING CODE: The DEVELOPER acknowledges that the lands to be developed are subject
to the VILLAGE of Lisbon Zoning Code.
P. DIGGERS HOTLINE: The DEVELOPER shall become a member of Diggers Hotline and
provide evidence of such membership to the VILLAGE Clerk before commencing any land

lands that are part of a recorded final plat within the SUBJECT LANDS to be used for any
agricultural uses as defined in Tax 18 of the Wisconsin Administrative Code. In the event
the DEVELOPER uses the land in a manner that causes the SUBJECT LANDS or any portion
thereof that is part of a recorded final plat to be assessed in a manner that reduces the
property tax liability below what would apply to residential property in the VILLAGE, the
DEVELOPER shall make an additional payment in lieu of taxes (PILOT) so that the total tax
payment plus PILOT equals the amount that would be paid if the SUBJECT LANDS were
classified for assessment as residential.
XV. PAYMENT OF COSTS, INSPECTION & ADMINISTRATIVE FEES
The DEVELOPER shall pay and reimburse the VILLAGE within thirty (30) days of VILLAGE billing for all
fees, expenses, costs and disbursements which shall be incurred by the VILLAGE in connection with this
subdivision or relative to the construction, installation, dedication and acceptance of the subdivision
improvements covered by this Agreement, including without limitation by reason of enumeration, design,
engineering, review, supervision, inspection and legal, administrative and fiscal work. VILLAGE employee
costs shall be based on regular VILLAGE pay rates (or Administrative overtime, if applicable) plus 40%
of the hourly rate for overhead and fringe benefits for any time actually spent on the project. Any costs
for outside consultants shall be charged at the rate the consultant charges the VILLAGE. Any such charge
not paid by DEVELOPER within forty-five (45) days of being invoiced may be charged against the financial
guarantee held by the VILLAGE pursuant to this Agreement or assessed against the subdivision land as
a special charge pursuant to §66.027, Wis. Stats.
XVI. GENERAL INDEMNITY
In addition to, and not to the exclusion or prejudice of, any provisions of this Agreement or documents
incorporated herein by reference, the DEVELOPER shall indemnify and save harmless and agrees to
accept tender of defense and to defend and pay any legal, accounting, consulting, engineering and other
expenses relating to the defense of any claim asserted or imposed upon the VILLAGE, its officers, agents,
employees and independent contractors growing out of this Agreement , unless claim is caused by
negligence of the VILLAGE, its officers, agents, employees or independent contractors, by any party or
parties. The DEVELOPER shall also name as additional insured on its general liability insurance the
VILLAGE, its officers, agents, employees and any independent contractors hired by the VILLAGE to
perform services as to this development and give the VILLAGE evidence of the same upon request by
the VILLAGE.

XVIII. EXCULPATION OF VILLAGE CORPORATE AUTHORITIES
The parties mutually agree that the VILLAGE President of the VILLAGE Board and/or the VILLAGE Clerk
entered into and are signatory to this Agreement solely in their official capacity and not individually and
shall have no personal liability or responsibility hereunder and personal liability as may otherwise exist
being expressly released and/or waived.
XIX. GENERAL CONDITIONS AND REGULATIONS
All provisions of the VILLAGE Ordinances are incorporated herein by reference, and all such provisions
shall bind the parties hereto and be a part of this Agreement as fully as if set forth at length herein. This
Agreement and all work and improvements required hereunder shall be per formed and carried out in
strict accordance with and subject to the provisions of said Ordinances.

The VILLAGE does not guarantee or warrant that the SUBJECT LANDS will not at some later date be
rezoned, nor does the VILLAGE herewith agree to rezone the lands into a different zoning district. It is
further understood that any rezoning that may take place shall not void this Agreement.
XXI. COMPLIANCE WITH CODES AND STATUTES
The DEVELOPER shall comply with all current applicable codes of the VILLAGE, County, State, and federal
government, and further, DEVELOPER shall follow all current and future lawful orders of any and all duly
authorized employees and/or representatives of the VILLAGE, County, State, or federal government.
XXII. PRELIMINARY PLAT AND FINAL PLAT CONDITIONS
The DEVELOPER acknowledges that the SUBJECT LANDS are subject to a conditional preliminary plat
approval and a conditional final plat approval by the VILLAGE of Lisbon. The DEVELOPER further agrees
that they are bound by these conditions. The conditional preliminary plat approval and the conditional
final plat approval for the SUBJECT LANDS shall be filed with the Register of Deeds and a copy kept on
file in the office of the VILLAGE Clerk . If there is a conflict between the conditions as set forth in said
conditional approvals and the DEVELOPER'S Agreement, the more restrictive shall apply.
XXIII. AGREEMENT FOR BENEFIT OF PURCHASERS
The DEVELOPER agrees that in addition to the VILLAGE’S rights herein, the provisions of this Agreement
shall be for the benefit of the purchaser of any lot or any interest in any lot or parcel of land in the
SUBJECT LANDS.

applies to any phase of the development of the subdivision.
XXVI. HEIRS & ASSIGNS
This Agreement is binding upon the DEVELOPER, lot owners, their heirs, their assigns, and successors,
and all future owners of the SUBJECT LANDS (collectively, the ‘successors”). This Section allows for
VILLAGE enforcement of the terms and conditions of this Agreement against all such successors, as
though such successors were the DEVELOPER. This Section does not, however, grant rights to such
successors absent VILLAGE written consent, as described in Section XXV.
XXVII. SALES OF LOTS
No lots in the SUBJECT LANDS may be sold until the final plat of the SUBJECT LANDS has been recorded
in the Waukesha County Register of Deeds.
XXVIII. MORTGAGEE CONSENT
The undersigned mortgagee of the property consents to this Developer’s Agreement and agrees that its
lien of mortgage shall be subordinate to the rights of the VILLAGE granted by this Developer’s Agreement.
XXIX. RECORDING

XXX. STORMWATER MAINTENANCE AGREEMENT

maintenance of all stormwater facilities within the SUBJECT LANDS, and such Stormwater Maintenance
Agreement shall be recorded against the SUBJECT LANDS with the Register of Deeds. No sales of lots
shall occur prior to the recording of said document.
XXXI. REVIEW PROCESS
If the VILLAGE Engineer and DEVELOPER cannot agree with the decision of the VILLAGE Engineer, then
DEVELOPER shall have the right to have the matter reviewed by the VILLAGE Attorney or VILLAGE Board
and to present such evidence as may be warranted. The VILLAGE Attorney or VILLAGE Board may
modify, correct, or affirm the VILLAGE Engineer’s decision.

has been consented to by the VILLAGE Board, it must be reduced to a written amendment which shall
be approved and executed by both the VILLAGE and DEVELOPER and filed with the Register of Deeds.
No such changes shall take effect until such amending document has been recorded.
IN WITNESS WHEREOF, the DEVELOPER and the VILLAGE have caused this Agreement to be signed by

REQUEST FOR CONSIDERATION
Committee/Board Village Board
Topic: 2026-2027 Fee Schedule Update
From: Daniel Green
Department: Administration
Presenter: Daniel Green
Date of Committee Action
Date of Village Board Action: July 8, 2026
INFORMATION
B
ackground / Rationale:
At its March meeting, the Village Board approved an ordinance creating a Weights and
Measures license. The accompanying fee schedule sets the cost for each device subject to
inspection. Staff recommends a fee of $25.00 per device, aligned with the standard licensing
period of July 1 – June 30.
T
his fee is intended to offset the annual charges from the Department of Agriculture for testing
these devices, as well as the administrative time required to manage the licensing process.
W
eights and Measures licenses apply to any business that uses a scale or measuring device
to sell goods. Examples include gas pumps, grocery store counter scales, and large industrial
scales used in quarry operations.
S
taff is also recommending a fee for checks that need to be returned to residents due to errors
that prohibit the bank from cashing. These errors, when caught require staff to mail back to the
resident, and which takes time. In order to prevent these types of errors, we will have a note on
Utility bills that state any errors will result in a $10 fee and returned check. By us doing this, it
saves the resident from a $40 NSF fee if the check were to be deposited, but it takes time from
staff to review each check for errors.
R
equested Action:
Village staff recommends adoption of Resolution 2026 -04, updating the 2026 –2027 Fee
Schedule to include the Weights and Measures license fee and a check error fee.

RESOLUTION 2026-08
A RESOLUTION PETITIONING THE WISCONSIN PUBLIC SERVICE COMMISSION TO
REQUIRE UNDERGROUND PLACEMENT OF ELECTRICAL DISTRIBUTION LINES IN AREAS
OF FREQUENT SERVICE INTERRUPTIONS WITHIN THE VILLAGE OF LISBON
WHEREAS, the Village of Lisbon has experienced numerous recurring power outages over many
years, many of which have been caused by storm damage, fallen trees, and other impacts to
overhanging electrical distribution lines maintained by We Energies; and
WHEREAS, these outages have resulted in significant disruptions to residents, businesses, public
facilities, and essential services, creating ongoing concerns regarding public safety, reliability of
service, and economic impact; and
WHEREAS, the Village has identified a particularly high-impact outage corridor along Good
Hope Road extending north to County Highway Q, from Townline Road, to Lake Five Road, where
overhead lines have repeatedly failed during severe weather events; and
WHEREAS, underground electrical distribution systems have been demonstrated to provide
substantially improved reliability, reduced exposure to weather-related hazards, and long-term
operational benefits in areas with chronic outage patterns; and
WHEREAS, the Wisconsin Public Service Commission has the authority to review, approve, and
require utility infrastructure improvements when necessary to ensure safe, reliable, and
reasonably adequate service to Wisconsin residents; and
WHEREAS, the Village of Lisbon believes that targeted undergrounding of distribution lines in the
above-described corridor is in the public interest, will reduce long-term outage frequency, and
will enhance the resilience of the local electrical grid.
NOW, THEREFORE, BE IT RESOLVED that the Village of Lisbon hereby formally petitions the
Wisconsin Public Service Commission to require We Energies to evaluate, design, and
implement the underground placement of electrical distribution lines along Good Hope Road
north to County Highway Q, from Townline Road to Lake Five Road, and in any additional areas
within the Village where outage frequency demonstrates a clear need for infrastructure
hardening; and
BE IT FURTHER RESOLVED that the Village requests the PSC to open a docket, conduct a reliability
review, and require We Energies to submit engineering, cost, and implementation plans for
undergrounding in the identified corridor; and

MEMORANDUM
Committee/Board Village Board
Topic: Richmond Road Culvert Replacement
From: Daniel Green
Department: Administration
Presenter: Daniel Green
Date of Village Board Action: N/A
INFORMATION
During the April flooding event, several culverts were washed out, including those on Mary Hill
Road, Lake Road, and Richmond Road. The Richmond Road culvert, located approximately 850
feet east of Hill Road , failed during the heavy rains. This culvert receives significant water flow
from subdivisions to the north and east.
Water from the October Fields subdivision flows under Mary Hill Road, through the Fallon
property, and along the Richmond Road ditch line before reaching this culvert. At the point
where the stream meets the culvert, the water must make a sharp turn to ent er the structure
and pass beneath Richmond Road. This turning point needs improvement to allow water to
enter the culvert more efficiently and reduce the risk of future washouts.
Kunkel has provided a preliminary cost estimate to replace the existing culvert with a box
culvert and to install guardrails along the section where there is a substantial drop- off. Staff
recommends that this project be funded through the Storm Water Fund and would like to see
the work completed this year.
Requested Action
Village Staff recommends the Village Board approve moving forward with design and
planning, and to prepare contract documents for bidding the Richmond Road culvert
replacement project.

REQUEST FOR CONSIDERATION
Committee/Board Village Board
Topic: Building Inspector Replacement
From: Daniel Green
Department: Administration
Presenter: Daniel Green
Date of Committee Action
Date of Village Board Action: July 8, 2026
Background / Rationale
Bryan Oelhafen has informed the Village that he will retire at the end of this year when his contract expires.
The Board will therefore need to appoint a new building inspector. We are currently reviewing two candidates
and require additional time to complete a thorough evaluation to determine the best fit for the Village of
Lisbon.
The board should consider inviting qualified candidates to submit a proposal to the Village Administrator by
August 15. After proposals are received, the Village Board can bring the two candidates forward and conduct
interviews with each of them in open session. Once the interviews are complete, the Board may move into
closed session to discuss the candidates and make a final selection.
Selection of a new inspector may require a code amendment, since the current ordinance requires the
building inspector to serve on the Plan Commission and to be a Village resident. If the chosen candidate is
not a Village resident, the residency requirement would need to be removed.
The Village should also consider contracting a separate firm for code compliance, as many inspectors do not
provide that service. Bryan performed code enforcement at a low hourly rate that is unlikely to be sustainable
for a new inspector. This should be t aken into account during negotiations, including any percentage -split
arrangements.
Requested Action
Authorize the Village Administrator to request final proposals from qualified candidates and set a deadline
no later than August 15
th.
REQUEST FOR CONSIDERATION
Committee/Board Village Board
Topic: Extension of Premises Code Amendment
From: Daniel Green
Department: Administration
Presenter: Daniel Green
Date of Committee Action
Date of Village Board Action: July 8, 2026
Background / Rationale
The Village’s code includes a section that restricts liquor license premise extensions, specifically regulating
where alcohol may be served outside the main licensed area. An extension of premises is defined as an open,
unroofed area connected to a license d establishment where alcohol may be served and consumed. Under
this section, any such extension must be enclosed by a 6-foot fence around its perimeter.
Since the adoption of this section, the Village has required all alcohol- licensed establishments to obtain a
Conditional Use Permit (CUP). The CUP ordinance already provides authority to regulate premise extensions,
making the fencing requirement in this code section unnecessary.
The Village Attorney has also advised that the original intent of this code section was to address special
events, not ongoing uses such as outdoor patios or golf courses. Based on this interpretation, the Attorney
recommends removing the outdated code sec tion and relying on the Plan Commission’s authority through
the CUP process to impose any needed restrictions on liquor license premises.
Proposed code section to remove:
2. If any part of the premises extension is not blocked by a building, there shall be maintained or
constructed a fence not less than six feet high with maximum spacing in openings of two inches, or
double fencing of not less than four feet high with six feet between the fencing, surrounding the premises
extension. The fencing shall contain the required fire exits. Each gate or exit shall be not less than four
feet high for double fencing and six feet high for single fencing, shall swing free to egress, sh all be
equipped with proper hardware, and shall swing free and clear of public sidewalks. The premises
extension fence shall comply with all local ordinances regarding vision clearance and distances from
corners.
Requested Action
Staff recommends approval of Ordinance 2026 -XX, an Ordinance to repeal Section 44.01(c)(5)f.2. of the
Lisbon Municipal Code related to fencing surrounding extension of premises for liquor licensing .

the requirements for a 6-foot fence to be maintained surrounding the premises where it is not
blocked by a building; and
WHEREAS, the Village Board wishes to remove the fencing requirement from Chapter 44 which
